Abstract

Penelitian ini berupaya untuk mengkomparasikan antara pernikahan dalam agama Islam Katolik. Perbedaan dari keduanya yang paling substansi adalah keyakinan adanya monogami dalam Islam walaupun tidak mutlak sedangkan menurut Katolik juga meyakini adanya monogami tetapi secara mutlak.sedangkan persamaannya dapat di lihat dari hakikat perkawinan bertujuan untuk menghindari perzinahan dan penyimpangan seksual maka pernikahan diperlukan untuk mengekspresikan cinta kasih dan hasrat seksual kodrati manusia, serta meneruskan generasi berikutnya serta untuk menjaga kehormatan manusia

Abstract

The Indonesian nation is a pluralistic nation, especially in religiosity. This is becoming a nation is rich in differences. The fact that it can not deny, that, the existence of normative standards that are owned by their respective religion. These religious norms when viewed at a glance, only to the extent of universal teachings and values of religious open to consensus. However, if further review, in these religions there are also religious norms that are partial-specific, such as religious doctrine, which is certainly difficult strived occurrence of a harmony. This is based on the reality that everything must be followed by a doctrinal interpretation, and in turn will establish religious fanaticism among his people. Of this fact, it can be ascertained that the conflict across religious doctrine among the adherents of a religion will continue. Hence, it is necessary to build an awareness of the plurality of religions in this country. Pancasila as the nation's basic philosophy is the ideal model of a plurality basis, Pancasila is a result of the contemplation of the founding fathers of the open-minded and tolerant in religion and was the embodiment of traditional values and cultural heritage. Order to create a harmonious and democratic life in this country, it is important to review the Pancasila as the foundation of religious plurality in Indonesia. Pancasila is the objectification of the universal values in every religion and belief, Pancasila is the philosophical basis of the intersection or along the Indonesian people in religion, with the supreme deity, please indicate that this nation with living up to her religion, Indonesia has one the same religiosity, namely joint recognition of the supreme deity. Pancasila is a social contract and state and nation.

Abstract

Penelitian ini bertujuan untuk mengidentifikasikan peran perempuan Samin dalam ketahanan nilai-nilai kejatmikaan di Kabupaten Bojonegoro. Berdasarkan hasil penelitian mengungkapkan bahwa kandungan nilai-nilai ajaran kejatmikaan Samin diantaranya adalah pengendalian diri, beribadah dan menghormati, mawas diri dan menyelaraskan, adanya bencana merupakan cobaan, memegang budi sejati. Sifat pengendalian diri dengan nafsu. Pengendalian diri mengajarkan jangan sampai hidup dengan memprioritaskan kehendak nafsu belaka. Sifat menghormati ke sesama makhluk Tuhan merupakan wujud toleransi. Selain itu, manusai harus mawas diri tehadap lingkungan sekitar. Hidup menyatukan dengan alam menjadi kekhasan dari ajaran ini. Ajaran kejatmikaan berhubungan erat dengan sifat Ketuhanan. Semua cobaan datangnya dari Tuhan. Konsekuensinya yaitu sebagai manusia harus memiliki jiwa kesabaran yang kuat. Abstract

Peradilan Agama is a court of Islamic Community in Indonesia and regarded as one of court for people who are seeking for the justice, especially after the ratification of Islamic Court Law Number 7 in 1989. The aim of the ratification this Islamic Court Law is to unity and to terminate the variety source of regulation that regulate structure, competency and procedural law of Islamic Court in Indonesia. Nevertheless, until now, there are still many source of regulation, even though that Islamic Court Law had been modify and revised by Ordinance Number 3 in 2006. Ironically the rule of Section 54 of Islamic Court Law still enforce procedural law of national court which its source is very multifarious, beside the very minimum special procedural law were ruled. As a result the source of procedural law in Islamic Court is still multifarious. The variety source of Islamic Court Regulation, especially procedural law, caused many problems and contradictions. On one side Peradilan Agama is a national court that must be compatible with nationality spirit but in other side so Peradilan Agama is Islamic Court that should always obeys Islamic norms and codes that sometimes not compatible with nationality spirit and impossible to synchronize. This paper concern about this issues and attempt to analyze from the law and regulation way of view that completed with fiqh analysis.

Abstract

Kajian dalam Ilmu Fiqh seringkali berada pada posisi benar-salah, halal-haram, dan seterusnya. Sementara hari ini, kita berada pada kontruksi budaya dan kondisi sosial yang sangat majmuk. Oleh karena itu, menjadi sangat penting untuk mengembangkan sebuah rumusan fiqh yang dibangun di atas basis kemajmukan itu sendiri, yang mengakui perbedaan serta menempatkan perbedaan tersebut dalam kesederajatan dan toleransi. Dalam bidang fiqh, wawasan multikulturalisme ini harus dibangun secara metodologis dengan cara mengembangkan paradigma tafsir sosial Islam yang mengedepankan pemaknaan-pemaknaan yang dinamis, progresif, dan toleran. Dalam hal ini, fiqh multikulturalis dapat dibangun di atas dasar prinsip mashlahah dengan menggunakan pendekatan maqashid al-syari’ah. Konsekuensinya, nilai-nilai al-Quran yang bersifat universal dipandang sebagai nilai yang bersifat substantif ketimbang nilai yang bersifat lokal-partikular. Karena itu, dengan pendekatan maqashid al-syari’ah, maka nilai keadilan, kemaslahatan, kesetaraan, hikmah-kebijaksanaan dan cintah kasih dianggap sebagai nilai yang paling utama yang akan menjadi sumber dan inspirasi tatkala al-Qur`an menjelaskan ketentuan-ketentuan sebuah kasus hukum tertentu (legal-spesific). Nilai-nilai yang bersifat universal inilah yang lebih relevan untuk dijadikan sebagai basis permusuan fiqh multikulturalis, karena nilai-nilai universal ini mampu menjangkau seluruh aspek kemanusiaan tanpa memandang perbedaan ras, agama, warna kulit, budaya dan sebagainya

Abdul aziz Sachedina invited to browse the existence of the Islamic religion in the public square level. Debate on whether Islam as a guidance or governance becomes important glasses to see the reality of social life of religious communities. The conflict in the name of religion into the wider community unrest. Therefore we are talkative to restore life to the problems of religion, the conflict would be returned to religion. But, reality of religion can not answer these problems, not because religion is not able to answer it. Abstract

In the al Quran at least there are 164 verses of jihad war that led to the people to get the glory and give spirit to fight and defend of Islam presence before the non-Muslims. This paper will need to frame verses in the context of inter-religious harmony in which Muslims live in close proximity to each other in many aspects. Frame basis and the principle is the interpretation, the spirit of life that is safe and peaceful and the attitude of Muslims in view of contemporary reality
