Abstract

Abstract: The Board of Directors is an organ of the company responsible for the performance of the company, which in its duties must adhere to fiduciary duties, duties of skill and statutory duties. The purpose of this research is First, to review the responsibility of the board of directors of PT. Asabri against high-risk investments based on the laws and principles of Sharia economic law, Second, to review sanctions against violations of the principle of responsibility committed by the board of directors of PT. Asabri for high-risk investments. The method used in this research is normative juridical, analytical descriptive research specification with systematic interpretation data analysis method. The results of this study concluded. First, the responsibility of the board of directors of PT. Asabri is a personal responsibility, and responsibility in a rented way with members of the board of directors of PT. Asabri because of his negligence and indiction violated the principle of responsibility and violated the principle of Sharia economic law, thereby harming the company and having to reimburse a certain amount of losses. Second, sanctions against violations of the principle of responsibility, namely civil sanctions based on articles 1365 and 1366 of the Criminal Code, and criminal sanctions if the actions of the directors do not comply with the principle of responsibility can be ensnared with articles 398 and 399 of the Criminal Code.

Abstract

Abstract: This research identifies the needs of cattle breeders for Islamic financing for cattle business development to provide solutions to problems faced by breeders in Deli Serdang Regency, North Sumatra, especially in obtaining access to capital through Islamic financial institutions. The condition of the breeders included in the non-bankable criteria and did not have the 5 C criteria (character, capacity, collateral, capital, and conditions of economic), which are the main requirements for distribution of financing. One way to provide a solution to this problem is by providing easy access for farmers to obtain financing from LKMS with the most appropriate financing schemes and models for farmer business activities. In order to reach this stage, it is necessary to identify the needs of breeders. The research method used is a qualitative approach. Data were collected based on primary sources in the form of interviews with breeders, LKMS around Deli Serdang Regency. The results showed the main needs (needs) of breeders in managing their livestock business to be successful where the availability of capital during the maintenance period, the need for knowledge and skills in processing potential waste from livestock manure to become business and additional income from livestock management, the availability of routine health assistants. Conduct visits to help and provide counseling and control the health of livestock. The Islamic financing model for cattle breeders shows very promising business potential and opportunities for both parties of Islamic cooperatives and cattle breeders. The welfare opportunities formed in a multiplier manner from the sharia financing model for cattle breeders and sharia cooperatives based on investment with a yield within 42 months reach an equivalent rate of 72.5%.

Abstract

Abstract: This research aims to examine and analyze the responsibilities of petrol stations as well as legal protection that can be obtained by consumers designed by petrol stations based on statutory views and Islamic law. This study uses the Normative Juridical method with references to Law Number 8 of 1999 concerning Consumer Protection and Law Number 2 of 1981 concerning Legal Metrology regarding measuring instruments. These results conclude that: First, engineering pump removal by business actors carried out by SPBU managers has an impact on the revocation of the PASTI PAS predicate by Pertamina which has harmed consumers, so that it is the responsibility of business actors who provide compensation in accordance with Article 19 of the Consumer Protection Law because it has increased to default. Furthermore, in Islamic law, the stipulation of compensation is carried out because no loss or damage to the victim has occurred. Second, legal protection for consumers, namely in the form of preventive and repressive. Preventive measures are carried out by providing guidance by the government and Pertamina, while repressiveness is carried out by law enforcement and / consumer dispute resolution both through courts and outside the court. Likewise, the Islamic view of pump engineering is not in line with the principles and principles of Islamic law because there is an element of gharar in it.

Abstract

Abstract: This paper tries to explain about the concept of justice both contained in al-Qur’an and hadith. As part of the implementation of Islamic law and the subsystem of national law, the role and position of the (Islamic) judiciary is very strategic and significant. The existence and position of the principles of justice not only lies in the theoretical development through academic studies, but also practically can provide its own color in the implementation of Islamic law in Indonesia. The implementation of the judicial principles is not only a normative individual obligation, but also a collective obligation involving both academics, legal practitioners and the government. Theoretically and practically, the principles of justice embodied in Qur’an and Hadith greatly affect the course of law and justice enforcement through religious court in Indonesia.Abstrak: Tulisan ini mencoba menjelaskan tentang konsep keadilan baik yang tertuang dalam Alquran maupun hadits. Sebagai bagian dari implementasi hukum Islam dan subsistem hukum nasional, peran dan kedudukan lembaga peradilan (Islam) sangat strategis dan signifikan. Keberadaan dan kedudukan asas keadilan tidak hanya terletak pada perkembangan teoritis melalui kajian akademis, tetapi juga secara praktis dapat memberi­kan warna tersendiri dalam penyelenggaraan syariat Islam di Indonesia. Pelaksanaan prinsip kehakiman bukan hanya kewajiban normatif individu, tetapi juga kewajiban kolektif yang melibatkan akademisi, praktisi hukum, dan pemerintah. Secara teoritis dan praktis, prinsip keadilan yang terkandung dalam Alquran dan Hadits sangat mempengaruhi perjalanan dan implementasi keadilan di Indonesia dalam upaya menegakkan hukum dan keadilan.

