Abstract

ABSTRAKDalam kasus lalu lintas khususnya apabila terjadi kecelakaan lalu lintas antara korban dan pelaku  biasanya saling mengklaim bahwa dirinya adalah yang paling benar. Secara umum biasanya  yang diminta oleh korban maupun pelaku adalah Surat Ijin Mengemudi (SIM) atau Surat Tanda  Nomor Kendaraan (STNK). . Penelitian ini mengambil rumusan masalah. Bagaimana kriteria pelanggaran dan tindak pidana lalu lintas yang berakibat sanksi penyitaan SIM dan STNK.Penelitian ini menggunakan pendekatan yuridis sosiologis, dengan sumber data yaitu data primer  yang diperoleh dari Polresta Kota Samarinda data sekunder mencangkup dokumen, buku, serta  laporan. Teknik pengumpulan datanya berupa wawancara dengan pihak kepolisian.Penulis dalam hal ini dapat memberikan saran kepada masyarakat untuk melaksanakan tertib  berlalu lintas, mematuhi ramburambu lalu lintas dan petugas, serta memperhatikan kelengkapan  kendaraan. Kepada aparat kepolisian yang secara langsung berkaitan dengan upaya penegakan  hukum dalam lalu lintas jalan raya, penulis menyarankan agar pihak kepolisian melaksanakan ketentuan peraturan perundangan dengan seadiladilnya, serta mengupayakan langkah preventif yaitu meningkatkan kesadaran hukum masyarakat dengan adanya berbagai penyuluhan dan  seminar yang bertujuan untuk meningkatkan pemahaman hukum masyarakat, terutama dalam  kaitannya dengan tata tertib berlalu lintas.

Abstract

ABSTRACT This thesis concerns with analysis of authority a biological father as the marriage guardian to illegitimate children. The purpose of doing this research are to know how the status of illegitimate children and rhe authority of their biological father depend on indonesian marriage law and four big madzab.The design of this research is descriptive qualitative design. The data collected by searching literature related to legislation, policy and opinion of the experts, and by reading and studying books and documents related to this research and legislation applicable. The data also collected by interview with people related to purpose of this study. In analyzing this research. The researcher used normative law approach. In this approach, the researcher observed and analyzed applicablelegislation to moeslem’s law. The researcher also implemented the regulation to solve the problem of status illegitimate children related to the authority of their biological father. This researcher was done at pengadilan agama samarinda for five working days.

Abstract

AbstractGeneral arrangements concerning the burden of proof in the settlement of a civil case are essentially contained in the provisions of Article 163 HIR / 283 Rbg, which states: Whoever says has a right, or specifies an event to affirm his right, or denied the rights of others, then the person must prove his or her right or the event.The development of jurisprudence shows, among other things, that recognition as a proof does not always have perfect evidentiary power. Therefore, to assess the strength of the proof is left to the judge's wisdom. This means that the role of acknowledgment as evidence in civil procedure law is highly dependent on their case.This means that the law needs to tighten the rules of civil procedure law with the development of the community who want it because in civil procedure law, not only seek the formal truth merely, but must always try to find and find the material truth.

Abstract

ABSTRACS  Pursuant to Article 61 paragraph 3 of Government Regulation No. 24 of 1997 states that: If a person has the right to land has died, the rights as heirs must register their rights in a grace period of 6 (six) months after the death of the person, not charged registration. Of the provisions of article above that the existence of legal events in the form of inheritance, it can be said that the heirs accept the transition of property rights as the heir must register their right transition to the Office of National Defense. In a grace period of 6 (six) months after the death of the testator must be registered, it is intended in order to issuance of new certificates on behalf of the heirs concerned and that certainty and legal protection for rights holders new property. The registration of transfer of rights for inheritance is done directly by the rights holder / or the heir to the Office of the National Land with accompanying documents must be satisfied that the respondent register transition of property rights for inheritance carried through the ravine as many as 18 respondents or 60% who make application through the intermediary of notary services as much as 9 respondents or 27%, and the register transfer of rights for the individual inheritance by 7 respondents or 19%.

