Abstract

Legal sanction of Kesepekang is a moral sanction that has been a habit in Balinese custom society and has been done from generation to generation, both the one in Bali and outside Balinese custom society. The implementation of Kesepekang sanction currently is considered by the intellectuals of Balinese custom society as a behavior that violates social values in society. In its development, legal sanction of Kesepekang has been politicized as a factor causing the occurrence of custom society disharmony, both the one in Bali and outside Bali. This society resistance has weakened the function of Balinese customary law sourced from one of Hinduism belief which is “believing the presence of karmaphala (result from behavior) law.” The issue occurring in Balinese custom society, especially the one in the Province of Lampung, is “whether the legal sanction of kesepekang is still relevant if it is applied in Balinese traditional system.”  Based on the observation result, the term of Kesepekang is the attitude of “silence” that is done by the other members of customers who do not obey the customary regulations in their groups. Certain groups consider that the legal sanction of Kesepekang has violated human nature as social beings. To prove this argument, a study entitled: Legal Sanction of Kesepekang in Balinese Customary System–(In Perspective: Empiricism Theory of David Hume) is conducted. The result of the study can be concluded that the legal principles in Kesepekang sanction are the law of causation (causality), which each action certainly affects “when doing good, the result will be good – when doing bad, the result will be bad.” In the perspective of David Hume’s Empiricism theory, Kesepekang sanction is a sensory experience that occurs in custom society. Experience, according to David Hume, is the only source of knowledge, so the act of “silence” done by the member of custom as the effort in giving punishment to the member of customer who does not obey is a reality received by sense as an experience. Keywords: Kesepekang Legal Sanction, Empiricism Truth Theory

Abstract

AbstractThe role of the people is needed to the achievement of development, because the success of development in a country is how the government determines empowerment models to community. Local government policy in the construction of having partnership with implement measures serious. Furthermore Indonesia will deal with public of the ASEAN economic MEA) on 2016, aimed at as an effort to to increase stability the economy in ASEAN. This gave rise to problems of them how policy as well as the anything that becomes obstacle strengthening for the coastal communities by the provincial governments East Java. The research is the qualitative study to the source of the data in the form of a source of primary and secondary data. Research locations in East Java which includes several districts whose were selected purposively. Primary and secondary data collected through a method of interactive and non interactive and analyzed by using analysis interactive and flows. Required continuity between the local government and communities to the face challenges MEA. Disquiet fishermen when it comes to develop businesses is where marketing their products. Lebih lagi Indonesia akan menghadapi Masyarakat Ekonomi ASEAN (MEA) pada tahun 2016, yang bertujuan sebagai salah satu upaya untuk meningkatkan stabilitas perekonomian di kawasan ASEAN. Memunculkan masalah diantaranya bagaimana kebijakan serta faktor apa saja yang menjadi kendala penguatan bagi masyarakat pesisir oleh Pemerintah Provinsi Jawa Timur. Penelitian ini merupakan penelitian kualitatif dengan sumber datanya berupa sumber data primer dan data sekunder. Lokasi penelitian di Jawa Timur yang meliputi beberapa kota/kabupaten yang ditentukan secara purposive. Data primer dan sekunder dikumpulkan melalui metode interaktif dan non interaktif serta dianalisis dengan menggunakan analisis interaktif dan mengalir. Diperlukan kesinambungan kerjasama antara pemerintah daerah dan masyarakat guna menghadapi tantangan MEA. Keresahan nelayan ketika ingin mengembangkan usaha adalah tempat pemasaran hasil produknya. Pemerintah daerah harus membuat regulasi terkait sistem resi gudang guna memangkas jalur tengkulak yang sangat mematikan hasil usaha nelayan dalam menjamin ketersediaan modal usaha untuk produksi yang berkelanjutan; mengendalikan ketersediaan kebutuhan pangan daerah dan menstabilkan harga komoditi. Kata Kunci: Nelayan, Pemerintah Daerah, Masyarakat Ekonomi ASEAN, Resi Gudang

Abstract

The rise of oligarchy in political democracy in Indonesia has more potential to exterminate democracy in Indonesia itself. Democracy might be used as just a tool by the oligarchy. Oligarchy is the cause that some immature politicians with a very short experience are now holding vital positions such as regents, a party leader, or local parliament member. Abstract

Sometimes Civil Service Police acts reactively or repressively without heed to civil rights in doing their operation. Then, Bandar Lampung government has to provide a proper place for street vendors as per local Regulation (The Law Number 8 of 2009). In order to prevent any clashes between civil service police and people in society, especially street vendors, there are several things which need to be done: (1) quality of human resource in civil service police unit need to be improved; (2) Civil Service Police need to use persuasive approach in performing their job; (3) local regulation needs to be aligned; (4) local regulation has to be enforced continuously and appropriately. Keywords: Civil Service Police Function, Local Regulation Enforcement

Abstract

The main problem of farmers in Indonesia today is the limited availability of agricultural land. The government gives farmers hope for the availability of agricultural land, through various accesses of forest resources. One of them through a partnership with forest managers. This study will examine the model of forest resource access arrangements and their implementation in Register 45 Sungai Buaya Lampung by Moro-Moro farmers. This study uses a socio-legal approach. This approach combines the study of doctrinal law with social studies. Data required primary data and secondary data. So the analysis is not only based on normative rules but also pay attention to social context.This research shows that forest resource access management model registers 45 Lampung to Moro-Moro farmers is a partnership model. Partnerships offered by forest managers have not provided welfare security to farmers. Forest managers have unilaterally determined types of crops and production sharing balances. The partnership process closes dialogue with farmers. The implementation of this partnership has not been implemented, as most Moro-Moro farmers reject the partnership model offered by forest managers.Keywords: Forest Resources Access, Farmers, Moro-Moro.

