Abstract

The creation of policy is one of the prerogatives of a free and uninhibited (freies ermessen, or free discretion) government administrations. Although freies ermessen grants free authority to the government, within the framework of national the law said the government should still observe legislation and the Principles of Good Governance. However, at the implementation level, there are still many policies that which are difficult to put into effect due to ambiguous interpretation and conflicts of interest, thus resulting in legal uncertainty. Based on this, there needs to be an affirmation of the position taken by the Indonesian government regarding the contradictory relationship between written law and implementation, so as to ensure the appropriate application of the principles of freies ermessen. Abstract

Indra Taufiq, an Indonesia citizen, a former local staff working for the United States of America Consulate General in Medan, brought an appeal to the Indonesian Supreme Court to the United States of America Consulate General in Medan and its embassy to pay Indra Taufiq’s termination of employement rights. Although the verdict of the cassation was won by Indra Taufiq, the consulate general and the embassy of the United States of America refused to carry out the court's verdict on the grounds of diplomatic immunity. This is a legal issue that should be reviewed in terms of the perspective of international law related to the legal status of diplomatic or consular representation in Indonesia and what should be done Indonesia to protect the rights of Indonesian citizens workers. Abstract

This paper examines problems as the result of the absence of statement on the establishment of Human Rights Ad hoc Court in the Human Rights Court Act Number 26 Year 2000. By highlingting the kidnapping of activists in the final days of New Order regime in 1997-1998, as Article 43 of Human Rights Court Act, the power to adjudicate is attached to the Human Rights Court. However, the absence of explicit provisions to the establishment of teh Ad hoc Court of Human Rights whether before or after the preliminary investigation to be made by the Indonesian Commission on Human Rights (Komnas HAM), Attorney General argues that no subsequent measures on the results of the investigation made by Komnas HAM into the process of investigation due to the Ad hoc Court of Human Rights was not established. The aim of this paper is to provide views on the establishment of the Ad hoc Court of Human Rights by using doctrinal research with statute and case approaces. As this paper shows, it concludes that the Ad hoc Court of Human Rights was established after premilinary investigation and full investigation as proposed by the House of Representatives which is assigned throug Presidential Resolution. Abstract

Korupsi adalah penyelewengan tugas dan penggelapan uang negara atau perusahaan untuk keuntungan pribadi maupun orang lain. Korupsi senantiasa melibatkan lebih dari satu orang. Setiap tindakan korupsi mengandung penipuan dan biasa terjadi pada badan publik atau masyarakat umum. Penyebab adanya tindakan korupsi berasal dari aspek individu, organisasi, dan peraturan yang ada.Dampak dari tindakan korupsi dapat merusak perekonomian negara, demokrasi dan kesejahteraan umum. Lahirnya Undang-undang Nomor 31 tahun 1999 sebagaimana diubah dengan undang-undang nomor 20 tahun 2001 tentang perubahan atas undang-undang nomor 31 tahun 1999 Tentang Pemberantasan Tindak Pidana Korupsi dengan adanya ancaman pidana minimum khusus, pidana denda yang lebih tinggi, dan ancaman pidana mati yang merupakan pemberatan pidana, pemberian ancaman pidana minimal khusus dalam UUPTPK adalah untuk memberikan efek jera kepada koruptor dan mencegah potensi terjadinya korupsi, oleh karena itu perimbangan Hakim dalam penjatuhkan putusan seyogyannya berpedoman dari ketentuan yang sudah di atur di dalam UUPTPK yang sudah memberikan ketentuan acaman pidana minimal khusus dalam pelaku tindak pidana korupsi. Kata Kunci: Korupsi, Ancaman Pidana Minimal Khusus, Pertimbangan Hakim.

Abstract

Riau Islands Province is an island-based region consisting of a group of islands. The Province has a very strategic geographic location due to bordering the neighboring countries in Southeast Asia, viz. Singapore, Brunei Darussalam, Malaysia, Cambodia, and Vietnam. It is different from other Island-based provinces, in which it lies in the hub areas of Malacca Strait. It shows that the Province is an important location to trade from America, Europe and Asia, in addition to a plenty of marine resources that will potentially maximize local government’s revenue and prosper society in the province. However, such marine resource has not been well-managed by local government by which in 2013 the figure shows poverty rate remains high. The decline of poverty rate counts only in urban areas where they do not lie in submarine areas, but the poverty has increased and could not be well-resolved. It asserts that the Government of Riau Islands has not maximized local powers to resolve poverty problems in the region. Keywords: Policy, Local Government, National Marine Resources