Abstract

ABSTRACT Sidewalks are part of highway engineering, with the aim of dividing the path between pedestrians and motor vehicle users. Given the pavement functions as a special path for pedestrians to use. Most bodies, sidewalks and upper trenches in Samarinda City have switched functions to other activities filled with permanent and non-permanent small buildings, such as kiosk stalls, street vendors, parking lots and businesses repairing motor vehicles using roads , sidewalks and above the trenches.Based on the results of research the authors get the fact that the enforcement of Regional Regulation No. 13 of 2002 on the prohibition of establishing a motor vehicle repair business on the roads, sidewalks and over the trenches in the city of Samarinda not run effectively hai because the content material regulation is still less clear about the criteria of place of business in addition, legal sanctions, both fines and confinement, are less burdensome to the people who use the roads, sidewalks and over ditches so as not to cause deterrent effects to the violating community. And the absence of legal sanctions for law enforcement officers who do not carry out their respective duties.Factors influencing the enforcement of Regional Regulation Number 13 Year 2002 regarding the prohibition to establish a place of vehicle repair business on the road, sidewalk and top of the trench in Samarinda city that is the factor of law enforcement officers, community factors and the substance of Local Regulation No. 13 of 2013 that there is still law enforcement who are less responsible for his work in the field and the lack of public awareness of local regulations especially Samarinda. Based on field research on Local Regulation No. 13 of 2002 the results of interviews with the Police Officers of Pamong Praja Samarinda City can be concluded that the lack of public awareness and lack of socialization of Local Government against Regional Regulation No. 13 of 2002. The factors causing ineffectiveness of the implementation of the law is the main factor of society is very influential in law enforcement. But the fact that the roads, sidewalks and the top of the trenches used as a place of business that is the land for a living or the necessities of life and the community also does not have other land to be used as their place of business.

Abstract

ABSTRACT The granting of parole to prisoners is the last link of the convict's fostering business in the penal system. By means of parole, inmates can improve communication with the wider community, rediscover their self-worth as human beings and their existence as members of society. In this conditional exercise it must be considered or based on correctional principles, one of which states that during the loss of freedom of movement, prisoners should be introduced to society and should not be alienated from it. By observing one of these principles, it is hoped that the implementation of parole as a means to foster prisoners based on the penal system in achieving its aims and objectives. Factors that are an obstacle or barrier to the implementation of parole are as follows: The inmate concerned still has other cases that have not yet been decided by the court; The prisoner concerned has not received remission or legal deduction; Prisoners who are recidivists; The convicted prisoner during the fostering of the Penal Institution violates; Inmates who underwent less than one year of crime; The Correctional Officer does want conditional exemption to be increased, but the prisoner often commits an offense while in the Penitentiary, so that his administrative requirements do not support prisoners being sent for parole. Sometimes the decline of the parole decree is delayed and if something like this happens then the inmates themselves will be confused, while the officers have tried as much as possible, the prisoners may feel that the prison officers made it difficult to issue the decree. From these communities, parole often encounters obstacles that make prisoners feel less acceptable, for example the families of the victims are still grudging against the prisoners concerned and there is a perception from the public that these prisoners after leaving and getting parole may disturb the order and security of the neighborhood his place. Keywords: Parole

Abstract

Abstracts In the process the cancellation request in the religious marriage about calling, examination, and shall be made in accordance with the procedures of filling a divorce. The trial judge UDH examine the request for revocation of marriage no later than 30 (thirty) days after receipt of the latter/request, a decision which has obtained permanen legal force, the clarks are obliged to make a statement about the concellation of the marriage  anddressed to employees registrar for holding registration of marriage annulment.  Cancellation of marriage in article 28 paragraph (2) of low no. 1 of 1974 about the marriage states that the decision as not retroactive to : children who are born of the marriage. Husbands or wives who act ingood faith, except to the joint property, if the cancellation of marriage is based on the basis of another first marriage. Abstract

ABSTRAK Menurut UU Nomor 33 tahun 2004 tentang Perimbangan Keuangann Pusat dan Daerah yang dimakdsud dengan Perimbangan Keuanga Pusat dan Pemerintah Daerah adalah suatu sistem pembagian keuangan yang adil,proporsional,demmokratis,trannsparan, dan efisien dalam rangka pendanaaan penyelenggaraan desentralisasi, dengan mempertimbangkan potensi, kondisi, dan kebutuhan daerah,serta besaran pendanaan penyelenggaraan dekonsentrasi dan tugas pembantuan. Pada dasarnya pelaksanaan perimbangan keuangan pusat dan daerah merupakan amanat UUD 1945 yaitu diselenggarakannya otonomi seluas-luasnya dalam kerangka Negara Kesatuan Republik Indonesia. Kemudian secara ekspisit tertuang dalam Pasal 18A ayat (2) Undang-Undang Dasar Negara Kesatuan Republik Indonesia Tahun 1945 yang mengamanatkan agar hubungan keuangan, pelayanan umum, serta pemanfaatan sumber daya alam dan sumber daya lainnya antara Pemerintah Pusat dan Pemerintah Daerah diatur dan dilaksanakan secara adil dan selaras berdaarkan Undang-Undang. Dengan demikian, Pasal ini merupakan landasan filosofis dan landasan konstitusional pembentukan Undang-Undang tentang Perimbangan Keuangan antara Pemerintah Pusat dan Pemerintah Daerah. Peraturan Presiden Nomor 66 Tahun 2016, bagian Daerah dari PPh, baik PPh Pasal 21 maupun PPh Pasal 25/29 orang pribadi, ditetapkan masing-masing sebesar 20 persen dari penerimaannya. PBB ditetapkan 90 persen, sedangkan sisanya sebesar 10 persen yang merupakan bagian pemerintah pusat,juga seluruhnya sudah dikembalikkan kepada daerah. Penerimaan SDA minyak bumi dan gas alam (migas), yang masing-masing ditetapkan 15 persen dan 30 persen.  Sementara itu, penerimaan SDA pertambangan umum, kehutanan, dan perikanan, ditetapkan masing-masing sebesar 80 persen.  Kata Kunci : Dana Perimbangan,, otonomi daerah

