Abstract

The distribution of zakat (masharif al-zaká) is an important factor as an indicator of the optimal function of zakat. In addition to the qur’an, the zakat distribution mechanism should be based on valid traditions as references in its management. This study aims to analyze the distribution of zakat in the review of maudhu'iy hadith. The method used is a thematic approach (al-hadith al-maudhu'i). The result of the research shows that the hadith that is being discussed is categorized as hasan lighairihi hadith, where the origin is dha'if but has reinforcement from other lines so that it is elevated to hasan lighairihi. In addition, the contents of the prophet's hadiths regarding mashârif al-zakât which are discussed do not contradict the verses of the qur’an, because they have the same meaning regarding the eight asnaf who are entitled to receive zakat.

Abstract

Various kinds of problems occur and have not been able to be resolved in themselves, families, until the nation and state have carried out various ways in an effort to resolve these problems, one of the methods recommended and ordered in the Qur'an is deliberation, what is the nature of deliberation and how the existence, essence and urgency of deliberation will be described in this discussion. This paper attempts to explain these three aspects to give us an idea of the concept of deliberation in the perspective of maudhu'iy. This study will describe the definitions, objects, principles to the benefits of deliberation in the perspective of the Qur'an.

Abstract

Environmental pollution in the perspective of the Prophet's hadith. what is meant here is a study of the hadith of the Prophet. which discusses environmental pollution with 3 issues that will be discussed 1) how is the quality of the hadith about environmental pollution, 2) how is the content of the hadith about environmental pollution both formally and substantially, and 3) what are the implications of the meaning of the hadith about environmental pollution and efforts prevention. The type of research used is descriptive with a rationalistic style, namely describing the quality, validity, and analysis of the traditions of the Prophet Muhammad, both in the aspect of the sanad and its matan. This research includes source studies (text review) because the emphasis is more on library research. In the research library, data is collected by quoting, adapting, and analyzing using content analysis on representative literature that has relevance to the problems discussed, then reviews and concludes. The results of research on environmental pollution in the perspective of the Prophet's hadith; First, the hadith of the Prophet (saw) related to environmental pollution has authentic quality. Second, a) the essence of environmental pollution is the occurrence of changes in a substance (water, soil or air) due to the inclusion of other components in it that can affect the quality of the environment (water, soil or air). b) forms of environmental pollution and their impacts include 1) prohibition of urination in stagnant water as a form of environmental pollution of water, 2) prohibition of defecating in public places, and water sources as a form of soil and water pollution, 3) prohibition of elevating buildings that block surrounding housing from clean air and prohibition of directing dirty air to it as a form of air pollution. Third, solutions to environmental pollution, namely; 1) Go green 2) Go clean, and 3) Environmental conservation. Based on the results of the study, it is recommended that UIN Alauddin Makassar establish a Center for Environmental Studies in order to give birth to Environmental Fiqh (fiqh of land, water and air) and that Government agencies engaged in the field of Environment in an effort to overcome environmental pollution to strengthen existing regulations even need to made new regulations in an effort to preserve the environment with a religious science approach. 3) prohibition of elevating buildings that block surrounding housing from clean air and prohibition of directing dirty air to it as a form of air pollution. Abstract

This paper describes the leadership of women in Indonesia in contemporary fiqh. The method used is literature and describes the main problems in the research. The sub-problems that are addressed are the role of women in the era of the Prophet and contemporary fiqh in women's leadership in Indonesia. This study found that the involvement of women in the time of the Prophet was not restricted in social aspects, attending lectures, discussion partners and so on. Reflecting that social involvement in the Sasulullah era was very open to women, it is not appropriate and fair if women are limited in their space of movement in social participation or career. The paradigm of women "staying at home" is not in line with the Prophet's example in his time, especially in today's life, especially in Indonesia, which gives women the freedom to work. The explanations in the collective verses of the Qur'an and Hadith and social facts at the time of the Prophet, as well as historical facts in Indonesia, are evident in the involvement of women in all aspects, including being leaders in social, educational and political aspects. Women's political participation is in line with Indonesia's social and constitutional situation in opening up space for women to be involved in practical politics, including running for Regional Head and President. The potential of women in terms of leading the state (becoming heads of state) is very open and justified in Islam because no text contradicts contextually but provides the same rights and responsibilities as men in all aspects, including religion, social and culture. Abstract

