Abstract

Bencana gempa dan tsunami di Provinsi Aceh dan Kepulauan Nias telah berdampak pada berbagai sektor, di antaranya sektor sosial, infrastruktur, produksi, dan lintas sektor lainnya. Salah satu upaya yang dilakukan pemerintah yaitu membangun kembali perumahan tempat tinggal korban. Namun, setelah pembangunan selesai dilakukan ternyata menimbulkan permasalahan baru, yaitu banyak rumah bantuan yang tidak ditempati dan dimanfaatkan oleh pemilik atau penerima bantuan, sehingga rumah-rumah tersebut terbengkalai dan rusak. Fokus permasalahan yang dikaji yaitu, mengapa rumah bantuan untuk korban tsunami banyak yang tidak dimanfaatkan oleh pemiliknya sehingga terbengkalai dan rusak, serta bagaimana pandangan hukum Islam terhadap perilaku pemilik rumah bantuan yang tidak menempati dan memanfaatkannya. Metode penelitian yang digunakan adalah gabungan antara metode yuridis normatif dan yuridis empiris. Teknik pengumpulan data menggunakan teknik observasi dan wawancara. Hasil penelitian menunjukkan bahwa sebagian rumah bantuan korban tsunami banyak yang tidak dimanfaat oleh pemiliknya disebabkan pendataan yang tidak akurat pada saat pembangunan, pihak penerima ada yang belum bisa menempati rumah tersebut karena masih di bawah umur, penerima bantuan juga ada yang telah pindah domisili karena perkawinan di tempat lain, udzur ahli waris setelah mendapat bantuan, dan faktor ketakutan untuk tinggal kembali di lokasi yang pernah diterjang tsunami. Adapun pandangan hukum Islam terhadap perilaku pemilik rumah bantuan yang tidak menempati dan memanfaatkannya dapat dikategorikan perbuatan dhalim karena telah melakukan perbuatan mubadzir dan menyiakan-nyiakan bantuan yang telah diberikan, seharusnya rumah bantuan tersebut dapat dialihkan penggunaannya untuk orang lain agar tidak terlantar dan rusak sia-sia. Beberapa saran yang dapat diajukan yaitu dalam setiap bencana yang terjadi diperlukan data yang jelas dan riil terhadap setiap calon penerima bantuan agar setiap bantuan yang disalurkan sesuai dengan kebutuhan masing-masing masyarakat korban bencana alam. Setiap bantuan yang disalurkan tersebut harus dilihat dan dievaluasi dengan calon penerima sehingga bantuan yang diberikan tepat sasaran, karena dalam keadaan bagaimanapun prinsip keadilan harus dikedepankan, bukan pemerataan yang menjadi standar.

Abstract

The Minangs are the world's largest matrilineal society; properties such as land and houses are inherited through female lineage. Some scholars argue that this might have caused the diaspora(Minangkabau, "merantau") of Minangkabau males throughout the Maritime Southeast Asia to become scholars or to seek fortune as merchants. However, the native Minangkabaus agreed that this matrilineal culture is indeed the result of (not the reason for) diaspora. With their men travelling out of the country for unspecified time (with possibility of some of them not returning home), it is only logical to hand the land and property to those who do not have to leave it: The women. This also ensures the women's (meaning: mothers of the future generations') welfare and hence ensuring their offsprings welfare. Besides, native MinangKabaus argue that "Men can live anywhere and hence they do not need a house like women do".

Abstract

One of the important aspects of a healthy family is the apparent division of roles or functions in which the function is embedded in a harmonious hierarchical structure, and there is also a commitment to the implementation of the function. However, effective family functioning can be shaken by a number of factors, including environmental changes, such as natural disasters. Therefore, this study aimed to see the description of family functioning among earthquake survivors in Pidie Jaya Regency. The subjects taken were 30 couples (60 people), consisting of 30 husbands and 30 wives. The data collection technique was done by using Family Functioning Scale developed by Maryam (2007) by referring to Rice’s theory (1986). The results showed that most of the family members had instrumental and expressive functions with medium category, with amounts of 53.3% and 91.7%, respectively. This meant family functions can run well in complete family typology.

Abstract

Islamic Education in Minangkabau is one of the contributors to the Indonesian Muslim intellectuals. In the recent decade, such statement is resounded to reproduce Muslim intellectuals in the present and in the future. What and how is the history of Islamic education atmosphere in Minangkabau in maintaining its existence? This paper will explore one of the Islamic educational institutions in Minangkabau, Madrasah Diniyyah Pasia. In the world of Islamic education in Minangkabau, the name of Madrasah Diniyyah Pasia is that popular, but this Madrasah has survived though it has undergone several changes in its education system. Since July 1, 1992, the Madrasah has adopted a boarding school system. Some names recorded to have been in contact with the Madrasah are Sheikh Abdul Latif Syakur, Prof. Mahmud Yunus, Prof Zakiyah Derajat and Prof Hashim Djalal.