Abstract

ABSTRAKGadai merupakan lembaga jaminan yang telah sangat dikenal dan dalam kehidupan masyarakat, dalam upayanya untuk mendapatkan dana guna berbagai kebutuhan transaksi hukum gadai dalam fikih Islam disebut ar-rahn. Arrahn adalah suatu jenis perjanjian untuk menahan suatu barang sebagai tanggungan utang. Berdasarkan hal-hal tersebut maka permasalahan yang akan diteliti dalam peneltian ini adalah: pelaksanaan gadai dengan sistem syariah, perlindungan hukum bagi para pihak dalam pelaksanaan gadai dengan sistem syariahMetode pendekatan yang digunakan adalah pendekatan yuridis empiris dan spesifikasi yang digunakan dalam penelitian ini bersifat penelitian deskriptif analitis. Berdasarkan hasil penelitian bahwa Pegadaian Syariah memiliki perbedaan mendasar dengan pegadaian konvensional dalam pengenaan biaya. Pegadaian konvensional memungut biaya dalam bentuk bunga yang bersifat akumulatif dan berlipat ganda, lain halnya dengan biaya di Pegadaian Syariah yang tidak berbentuk bunga, tetapi berupa biaya penitipan, pemeliharaan, penjagaan, dan penaksiran. Biaya gadai syariah lebih kecil dan hanya sekali saja.Apabila ditinjau dari aspek legalitas, PP No. 103 tahun 2000, dan fatwafatwa Dewan Syariah Nasional (DSN) Majelis Ulama (MUI) yang dapat dijadikan acuan dalam menjalankan pratek gadai sesuai syariah, yakni Fatwa No. 25/DSN/MUI/III/2002 tentang Rahn (Gadai), yang disahkan pada tanggal 26 Juni 2002, dan Fatwa No. 26 DSN/MUI/III/2002 tentang Rahn Emas (Gadai). Memberikan kepada Perum Pegadaian legalitas yang cukup kuat untuk melakukan gadai dengan sistem syariah, walaupun gadai syariah belum diatur dalam suatu peraturan perundangan-undangan secara khusus di Indonesia. Lelang sebagai upaya eksekusi terhadap barang jaminan juga dilakukan di Pegadaian Syariah. Lelang merupakan upaya terakhir yang dilakukan oleh Kantor Cabang Pegadaian Syariah apabila ada nasabahnya yang wanprestasi. Lelang akan dilaksanakan apabila sampai batas waktu yang telah ditetapkan penerima gadai (rahin) masih tidak dapat melunasi uang pinjamannya (marhun bih).KATA KUNCI : GADAI,SYARIAH

Abstract

ABSTRAKSkripsi ini berjudul “Kewenangan Pemerintah Daerah Terhadap Pemberian Ijin Mendirikan Bangunan (IMB) Di Kota Samarinda”, dengan 3 (tiga) Pokok permasalahan yaitu:a) Bagaimana Dasar Hukum Pemberian Ijin Mendirikan Bangunan (IMB) Di Kota Samarinda?b) Bagaimana Tanggungjawab Pemerintah Terhadap Pemberian Izin Mendirikan Bangunan (IMB) Di Kota Samarinda?c) Bagaimana Tindakan Hukum Pemerintah Daerah Terhadap  Pelanggar Ijin Mendirikan Bangunan (IMB) Di  Kota Samarinda? Penelitian ini adalah jenis penelitian gabungan normatif dan empiris. Hasil penelitian dari skripsi ini menunjukkan bahwa;a) Dasar Hukum Pemberian Ijin Mendirikan Bangunan (IMB) Di Kota Samarinda disesuaikan dengan aturan yang berlaku berdasarkan Peraturan Daerah Kota Samarinda Nomor 15 Tahun 2011 Tantang Restribusi Perijinan Tertentu.b) Sehubungan dengan tugas BPPTSP Kota Samarinda dalam rangka pemberian Sertifikat IMB, maka pemerintah daerah mengeluarkan peraturan atau dasar hukum yang membahas tentang tata cara pembuatan dan retribusi IMB yaituPeraturan Daerah Kota SamarindaNomor 15 Tahun 2011 tentangRetribusi IMB.c) Pelanggaran terhadap ketentuan Peraturan Daerah Kota Samarinda Nomor 15 Tahun 2011 Tentang Restribusi Perijianan Tertentu dapat dikenakan berupa sanksi pidana dan sanksi administratif sebagai mana di atur dalam Pasal 47 sampai dengan Pasal 49 pada Peraturan Daerah tersebut di atas.). Kata Kunci : Wewenang, Satuan Polisi Pamong Praja, Peraturan Daerah.
