Abstract

This article discusses the new paradigm of Islamic law which is offered by Muḥammad Shaḥrūr, one of the contemporary Muslim thinkers from Suria. The focus of study on this paper is an attempt to criticize the redefinition of the basic concepts of Islamic law in Shaḥrūr view. According to Shaḥrūr, redefinition basic concepts in Islamic law must be done as a starting point to develop a new paradigm of Islamic law which is based on anthropocentric approaches, —not theocentric approaches. Islamic law is civil law, democratic and positive. Therefore, it requires more realistic, elastic, and implementable definition. For Shaḥrūr, the existence of a new paradigm, such as the democratization of Islamic law is very urgent in the midest of the Muslim world today on the era of the nation state, constitutionalism and democracy, rapidly changing, and increasingly distant from the tyranny period

Abstract

Masdar Farid Mas'udi is famous as an eclectic scholar who produces Islamic thought (ijtihad), which is becomes a subject of conversation among thinkers of Islam in Indonesia. The discourse of zakat and tax integration actually is not something new, but substantially, his thoughts can be used as a consideration of zakat and tax policies in Indonesia, and even become enlightened understanding of Islamic substance in Indonesia. His thoughts on integration of zakat and tax caused controversy and quite diverse questions. This even seems “strange” because he wanted to unite two things that are different substantially and usefulness. However, if we understand his thought more comprehensively both its content and his method of ijtihad, it would seem that his real thinking about tax and zakat unification substantially, can be a problem solution of zakat and tax implementation for Muslims in Indonesia. This paper will present ideas, methods and the formulations of zakat and tax’s concept of Masdar Farid Mas'udi.

Abstract

This study aims to know the horizontal and vertical synchronization of legislation on interfaith marriage in Indonesia. This study is a part of normative legal research which is projected to examine the harmonization of legislation regarding interfaith marriage. The current approach of this research is legislation approach (statue approach) in which the data was collected by reciting the literature of primary and secondary legal materials. The next to analysis the data, the researcher examined them through horizontal and vertical synchronization.  And the last, the finding outs are :  the first, it horizontally occurs discrepancies between the regulation No. 1 of 1974 on Marriage and the regulation No. 23 of 2006 on Demographic and Civic Administration. According to the marriage regulation, interfaith marriage is prohibited meanwhile Demographic and Civic Administration regulation allows it. The second, vertically, between the Marriage regulation of the Government Regulation No. 9 of 1975 and Presidential Decree No. 9 of 1991 already contained synchronization that prohibits interfaith marriage. However, the Cross Marriage Regulation No. 158 of 1898 occurred discrepancies in where Marriage regulation prohibits people to do the interfaith marriage, meanwhile according to the Cross Marriage Regulation, interfaith is not a barrier to marry.

