Abstract

Nilai rupiah pada pidana pencurian dalam KUHP terus menurun dan tidak mampu bertahan setelah lebih dari 57 tahun berlalu. Sebaliknya, nisâb harta curian dalam hukum pidana Islam tetap bertahan dalam usianya yang ke 1440 tahun. Dalam tulisan ini dikemukakan konsep nisâb dalam pencurian secara terperinci dan faktor-faktor yang membuat ketentuan ini tetap bertahan dan bisa digunakan dalam keadaan apapun. Mazhab Hanafi menetapkan 5 dirham sebagai nisâb harta curian. Kalangan ulama Hanafiah lainnya menetapkan 1 dinar atau 10 dirham sebagai nilai minimal nisâb harta curian dan menjadi pendapat terkuat di kalangan mereka. Adapun ulama mazhab Syafi’iy, Maliki, dan Hanbali menetapkan ¼ dinar atau 3 dirham sebagai nisâb harta curian. Standar emas dan perak yang digunakan untuk menghitung nilai harta curian dalam hukum Islam senantiasa berguna dan sesuai sepanjang masa. Beberapa negara Muslim di dunia menggunakan ketentuan ini sampai sekarang. Kajian ini dilakukan dengan menggunakan sumber kepustakaan dan dilakukan analisis isi pada setiap teks yang berkenaan

Abstract

Kebebasan berkeyakinan dan beragama merupakan instrument hak asasi manusia internasional, sebagaimana juga dijamin dalam Pasal 28 E dan Pasal 29 UUD 1945. Namun dalam realitanya, Pemerintah telah melakukan diskriminasi dengan hanya memberikan pengakuan dan perlindungan terhadap enam agama: Islam, Kristen, Katolik, Budha, Hindu, dan Khonghucu, sedangkan penghayat kepercayaan terhadap Tuhan Yang Maha Esa tidak mendapat pengakuan dan perlindungan, karena dinilia tidak “beragama”. Melalui mekanisme judicial review UU Administrasi Kependudukan, Mahkamah Konstitusi telah merekonstruksi konsep pengakuan agama dan kepercayaan dalam sistem administrasi kependudukan sebagai ruang kontestasi politik kewarganegaraan. MK menegaskan bahwa penghayat kepercayaan memiliki hak yang sama dengan penganut enam agama resmi yang ada di Indonesia dalam pemenuhan hak warga negara. Tulisan ini berupaya mengelaborasi politik hukum Mahkamah Konstitusi atas rekognisi penghayat kepercayaan dalam politik kewargaan.

Abstract

The Gowa Regency Government enforces Regional Regulation No. 2/2020 concerning Mandatory Masks and Implementation of Health Protocols in Preventing the Spread of Corona Virus Disease 2019 on September 21, 2020. The enactment of this regional regulation has drawn a lot of criticism and protests from the public, especially those who have been caught in the operation of law enforcement. The bylaw is interesting to study further for reasons. First, this regional regulation was born and enforced for people affected by Covid-19 who feel the impact in various aspects of life. Second, the spread of the 2019 corona virus disease is determined by the Central Government as a non-natural national disaster, therefore the regulations governing it are also stipulated by the Central Government. This study is viewed from two aspects, namely: 1) What is the legal position of Perda No. 2 of 2020 Gowa Regency according tao the laws and regulations in Indonesia? and 2) What is the saddu zari'ah perspective on the enforcement of the sanctions in the perda? This study is expected to provide insight regarding the legal position of Perda No. 2 of 2020, Gowa Regency, as well as revealing the saddu zari'ah perspective on the imposition of sanctions in the perda. This discussion uses a juridical-syar'iy approach. This study shows that Regional Regulation Number 2 of 2020 Gowa Regency is legal and binding in accordance with the applicable laws and regulations. The Perda fulfills the formal and material requirements in the formation of legislation in Indonesia. Meanwhile, the saddu zari'ah perspective on the imposition of sanctions in this regional regulation is in accordance with the Shari'a, because the imposition of sanctions leads people to comply with the obligation to wear masks and implement health protocols to avoid and control the transmission of covid-19.

