Abstract

AbstractEven though many aspects that show the way to run a democratic government, but the most important aspect is related to the leadership of integrity. The leadership of integrity put the perspective of power in the orientation of partisanship on the people. Also, democratic governance at the local level can be run effectively and constructively if the leadership held with integrity. In another word, the leadership of integrity is a requirement to run a democratic government. Therefore, the integrity of local leadership should be encouraged. Strengthening the integrity of local leadership includes two main things, namely giving a great opportunity for people participation and is committed to a clean and accountable government. Our conception of the strengthening the local leadership integrity and relevance of a democratic government explains important aspects of leadership in maintaining the continuity of a government. For success or failure of a reign depends on how to reach a democratic government that can be reached and gets the highest appreciation from the community. Therefore, the purpose of the writing of this article is to explain the significance between the leadership of integrity with democratic governance and elaborating how to strengthen the integrity of the leadership in the efforts to reach a democratic government. Keywords: Leadership, Leadership Integrity, Democracy, Local Government, Democratic Governance.

The procedure Oversight Judge (How It Treats People) is regulated by an internal mechanism by the Supreme Court as an institution builder through the remedies and oversight mechanisms of behavior, as well as the external monitoring Judicial Commission behavior of justices and judges in the Supreme Court. While the constitutional judges monitored internally without the involvement of outside agencies. There is injustice setting norms supervision of judges (How It Distribute). Abstract

The objectives of the professional agencies must embody provisions that promote good governance and embrace values of integrity and accountability and seek support from the public and the government of the day to provide an independent view on all matters. The universal truth is that everything should be done in the public good. Professionals form the backbone of human infrastructure in any economy, politics, social and legal growth. Their contributions through professional performance enhance the good delivery system that facilitates policies making and management for public sector. They provide the skills and talent in balancing the pursuits of maximization of services. The expression “good governance” has constantly been used lately in both public sector as well as private sector in Malaysia. In the context of a private body, it should be within the framework of the statute, which governs the body and also its constitution. In the public sector, it means that the administrators should act professionally and not to abuse or misuse the power or authority given to them. They are regarded as the trustees of the public at large. The scope of this article is on good public governance in the public sector or to be exact, good governmental administration as interpreted by the judiciary especially through its judicial review power and Islamic Perspective based on the principles of Maqasid As Shariah (Objectives of Islamic Law). Keywords: Good Governance, Public Sector, Malaysian Law, Islamic Perspective, Maqasid As-Shariah.

Abstract

Monitoring and observation of court decisions made by judges is a new institution in the criminal procedural law in Indonesia. Through monitoring and observation of expected gaps (gap) between what the judge decided and reality implementation of the criminal in prison can be bridged. Judges will be brought closer to the prosecutors and corrections officials so that judges can follow the development of the state of the convict. Abstract

The amendment to the 1945 Constitution of the Republic of Indonesia has shown progress in respecting, protecting and fulfilling human rights in Indonesia. It is proven from the advanced provisions that have set the human rights material, starting from the affirmation of fundamental rights, individual rights, social rights, solidarity rights, and even the assertion of rights included in the category of not-derogable rights in the Second Amendment to the 1945 Constitution. The urgency of the Constitution 1945 as written constitution due to its status as the ultimate instrument to determine a norm (law), action or government policy, so it will not violate human rights and constitutional rights of the citizens. Thus, the Constitution is an important instrument in term of guaranty and ensuring that human rights within the Republic of Indonesia are protected, even though the source of human rights is not actually derived from the State but naturally originated from natural law, whether its universal validity is either affirmed or not in the Constitution. It shows progress in the level of regulation and protection of human rights in Indonesia.Related to the guarantee of the protection of human rights, one of the important material of the 1945 Constitution of the Republic of Indonesia is the presence of a new judicial institution called the Constitutional Court, in addition to the Supreme Court. The existence of the Constitutional Court in Indonesia is an improvement in maintaining and upholding the Constitution and protecting human rights. Hence, the Constitutional Court referred to as “the Protector of Human Rights.” Protection of human rights is carried out through the exercise of authority as defined in Article 24C Paragraph (1) of the 1945 Constitution which is to review an Act against the Constitution, to judge on authority disputes of state institutions whose authorities are granted by the Constitution, to judge on the dissolution of a political party, and to judge on disputes regarding the result of a general election. Also, Article 24C Paragraph (2) obliges the Constitutional Court to render a judgment on the petition of the People’s Representative Council regarding an alleged violation by the President and the Vice President according to the Constitution. Keywords: Human Rights, Constitutional Law, Amendment to the Constitution.

