KARSA is a peer-reviewed national journal published by Institut Agama Islam Negeri Madura. It has been nationally accredited SINTA 2 since 2017 by Ministry of Research Technology and Higher Education of Republic Indonesia. It is published twice a year (June and December). It publishes articles of research results, applied theory studies, social issues, cultural studies, and Islamic culture issues. The aim of KARSA is to disseminate cutting-edge research that explores the interrelationship between social studies and (including) culture. The journal has scope and seeks to provide a forum for researchers interested in the interaction between social and cultural aspects across several disciplines. The journal publishes quality, original and state-of-the-art articles that may be theoretical or empirical in orientation and that advance our understanding of the intricate relationship between social science and culture. KARSA accepts manuscript with a different kind of languages are Indonesian, English, Arabic, or French.

Abstract

Abstrac Industry requires competition and competencies. The former is kind of race or contest to allow people to gain the objective, however the latter is an individual skill or capability to gain the objective. Competition goes around social room, therefore competence is a part of individual resource. The social and individual chambers are free from gender, both man and woman have an equal opportunity to reach the individual expected wish. Only those who are able to win the social sphere fight that could be a part of indutrialization, nevertheless those who are not will be left behind. Thus, Madurese woman challenges the fight agains traditional bond which close to social and religious norm and industrial bond which relies on rationality. Based on the fact, industry becomes a social room for Madurese woman. Indeed, this article would view the reality that cannot be avoided by woman---the reality of how the tradition, as social sphere gives meaning on the woman role and how the women fight becomes an important part of them. Abstract

Poverty is a set of problems encountered by developing countries, including Indonesia. This study attempts to solve the problems using zakat instrument. Indonesia has high zakat revenue potency, but its realization is still low, therefore factors affecting society motivation in paying zakat through Amil Zakat Agency still need to be investigated. The purpose of this study is to identify if religious, psychological, social factors and government regulation enable to influence society motivation in paying zakat both simultaneously or partially. Multiple linier regression was used as the method of analysis. The results shows that religiosity, psychological, social factors and government regulation have positive and significant impact on society motivation in paying zakat through Amil Zakat Agency. Partially, religious factor and psychological factor influences society motivation in paying zakat while social factor and government regulation does not influence it. Copyright (c) 2017 by KARSA. Abstract

Abstrak: Nabi Muhammad tidak sepenuhnya memusnahkan tradisi Arab pra-Islam. Bahkan, Nabi Muhammad banyak menciptakan aturan-aturan yang melegalkan hukum adat masyarakat Arab, sehingga memberi tempat bagi praktik hukum adat di dalam sistem hukum Islam. Signifikansi peran budaya dalam hukum Islam kemudian diteruskan oleh para penerusnya. Dengan demikian, budaya memiliki posisi yang penting dalam sejarah hukum Islam. Ini juga membuktikan bahwa budaya yang berkembang dalam masyarakat tidak harus tunduk dalam ekspresi hukum Islam (corak Arab), melainkan hukum Islam harus melakukan proses mutasi untuk beradaptasi di bawah naungan budaya yang hidup di masyarakat sepanjang budaya tersebut tidak bertentangan dengan ajaran fundamental dan spirit Islam. Dalam konteks Indonesia, paling tidak ada dua gagasan penting, yaitu: “fikih Indonesia” dan “pribumisasi Islam”. Dari kedua gagasan ini, setidaknya ada dua paradigma penting dalam upaya pribumisasi hukum Islam, yaitu: pertama, kontekstual, hukum Islam dipahami sebagai ajaran yang terkait dengan dimensi zaman dan tempat. Kedua, menghargai tradisi lokal. Dengan kedua paradigma ini, maka pribumisasi hukum Islam akan menjadi lebih jelas. Dengan demikian, pasca reformasi haruslah menjadi momen positif untuk merekontruksi budaya lokal, bukan malah menghancurkannya dengan pemaksaan konsep hukum yang tidak sesuai dengan kepribadian bangsa Indonesia. Abstract: The fact explains that the Prophet Muhammad is not completely destroy the tradition of pre-Islamic Arabia. In fact, Prophet Muhammad creating many rules of customary law which  legalizing pre-Islamic custom of  Arab society, thus giving the place for the practice of customary law in the Islamic legal system. The significance of  culture in Islamic law and then passed on by his successors. Thus, culture has an important position in the history of Islamic law. It also proves that the culture that developed in the community should not be subject to the legal expression of Islam (Arabic style), but Islamic law is the subject of  mutation process under the auspices of cultures living in the community as long as it  is not contrary to the fundamental teachings and spirit of Islam . In the Indonesian context, there are at least two important initiatives, namely: "fiqh Indonesia" and "pribumisasi Islam". There are at least two important principles in this process namely: first, contextual, Islamic law is understood as a doctrine which associated with the dimensions of time and space. Secondly, respect local traditions. With these two principles, pribumisasi of Islamic law will become clearer. Thus, the post-reform must be a positive moment to reconstruct the local culture, rather than destroy it by forcing  law concept which does not fit with the personality of the Indonesian people. Kata kunci: Hukum Islam, sosial budaya, pasca reformasi, pribumisasi Islam.

