Abstract

Humanitarian intervention is an attempt to prevent or stop the gross human rights violations with particular strengths (diplomatic and military) in a State, either with or without the consent of the State (countries with internal conflict). The problems in this journal are: first, how the arrangement of international law on humanitarian intervention. Secondly, the role of the UN in humanitarian intervention in armed conflicts. The method used is a normative legal research methods with the main source of data collection procedures is a legal substance that contains of normative law. The results showed that the rules of international law on humanitarian intervention by the United Nations stipulated in the UN Charter and general principles of international law. Humanitarian intervention legally justified by following provisions in applicable international law, namely Articles 39-51 of UN Charter. While the role of the UN in humanitarian intervention in armed conflicts carried out by the Security Council as the organ of the United Nations in maintaining peace with the decision issued in the form of a resolution for areas experiencing conflict. Therefore, it takes an international treaty that regulates clearly about humanitarian intervention, so that in practice, remain consistent with the objectives and executive organs of humanitarian intervention. Keywords: Humanitarian Intervention, Security Council of UN, Armed Conflict.

Abstract

The principle of sustainable development in environmental management is a principle that was born out of responses to the serious environmental damages and give bad effects for human survival, the more damaged of the environment, the higher the threat to humanity itself. Therefore, development is a process of fulfilling human needs that supported on the carrying capacity of the optimal environment. Thus, the higher carrying capacity of environment makes the better stability for human life, conversely the higher human needs in life should be supported by the data support of good environment, so that it can function as a life supporting system. In the implementation, the principle of sustainable development has experienced the complex problems in implementing the balance of human life needs and also the environment, as a result, the environmental damage becomes severe and seemed not able to overcome, people assume that natural resources is the material that should be exploited for fulfilling the human needs. Therefore, environmental management geared to optimize natural resources as a supplier of material needs. By paying attention to that concept, then, environment is seen as a mere object, in turn, the environment can not be saved. Where as the concept of sustainable development requires a balance between human needs and environmental capacity. Hence, the future generations also have the right to enjoy a good and healthy environment as part of their human rights in the future. If the present generation does not pay attention those things, then, the present generation can be said violating the human rights of future generations. Keywords: Problematic of Applying the Principle of Sustainable Development, Human Rights.

Abstract

The Nigerian legal system is pluralistically consisting of statutory law, which is derived from received English law and native customary law. The latter is made subservient to the former through the validity tests. This paper examined the position of the two regimes on the meaning and definition of the child and the legal consequences that arise from it. The paper found that while the two legal regimes conceptualize the ‘child’ differently, there is an acute internal divergence of who a child is, within each of these regimes. The paper recommended both the internal and inter-systemic harmonization of the meaning and definition of the child within the Nigerian legal system. Keywords: Nigerian Child, Customary Law, Statutory Law, Validity Tests, Child’s Rights Act

Abstract

The business world today has grown indefinitely so as to break through the dimensions of human life and behavior of the economy into banking minded and change the values and aspects of the business itself, either legally or sociologically. Business development with the pattern and any system can not be separated from the financial institution whose name the bank. Banking deregulation undertaken by the government has been precise to support the economy in order to develop better. With the enactment of Law Number 10 of 1998 concerning amendments to the Law Number 7 of 1992 on Banking, is an opportunity and provide an opportunity for Muslims to establish a bank based on Islamic Shari'a, as support to the business world and the economy of the people. Abstract

Genetic Resources is a foundation of human life, as a source of food, industrial raw materials, pharmaceuticals, and medicines. From its utilization may provide a financial benefit to the provider and the user of it. Unfortunately, most of it obtained from developing countries through biopiracy, including Indonesia. Furthermore, in the early 1980s, access and benefit sharing (ABS) to genetic resources became an international issue. It leads to the adoption of the Convention on Biological Diversity (CBD) in 1992. However, since it was approved, the whole ideas of excellence of it could not be implemented, a problem on it still arises. Intellectual property right laws, in certain aspects, are possible for using to protect traditional knowledge from their utilization. However, at the same time, intellectual property regime also becomes “a tool” to legitimate of biopiracy practices. Due to massive international pressure, mostly in developing countries, it proposes two kinds of protections, which are positive protection and defensive protection. This paper will examine one of it, which is positive protection. By using the normative method and qualitative approach, this paper identified at least two kinds of positive protections that we can develop to protect genetic resources related to traditional knowledge, which are optimizing the patent law and developing the sui generis law. Furthermore, it can be done by some revision by adding new substances, an improvement on the articles, or even by doing the deletion on certain articles. Moreover, in order to develop the sui generis law, it identified several minimum elements that shall be contained on it, inter alia: the purposes of protection; scope of protection; criteria of protection; the beneficiaries of protection: the holder of traditional knowledge; the kind of rights to be granted; how the rights acquired; how to enforce it; how the rights lost or expired; and dispute resolution.  Keywords: Positive Protection, Genetic Resources, Traditional Knowledge.

