Musawa : Jurnal Studi Gender dan Islam
Musãwa Journal of Gender and Islamic Studies was first published in March 2002 by PSW (Pusat Studi Wanita) Sunan Kalijaga Yogyakarta under contribution with the Royal Danish Embassy Jakarta. In 2008, published twice a year in collaboration with TAF (The Asia Foundation), namely January and July. Musãwa Journal is a study of gender and Islam especially on gender mainstreaming and child rights both in the study of texts in the Qur’an and Hadith, figures and thoughts, history and repertoire, classical and contemporary literature as well as socio-cultural studies. All concentrations are in the context of Indonesia and other countries in Southeast Asia within the framework of unified NKRI, based on Pancasila. Musãwa Journal has been published by PSW UIN Sunan Kalijaga Yogyakarta since 2002. Initiated by lecturers, gender activists and Islamic studies scholars of PTKI ( Higher Education of Islamic Religion) Musãwa has regularly published academic works and researches on gender and Islam for almost two decades. Now, the Journal extends its studies with Children and Human Rights (HAM). All studies are still in the context of gender and its mainstreaming. Through the studies hopefully, the Musawa journal can be part of the implementation of gender mainstreaming in the context of Indonesian society.

Abstract

The phenomena of child marriages have been assumed to have significant correlation with patriarchal society and culture which is characterized by gender biases. Many today's communities who endorse child marriages are still ignorant of the negative impacts of such child marriages. Many studies have showed that child marriages have resulted in unwanted pregnancy, unsafe abortion, high number of divorce, human trafficking, as well as unemployment. This article argues ihat child marriage may not only endanger the physical wellbeing of the brides, but also their mental and social health.

Abstract

Kearifan lokal merupakan kajian yang menarik dan penting untuk dilakukan karena manfaat yang akan diperoleh ketika bisa menggali potensi kearifan lokal yang ada pada suatu masyarakat.Kearifan lokal merupakan potensi lokal yang perlu untuk  dipertahankan dan dikelola seecara bijaksana. Mengkaji dan mempelajari tentang kearifan lokal merupakan upaya untuk memepertahankan nilai- nilai budaya yang telah menjadi kebiasaan atau  adat istiadat pada suatu kelompok masyarakat atau daerah. Mempertahankan nilai budaya tersebut dilakukan agar kearifan lokal yang ada tidak pudar dan dapat dinikmati serta memberi kemanfaatan bagi generasi berikutnya. Tetapi tantangan besar juga harus dihadapi, salah satunya adalah tantangan kehidupan saat ini yang semakin modern, dimana teknologi semakin canggih, kebudayaan asing juga semakin mudah untuk diakses oleh generasi muda. Sehingga mempertahankan kebudayaan dan kearifan lokal membutuhkan usaha keras dan kerjasama dari berbagai lintas sektor. Kerjasama tersebut tidak bisa lepas dari peran perempuan yang identik dengan berbagai sifat bijaknya untuk mempertahankan kearifan lokal demi kemanfaatan bagi lingkungan sekitar

Abstract

This article focuses on the efforts to optimize village assets, especially physical assets or natural resources in an effort to increase livelihoods in the village. Through interview, observation and FGD methods, this paper presents three cases to deepen the dynamics of women and the economics of asset-based village. This paper shows that village women can be the figures of active citizens in promoting the village economy by organizing and utilizing the village assets in order to have a source of livelihood. This is certainly contrasted with the perception that the village women are only complementary in the life of the village. In addition, this paper shows that village assets have an important contribution in supporting and mobilizing the livelihoods of the citizens. Asset mapping is also useful as a base to increase the livelihoods of the people, so that they do not rely on one source only. The village-cracker industry is a proof of the role of village women in mobilizing people’s economy, processing raw materials into ready products and sold. In this sense, asset mapping is one of the important instruments that contribute to prosperity and happiness of the villagers.[Artikel ini fokus pada upaya optimalisasi aset desa, terutama aset fisik atau sumber daya alam dalam upaya mem- perluas sumber penghidupan di desa. Melalui metode wawancara, observasi dan FGD, tulisan ini menyajikan tiga kasus untuk memperdalam dinamika perempuan dan ekonomi desa berbasis aset. Tulisan ini menunjukkan bahwa perempuan desa bisa menjadi profil warga aktif dalam mendorong ekonomi desa dengan cara berorganisasi serta memanfaatkan aset desa dalam rangka menemukan sumber penghidupan. Ini tentu kontras dengan persepsi yang selama ini berkembang bahwa perempuan desa hanyalah pelengkap dalam tata kehidupan di desa. Selain itu, tulisan ini menunjukkan bahwa aset desa memiliki kontribusi penting dalam menopang dan menggerakkan sumber peng- hidupan warga. Pemetaan aset juga berguna menjadi pijakan dalam upaya memperluas sumber penghidupan warga agar tidak terkungkung hanya mengandalkan satu sumber penghidupan saja. Industri kerupuk yang dikelola pe- rempuan desa adalah bukti konkrit mengenai peran perempuan desa dalam menggerakkan ekonomi warga sekali- gus berupaya mengolah bahan mentah di desa menjadi produk olahan yang siap jual. Dalam konteks tersebut, pemetaan aset adalah salah satu instrumen penting dalam menghadirkan kesejahteraan dan kebahagiaan warga desa.]