Abstract

Entrepreneurs of culinary business must have employees so their business can run smoothly. Additionally, they must also have a business license, as part of their legal obedience. Some of their legal responsibilities include the payment of minimum salary for employees, stated in regulations. In a practical matter, the payment of minimum wages faces problems, especially for small and medium business enterprises. This minimum wages' research is undertaken based on laws which set about employment, determination of minimum wages by culinary businesses, and legal solutions that employees can do if they did not get minimum wages salary. This research also uses the interview to collect data. Some of the respondents being interviewed are someone who has better knowledge about these problems. The conclusions from this research that salary payment is a never-ending problems, the things that entrepreneur’s thought fair for them but it’s unfair or employees, like minimum wages payments. Employees who did not get minimum wages salary choose to not reporting that, and quit their jobs. Keywords: Culinary businesses, Salary, Minimum Wages, and Employees

Abstract

The Conflict in South China Sea involves several countries in Southeast Asia, such as the Philippines, Vietnam, Malaysia, Brunei Darussalam, and Indonesia. It is dealt with the rights of ownership, as a result of the People Republic of China (PRC) to unveil nine-dashed line which partially claims over South China Sea. But, it is followed by other countries to release new evidences on the territorial status of South China Sea. Though the Permanent Court of Arbitration had decided the petition of the Philippines in 2013, PRC could not admit the Arbitration. Essentially, Indonesia is not directly involved as a party in the case. But as the evidence provided by PRC, Natuna Islands is part of nine-dashed line in which it asserts that such islands are regarded part of PRC. As a result, Indonesia needs to anticipate on the further potential contention of territorial claims as it has islands around the South China Sea. Abstract

A notary in exercising powers to make an authentic deed is required to read it before an interlocutor as it is set in Article 16 paragraph (1) letter (m) Notary Act. The problem that arises is that, in some cases, notaries are not the only persons who exercise such duties. In fact, such role is often replaced by their staffs on duties entitled to them. It asserts that Notary Act is not extremely obeyed with following effects of the absence of laws in Notary Act which is specifically dealt with the role of notary’s staffs. This study uses empirical legal research with sociological jurisprudence approach. The result shows that a notary has attributive powers from Notary Act which is granted rights or powers to authorize staffs to act and exercize notary’s duties. To adhere with this view, a notary deed is seen as a perfect evidence if a notary did not accomplish certain procedures. However, if a notary cannot prove it, the declaration of a privately made deed should be made by judges of the courts. If there is any disadvantage as the result of deed read by staffs, a notary can be sued in the courts to provide compensation or certain terms as constituted in Article 1365 of the Civil Code, including maerial and immaterial compensations. Abstract

Tuntutan dana kampanye yang begitu besar ini menjadikan peserta pemilu harus berusaha menyiapkan dana. Dana yang digunakan peserta pemilu dapat berasal dari peserta pemilu maupun sumbangan yang sah menurut hukum dari pihak lain yang diatur oleh peraturan perundang-undangan. Namun, dari dana yang dikumpulkan muncul berbagai persoalan mengenai keabsahan dana tersebut, maupun pengaruh dana yang disumbangkan terhadap tanggung jawab peserta pemilu. Disamping partai politik membutuhkan dana besar untuk membiayai kampanye, di pihak lain besarnya dana kampanye yang disumbangkan pada partai politik membuat partai politik terjebak dalam kepentingan penyumpang dan seakan melupakan kepentingan rakyat. Abstract

This article describes the relationship between the authority local governments and participation in the management of the potential of the region. The authors argue that local government has a broad authority within its jurisdiction to manage local potentials. One of the tasks borne by government is by following the country, namely hold some of the state as organization power, one of them is given to the public and private in publishing licensing. On one side, the role of the community is very important in the management of the potential of the region as a form of concern of the community development of area, then with the participation of the community hope to increase the income of the around and for the local government assets. On the other hand, residents as a their nets a an ongoing activity. Later in this article explain also forms of public participation in the management of the potential of the region. This article use the study literature regarding the authority local governments and the study legislation about the authority local governments that applies. The results of the study concluded that extent authority local governments one of which is the licensing on the management regional potential, on the other side, required public participation in the management of potential an area.