Abstract

Abstract: One of the most discussed issues in legal studies is the marriage minimum age regulation. This study aims to reveal the Maqashid Shari'ah conception in formulating the objectives of Islamic law regarding the determination of the age limit for marriage in Indonesia. Systematic literature review (SLR) was applied as the research approash, with literature study as data collection technique. The results of this paper indicate that the Maqashid Syari'ah conception on marital age limit is to achieve benefits and to reject harms, which can be seen in the following aspects: Firstly, marriage must be carried out at a mature age as a provision to navigate domestic life; secondly, determining the marriage minimum age is a strategic step to suppress early-agemarriage as one of divorce causes ; thirdly, the age limitation is in line with the protection of offspring principle (hifdz al-nasl) as an effort to prepare a family with strong descendants; fourthly, the age control becomes part of the development of community in term of psycologycal and sociological aspect. This research is expected to provide a broad understanding and encourage community’s legal awareness that the determination of marital age limitation has values that are relevant to the principles of Maqashid Syari'ah.Abstrak: Salah satu kajian hukum yang menyita banyak perhatian adalah pengaturan batas usia pernikahan. Penelitian ini hendak mengungkap konsepsi Maqashid Syari’ah dalam merumuskan tujuan hukum Islam berkenaan dengan penentuan batas usia pernikahan di Indonesia. Pendekatan yang digunakan dalam penelitian ini adalah Systematic Literature Review (SLR), dengan teknik pengumpulan data melalui studi kepustakaan. Hasil tulisan ini menunjukkan bahwa konsepsi Maqashid Syari’ah mengenai hukum batas usia pernikahan bertolak dari tujuan meraih kemaslahatan dan menolak kemadharatan, yang dapat dilihat pada aspek berikut: Pertama, pernikahan harus dilakukan pada usia matang sebagai bekal me­ng­arungi kehidupan rumah tangga; Kedua, penentuan batas usia nikah merupakan langkah strategis dalam menekan terjadinya pernikahan dini sebagai salah satu penyebab perceraian; Ketiga, penentuan batas usia nikah sejalan dengan prinsip perlindungan ter­hadap keturunan (hifdz al-nasl) dalam upaya mempersiap­kan keluarga yang tidak mening­galkan keturunan yang lemah; keempat, penentuan batas usia nikah merupakan bagian dari upaya merespon perkembangan kondisi masyarakat dari sisi kematangan usia menikah berdasar­kan aspek psikologis dan sosiologis. Implikasi penelitian ini diharapkan dapat memberikan pemahaman secara luas dan mendorong kesadaran hukum bagi masyarakat bahwa penentuan batas usia nikah memiliki nilai-nilai yang relevan dengan prinsip-prinsip Maqashid Syari’ah.

