KARSA is a peer-reviewed national journal published by Institut Agama Islam Negeri Madura. It has been nationally accredited SINTA 2 since 2017 by Ministry of Research Technology and Higher Education of Republic Indonesia. It is published twice a year (June and December). It publishes articles of research results, applied theory studies, social issues, cultural studies, and Islamic culture issues. The aim of KARSA is to disseminate cutting-edge research that explores the interrelationship between social studies and (including) culture. The journal has scope and seeks to provide a forum for researchers interested in the interaction between social and cultural aspects across several disciplines. The journal publishes quality, original and state-of-the-art articles that may be theoretical or empirical in orientation and that advance our understanding of the intricate relationship between social science and culture. KARSA accepts manuscript with a different kind of languages are Indonesian, English, Arabic, or French.

Abstract

This research aims to reveal the legal facts regarding the substance of the contract clauses in Islamic financial institutions such as Islamic banking, shariah pawn-shop, and takâful (sharia insurance) which show the nuance of capitalistic con-tract clauses. Based on the purpose of this paper, the scope of this study is limited to the normative contracts in several Islamic financial institutions in order to ref-lect the purity of the sharia norms as well as to produce a format of sharia contract that puts forward maqâshid al-syarî’ah as the basic orientation. To sharpen the analysis framework, this study applies normative legal method with a con-ceptual approach. It is found that several contracts in Islamic financial insti-tutions use money as the object of the agreement (contract). Of course, if it goes uncontrolled, it could potentially trap other parties in the contracts into the prac-tice usury (ribâ). In conclusion, it is necessary to reformulate the contract format of the Islamic financial institutions in order to make it in line with the maqâshid al-syarî’ah  so that it could benefit the costumers of the sharia economy.Copyright (c) 2016 by KARSA. Abstract

This article aims to criticize the incorporation and commodification of Using cultures undergone by Abdullah Azwar Anas in Banyuwangi, East Java. To answer the problem, we analyze primary data from our field research and secondary data from online media related to AAA’s efforts to incorporate, articulate, and commodify Using cultures into various carnival programs (2011-2017) by applying theories of commodification, postmodernism, and hegemony. The result of this study shows that, driven by his desire to promote Using cultures globally in the midst of postmodern trends, since 2011 the government of Banyuwangi has created many carnivals and festivals, such as “Banyuwangi Ethno Carnival”, “Banyuwangi Beach Jazz Festival”, “Parade Gandrung Sewu”, and other various programs. Economically, the programs are idealized to support the regional economic growth through tourism activities, both for domestic and international tourists, by displaying traditional expressions with new styles and performances. Politically, the carnivals and festivals can support AAA efforts to negotiate its political concern in order to produce consensus.Copyright (c) 2017 by KARSA. Abstract

Perkembangan dan kemajuan keuangan syari’ah menghadapi tantangan yang makin kompleks. Salah satu pilar penting untuk menciptakan produk keuangan syari’ah dalam menyahuti tuntutan kebutuhan masyarakat mo-dern adalah pengembangan hybrid conctract (multi akad). Tulisan ini meng-analisis produk rahn yang banyak dipraktikkan di lembaga keuangan sya-ri’ah, khususnya pegadaian syari’ah, dari sudut hybrid contract. Penelitian ini menggunakan pendekatan kualitatif dengan jenis penelitian studi kasus di Pegadaian Syariah Jombang. Teknik pengumpulan data salah satunya be-rupa dokumentasi, yakni  dokumen perjanjian transaksi rahn antara nasabah gadai dengan pihak pegadaian syari’ah Kabupaten Jombang. Analisis data kajian ini di samping menggunakan pendekatan fiqh juga menggunakan pendekatan substantif-normatif dalam pemikiran hukum Islam. Hasil pe-nelitian menunjukkan bahwa produk rahn di pegadaian syari’ah masih dipertanyakan kesyari’ahannya. Jika dikaji lebih mendalam berdasarkan kriteria hybrid contract yang dibolehkan, maka produk ini bisa termasuk ke dalam hybrid contract yang dilarang, karena ia termasuk ke dalam penggabungan jual-beli dengan hutang-piutang yang dilarang oleh hadits dan ulama, karena ia menggabungkan dua akad yang bertentangan ka-rakter dan sifatnya.Copyright (c) 2016 by KARSA. Abstract