Abstract

Salah satu lembaga negara yang muncul melalui perubahan ke-tiga UUD 1945 antara lain adalah Dewan Perwakilan Daerah (DPD), Hadirnya DPD dalam struktur ketatanegaraan di Indonesia diatur dalam Pasal 22C dan 22D UUD 1945, tujuan dari pada pembentukan Dewan perwakilan Daerah (DPD) semula dimaksudkan dalam rangka mereformasi struktur parlemen indonesia menjadi dua kamar (bikameral) yang terdiri atas DPR dan DPD, Akan tetapi, ide bikameralisme atau struktur parlemen dua kamar itu mendapat tentangan yang keras dari kelompok konservatif di panitia Ad Hoc Perubahan UUD 1945 di MPR 1999-2002, sehingga yang disepakati adalah rumusan yang ada sekarang tidak dapat disebut sebagai menganut sistem bikameral sama sekali. Dalam ketentuan UUD 1945 dewasa ini, jelas terlihat bahwa peran DPD tidaklah mempunyai kewenangan yang sama dengan DPR terutama dalam membentuk undang-undang. Kata Kunci: Amandemen, Dewan Perwakilan Daerah, Sistem Bikameral

Abstract

The development of currency trading is not only using the cash as a payment instrument for a transaction. For example is the emergence of non-cash payments such as negotiable instruments. That type of instrument offers a more effective and safer way than using the cash. Along with the development of the technology, a non-cash payment innovation emerged, which characteristics, at a glance, similar to negotiable instruments, such as credit cards, debit cards, and electronic money products which gives a safer and more efficient way than using the cash for a transaction. Based on this, led to the view that non-cash payment instruments such as credit cards, debit cards, and electronic money products can be classified as negotiable instruments. However, that classification must be done by reviewing the relevant regulations, such as Commercial Code and else and also observing the doctrines in the perspective of the science concerned, to state that the development of such instruments can be classified as negotiable instruments or not.Keywords:    Negotiable instruments, Letter of Value, Credit Cards, Debit Cards, Electronic Money Products, Classification.

Abstract

Legal protection for debtor as a consumer in banking becomes important which the position of the some parts of credit contract is not balanced. Bank prefer to have a strong bargaining position, so the bank based on the reason of efficiency makes standard contract contain exoneration clause that incriminating debitors. The Government’s Determination Law No. 8 of 1999 on Consumer Protection has been set up the opposition to banning the use of the standard contract. Similarly, the Financial Services Authority (FSA)/ Otoritas Jasa Keuangan (OJK) carried out a function of supervising the financial institution has issued POJK No. 1/POJK.07/2013 on Consumer Protection of Financial Services Sector. The regulations issued to protect consumers especially financial services sector. The result showed that credit contract of the commercial bank in Bandar Lampung still contains exoneration clause that prohibited on The Government’s Determination Law No. 8 of 1999 on Consumer Protection and OJK Regulation No.1/POJK.07/2013 on Consumer Protection of Financial Services Sector. There is a clause that requires the debtors to submit all bank’s guidance and regulations, either already exist or will be set later. The legal consequence of the implementation of exoneration clause in credit contract is the contract can be canceled by law as mentioned in Article 18 paragraph (3) The Government’s Determination Law No. 8 of 1999 on Consumer Protection. The legal protection of debtor as a consumer of banking service has been arranged by the regulations, but the implementation has not effective because still there are abuses by the bank. Therefore, the active role of Financial Services Authority to conduct monitoring and providing strict sanctions to banks that violate the rule. Furthermore, need education for community and have to make a format of standard contract that compatible with rules which formulated by the Financial Services Authority (FSA)/ Otoritas Jasa Keuangan (OJK). Keywords: Exoneration, Clause, Customer Protection, Standard Contract

Abstract

The demand for changes in law sector (political law), particularly in maritime and fishery sector, have the consequences of changes to happen. Thus, can be observed for the last 24 years (1985-2014) and has been changed twice, respectively, Law Number 9 of 1985 on Fishery, Law Number 31 of 2004 on Fishery and Law Number 45 of 2009 on Fishery. The changes shows that laws are made to suit society needs and social development, based on theories and law changer aspect. Fishery crime in Indonesia’s territory are dominated by IUU fishing (Illegal, Unreported and Unregulated Fishing). The even rising number of illegal fishing crime that caused financial less to Indonesia has made the government to produce law instruments outside of laws concerning fishery in order for enforcement of law and justice. Keywords : political law, law enforcement, and illegal fishing

Abstract

Children are people who have physical or mental limitations. Limitation understand everything, tends to bring negative influences into themselves and can cause it to do damage (juvenile delinquency) or even become perpetrators of delinquency (a criminal offense). Law No. 3 of 1997 on Juvenile Justice (Juvenile Court Act), in principle, was born to protect and nurture children in conflict with the law (ABH). However, it was legally incapable angle Court Law provide legal protection against the ABH. Thus was born the amount of number 11 of 2012 on the Criminal Justice System Child (Law SPPA) to replace the Juvenile Justice Act. In the case of change of the Act there are striking differences in issues related to children in the examination of the case law SPPA. The purpose of this paper are: first, to determine the child's examination of the case in court demanding the setting ABH Court Law Act with SPPA angle.