Abstract

Abstract: Marriage ratification or itsbat nikah is a way out for unregistered marriages in order to obtain registration and recognition from the state. Not every application for ratification of marriage is always granted, sometimes the application is rejected which refers to the Compilation of Islamic Law. This paper has the aim of revealing the basis for the judge's considerations as well as having a role as chairman of the Purwakarta Religious Court when processing several cases regarding the legalization of underage marriages which always grants and never rejects the application, this is interesting because there is a decision by another Religious Court judge who refuses similar application. This study uses this analysis method (content analysis) with a qualitative approach. The results of this study show that the judge in question concluded that the age of the bride and groom is not a benchmark for accepting or rejecting the application for itsbat marriage, but the parameter is that every marriage that meets the conditions and pillars is legal and worthy of marriage, but unfortunately the conclusion is not attached to the sheet. the decision and give the impression that it is very easy to apply for an istbat. Therefore, underage marriages as long as they fulfill the pillars and requirements are treated as legal marriages and will always be accepted and granted the application for ratification of marriage.Absktrak: Pengesahan nikah atau itsbat nikah merupakan jalan keluar bagi pernikahan yang tidak tercatat demi mendapatkan pencatatan dan pengakuan dari negara. Tidak setiap permohonan pengesahan nikah itu selalu dikabulkan, adakalanya permohonan itu ditolak yang mengacu pada Kompilasi Hukum Islam. Tulisan ini bertujuan untuk mengungkapkan dasar landasan pertimbangan hakim sekaligus memiliki peran sebagai ketua Pengadilan Agama Purwakarta ketika menangani beberpa perkara tentang pengesahan nikah perkawinan anak di bawah umur yang selalu mengabulkan dan tidak pernah menolak permohonan tersebut, hal ini menarik karena adaya putusan hakim Pengadilan Agama lain yang menolak permohonan yang serupa. Penelitian ini mengguna­kan metode analisis ini (content analysis) dengan pendekatan kualitatif. Hasil penelitian ini menunjukan bawa hakim yang bersangkutan memberikan kesimpulan bahwa usia pengantin bukanlah patokan untuk menerima atau menolak permohonan itsbat nikah, melainkan parameternya adalah setiap perkawinan yang  terpeuhi syarat dan rukunya itu adalah sah dan layak untuk diistbatkan, namun sangat disayangkan ungkapan tersebut tidak dilampirkan dan dituliskan secara jelas dalam setiap lembaran putusan yang memerikan kesan bahwa hakim sangat mempermudah sekali untuk menga­bulkan istbat. Oleh karena itu pernikahan dibawah umur selama memenuhi rukun dan syarat dininai sebagai perkawinan yang san dan akan selalu diterima dan dikabulkan permohonan pengeshan nikahnya di Pengadilan Agama Purwakarta.

Abstract

Abstract: This paper departs from the different concepts between grants and inheritance. A grant is a form of transfer of property from a person (grantor) to another person (grantee) which is carried out while the grantor is still alive with the maximum amount of 1/3 of the inheritance. The grantee may come not only from the grantor’s heir, but also from other party, whether a person or a legal person. While inheritance is the transfer of property from a deceased person to their heir with the provisions that have been stated in the Qur'an and hadith, and other applicable legislation. The descriptive method with normative judicial approach was applied to describe how grants might become one of resolutions for inheritance-related conflict. The research found that some part of community distributes inheritance while the testator is still alive in order to avoid dispute between heirs. This practice is based on custom or simply due to lack of knowledge on Islamic inheritance provision. It can be concluded that the inheritance may be distributed while the testator is still alive through the concept of grant, as long as there is an agreement between the heirs. Whenever a dispute occurs after the grantor deceased, the distributed assets can be withdrawn and taken into account as inheritance.Abstrak: Tulisan ini berangkat dari konsep yang berbeda antara hibah dengan waris. Hibah merupakan bentuk perpindahan harta dari seseorang (pemberi hibah) kepada orang lain (penerima hibah) ketika pemberi hibah masih hidup dengan batasan yang disepakati maksimal sampai 1/3 dari harta peninggalan. Penerima hibah tersebut tidak hanya ahli waris tetapi bisa orang lain baik secara perorangan maupun lembaga atau organisasi yang dilaksanakan. Sementara waris merupakan perpindahan harta dari orang yang sudah meninggal dunia kepada ahli waris dengan ketentuan yng sudah tercantum dalam al-Qur’an maupun hadist atau dalam ketentuan perundang-undangan yang berlaku. Metode ynag digunakan dalam tulisan ini adalah metode deskriftif dengan pendekatan yuridis normatif yang bertujuan untuk menggambarkan hibah sebagai penyelesaian waris. Ditemukan dalam masyarakat bagaimana pembagian warisan dilakukan ketika si pewaris masih hidup. Adapun alasannya antara lain agar tidak terjadi sengketa diantara ahli waris, karena faktor pemahaman keagamaan masyarakat yang masih kurang terhadap kewarisan Islam, atau karena kebiasaan yang terjadi dimasyarakat. Dapat disimpulkan bahwa penyelesaian waris bisa dilakukan dengan cara membaginya ketika pewaris masih hidup melalui konsep hibah, selama adanya kesepakatan diantara ahli waris. Jika terjadi sengketa setelah meninggalnya pemberi hibah, maka harta hibah yang diberikan ketika hidup dan dinilai sebagai warisan dapat ditarik kembali dan diperhitungkan sebagai warisan.