The world has three existing economic systems, derived from human thinking product (science) and God’s word. The first leads to secular capitalist and soci-alist system, and the second leads to a transcendent sharia-based economy. In reality, the secular system is not able to provide a fair welfare. In fact, it often triggers human problems. In this matter, the only system able to provide solution is a system derived from God’s word. However, it is important to reveal and im-plement sharia thought from God’s word to make society knowing, under-standing, and applying it in their life. The study is a library research which data are collected using documentary method. The result of the study shows that al-Qardlâwî’s thinking is purely based on God’s word using mu’âmalah, fiqh, and akhlâq approach. Meanwhile, Chapra tries to cover how the work practice of con-ventional economy and compare it to Islamic system, and tries to offer solution using scientific approach and Islamic values. The relevance of both thinkings is that they are able to provide Islamic values in the economic development, which is lack of spiritual content.Copyright (c) 2016 by KARSA. Abstract

This study aims to respond the problems on: Why Indonesia which is merely independent but there still exists the feudal culture in the society, especially people around the Ijen highlands? The problem is investigated along several questions, elaborated as: 1) What causes PT. Nusantara Plantation XII (PTPN XII) gains HGU (Cultivation Right on Land) from the government to manage the coffee plantations in the Ijen highlands?; 2) Why people around the Ijen highlands only became workers in their own homes? This research combines the historical and anthropological political methods, particularly the use of agricultural involution theory and the theory of hegemony to examine why the feudal culture still exist among the already independent society, especially in the Ijen highlands. The results of this study are: (1) PTPN XII got HGU of the government to manage the coffee plantations in the Ijen highlands is not merely without a reason, but it has gone along a careful govern-ment consideration. PTPN XII is a state-owned company managed by a profes-sional so that the government benefited from a big share of profit in every single year. (2) the society of the Ijen Highland became laborer in their own homes is because the large number of people work for PTPN XII, particularly in Blawan and Kalisat Jampit plantations, as laborers not as skilled employees.Copyright (c) 2016 by KARSA. Abstract

Indonesia is currently embroiled in social and ecological crisis as a result of the exploitation of natural resources redundant as a consequence of the dominance of the global capitalist system. As a country with a Muslim majority deemed the need for religious organizations to resolve the issue. In 2013, Front Nahdliyin for Sovereignty of Natural Resources (FN-KSDA) was established as a response to the social-ecological crisis in Indonesia. Among NU members (Nahdliyin), the existence of organizations such as FN-KSDA is something new. In the middle of NU's attention to the agrarian conflict and natural resources that are considered quite minimal, until now FN-KSDA moving outside the formal structure of the NU. This study also examines how the perspective of FN-KSDA against the sovereignty of natural resources. This article reviews the importance of the agrarian reform carried FN-KSDA by relying on sources of Islamic law that the Qur'an and Hadith, as well as the results of the NU congress. The agrarian reform and upholding the sovereignty of natural resources made FN-KSDA are already have a legitimacy whether from the main sources of Islamic law, the Qoran and the hadith as well as internal decisions of organizations such as Nahdlatul Ulama.Copyright (c) 2017 by KARSA. Abstract