Abstract

Waqf is a Islamic economics social institution that has a very important role in the development of Indonesian society. However, the potential of the waqfhas not been fully explored and developed. Some causes are: lack of pu blic understanding of the importance of recorded waqf, its has not managed professionally, lack of profe ssional nāẓir and weakness of supervision and management of waqf. Therefore, supervision becomes something absolutely necessary especially for productive waqf. The nāẓirof waqfinstitutions must be willing to be audited, becaus e nāẓiris a person who have right to act on waqfproperty, also to take care of it, maintain it, develop and distribute the waqfrevenue to people who deserve it. In addition, in o rder to manage waqfproperly and accountability, supervision should be done by the g overnment and society, active and passive. In performing supervision of waqfmanagement, The government and society may ask some help to an independent public accounting firm. With tight and good supervision, waqf in Indonesia is expected to be managed more proper ly then the revenue can be used to empower society.***Wakaf merupakan salah satu lembaga sosial ekonomi Islam yang memiliki peranan sangat penting dalam pembangunan masyarakat Indones ia. Namun demikian potensi wakaf tersebut belum sepenuhnya digali dan dikembangkan. Beberapa penyebabnya adalah: lemahnya pemahaman masyarakat tentang penti ngnya pencatatan wakaf, belum profesionalnya pengelolaan dan manajemen wakaf, terbatasnya nāẓir yang profesional serta pengawasan dan pengelolaan wakaf masih lemah. Oleh karena itu pengawasan menjadi sesuatu yang mutlak dilakukan apalagi terhadap wakaf produktif. Suatu lembaga wakaf dalam hal ini nāẓir-nya harus bersedia untuk diaudit, karena nāẓirmerupakan orang yang berhak untuk bertindak atas harta wakaf, baik untuk mengurusnya, memeliharanya, mengembangkan dan mendistribusikan hasil wakaf kepada orang yang berhak menerimanya. Di samping itu agar wakaf dapat dilaksanakan dengan baik dan akuntabilitasnya dapat dipertanggungjawabkan, maka pengawasan harus dilakukan oleh pemerintah dan masyarakat, baik secara aktif maupun pasif. Dalam melaksanakan pengawasan terhadap pengelolaan wakaf,pemerintah dan masyarakat dapat meminta bantuan jasa akuntan publik independen. Dengan pengawasan yang ketat dan baik diharapkan wakaf di Indonesia dapat dikelola dengan baik sehingga hasilnya dapat dimanfaatkan untuk memperdayakan masyarakat.***Keywords: wakaf, manajemen wakaf, pengawasan, wakaf produktif, nāẓir

Abstract

This paper intends to review the basic concepts of crescent issue as the most fundamental concepts of the Hijri calendar systems. The crescent basic concept of ṭulū‘ al-hilāl, based on these principles: first, put the crescent as a matter of objective existence does not depend on the subject or observer, but the object itself. Second, the lower moon extremity as a conceptual reference for basic concepts. Third, the beginning of the lunar calender is based on crescent moon rising. This paper also tries to determine the cause of the beginning of lunar calender with the normative traditions of the prophet to analyze the visual sighting of the crescent and istikmāl from the philosophy of Islamic Law’s point of view. Normative cause of fasting Ramadan is not obligatory visual sighting of the crescent of Ramadan, but the rising of the crescent (ṭulū‘ al-hilāl). Visual sighting of the crescent and istikmāl and also Astronomy is a way to find out and make sure that the cause has occurred and they are not the cause by itself

Abstract

This paper aims to discover the truth of the authenticity of the Sunnah as the basis of Islamic law legislation. The problem lies on the "doubt" polemic of the existence of Sunnah considering the length of time from the time of codification. Namely, on how the Sunnah "made" and defended as genuine (authentic) sources derived from the Prophet. How did the position of the Sunnah in Islamic law legislation that he deserves obeyed. To find out the answer to these problems, this study analyzes literatures related with, both the "pro-Sunnah" and the "counter-Sunnah", both from the insider and outsider. The conclusion is that the question of the authenticity of the Sunnah always raises debate over writing, history, until the issue of trustworthiness to it. This problem not only sparked debate in relation Muslims and non-Muslims, even among fellow Muslims themselves.

Abstract

In Indonesia, frequently occured the differences on initial determination of islamic lunar month such as Ramadhan, Syawal and Zulhijjah. This difference can not be separated from the two major methods of determining begining of lunar month namely ḥisāb (calculation) and ru’yat (observing hilāl). Apart from debate between ḥisāb and ru’yat, another issue that is also often raises is applicability rukyah and ḥisāb, known as validity of maṭlā‘. Meaning of the maṭlā‘s concept now seen no longer adequate and unable to overcome that differences. For that reason, reinterpretation of the maṭlā‘s meaning is something that is very important. However it should be noted that reinterpretation should not be out of bounds from Shar'i limitation and on the other hand must involve basic science of astronomy so can make it more up to date and more easily accepted rationally.