This paper elaborates the social relationships in congregational prayers toward the social life in Makassar City during Covid 19 pandemic. The study used qualitative method and took place in Makassar City, South Sulawesi Province. The researchers applied phenomenological, normative, and anthropological approaches and used in-depth interviews, non-participatory observation, and documentation for data collection. The research instrument was interview guide and observation guide. After the data was collected, it was analyzed through three stages; data reduction, data presentation, and data verification/ conclusions drawing. The data triangulation involved credibility, dependability, confirmability, and transparency criteria. The results show that the role of congregational prayers on social problems in Makassar city during the Covid-19 pandemic is to educate the public directly to face the pandemic, encourage more self-reflection in interpreting the pandemic, and take wisdom from the situation.

Abstract

This study purpose to test empirically the effect of consumptive ZIS distribution on the ZIS distribution for economic activities and the provision of capital and per capita GRDP. To test the effect of ZIS distribution for economic activities and capital providing on GDP per capita. To test the effect of the consumptive ZIS distribution on the GDP per capita through the ZIS distribution for economic activities and capital providing. The type of research used is quantitative with an explanatory approach. The study population was the districts and cities in South Sulawesi. The data used are: consumptive ZIS distribution, ZIS distribution for economic activities and capital providing and GRDP per capita according to the business fields and constant prices in the form of published documents. The sample used was 105 in the form of data panels consisting of 21 districts and cities using 5 years of documentation data (2015-2019). Data processing and analysis techniques use panel data regression statistical tests and path analysis using Eviews program data processing. The results showed that:   (1) Increasing the distribution of consumptive ZIS can increase ZIS distribution for economic activities and capital providing and GRDP per capita. (2) Increasing the distribution of ZIS for economic activities and capital providing can increase GDP per capita. (3) Increasing the consumptive ZIS distribution can increase GDP per capita by increasing the ZIS distribution for economic activities and capital providing. The implication of the research results using the consumptive ZIS distribution approach model and the ZIS distribution for economic activities and the capital providing can be used as an instrument to  increase  GDP  per  capita  directly  and  indirectly.  This  implication  can  be  achieved  by encouraging an increase in the consumptive ZIS distribution and the ZIS distribution for economic activities and the provision of capital as well as public awareness of the obligation of zakat.

Abstract

This study will elaborate on the form of mappaja' trading, which is considered as an attractive economic issue as in its transactions, people do not use a system of weighing scales in trading their harvests, but with a cost estimation system for the goods. Therefore, in the trading practice, there is often a discrepancy between the harvest and the buyer’s expectation, because it may contain an element of gharar/obscurity of the goods, which can lead to an invalid transaction and harm one of the parties. This study indicated that the practice of mappaja' for agricultural commodities has occurred for a long time. The mechanism is by estimating the number of plants based on mutual trust and responsibility. The agricultural commodities used as the mappaja' objects are cloves and vegetables (carrots, cabbage, and tomatoes). The payment method in mappaja' practice is carried out in two ways, namely full payment and twice payment. Twice payment refers to the transaction where half of the payment was handed over on the agreement as a down payment and a sign of completion, then the rest of the payment were handed after the harvest. The condition of the plant is ready to harvest or not ready for harvest in the transaction of mappaja’. The rights and obligations of both parties are that traders are obliged to make payments to farmers according to the agreement and for the farmers, they have to keep taking good care of the plants if at the time of the transaction the condition of the plants is still not ready for harvest.