The phenomenon that occurred in some cities shows that the mosque has many additional functions besides the means of worship, such as a place of education and other social activities. Dian Al-mahri Mosque has been functioned widely and gives impact to the community. The impact of tourism can be divided into positive and negative. The purpose of this study is to know the impact from existence of Kubah Emas Mosque (Dian Al-Mahri Mosque) as tourism site in social, culture and environment that are happened in people in Meruyung area. The descriptive qualitative method was used in this study, data collect used observation, questioner, related documents and from key informant which was the urban village head of Meruyung. The research result show social impacts that were felt by people around Meruyung as the spiritual feeling so they are still istiqomah, it was proven by people who came for Hadits study, istighotsah and tausiyah as well as Dakwah. There are a lot of tourists that come by using vehicle, it is impacted directly to the environment, because there are a lot of emissions as well. It makes air pollution and also the traffic around that area. Another impact is garbage from the existence of this tourist site impacts the environment. It is known that the committee of Dian Al- Mahri Mosque have minimalized the negative impacts that are possibly happened. For example, there is a garden as neutralizer of air pollution from the emissions of vehicles and they also forbid the street seller come into the mosque area to make less garbages.Copyright (c) 2017 by KARSA. Abstract

Translation is a rendering of form and meaning, but in the other hand, translation also can be defined as the rendering of message (amanah) from the source/start text into target text. This research elaborate the Arabic – Javanese translation text. Arabic is the source language (L1) and Javanese is the target language (L2). The material object selected was the book of Bidāyatul-Hidāyah (Islamic Moral Ethic) written by Imam Al-Ghazali. This research investigate the personal image of Imam Al-Ghazali using the discourse perspective of translation. There are two basics problems in this research, (1) the translation of units language in the book of Bidāyatul Hidāyah in representing the concept of loyalty (thā’at) using the discourse perspective of translation, and (2) the concept of loyalty based on Imam Al-Ghazali in the book of Bidāyatul Hidāyah. The method had been divided into three basic steps: collecting the data using the observation method, analysis data related with the distributional method, and reporting the data. The result had been concluded that Imam al Ghazali’method to delivering the concept of loyalty (thā’at) message was the balancing between fiqh and sufism.Copyright (c) 2017 by KARSA. Abstract

The most complex problem in the world nowadays is subjugating human’s egocentrism as a superior human being toward the nature, and exploiting the nature on the strength of human needs and interests created the new problem for the human itself. The nature starts to turn against us using its own way, and this problem slowly threatens the continuity of life chain for all beings in this earth. Owing to this problem, a contemporary philosopher, Sayyed Hosen Nasr expressed his thought to criticize the modern civilization with the globalization that continuously devastates the nature without considering how life goes well and how to make this not harm each other. One of the thoughts created by Nasr is his idea about ‘nature’, how to revive the nature, and the idea of eco-theology in this paper is the introduction of a piece of his thoughts that truly criticizes the modernity conception that revives the nature slowly. The result proposed by Nasr shows that he wants to reconcile the modernity without ‘God’ soul and turns it into the religious modernity that shows the nature is not supposed to be treated as the human wants, but the nature must be treated like the equal beings, to be maintained and to be preserved, because the human life is determined by how the nature goes.Copyright (c) 2017 by KARSA. Abstract

Critical discourse analysis (CDA) in this research came from two texts of online news. They were Medan Business Daily from Medan, North Sumatera and Kabar Pidie Jaya from Pidie, Aceh. Both of the news had the same theme, that was legitimation zero point kilometer of Islamic entrance in Indonesian archipelago. However, both of the news was conflicated, if it had not been finished as soon as possible, it would be a long conflict. Because of that, this CDA had a purpose to try for giving solution from another point of view. The point of view was from historical data about differences of point of view on the online news. The method of this study was by using Norman Fairclough approach with text analysis (description), discourse practice (interpretation), and social practice (explanation). The result of text analysis (description) was analyzed by using rhetoric pattern; modality, such as akan, bisa; positive sentences; negative sentences; interrogative sentences; experiential and attitudinal vocabularies; life metaphor. Discourse practice analysis (interpretation) such as event series from the two online news texts. Explanative analysis followed the situational change, institution change, and social-cultural change which would be mediating this conflict based on the historical facts. Copyright (c) 2017 by KARSA.