Abstract

The Islamic Banking has been growing significantly in Indonesia. However, studies discussed the detail of the roles and the influences of the political parties in the parliament towards the formation and the development of the Islamic Banks had been limited. Due to this condition, this paper aims at discussing the roles and the influences of the political parties in the parliament towards the formation and the development of Islamic Banks in Indonesia. The method used to examine the above issues is by conducting desk research. Data and information collected are from the secondary sources and the empirical studies advanced in the literature. The study argued that the Islamic banking had been given a social and economic contribution to the Indonesian economy. However, support for the formation and development of this bank is still limited. For that reason, it is a must for the Government of Indonesia in general and the Bank of Indonesia in particular to support the development of Islamic bank. Also, the role of the political parties in the parliament was also considered important. Abstract

The formulation of problem in the implementation of inclusion in handling corruption case has reflected the legal objectives which are legal certainty, justice, and expediency, and inconsistency in implementing the inclusion in handling corruption case, the purpose of the research is To find out and analyze the application of inclusion in handling corruption case has reflected the legal purposes which are legal certainty, justice and expediency and To find out and analyze the inconsistency in applying of inclusion in handling of corruption case, using empirical research method which resulted that there is indication that the implementation of inclusion is not yet implemented which causing inconsistency of law enforcement officer, i.e., Police, Attorney in applying the article of inclusion in handling of case corruption and inconsistency in the application of inclusion in corruption cases causes the occurrence of discrimination in the process of law enforcement, so that does not reflect the legal purpose of legal certainty. It is recommended that to create legal objectives, law enforcement officers must be consistent in applying the articles of inclusion in the handling of corruption cases and to achieve legal certainty should investigators, and prosecutors apply the juridical participation in corruption cases. Keywords: Implementation, Inclusion, Corruption Case

Abstract

Two things become an important part of studies in Indonesian law related to energy management. The first, related to the management of natural resources. Second, the energy sector is also related to other sectors, that is forestry, water resources, marine and fisheries, agriculture and plantations, as well as land. Ideally, all of the energy management law must reflect the state ideology, as natural resources energy must be managed for the greater prosperity of the people. Energy should not be administered arbitrarily because, in addition to the utilization, the existence of natural resources should not be separated from the philosophical orientation of Indonesian legislation, Pancasila, and The 1945 Constitution. However, the reality of energy legislation indicates of the authority competes between sectors and alignments to society which is not optimal. It is due to the legal nature of the energy sector which is liberal and still-exploitation oriented and pro-capitalist. By using a socio-legal approach, this paper describes the reconstruction of law-oriented to the Indonesian legal system in energy management based on Pancasila and the 1945 Constitution as the foundation and soul of the energy sector law. Keywords: Reconstruction of Law, Energy Management, the Indonesian Legal System.

Abstract

The Harmonization of the Authority between Supreme Court (MA) institutions The Constitutional Court (MK) and Judicial Commission (KY) is a must. It is done by way of revision of the Law of the Supreme Court, MK and KY for the harmonization of authority. However, if the revision finds a dead end, then the fifth amendment (5) of the 1945 Constitution of the State of the Republic of Indonesia (UUDNRI 1945) is limited to be reconstructed by the provision of Article 24B paragraph (1) of the 1945 Constitution by affirming the authority of KY clear so that it is not considered to interfere with judicial power. The harmonization can be done by adding an institution that oversees the authority of the Constitutional Court by performing reconstruction in Article 24B paragraph (1) so that there is no more tendency of absolute power. Abstract

The Audit Board of Indonesia performs audits on the management and the accountability of state finances, including those implemented by State-Owned Enterprises. This study aims to see the synchronization of various regulations related to the authority of Audit Board in performing state-owned enterprises audit, as well as the audit conducted by the Audit Board on state-owned enterprises in the period of 2012-2017. This research is conducted by using normative legal research method, and data collection are done through library research to find relevant data. Based on the analysis, it is known that first, the regulation of Audit Board authority over state enterprises has been synchronized in several Acts. The audit conduct by The Audit Board is the attribution authority derived from the 1945 Constitution and further regulated in Acts. Second, the implementation of state-owned enterprises audit period 2012-2017 implemented against Persero and Perum with three types of audit, namely financial, performance and a specific purpose audit. Keywords: Audit Board of Indonesia, State-Owned Enterprises, Audit on State Finance