Abstract

Al-Qur’an and Sunnah, needs of understanding and extracting optimally, so that the contents of law can be applied for the benefit of people. The way- to understand and to extract the contents in these two sources- called ijtihād. Thus, ijtihād is needed on istinbāṭ of law from many arguments of the texts (naṣ), eventhough it is qaṭ’ī in which the uṣūliyyūn have agreed that it is not the area for re-extracting to the law (ijtihādiyyah). The problem in this case is that even a qaṭ’ī argument according to the most of uṣūliyyūn has not been qaṭ’ī argument in the other uṣūliyyūn opinion. Reconstruction of ijtihād becomes an alternative, with some considerations: First, weight and tightening the requirements to become a mujtahid, which is almost impossible controlled by someone at the present time; Second, the increasing complexity of the problems faced by the ummat which is very urgent to get the solution; Third, let the period without ijtihād (vacuum of mujtahid) is contrary to the basic principles of Islamic law are always sāliḥ li kulli zamān wa makān. This paper present to discuss further about the urgency of the reconstruction of ijtihād in the challenge of modernity.***Al-Qur’an maupun sunnah sangat membutuhkan pemahaman dan penggalian secara optimal agar isi kandungan hukumnya dapat diterapkan bagi kemaslahatan umat. Cara untuk menggali dan mengeluarkan isi kandungan yang ada dalam kedua sumber tersebut dinamakan ijtihād. Ijtihād sangat dibutuhkan pada setiap istinbāṭ hukum dari dalil naṣ, sekalipun dalil naṣ tersebut bersifat qaṭ'ī yang oleh para uṣūliyyūn sudah di­sepakati tidak menjadi wilayah untuk dijitihadi lagi. Permasalahannya adalah bahwa sesuatu dalil naṣ yang sudah bersifat qaṭ'ī sekalipun oleh sebagian besar uṣūliyyūn, belum tentu dipandang qaṭ'ī oleh sebagian uṣūliyyūn yang lain. Rekonstruksi ijtihād menjadi se­buah alternatif, dengan beberapa pertimbangan: Pertama, berat dan ketatnya persyaratan-persyaratan menjadi seorang mujtahid, yang hampir tidak mungkin di­kuasai oleh seseorang pada masa sekarang; Kedua, semakin kompleksnya per­masalah­an yang dihadapi oleh ummat yang sangat mendesak untuk mendapatkan solusi; Ketiga, membiarkan satu periode tanpa ijtihād (kevakuman mujtahid) adalah bertentangan dengan prinsip dasar hukum Islam yang selalu sāliḥ li kulli zamān wa makān. Abstract

This paper aims to describe and analyze the problems and prospects of endowments (perwakafan) in Indonesia, mainly related to the enactment of Law No. 40 of 2004 on Waqf. An analysis of the problems focused on management of waqf properties by waqf institutions that are still traditional and far from productive orientation. The problems on waqf management are triggered by several things, such as: Lack of socialization on fiqh waqf and regulations about waqf from the state; not seriusly management of waqf, the issue of nadzir commitment, weak institutional monitoring system, and problems of funding. The enactment of the Law of Waqf believed to be the initial breakthrough has strategic and significant meaning in order to strengthen the better prospects of waqf institutions in Indonesia for tomorrow. It was at least found on some of the indicators in the Law of Waqf, namely: progressive thinking about productive waqf (cash waqf), institutional strengthening on waqf, structuring the management of waqf administration, and law enforcement of waqf

Abstract

This article will view specifically codification of Islamic Criminal Law in `Muslim community, such as Brunei Darussalam, a country based on Islamic principles, and Aceh is a part of Indonesian territory administratively, granted special autonomy to implement Islamic Sharia. Despite having different qualities, -as a country and a province- both have in common as a political power which apply Islamic Criminal Law. Refer to both qānūn jināyat in Brunei and Aceh, the author’ll explain the substance of the criminal law in both area, while also reinforces the implementation of Islamic Criminal Law in the framework of a modern state. The article concludes that basically the application of Islamic Sharia, particularly the Islamic Criminal Law, is closely related to the situation and socio-political conditions of a community or country. The differences of political system, for example, has contributed to the difference in the output of product or policy made by a particular country or territory. On the other hand, Brunei and the Aceh case show that there has been adjustment Islamic Criminal Law specifically set forth in the books of fiqh (as illustration of the Qur'an and Sunnah) with the needs of the community itself
