Abstract

In the 13th century BC Heliocentric concept presented by the Greek philosopher: Aristarchus. But the theory is still a hypothesis, and contrary to the opinion of Aristoteles. Heliocentric theory has not been able to replace Geocentric one, especially with the emergence of Ptolemy (140 AD), known as a pioneer of the Geocentric theory, who wrote a big book titled Almagest which astronomers have refered for centuries. But after Nicolaus Copernicus wrote a book with the title De Revolutionibus Orbium Coelestium, his published heliocentric theory, and finally It was able to undermine Geocentric theory that has long been established. Qur'an which was revealed long ago before this theory has been presented, has explained the astronomical concept such us motion of earth, that aligned with the Heliocentric theory. In the Qur'an there are some verses of earth, moon and sun, among others: Surat Yūnus: 5, al-Naml: 88, Yāsīn: 38, dan 40, al-Anbiyā’: 33, Āli ‘Imrān: 190. According to the exegete such Aḥmad Musṭafā al-Marāghī in his book Tafsir al-Marāghī, that the Heliocentric theory was the one that inline with the Qur'an,and that the Heliocentric theory is a part of the miracle of the Qur'an.

Abstract

The development of the feminist movement has significantly demonstrated in the history of the Nahdlatul Ulama’ (NU) organization. In the midst of the discriminatory issues against women and gender mainstreaming bias, NU consciously and courageously opens up to make space for an expanded discussion of the role of women even in the area of Islamic law (fiqh), which is considered sacredly. Not only in theoretical-normative, but also NU showed consistency in the implementation for the ideas of women roles in the public sphere significantly, although a number of issues is still on the agenda of feminist struggle in the Muslimah community, such as violence against women in the household (domestic violence) and gender mainstreaming issues in a variety of positions in the executive, legislative, and judicial branches of government as well as other strategic institutions. The certain thing is that the feminist movement in Indonesia showed a significant effect on the changes in the political, social, legal, and economical areas.

Abstract

Unification of the Islamic calendar was much needed and is a major requirement for Muslims today in the running of worship. Uniformity in to worship and celebrate Islamic holy days is something that has been long awaited. An expectation of the Islamic calendar is determining who has the certainty that a better and more organized for various purposes. However, it is in conflict with a different concept of the new moon from several groups paradigm respectively, both from the perspec tive of science and religion. Hilāl is one of the main sources in the preparation of the I slamic calendar. Currently, the definition of the new moon is very diverse. Which d efinition is used for the initial determination new month of hijriyah, both from the perspective of astronomy or fiqh, or combination of them. Therefore, the article is devoted to the redefinition of the concept of the new moon from the perspective of science and fiqh, that synergy occurs between fiqh and the astronomical new moon to determine new month of Islam. So that the unity of the Islamic calendar can be realized well.***Penyatuan kalender Islam sangat dibutuhkan dan merupakan syarat utama bagi umat Islam saat ini dalam menjalankan ibadah. Keseragama n dalam beribadah dan merayakan hari besar Islam adalah sesuatu yang telah lama ditunggu. Harapan atas kalender Islam adalah sebuah kalender yang memilikikepastian (akurasi) lebih baik dan lebih terorganisir untuk berbagai keperluan. Namun dalam realitas terdapat perbedaan pandangan tentang konsep bulan baru oleh beberapa kelompok, baik dari perspektif ilmu pengetahuan maupun agama. Hilāl adalah salah satu sumber utama dalam penyusunan kalender Islam. Saat ini definisi bulan baru sangat beragam, padahal definisi inilah yang digunakan untuk penentuan awal bulan ba ru Hijriyah, baik dari sudut pandang fikih astronomi atau kombinasi dari mereka. Artikel ini difokuskan untuk mendefinisikan kembali konsep bulan baru dari sudut pandang ilmu pengetahuan (astronomi) dan fikih. Abstract

This article aims to discuss the issues of the relationship between Islam and state in the Islamic political perspective in Indonesia. This study was motivated by the desire to criticize the development and “up and down” relationship between Islam and state that is very dynamic coloring political situation in “Islamic majority country” Indonesia. This article concluded that understanding the relationship between religion and state with Islamic political approach is not meant to establish a religious state or an Islamic state of Indonesia, but more on filling spaces are functionally religion in order society, nation and state. The relationship between Islam and state can be integrated in a functional relationship equally aspire to nobility. Even integralistic, symbiotic, and secularistic relations, each should be viewed as a form of complementary. Facing the development of modernization, the relationship between Islam and state should be articulated as an effort to always adapt to the development of society in its various aspects, such as: the globalization of the world political economy, science and technology, the development issues of democracy, gender, human rights, pluralism, both nationally and internationally.