Abstract

Tulisan ini mengulas peran dan fungsi dari partai politik Islam; sebagai penyerap aspirasi masyarakat dengan studi kasus di DPW PPP Jatim. Adapun Rumusan masalah secara spesifik adalah; (1) Bagaimanakah Dewan Pimpinan Wilayah Partai Persatuan Pembangunan (DPW PPP) Propinsi Jawa Timur mengimplementasikan Undang-Undang  No. 2/2008 tentang Partai Politik dalam mengaktualisasikan fungsinya sebagai sarana penyalur aspirasi masyarakat. (2) Bagaimanakah pola komunikasi politik dalam penjaringan aspirasi masyarakat yang dilakukan Dewan Pimpinan Wilayah Partai Persatuan Pembangunan ( DPW PPP ) Propinsi Jawa Timur. Perspektif kajiannya adalah sosial politik. Penelitian ini dilakukan di Dewan Pimpinan Wilayah Partai Persatuan Pembangunan Propinsi Jawa Timur. Data dikumpulkan dengan cara wawancara mendalam dan dianalisis menggunakan model fenomenologi. Hasil penelitian ini menunjukkan: (1) Implementasi Undang-undang No.02 Tahun 2008 tentang Partai Politik telah dilakukan secara baik oleh Dewan Pimpinan Wilayah Partai Persatuan Pembangunan Propinsi Jawa Timur dalam mengaktualisasikan fungsinya sebagai penyalur aspirasi masyarakat. (2) Komunikasi politik Dewan Pimpinan Wilayah Partai Persatuan Pembangunan sebagai penyalur aspirasi masyarakat sebagian besar telah dilakukan oleh para wakil rakyat di Dewan Perwakilan Rakyat Daerah Propinsi Jawa Timur. Tiga fungsi yang tersebut adalah; fungsi legeslatif, fungsi controling/ pengawasan, dan fungsi budgeting/ anggaran telah dilaksanakan oleh para anggota DPRD Jatim dari Fraksi Persatuan Pembangunan.

Abstract

This article discusses the politics of identity in dance representations. Lah Bako dance is one of the Jember icons that was created to build an image of the tobacco farmers' culture. This dance is performed by women who represent the tobacco production process. However, the practical needs that are framed through aesthetic motions present a new form of how women are positioned in agricultural societies. In this context, the Lah Bako dance becomes an instrument to create new meanings for women and also becomes an imaginary space for tobacco farming. The article discusses two main points: first, the Lah Bako dance became an integral part of government’s project to construct mass memories in the relations of production in the tobacco sector, and the second is women as subjects representing a farmer’s spirit which is formed as a new figuration that fluid and changeable as political image that transcended existing experimental conditions. An addition point highlighted in this article was the emergence of Islamic values in a dance version which is accomodated the elite interest of Jember’s identity slogan formation. Reseachers use Stuart Hall’s cultural representation and ethnography method to narrate the identity. This research found that the Lah Bako dance is constructed in dominant cultural formations that are legitimized by the structure of the regional government bureaucracy. Furthermore, it is crucial to criticize the space for voicing farmers’ subjectivity and class politics, which has been muddled from the elite network. The problem appears as a paradox for creating aesthetic reality through art, where the symbolic form can be enjoyed without touching inequality that continually arises.

Abstract

Social cohesion is one important social capital to support the ongoing process of development programs and also as a guarantee for social stability. The good indication of social cohesion in a society characterized by a strong sense of belonging that encourages the desire to work together. This paper will substantively elaborate how Jakarta provincial election has strengthen the identity politics which posed great challenge to the constructed social cohesion. This paper will try to answer why identity politics was used as strategic political campaign strategies to generate massive support and how the confusion to the sentiment of identity politics has turned into the emergence of social gap in the society which leads to the disturbance of existing pattern of social cohesion. The explanation from this paper build on the basis of different media analysis throughout Jakarta provicial election on the issue related SARA (religion, ethnic and group). From this study,  shows that the issue related SARA in Jakarta provincial election case was the culmination of the political ideology confrontation which give subsequent impact to the equilibrium of social cohesion in the society.