Abstract

Recognition of the existence of legal values and sense of justice that life is constitutionally recognized as the author explained earlier. One of the key concepts that evolved form of legal recognition or live in the community is the adoption of the system of sanctions in customary law (customary criminal) in the national legal system. Recognition and protection of sanction customary law becomes an important thing in the life of indigenous peoples, for the customary sanctions, then it can be constructed or create a balance and social harmony, interests between the human race and the individual, between the alliance (group) and wider society that is the basis from the minds of traditional Indonesian nation. Recognition of the importance of values in society as customary law (customary criminal) in the renewal of the national criminal law as the national law reform agenda is a necessity and demand to the fulfillment of social justice in accordance ideals of the Indonesian nation.Keywords: Customary, Existence, Criminal Law Reform

Abstract

The Identity Politics of Sunda Wiwitan community, which nowadays is rated as a form of self-preservation to meet the economic needs of families, has been considered to get restraints from the state. The economic needs make the identity politics as a means to save oneself. The Identification card, which is known as KTP and in which there is a religion column, has created discrimination of the identity for the Sunda Wiwitan Community (KSW). The KSW still runs the obedience to the teachings of the ancestors but to save the economy, the status of the religion is willingly written to be recognized as other religions by the state. There is no other way to save the economic life for the sake of the family survival than to fill in the religion column with the state-recognized religions. The situation is certainly influential for the KSW against other identities such as marriage and education cards. The discussion uses the result that comes from the interviews and some literature. Then the result becomes something ideal for KSW to save themselves in the economic field by changing the identity on the ID card. It is the way from KSW in passing the identity politics to meet the economic needs while the other side becomes the weakness of the Indonesian national law that does not provide any space for KSW in order to have equal opportunity as the Indonesian citizen.  Keywords: The Identity Politics, KSW, Constitutionality.

Abstract

Lahirnya Undang-undang No.  22 Tahun 1999 tentang Pemerintahan Daerah UU No.  25 Tahun 1999 tentang Perimbangan Keuangan Antara Pemerintah Pusat dan Daerah,  ternyata menimbulkan berbagai persoalan khususnya dalam perkembangan pajak Daerah dan terutama Retribusi Daerah.  Kedua peraturan tersebut menjadikan Daerah seakan berlomba-lomba menciptakan jenis retribusi Daerah Terbitnya Peraturan Pemerintah(PP)  No.  25 Tahun 2000 tentang Kewenangan Pemerintah Dam Kewenangan Propinsi Sebagai Daerah Otonom ternyata bukan sebagai solusi bagi perkembangan pajak daerah dan retribusi daerah.  Akibat terbitnya PP yang multitafsir ini menjadikan Daerah Kabupaten/Kota menganggap semua kewenangan yang tidak tertulis dalam PP imi merupakan kewenangan yang bagi kedua Daerah itu.  Akibatnya,  di berbagai Daerah terutama otomatis Kabupaten/Kota bermunculam Perda tentang retribusi Daerah baru yang berkaitan dengam kewenangannya yang tidak diatur dalam PP itu.  Kata Kunci Perda,  Retribusi Daerah,  Evaluasi Terhadap Perda

Abstract

This research begins with the number of liquid vapor which spread in Indonesia that is not licensed by BPOM, and there is no clear law for liquid vapor, so there is no clarity from legal protection against liquid vapor consumers who are not licensed by BPOM. Therefore, in this research, the formulation of the problem is as follows: Is there legal protection against liquid vapor consumers who are not licensed by BPOM? The purpose of this research is to determine whether there is legal protection against liquid vapor consumers who are not licensed by BPOM. So this research can be useful for subsequent research that has the same theme and beneficial to researchers, liquid vapor consumers and also for the government. The research method used is the normative method. Normative research methods use the statute approach. The result of the research shows that there is a legal protection for liquid vapor consumer who is not licensed by BPOM, which is reviewed from the Law of the Republic of Indonesia Number 36 Year on concerning the health of Article 113 paragraph (1) and Article 114, Law of the Republic of Indonesia Number 8 Year 1999 on Consumer protection Article 8 paragraph (1) c and paragraph (1) i, Regulation of the Head of the Food and Drug Supervisory Agency of the Republic of Indonesia Number 4 Year 2017 on the Supervision of the Importation of Drugs into the Territory of Indonesia Article 4 paragraph (1). Keywords: Legal Protection, Consumer, Liquid-Vapor