Abstract

Mosque Welfare Agency (BKM) Semarang and Pekalongan Muslim Foundation (YKMP) is a nāẓir of productive waqf land. Management of waqf performed by BKM Semarang has not given the expected results, while the management of waqf by YMKP has given results as planned. The main question in this research is what are the factors of success and failures of both institutions in managing of productive land waqf? The answers are measured using two parameters: 1) The investment strategy by BKM Semarang and YMKP; 2) The organization's management of nāẓir of YMKP and BKM? This is a qualitative research with case study approach. Data is collected using observation, interview, and documentation. The methode of analysis is the comparative descriptive. The findings of this research are: 1) Investment of land waqf performed by BKM Semarang unproductive, while investment and distribution of land waqf performed by YMKP productive. 2) The organization's management of BKM in each function is not effective. While the organization's management of YMKP is effective.Badan Kesejahteraan Masjid (BKM) Kota Semarang dan Yayasan Muslimin Kota Pekalongan (YKMP) adalah nazhir badan hukum yang mengelola tanah wakaf secara produktif. Pengelolaan wakaf yang dilakukan oleh BKM Kota Semarang belummemberikan hasil seperti yang diharapkan, sedangkan pengelolaan wakaf oleh YMKP telah memberikan hasil seperti yang direncanakan. Pertanyaan utama dalam penelitianini adalah apa faktor keberhasilan dan ketidakberhasilan dari kedua lembaga tersebut dalam mengelola wakaf tanah produktif? Jawaban pertanyaan di atas diukur menggunakandua parameter: 1) Strategi investasi BKM Kota Semarang dan YKMP; 2) Manajemen organisasi kenazhiran BKM Kota Semarang dan YKMP. Penelitian kualitatif ini menggunakan pendekatan studi kasus. Pengumpulan data dilakukan menggunakanteknik observasi, wawancara, dan dokumentasi. Penelitian dianalisis dengan metode deskriptif komparatif. Temuan penelitian ini adalah: 1) Investasi tanah wakaf yang dilakukan oleh BKM Kota Semarang tidak produktif sedangkan Investasi dan pendistribusian hasil yang dilakukan oleh YMKP produktif. 2) Manajemen organisasi BKM Kota Semarang pada tiap-tiap fungsinya tidak berjalan efektif. Sedangkan manajemen organisasi YMKP telah berjalan cukup efektif.

Abstract

This study based on library research that discusses the legal status of women in the view of Ibn Ḥāzm. This study intends to answer three important questions; first, how the circumstances of the biography of Ibn Ḥāzm and socio-historical culture that surrounds his life; second, how the thought of Ibn Ḥāzm about the legal status of women; third, is there any thought of Ibn Ḥāzm relevance to the concept of gender in islamic law compilation (KHI). This research is expected to contribute at least in three points of view; first, examine the biography of Ibn Ḥāzm and educational history and culture surrounding his social life; second, describe Ibn Ḥāzm’s modern thinking with regard to the legal status of women; and third, discover the extent of the relevance of his thinking on gender discourse in KHI. Using istiṣḥāb, Ibn Hazm concludes that women and men have the same high legal status. This thought even beyond the perspective of gender, human rights, multiculturalism, pluralism and democracy that are still not familiar with Indonesian ulama’. This is among the arguments that claimed as the reason for the failure of the initiative of KHI Counter Legal Drafting (CLD).

Abstract

Waqf is one of Islamic philanthropy institutions which is supposed to be well managed in order to optimize its profits. One of the ways is providing an opportunity for thestakeholders to participate. In reality, nevertheless, the stakeholders’ participation in waqf is still considered low. This is due to the unawareness of the manager (nāẓir) in supporting the stakeholders to take part. Another cause is the stakeholders’ lack of knowledge about their rights in the management of waqf. This is the result of research that describes the forms and reasoning of stakeholder’s participation in waqf in Semarang, especially at Roemani Hospital, Foundation of Badan Wakaf Sultan Agung and Masjid Agung Semarang. This research is conducted with good governance approach that includes management dynamic, professionalism and agency representation.Lembaga wakaf seharusnya menerapkan tata kelola yang baik agar hasilnya optimal. Salah satu caranya adalah dengan memberikan kesempatan stakeholder untuk berpartisipasi. Tetapi dalam realitasnya partisipasi stakeholder masih rendah. Hal ini karena belum terbangun kesadaran pihak pengelola (nazhir) dan ketidaktahuan stakeholder akan hak yang dimilikinya. Tulisan ini merupakan hasil penelitian yangmendeskripsikan bentuk dan alasan partisipasi stakeholder dalam perwakafan di Kota Semarang, khususnya yang terdiri dari Rumah Sakit Roemani, Yayasan Badan Wakaf Sultan Agung dan Masjid Agung Semarang. Penelitian ini dilakukan dengan pendekatan good governance yang mencakup dinamika pengelolaan, profesionalitas serta keterwakilan lembaga.