Abstract

Abstrak: Gagasan tentang pemidanaan terhadap kasus perkawinan yang tidak dicatatkan—biasa disebut perkawinan sirrî—yang mencuat di awal 2010 langsung memunculkan polemik. Bagi masyarakat yang mendukung, pemidanaan perkawinan yang tidak dicatatkan akan bisa memperketat prilaku perkawinan yang semena-mena, melindungi hak-hak perempuan dan anak-anak, serta menumbuhkan budaya tertib hukum di masyarakat. Sementara bagi kalangan yang menentang, perkawinan yang tidak dicatatkan adalah tetap sah secara agama (Islam)—jika dilakukan sesuai syarat dan rukun nikahnya—dan negara tidak bisa memidanakan pelaku perkawinan yang tidak mencatatkan perkawinannyake instansi pemerintah.Tulisan ini berusaha mengana-lisis polemik tersebut dari sudut pandang siyâsah syar`iyyah, utamanya berkait dengan peluang dimasukkannya aspek hukum pidana dalam penerapan hukum perkawinan di Indonesia. Abstract: The notion of criminalizing on illegal (not legally registered) marriage appearing in the early 2010 resulted polemics. Those who support this idea argue that it could tighten an unfair marriage, protect children and women rights, and create law-abiding culture concerning marriage in society. Those who deny the notion claim that an unregistered marriage is consider lawful from the perspective of Islam as long as it fulfils marriage principles and requirements. Abstract

Indramayu District Government issued Local Regulation No. 12 of 2012 on Compulsory Education Diniyah Takmiliyah. Compulsory Education Diniyah Takmiliyah is a Non-Formal Religious Education Program which must be followed by all students starting from elementary level up to upper level in Indramayu District on joint responsibility between local government and province and society. Diniyah Takmiliyah aims to complement the Islamic religious education obtained at the basic level up to the upper level or in higher education in order to increase the faith and devotion of learners. This study uses qualitative analysis of case studies. The results of this study are expected to be useful and contribute thoughts to other local governments to implement compulsory diniyah policy. This research explains the background of the birth of the regulation of Indramayu Regency about the compulsory education of Diniyah Takmiliyah from the community; also describes the strategy implementation strategy from concept, set into local regulations, followed by regent regulation, socialization and control; as well as describe the implications experienced in the implementation of this policy such as increasing the achievement of Islamic studies in schools, the addition of religious lessons, the local budget for Islamic education, the increase of Madrasahs in the study sites and the effect of political electability decision makers.

Abstract

Abstrak: Artikel ini membahas tentang perilaku kepemimpinan kharismatik-tradisional pesantren yang bersandar kepada keyakinan bahwa kyai mempunyai kualitas luar biasa yang bersifat teologis, kekuasaannya diyakini berasal dari Tuhan, serta fenomena kepemimpinan kolektif yang bersandar pada pembagian peran, tugas dan kekuasaan, sehingga lahirnya kepemimpinan kolektif di pesantren diasumsikan sebagai usaha bersama untuk mengisi jabatan baru sebagai tuntutan sosial masyarakat. Penelitian ini menggunakan pendekatan kualitatif. Dari hasil penelitian ditemukan bahwa Perubahan kepemimpinan tunggal yang mengacu pada figur kyai tertentu ternyata tidak meniadakan otoritas kiai yang menjadi ciri utama pesantren, melainkan menempatkan kyai sebagai pengasuh yang terlembaga dalam dewan kekyaian (masyayikh). Abstract: This article discusses the behavior of charismatic leadership-traditional leadership which based on belief that the kyai has extraordinary  theological qualities His authority is believed derived from God, and the phenomenon of collective leadership that relies on the division of roles, tasks and powers, so the birth of a collective leadership in pesantren assumed as a common endeavor to fill the new position as the social demands of society. Changing  in  single leadership which refers to a specific kyai did not negate kyai’s authority. But it extends Kyai’s authority in the form of institution named the council of kyai (masyayikh). Abstract

Tulisan ini bertujuan mengungkap makna di balik fenomena pendidikan Islam ditengah-tengah budaya carok di desa Bujur. Desa ini rawan terjadi carok,meskipun lembaga pendidikan berbasiskan Islam menyebar di desa ini.Sayangnya, tradisi carok ternyata tidak bernading lurus dengan julah pendidikanIslam yang ada. Indikasi ini bisa dilihat dari fakta yang terjadi di lapanganbahwa kekerasan yang berwujud carok masih menjadi cara dalammenyelesaikan persoalan. Tulisan ini menunjukkan bahwa: pertama, ternyatapola pendidikan yang diterapkan dalam keluarga dan pola pendidikanmadrasah sangat dipengaruhi oleh kultur masyarakat yang keras, sehinggakekerasan terinstitusionalisasi dalam masyarakat. Oleh karena itu, rekulturasipendidikan Islam yang mengarah pada pola internalisasi nilai-nilai yangdemokratis mutlak dilakukan. Kedua, materi pendidikan Islam, baik di lembagapendidikan formal maupun yang non normal harus mempertimbangkankearifan lokal, di samping kurikulum nasional. Dalam kurikulum lokal,pembahasan tentang tradisi carok secara khusus, dan persoalan kekerasan searaumum, dalam pandangan Islam harus mendapat perhatian serius. Ketiga,pentingnya pembekalan pada guru agar menggunakan strategi dalam prosesbelajar mengajar sangat jarang sekali dilakukan, karena terkait dengan komposisiguru yang rata-rata bukan lulusan bidang kependidikan, dan otomatis kurangmemahami strategi dalam kegiatan belajar mengajar.