Abstract

Abstrak:Problem mendasar yang menyebabkan terjadinya overcrowded di Lembaga Pemasyarakatan tidak lepas dari paradigma pemidanaan yang masih berorientasi retributive justice. Kebijakan kriminal yang didesain pasca reformasi justru masih terjebak pada paradigma pidana penjara sebagai bentuk paling efektif dan rasional dalam fungsi kontrol sosial. Hal ini dapat dilihat dari masifnya ancaman pidana dalam rentang 1998-2014 sehingga terkesan overkriminalistik. Oleh karena itu, penelitian ini ingin menelaah proyeksi kebijakan kriminal yang dapat menekan laju pertumbuhan overcrowded di Lapas. Selain itu, penelitian ini juga membahas grand design kebijakan kriminal di bawah naungan Kementerian Hukum dan HAM dalam menanggulangi kondisi overcrowded Lembaga Pemasyarakatan. Penelitian ini merupakan penelitian kualitatif dengan pendekatan yuridis normatif. Sifat penelitian adalah deskriptif, analitik dan preskriptif. Sumber data dalam penelitian ini menggunakan data sekunder yang terdiri dari bahan hukum primer dan bahan hukum sekunder. Hasil penelitian menunjukkan tren kriminalisasi mengarah pada overkriminalisasi dengan dominasi ancaman pidana penjara. Kebijakan tersebut sangat berperan bagi laju pertumbuhan overcrowded. Proyeksi yang dibangun untuk menanggulanginya adalah konsep individualisasi pidana dalam RKUHP, diversi dan mediasi penal, subsidairitas terbalik pada model pemidanaan yang mengutamakan ultimum remedium, berkembangnya pola pembinaan extramural treatment dan sinkronisasi regulasi terkait. Adapun grand design yang dibangun adalah perlunya segera dilakukan sinkronisasi regulasi terkait tata kelola dan manajemen pegawai, penguatan kelembagaan di bawah kendali Direktorat Jenderal Pemasyarakatan, memperkuat peran penelitian masyarakat dan pola pembinaan ke arah extramural treatment. Abstract:The fundamental problem that causes overcrowding at the correctional institution cannot be separated from the sentencing paradigm which is still retributive justice oriented. The criminal policy designed after the reformation period is still trapped in the paradigm of imprisonment as the most effective and rational form in the function of social control. This matter can be seen from the nature of the imprisonment in the range 1998-2014 so that, it seems overcriminalistic.Threfore, the aim of this research is to review criminal policy projections that can reduce the growth of overcrowding at the correctional institution. This research also discusses the grand design of criminal policy under the authority of the Ministry of Law and Human Rights in tackling overcrowding at the correctional institution. This research is qualitative research with a juridical normative approach. The nature of this research are descriptive, analytic and prescriptive methode. The source of data uses secondary data with the composition of primary legal materials and secondary legal materials. The result of this research show that criminalization trends are overcriminalistic with the dominance of imprisonment. These trends have an impact on the overcrowded growth rate. Projections that built to reduce it are the concept of individualization in criminal punishment, diversion and mediation program, subsidiarity of sentencing model to prioritize ultimum remedium, extramural treatment as the progressive treatment for prisoners and regulatory synchronization on criminal regulations. Grand designs that have been developed are necessary to synchronize regulations related to the correctional administration, institutional management, strengthen institution under the authority of the directorate general of correction, strengthen the role of community research and to develop extramural treatment.

Abstract

This research analyses how is corporate criminal liability regulation in Indonesia regarding IUU Fishing following the enactment of the Job Creation Law. This research uses both statute approach and conceptual approach as the legal research methods to analyse the issued legal problem. Following the enactment of the Job Creation Law on 5th October 2020, some articles of Law No. 45 of 2009 amending law no. 31 of 2004 concerning Fishery are amended, including the corporate criminal liability regulation. This research’s analyses shows that in order to improve the effectiveness of IUU Fishing law enforcement, specifically the ones being committed by a corporation, the Job Creation Law needs to be amended, specifically its article concerning corporate criminal liability, by changing the used conjunction to ‘and/or, as regulated in the draft of Fishery Law as well. Furthermore, as the term of ‘person in charge’ is more appropriate, in case of corporate criminal liability system, than the one used in the Job Creation Law, which is ‘employee’, the Job Creation Law shall be revised by opting the former term into it.

Abstract

Covid-19, which has attacked the world since the end of 2019, has had a global impact both economically and socially to the world community. Taiwan is one of country categorized as quite successful in dealing with Covid-19. From December 2019 until March 2021 there were 177,578 reported cases in Taiwan with a total of 976 positive cases and resulted in 10 deaths. A very small number compared to other cases that occur in other parts of the world. However, behind all that successful story, migrant workers in Taiwan are still forgotten during the pandemics. Migrant workers, particularly Indonesian migrant workers, who make up the majority in Taiwan, receive the least sympathy and understanding from the community. Several human rights issues confronted Indonesia Migrant Workers during the Covid-19 pandemic, including discrimination, loss of spatial public space, strict mobility limitations, concern for the family in Indonesia, a higher burden of common mental health, and a lower quality of life than local society, difficulty accessing health services and masks, and difficulty returning home. The purpose of this paper is to demonstrate how Indonesian migrant workers' rights were violated in Taiwan during the two phases of the Covid-19 pandemic. The data was collected through interviews, observation, and then was analyzed using the "rights-based" approach. The first phase lasted from December 2019 to March 2020, when the pandemic was still in its early stages, and the second phase lasted from March 2020 to January 2021, after the Taiwan government succeeded in controlling the pandemic