Abstract

Abstract: This paper aims to analyze the process of forming the Draft Law on the Elimination of Sexual Violence (RUU Elimination of KS) from the perspective of Islamic law and analyze the political configuration in the formation of the law. The method used is descriptive analysis with the type of normative-empirical research. This method is considered able to answer all the main problems in this study. The results show that, in Islamic law a leader is obliged to maintain the soul, mind, dignity and worth of his people. Islam does not justify violence against women, Islam commands that every human being can give love and affection to women without violence as stated in QS. Ar-Rum (30): 21. To prevent sexual violence against women and uphold moral values, the leader must form a regulation as a form of responsibility from a leader to his people. These regulations must be obeyed and implemented by all his people, this is explained in (QS. An -Nisa, (04); 59. In the formation of the Draft Law on the Elimination of KS, there was a tug of war. Since 2016 until now, the Bill on the Elimination of KS has been in and out of the National Legislative Council (Prolegnas) however, until now it has not been ratified for various reasons given until it was clashed with religious beliefs The ratcheting up of the ratification of the KS Abolition Bill shows the reluctance of the legislature to provide legal protection to the public.Abstrak: Tulisan ini bertujuan untuk menganalisis proses pembentukan Rancangan Undang-Undang tentang Penghapusan Kekerasan Seksual (RUU Penghapusan KS) ditinjau dari perspektif hukum Islam dan menganalisis konfigurasi politik dalam pembentukan Undang-Undang tersebut. Metode yang digunakan adalah analisis deskriptif dengan jenis penelitian normatif-empiris yang dianggap mampu menjawab semua pokok permasalahan dalam penelitian ini. Hasil penelitian menunjukkan bahwa dalam hukum Islam seorang pemimpin wajib menjaga jiwa, akal, harkat dan martabat dari rakyatnya. Islam tidak membenarkan adanya kekerasan terhadap perempuan, Islam memerintahkan agar setiap manusia dapat memberikan kasih dan sayang kepada perempuan tanpa adanya kekerasan sebagaimana tertuang dalam QS.Ar-Rum (30):21. Untuk menjaga agar tidak adanya kekerasa seksual terhadap perempuan dan menjunjung tinggi nilai moralitas, maka pemimpin harus membentuk suatu peraturan sebagai bentuk tanggung jawab dari seorang pemimpin kepada rakyatnya. Peraturan tersebut wajib dipatuhi dan dilaksanakan oleh semua rakyat­nya, hal ini dijelaskan dalam (QS. An-Nisa, (04);59. Dalam pembentukan RUU  Penghapusan KS terjadi tarik ulur. Sejak tahun 2016 hingga saat ini, RUU  Penghapusan KS telah berapa kali keluar masuk Prolegnas, namun sampai saat ini belum kunjung disahkan dengan berbagai alasan yang diberikan sampai dibentrokan dengan keyakinan agama. Tarik ulur pembahasan RUU Penghapusan KS menunjukan, keengganan dari badan legislatif dalam memberikan payung hukum kepada masyarakat.

Abstract

Abstract: Economic justice in the State of Indonesia is still far from what is aspired, plus large foreign credits, causing various problems, especially poverty. Islamic economists provide a solution with waqf to answer these problems. This study aims to determine the pattern of waqf management, the waqf empowerment system for the village community's economy, as well as the waqf institutional model which is used as an instrument of economic empowerment for rural communities in Pontang sub-district, Serang district. This study uses a normative juridical scientific approach, among these approaches are the approaches taken, including: the statute approach, the concept approach, and the sociological approach. The data collected consists of primary and secondary data. The Miles and Hubermen model method was used as a data analysis method. The results of this study indicate that the pattern of waqf management in the villages of the Pontang sub-district is managed by the nazdir of the organization, namely the Mosque and Foundation Prosperity Council. Waqf-based community economic empowerment system for youth groups and farmers. The waqf institutional model is simple and carried out independently, there is no coordination between waqf managers and Badan Wakaf Indonesia (BWI) as the parent organization of waqf management. The results of this study contribute to knowledge about the concept of waqf management in rural areas, patterns of empowerment with effective waqf and in rural areas, as well as input for BWI in improving waqf governance.Abstrak: Keadilan ekonomi  di  Negara  Indonesia  masih  jauh  dari  yang   dicita-citakan, ditambah pinjaman luar negeri yang besar, menyebabkan  permasalahan kemiskinan. Para  ekonom Islam memberikan solusi dengan wakaf untuk menjawab permasalahan tersebut. Penelitian ini bertujuan untuk mengetahui pola manajemen wakaf, sistem pemberdayaan wakaf terhadap ekonomi masyarakat desa, serta model kelembagaan wakaf yang dijadikan instrumen pemberdayaan ekonomi masyarakat desa Kecamatan Pontang Kabupaten Serang. Penelitian ini menggunakan pendekatan saintifik yuridis normatif, yaitu di antara­nya adalah pendekatan perundang-undangan (statute approach), pendekatan konsep, dan pendekatan sosiologis atau empiris. Data yang dikumpulkan terdiri dari data primer dan sekunder. Metode model Miles dan Huber-men digunakan sebagai metode analisis data. Hasil penelitian ini menunjukkan bahwa pola manajemen wakaf di desa-desa Kecamatan Pontang  dikelola oleh nazdir organisasi yaitu Dewan Kemakmuran Masjid dan Yayasan. Sistem pemberdayaan ekonomi masyarakat  berbasis  wakaf  menyentuh  kelom­pok pemuda dan petani. Model kelembagaan wakaf bersifat sederhana dan dilaku­kan secara mandiri, belum ada koordinasi antara pengelola wakaf dengan Badan Wakaf Indonesia (BWI) sebagai organisasi induk pengelolaan wakaf. Hasil penelitian ini memberikan kontribusi pengetahuan tentang konsep manajemen wakaf di pedesaan, pola pemberdayaan dengan wakaf yang efektif dan efisien di pedesaan, sekaligus masukan bagi BWI dalam peningkatan tata kelola wakaf.