Abstract

The purpose of this study is to find out the various factors that cause divorce due to domestic violence in Sinjai Regency and to describe how to resolve divorce due to domestic violence in Sinjai Regency and to elaborate on how divorce due to domestic violence is from an Islamic legal perspective. This research is a qualitative descriptive field research, taking place in Sinjai Regency. The approach used is a normative theological approach, a juridical approach and a sociological approach. The data collection obtained in the field with the technique of observation, interviews / interviews and documentation. The collected data is then processed using data reduction analysis, data presentation and conclusion drawing. Furthermore, by linking one of the theories of Islamic law, namely the theory of existence and competence of religious courts, the process of resolving divorce cases due to domestic violence in Sinjai Regency, which in this case is the authorized and entitled institution in resolving it, namely the Sinjai level I religious court, goes through several stages. namely through table I, table II and table III. However, before the plaintiffs and defendants seek justice, the panel of judges first has the obligation to mediate/advise both parties, in which the panel of judges makes every effort to provide the best advice or solution to the plaintiff or defendant. And Islamic law does not legalize violence against wives. Beating a wife who does nusyuz as contained in QS al-Nisa` verse 34 should be interpreted as an act to teach a lesson / for obedience, not to hurt or even do violence. The beatings carried out in the case of nusyuz basically should not injure. Meanwhile, the husband's act of hitting his wife until he is injured or the husband's violence against his wife can be declared as nusyuz of the husband against his wife. Furthermore, related to divorce due to domestic violence in Sinjai Regency which is analyzed from the perspective of Islamic law, the researcher connects one of the theories of Islamic law that applies in Indonesia to date, namely the theory of existence and competence of the Sinjai religious court which refers to the compilation of Islamic law or Islamic law. Abstract

This study formulates three problems which include: (1) The principles of the social protest movement from the perspective of Islamic law; (2) Methods and techniques for conducting demonstrations from the perspective of Islamic law; (3) The social impact of demonstrations in Indonesia from the perspective of Islamic law. This study uses a qualitative method (descriptive-analytic). Based on the data source is library research (library research). The approach used is the sociological approach of Islamic law and the siyasah fiqh approach. In the perspective of scientific studies, these two approaches are used to understand the phenomenon of demonstrations in Indonesia based on legal arguments contained in the Qur'an and Hadith, the opinions of fuqaha' and opinions that develop (ijitahad) at a time in life. Muslims. Meanwhile, from a methodological perspective, these two approaches are used to provide an interpretation of the methodology of Islamic law on the concept and practice of demonstrations based on social movement theory and Islamic political theory. The results of this study found that: The principles of the Islamic social protest movement are built on the doctrine of rights and obligations between the people and the rulers in an Islamic state which include: the principle of hisbah; The principle of freedom of expression; The principle of deliberation; and constitutional principles. Based on the method of carrying out the demonstration, there are 2 methods, namely the exclusive method and the inclusive method. Based on the technique of holding demonstrations, there are 3 levels, namely: (1) demonstrations with the ability and strength of the masses; (2) demonstration with verbal ability and strength; (3) protest with the ability of the heart. Through the istislahi approach, that Islamic law strongly condemns all demonstration activities that cause harm to religion, soul, mind, descendants and property. On the other hand, he strongly supports all demonstration activities that uphold the five maintenances (Maqasid al-khamsah). That demonstrations are not at all motivated by passion or personal tendencies, let alone to cause damage to the earth. It is an obligation not just an appeal for those who can afford it. The law is fardu kifayah. Abstract

This paper discussed hadith related to the existence of the heart with main topics 1) the quality of the hadith and 2) content. The results of this study indicate that the existence of heart hadith based on the transmission consists of 16 lines (sanad) which are spread in the book of 9 imams (al-kutub al-tis'ah) and narrated in meaning. In addition, 1) the existence of heart hadith has good quality, both in terms of the sanad and matan, and 2) the hadith shows the existence of the heart as a treasury of abstract issues, such as; beliefs, feelings, disbelief, and others. In addition, the liver is an organ that plays a role in giving a command to all body organs to move. This paper is expected to understand the broader community that the heart has a vital role in the excellent condition of the body and human actions, especially to achieve the best level as human beings mentioned in QS al-Hujurat(49:13).