Abstract

This article outlines the relationship between politics and law in the formation and enforcement of the law in Indonesia until the current reform era. There are three models of relations in describing legal and political relations. First, as Das Sein, the political determinant of the law because the law was born from the political process so that the law is a crystallization of competing for political desires. Secondly, as Das Sollen, the Law of determinants on the politics of every political agenda should be subject to the rules of the law. Thirdly, politics and laws influence each other because political lawlessness will be wronged while the law without an escort will be paralyzed. In the process of forming legislation by political institutions, the role of political power is very decisive because political institutions are formally given the authority in making the law. Political institutions that are not given such authority will become a vacuum. Here it appears that political institutions are only a tool of the group of political power holders. There are three main elements directly related to law enforcement efforts. First, the element of artificial lawn is a legislative institution. Second, the element of law enforcement is the police, prosecutors, and judges. Third, environmental elements include personal citizens and society.Keywords: Determination, politic, formation, and enforcement of the law.

Abstract

The purpose of writing this article is to focus on how the Indonesian state in accordance with the Contitution, makes the protection of citizen’ rights as one of the main characteristics of the implementation of human rights. In the process important issues that deserve to be studied in depth were discovered (1) the role of the state institutionally protecting citizens from acts of persecution and intolerance that also occurred during the Covid-19 pandemic; (2) prevention of acts of persecution and intoleranceaffecting the life of the nation and state in the past five years occurated in the Covid-19 pandemic. The results of the study provide a perspective that legal efforts which are a form of the existence of the practice of Pancasila and UUD 1945 including the implementation of protection of human rights in Law number 39/1999 concerning Human Rights as legal umbrella that must be upright and firm in its implementation, because law emforcement in human rights will fatale consequences with the destruction of diversity in the Republic of Indonesia, during the Covid-19 pandemic it turned out that persecution and intolerance continued and needed consistency in the protection of human rights law in accordance with the mandate of Pancasila as a value and UUD 1945 as a legal norm.

Abstract

Penelitian ini menggunakan  jenis penelitian hukum doktrinal yang dipadukan dengan pendekatan konsep (concept approach), analitis (analitycal approach), kasus (case approach) dan perundang-undangan (statute approach) dalam pemecahan permasalahan. Data penelitian yang terlibat dalam penulisan ini adalah bahan hukum primer berupa hasil penelitian sebelumnya, literatur, dokumen terkait dan pendapat hukum (doktrin), yang kemudian dilanjutkan bahan hukum sekunder sebagai data analisis penting dari beberapa peraturan positif serta bahan hukum tersier sebagai penunjang dalam penelitian ini. Adapun hasil penelitian ini menyimpulkan bahwa dengan melakukan penyelesaian melalui praktik Restoratif Justice memberikan tawaran melalui  pendekatan secara integral  antara  pelaku  dengan  korban  untuk mencari berbagai solusi atau jalan keluar yang terbaik diantara kedua belah pihak. Perbaikan yang dimaksud dalam hal ini akan menekankan dengan melakukan penggantian kerugian yang diperbuat oleh pihak pelaku serta melakukan pemulihan dan perbaikan pada korban. Dalam hal ini proses penyelesaianya sesuai dengan prinsip-prinsip yang berwawasan pancasila dengan melakukan upaya penyelesaian secara musyawarah dan mufakat. keadilan restoratif harus dapat dijadikan kekuatan guna mendukung supremasi hukum dalam rangka pembangunan nasional. Dalam hal ini melalui pendekatan restoratif justice sebagai perwujudan nilai-nilai Pancasila.

Abstract

Marriage is a form of worship, this is in line with the definition of marriage in the Islamic Law Compilation which reads; marriage is a very strong mitsaqan ghalizhan contract to obey Allah's commands and carry out it is worship. Religion and state also provide rules for marriage, especially at the age of the prospective husband and wife, so that it can be considered mature, with the aim of achieving sakinah mawaddah warahmah. However, there were several cases of underage marriage in Indonesia. And it is in the background of many factors and their respective goals. Among the factors are wanting to maintain religion, honor and achieve happiness and welfare. Such as the case of early marriage in the Tanjung Morawa area in Bangun Sari Village. They decided to get married because the candidates who came were people of good religion and morals, so that the married life they live is blessed according to their hopes and dreams.