Abstract

Calendar is an organizing system to calculate the time for a certain period. By convention, the day is the smallest unit of the calendar, while the measurement part of a day using timing systems (hours, minutes, and seconds). Some calendar systems refers to an astronomical cycle, follow the rules anyway. The concept of day used by most people on earth is the concept of the day where the day begins at midnight and the day started online within 1800 of the City of Greenwich. This qualitative study intends to analyze the determination of days in the Hijriyah calendar. The main problem is the disagreement about the start of the day and where the beginning of the day begins. In contrast to the international community in general, Muslims have several criteria to determine where and when the day begins in Islam. There are three opinions about the beginning of theday. First, the dawn as a benchmark of the start of the day. Second, the start of the day occurs when the setting sun. Third, the day began at midnight (00:00).Kalender merupakan sebuah sistem pengorganisasian untuk menghitung waktu selama periode tertentu. Secara konvensi, hari adalah unit kalender terkecil, sementara untuk pengukuran bagian dari sebuah hari digunakan sistem perhitungan waktu (jam, menit, dan detik). Beberapa sistem kalender mengacu kepada suatu siklus astronomi, mengikuti aturan yang tetap. Konsep hari yang dipakai oleh sebagian besar manusia dibumi adalah konsep hari dimana hari dimulai pada tengah malam dan hari dimulai di garis yang berjarak 1800 dari Kota Greenwich. Penelitian kualitatif ini bermaksud untuk menganalisis penentuan hari dalam kalender Hijriah. Masalah utama adalah perbedaan pendapat tentang awal hari dan di mana awal hari dimulai. Berbeda dengan masyarakatdunia pada umumnya, umat Islam mempunyai beberapa kriteria dalam menentukan dimana dan kapan hari dimulai dalam Islam. Ada tiga pendapat tentang permulaan hari. Pertama, fajar dijadikan patokan dari permulaan hari. Kedua, permulaan hari terjadi saat terbenamnya matahari. Ketiga, hari dimulai sejak tengah malam (pukul 00.00).

Abstract

Mediation as one of Alternative Dispute Resolution (ADR) is seen as a way dispute resolution humane and just. Humanist because the mechanism decision-making (the peace agreement) become the authority of the parties dispute and maintain good relations. Fair because each party negotiate to option a problem solution from his problem and outputs a win-win solution. Therefore, dispute resolution with litigation is becoming obsolete and people turn to mediation. Through the Supreme Court Regulation (Perma) No. 1 In 2008, mediation has been integrated into the proceedings in the court system. Every civil matters must completed first by way of mediation. Each judge's decision not by way of mediation first, the decision shall be considered null and void. This paper discusses the effectiveness of mediation in the settlement of divorce cases in the Religious Court Central Java, because of a divorce case is a matter of the highest ranks in the Religious Court. The focus of the study is the implementation of divorce mediation cases, mediation success standard divorce cases and the litigants public response to the peace efforts through mediation procedures

Abstract

Nushūz means a wife do anything against her husband for no reason that can be accepted by Islamic law (wife nushūz), or husband does not carry out its obligations as stipulated in Islamic law (husband nushūz). This article intends to analyze the concept of nushūz according to Islamic law in the perspective of Fakhr al-Dīn al- Rāzī in his Qur’anic commentary (tafsīr). It also discussed about the solutions of nushūz according to the Qur’an. Based on the study of sura al-Nisa verse: 34, 35, and 128 that nushūz can be done even by the wife or the husband. When problems of nushūz already potentially shiqāq, it is advisable to appoint a ḥakam (mediator), both from husband’s families and wife's families.Nushūz berarti seorang istri melakukan perbuatan yang menentang suami tanpa alasan yang dapat diterima oleh hukum Islam, atau sebaiknya suami tidak menjalankan kewajibannya sebagaimana ketentuan hukum Islam. Artikel ini bermaksud untuk menganalisis konsep nushūz menurut hukum Islam dalam perspektif Fakhr al-Dīn al-Rāzī dalam kitab tafsirnya. Selain itu juga dibahas tentang bagaimana tawaran solusi nushūz menurut al-Qur’an berdasarkan kajian terhadap surat al-Nisā’ ayat 34, 35, dan 128 bahwa nushūz bisa dilakukan oleh istri maupun suami. Ketika permasalahan nushūzsudah mengkhawatirkan sehingga berpotensi shiqāq, maka dianjurkan untuk mengangkat seorang ḥakam (mediator), baik dari keluarga suami maupun keluarga istri.