Abstract

Artikel ini bertujuan untuk mendialogkan pemahaman Ahmad Syafi’i Ma’arif, seorang negarawan dan agamawan di Indonesia kontemporer, atas QS. an-Nisa: 34 dengan diskursus kesetaraan gender dalam mengkontekstualisasikan ajaran Islam di Indonesia, termasuk peran perempuan di ruang publik. Letak penting pemahaman Ahmad Syaf’i Ma’arif adalah kemampuannya dalam memberi sikap tengah, tidak konservatif dan tidak juga liberal, dalam mengemukakan spirit kepemimpinan perempuan menurut Islam dan Negara. Syafi’i Maarif menilai wacana konteks antara Arab-Indonesia tidak dapat diabaikan ketika pembaca teks hendak memahami kandungan QS. an-Nisa: 34. Perempuan Arab memiliki ruang dan dinamikanya sendiri, yang berbeda dengan perempuan di Indonesia, sehingga konteks ini berpengaruh dalam memahami al-Qur’an. Catatan kesetaraan gender Syafii Maarif adalah ada keadaan tertentu, seperti mengandung dan melahirkan, yang hanya dilakukan oleh perempuan. Upaya Ahmad Syafii Maarif dalam mengkontekstualisasikan QS. an-Nisa: 34 adalah kerja penting atas pembumian al-Qur’an sebagai pedoman (QS. al-Baqarah: 2 dan 185) ke dalam kehidupan masyarakat Indonesia, sehingga Islam yang rahmatan lil alamin dapat dirasakan dari segi pengangkatan peran perempuan di ruang publik.[This article aims to provide understanding of Ahmad Syafi’i Ma’arif, an Indonesian statesman and religious leader, over QS. An-Nisa: 34 with the discourse of gender equality in the contextualization of Islamic teachings in Indonesia, including the role of women in public space. The important point of understanding Ahmad Syaf’i Ma’arif is in his ability to give a central, non conservative and illiberal in raising the leadership spirit of women according to Islam and the state. Syafi’i Maarif assessed that the context discourse between Arab-Indonesia can not be ignored when the reader want to understand the content of QS. An-Nisa: 34. Arab women have its own space and dynamism, that is different from women in Indonesia, so this context is influential in understanding the Qur’an. The notion of the gender equality of Syafi’s Ma’arif is that there are certain circumstances, such as pregnant and childbirth, that only women can do.  The efforts of Ahmad Syafi’i Ma’arif in contextualizing QS. An- Nisa: 34 is an important work on the ground of the Qur’an as a guideline (QS. Al-Baqarah: 2 and 185) into the lives of Indonesian society, so that Islam, as rahmatan lil alamin, can be felt in terms of the female role in the public space.]

Abstract

All people who enter the gates of family life through marriages intend to achieve a  prosperous and harmonious family life and receive blessing in this world and the next. Marriages must therefore be done in accordance with religious law. A marriage is legal if conducted in accordance with one’s religion, and must be recorded in the Office of Religious Affairs (KUA). Marriages which are not recorded by authorized officials are sirri marriages, and are contrary to legislation. Furthermore, its harm can be seen from its consequence, the lack of legal certainty between husband and wife and the children. This entails the legal consequence that sirri marriages do not have a Marital Deed and children borne of such marriage receive no government recognition, and are considered children born out of wedlock, only having civil relations with the mother and the mother’s family. The wife and children abandoned by a biological father cannot take legal action for the fulfillment of their economic rights or for joint marital assets.

Abstract

The Perspective of al-Syafi’I on Partnership in Marriage In husband and wife relationships, contemporary couples prefer a partnership pattern rather than one of  leadership. Although the latter is not necessary better than the former, it is obviously more accommodative of modern ideas of justice, egalitarianism and gender equality.  This article aims to explore the connections between household partnership patterns, as fundamental to contemporary Muslim’s, and the traditional Islamic jurisprudence (fikih) most dominant among the diverse adherents of Islam.   More specifically, this research describes al-Syafi`í thought. To explore the partnership patterns of married couples, it elaborates on three points: (1) the meaning of qawwamuna, (2) the concept of bride price and household expenses, and (3) interactions between husband and wife. The primary resource use in this research is al-Umm. This article concludes that Syafi’i jurisprudence implicitly accommodates the idea of partnership between marriage partners, as evident in (1) the acknowledgement of a woman’s right to choose her husband; (2) the bride price, which has both legal, formal and moral implications; (3) the co-understanding of the marriage partners in matters of household expenses and the emphasizing of discussion in solving financial problems; and (4) the use of good reason in dealing with household and personal conflicts.