Abstract

The progress of science, technology, and globalization has had such a huge impact on human civilization, both positive and negative impacts. This research studies the various impacts and offers epistemology which is based on the foundation of Divine transcendental values that refer to the framework of the Qur'an and Sunnah. This is intended to save humans from their fall as spiritual beings. To realize this, the axillogical, ontological, and epistemological aspects need to be reformulated based on the Qur'an and Sunnah. In exploring these instructions, a semantic approach is needed as an internal analysis of the text. Whereas the contextual approach requires tracking the historical context that 'forms the text', namely micro and macro socio-historical to be drawn into the context of reality that continues to change without limits. Thus a limited sacred text will always be able to dialogue with unlimited context changes. The epistemological framework built from it is expected to be able to inspire the progress of human civilization universally. Institutional transformation from STAIN to IAIN and from IAIN to UIN by developing a paradigm of integration of Islam and sciences. As an effort, consistency, revitalization and sustainability are needed to achieve the glory of universal Islamic civilization.

Abstract

Islamic banking was engineered to frame a financial model based on contemporary Islamic modes of business and finance. One of the products of Islamic banking is a current account, whose roots and fruits, both are still controversial. Islamic Researchers hold three different opinions regarding fiqh (jurisprudential) status of the current account while the benefits offered by this account have also been the focus of research these days, being regarded by some Islamic scholars as permitted while by others as interest. This conceptual paper aims at exploring the real Islamic basis for these accounts, thus framing the guidelines for its practical applications. Both descriptive and applied research approaches are used to study the relevant literature and current banking practices as well. The general findings show that the nature of this account is that of loan so that its specific injunctions should be applied to all services of this account.

Abstract

This study surveys the role of women in the development of shari`ah from the introduction of Islam to Aceh in the 12th centurydown to the modern erawith the formal adoption of Islamic law by an Indonesian parliamentary Bill on Aceh’s Special Status in 1999. After briefly exploring this history, we examine contemporary debates on the current implementation of Islamic law by means of five women of differing backgrounds in this Indonesian province. We review historical documents and existing literature as well as qanuns of Aceh (local regulations) which stipulate shari`ah requirements. We also interview the five women, including one whose husband and another who herself were subjected to shari`ah punishment. The results are complex reflecting the intricacy of contemporary understandings of the shari`ah and the issues surrounding rights of women in Islamic law. One voice represents her agreement to the shari`ah punishment of her husband on account of its positive outcome for her family. The other four are critical of the current implementation of the shari`ah in Aceh, yet are not opposed to it; these ladies argue for women friendly shari`ah.

Abstract

Kesantunan merupakan aturan perilaku yang ditetapkan dan disepakati bersama oleh suatu masyarakat tertentu sehingga kesantunan sekaligus menjadi prasyarat yang disepakati oleh perilaku sosial. Kesantunan berbahasa tecermin dalam tatacaraberkomunikasi lewat tanda verbal atau tatacara berbahasa. Ketika berkomunikasi, kita tunduk pada norma-norma budaya, tidak hanya sekedar menyampaikan ide yang kita pikirkan. Tatacara berbahasa harus sesuai dengan unsur-unsur budaya yang ada dalam masyarakat tempat hidup dan dipergunakannnya suatu bahasa dalam berkomunikasi.Tujuan utama kesantunan berbahasa adalah memperlancar komunikasi. Oleh karena itu, pemakaian bahasa yang sengaja dibelit-belitkan, yang tidak tepat sasaran, atau yang tidak menyatakan yang sebenarnya karena enggan kepada orang yang lebih tua juga merupakan ketidaksantunan berbahasa. Kenyataan ini sering dijumpai di masyarakat Indonesia karena terbawa oleh budaya “tidak terus terang” dan menonjolkan perasaan.

Abstract

The school has a function in addition to educating students, it also serves to provide services and guidance so that students avoid bad behavior. However, violence still occurs within the scope of the school, this certainly demands the role and hard work of Islamic Religious Education teachers to minimize the occurrence of violence in students. The purpose of the study was to look at teacher responsibilities, factors and efforts of teachers in minimizing violence in pidie jaya junior high school students. This research uses descriptive qualitative approach and research subjects of principals, Islamic Education teachers and students. Data collection is done by interview. The results showed that, the responsibility of coaching pai teachers in students is carried out through two processes, a) the process of guidance in the classroom and, b) the process of guidance outside the classroom. Factors of occurrence of violence, Internal: a) Unstable emotional state, b) High-risk personality, c) Lack of faith-religiosity. External factors: a) Influence of globalization, b) Family and, c) Social association. As for the efforts made by Islamic Religious Education teachers there are three, preventive (prevention), reprensive and curative, this effort is carried out with approaches in the learning process and outside the learning process.

Abstract

Human resources (spirit and body, aql, heart, and soul) which are granted by Allah has a very powerful force as through it human is able to manage the existing resources of the universe. Principally, the entire creations of Allah are for the sake of humans. Therefore, the resources must be managed properly through education in accordance with the mandate given by Allah as it is stated in Sura al „Alaq: 1-5. The enrichment of human resource quality is an obligation in Islam to optimize the existing resource. Allah and His Messenger Muhammad (peace be unto him) order humans to pursue knowledge unlimitedly to find the power of Allah. Thus, all resources are bestowed by Allah must be used solely to seek His pleasure. To reach, educational institutions, teaching-learning place, play a great role and must be well managed and planned in order to produce qualified students with good character in conformity with the teachings of the Qur'an and Hadith.