Abstract

Abstract: This research is based on landslide that happened in Bojong Kondang village, Cimanggung sub-district, Sumedang regency; due to reckless development in sloping land. There are various permits and codes that need to be fulfilled and followed before a housing construction company builds constructions especially on a hillside as water catchment area. The company should adhere precautionary principle and applies a proper drainage system. This study aims to review Islamic law and national legislation regulate housing construction activities in water catchment areas. The other aim is to examine the responsibility of the company that caused landslides due to Cihanjuang Regency drainage construction. The study applied normative legal method and analytical descriptive specifications. The collected data in form of primary and secondary data were analyzed with systematic interpretation. This research concluded that according to the positive law, any company whose project is on sloping area should adhere the spatial zoning, take into consideration the geographical conditions and soil stability of the area. Both national and Islamic law stated that the company should guaranties and provides safety, benefit, and advantages for the people and environment. For the damage and casualties caused by the construction related landslide, the company is responsible to compensate the loss to the victims. In case the total payment exceeds the company’s assets, the company board of director shall compensate from personal assets if it is proven that there is an element of negligence in the decision making.Abstrak: Penelitian ini didasarkan pada kejadian longsor di Kampung Bojong Kondang, Kecamatan Cimanggung, Kabupaten Sumedang yang menyebabkan kerugian bagi masyarakat kampung tersebut. Longsor tersebut dipicu oleh ketidak-hati-hatian developer perumahan yang tengah melakukan pembangunan drainase di lahan miring. Penelitian ini bertujuan pertama untuk menelusuri ketentuan perundang-undangan dan Hukum Islam tentang pembangunan perumahan di lahan dengan kemiringan tertentu dan kawasan resapan air. Kedua, untuk mengkaji bagaimana pertanggung jawaban developer atas pembangunan drainase yang berdampak pada terjadinya longsor pada perumahan Cihanjuang Regency. Metode yang digunakan dalam penelitian ini adalah yuridis normatif, dengan spesifikasi deskritif analitis, yang bersumber dari data sekunder berupa buku, jurnal, dan wawancara, dengan metode analisis data berupa penafsiran sistematis. Hasil penelitian ini menyimpulkan, pertama, perusahaan dalam membangun proyek perumahan pada lereng harus memperhatikan zonasi tataruang, kondisi geografis dan kestabilan tanah. Sesuai dengan perundang-undangan dan hukum islam, bahwa perusahaan berkewajiban untuk memberikan keselamatan, kemanfaatan, serta kemaslahatan bagi manusia dan lingkungan. Kedua, pertanggung jawaban developer perumahan atas pembangunan drainase yang berdampak pada terjadinya longsor di Cihanjuang Regency berupa penggantian kerugian terhadap korban bencana longsor. Apabila penggantian kerugian melebihi aset yang dimiliki perusahaan, maka direksi perusahaan harus mengganti kerugian dari aset pribadi manakala terbukti terdapat kelalaian atas keputusan yang diambilnya.
