Abstract

This research aims to reveal the legal facts regarding the substance of the contract clauses in Islamic financial institutions such as Islamic banking, shariah pawn-shop, and takâful (sharia insurance) which show the nuance of capitalistic con-tract clauses. Based on the purpose of this paper, the scope of this study is limited to the normative contracts in several Islamic financial institutions in order to ref-lect the purity of the sharia norms as well as to produce a format of sharia contract that puts forward maqâshid al-syarî’ah as the basic orientation. To sharpen the analysis framework, this study applies normative legal method with a con-ceptual approach. It is found that several contracts in Islamic financial insti-tutions use money as the object of the agreement (contract). Of course, if it goes uncontrolled, it could potentially trap other parties in the contracts into the prac-tice usury (ribâ). In conclusion, it is necessary to reformulate the contract format of the Islamic financial institutions in order to make it in line with the maqâshid al-syarî’ah  so that it could benefit the costumers of the sharia economy.Copyright (c) 2016 by KARSA. Abstract

AbstractThis article explains how the state commits a hegemony against pesantren (Islamic boarding school) and how pesantren performs a counter-hegemony. The writer uses the concept of Hegemony purposed by Gramsci. State hegemony against pesantren has started since the collonialism of the East Indies through the penetration of modernization discourse issued to the pesantren circle. The hegemony continued in the era of new order (orde baru) by publishing an integrated-letter of akcnowledgment (SKB) released by three ministries  in 1975. It claimed that pesantren and madrasah became the part of  national education. As a result, the compostion of Madrasah instructional material must be 60% for general science and the rest was for religious science. Yet, when the state hegemony comes to the peak point pesantren undergoes a counter-hegemony. Pesantren still maintains its distinct educational system independently; the educational system includes the curriculum as well as the instructional process. This firm act results a state acceptance. Since 1998 the government  has released a  letter of acknwoledment of degree equating. This model of pesantren known as pesantren mu’adalah (equation). The graduation certificate of pesantren could be used for any purposes, as the certificate of MA and SMA do.. Kata-kata kuncihegemoni, hegemoni tandingan, negara, kurikulum, pesantren, mu’adalah

Abstract

Pesantren and its social religious teaching is a complex and challenged issue. This paper analyzed with the historical-critical approach and reflective logic was aimed to claim that pesantren should behave wisely and carefully to confront extremely purification movement and globalization symptom. To purify Islam leads to the failure to understand and identify Islamic power to discuss creatively with local wisdom. Whereas, with the global growth and modern culture, some pesantrens show an ambiguity and unclear direction and the goal in modernizing pesantren. Pesantren has missed its ability to define and place its position amid global reality at the intersection of maintaining the tradition and adopting the new development. For that, with the strong of pesantren cultural tradition, pesantren must be able to make continuity and change to bind local, national, and global values. In other words, the future of pesantren is determined by an education model which relates pesantren cultural values, nationality, and global human issues.Copyright (c) 2015 by KARSA. Abstract

Abstract

Translation is a rendering of form and meaning, but in the other hand, translation also can be defined as the rendering of message (amanah) from the source/start text into target text. This research elaborate the Arabic – Javanese translation text. Arabic is the source language (L1) and Javanese is the target language (L2). The material object selected was the book of Bidāyatul-Hidāyah (Islamic Moral Ethic) written by Imam Al-Ghazali. This research investigate the personal image of Imam Al-Ghazali using the discourse perspective of translation. There are two basics problems in this research, (1) the translation of units language in the book of Bidāyatul Hidāyah in representing the concept of loyalty (thā’at) using the discourse perspective of translation, and (2) the concept of loyalty based on Imam Al-Ghazali in the book of Bidāyatul Hidāyah. The method had been divided into three basic steps: collecting the data using the observation method, analysis data related with the distributional method, and reporting the data. The result had been concluded that Imam al Ghazali’method to delivering the concept of loyalty (thā’at) message was the balancing between fiqh and sufism.Copyright (c) 2017 by KARSA. Abstract

The journey to the sacred place is a fairly old tradition. In the history of ancient civilization, the sacred place became a magnet for religious believers to do the pilgrimage and magical rituals. The sacred place has become a tourist object from generation to generation. To visit the sacred place is not always identical with rural communities, communities that often are identified as followers of khurafat. Visiting the sacred place is also a city-educated public interest.Like the form of tourism in general, visiting the sacred place may  be just pure entertainment, education, or indeed release a spiritual thirst for community.
