Musawa : Jurnal Studi Gender dan Islam
Musãwa Journal of Gender and Islamic Studies was first published in March 2002 by PSW (Pusat Studi Wanita) Sunan Kalijaga Yogyakarta under contribution with the Royal Danish Embassy Jakarta. In 2008, published twice a year in collaboration with TAF (The Asia Foundation), namely January and July. Musãwa Journal is a study of gender and Islam especially on gender mainstreaming and child rights both in the study of texts in the Qur’an and Hadith, figures and thoughts, history and repertoire, classical and contemporary literature as well as socio-cultural studies. All concentrations are in the context of Indonesia and other countries in Southeast Asia within the framework of unified NKRI, based on Pancasila. Musãwa Journal has been published by PSW UIN Sunan Kalijaga Yogyakarta since 2002. Initiated by lecturers, gender activists and Islamic studies scholars of PTKI ( Higher Education of Islamic Religion) Musãwa has regularly published academic works and researches on gender and Islam for almost two decades. Now, the Journal extends its studies with Children and Human Rights (HAM). All studies are still in the context of gender and its mainstreaming. Through the studies hopefully, the Musawa journal can be part of the implementation of gender mainstreaming in the context of Indonesian society.

Abstract

Tujuan penelitian ini adalah untuk mengetahui beragam resepsi pembaca terhadap bentuk ketidakadilan gender dalam cerpen feminisme berjudul Mata Telanjang. Bentuk ketidakadilan gender yang dibahas dalam penelitian ini meliputi: marginalisasi, subordinasi, stereotipi, dan kekerasan. Data resepsi dikumpulkan melalui kuesioner dan dianalisis berdasarkan metode resepsi sastra. Hasil penelitian ini menunjukkan adanya kontradiksi penerimaan pembaca terkait bentuk ketidakadilan gender terhadap tokoh perempuan (pekerja seks) yang ditawarkan oleh cerpen Mata Telanjang. Perbedaan perspektif dari pembaca disebabkan oleh latar belakang usia, pengetahuan, dan status sosial pembaca sehingga menimbulkan dua kelompok pembaca, yakni kelompok pembaca yang pro terhadap adanya bentuk ketidakadilan gender, dan kelompok pembaca yang menolak bentuk ketidakadilan gender pada tokoh perempuan dalam cerpen.[The purpose of this study is to find out various reader receptions towards gender inequality in feminism short stories entitled Mata Telanjang. The forms of gender injustice discussed in this study include: marginalization, subordination, stereotyping, and violence. The data of reception were collected through questionnaires and analyzed based on the method of literary reception. The results of this study indicate a contradiction in readers' acceptance of the form of gender inequality towards female leaders (sex workers) offered by Mata Telanjang short story. The difference in perspective from the reader is caused by the background of the age, knowledge, and social status of the reader. Here, there are two groups of readers, namely the readers who are pro against the form of gender inequality, and the readers who reject the form of gender injustice in female characters in the short story.]

Abstract

Indonesia has reached a stepping stone in increasing equality and justice in education for both male and female citizens. That can be proven by the ratio of participation in education and literacy rates of men and women. Women's involvements in non-agricultural sector, participation of women in politics and the large number of women who are actively participating in progressing technology are true and concrete indicators. This article tries to observe how far the part and participation of women in the struggle to increase and develop technology. This is very meaningful because practically all of humanity is touched by technology, however crude it may be. If man were to live without technology in this age, it would be like a car with no wheels. Its means that technology has been a vital part of our lives, even if it may seem ghastly, scary, and can even trap and kill of the rights of women. But orderly technology has helped the participation of women in the public space; and with technology, many domestic jobs that have always been done by women can also be done by men.

Abstract

The problem of unwanted pregnancy, better known as abortion, is not easy to solve. This article discusses the differing opinions toward the issue of abortion. Abortion is a multidimensional and controversial issue, particularly when it is carried out for social reasons. This article claims that abortion may cause a psychological burden for clients undergoing the procedure, both before and after the event. The doctors, nurses and people who assist them may also feel this psychological burden. As such, before performing an abortion, for whatever reason, clients should have access to counselling as an effort to safeguard their reproductive health.

Abstract

The Quran laid down a normative standard, that men and women should  be held in equal regards, also in matters spiritual. It strives for a meritocracy that the worship of God should be without a spiritual monopoly by one gender. Regrettably, this message becomes distorted through the imposition cultural and sociological aspects. Our patriarchal culture for example, takes the Quran and hadiths at face value, and refusing to realize its underlying message, creates misogynic rules and perspectives. A product thereof is a ban (or at least a strong discouragement) on women from going to the mosques to pray, resulting in a loss of religious rights and a limitation in the avenues of worship for women. Such inequality causes discomfort and loss of rights and dignity to women as human beings, and such inequality, being inherently detrimental towards justice and humanity must be put to an end.

Abstract

Within the Islamic marriage law, the issue of guardianship (wali) is quite important to discuss. There is no agreement on the "position" ofthe guardian within marriage in various madzhab. Furthermore, there are debates within the feminists on this very issue. Within numerous laws in different Muslim countries such as Indonesia and Iraq, the issue of guardianship has undergone some changes. This article attempts at exploring four laws on the guardianship in three Muslim countries: Indonesia, Iraq, and Syria.

Abstract

Artikel ini menelaah poligami dalam perspektif hermeneutika feminisme ala Amina Wadud. Buku Qur’an and Woman Rereading the Sacred Text from a Woman’s Perspective adalah landasan dasar dalam perwakilan pandangan Amina Wadud pada tiga pembahasan penting dalam pemikiran pada konsep pembebasan, konsep patriarkhi, dan klasifikasi makna feminis. Penulisan ini membedah hakikat pemikiran Amina Wadud pada hak perempuan dan kebebasan poligami dengan syarat. Islam adalah agama kebebasan dalam menata muamalat dalam pola pernikahan yang rahmatan lilalamin.[The article talks about polygamy in Amina Wadud's hermeneutic feminism theory. The base paper, the Qur'an and Woman Rereading the Sacred Text from a Woman's Perspective, is an essential root in Amina Wadud's thought view. Three meaningful discussions are in Amina Wadud's thoughts on freedom concepts in human rights, patriarchal concepts inhabit rule and classification of feminist meaning in the text Qur'an. This paper examines Amina Wadud's thoughts on women's rights and the polygamy perspective with the rule. Islam is a peaceful religion in engaging relationships in a pattern of marriage.]

Abstract

The analysis in this article will utilize the principles of non-discrimination and  the best interest of the child. The principle of non -discrimination is central in all international human rights convention. This principle of non-discrimination is deeply entwined with the principle of the best interest of the child. The latter principle is of paramount consideration in the issue of marriage registration. This article stresses that registration of marriage is not simply a simple nor personal issue, but also raises the issue of the rights of children. Therefore, this issue cannot be distanced from the  responsibility and role of the state. Unregistered marriages have a direct effect on  children as legal subjects, and individual whose rights are guaranteed, recognized and protected. Unregistered marriages are simply incompatible with the rights of children, as those marriages are positioned vis-à-vis the need for child protection, whether in family law or their individual fulfillment of rights. The legal consequence from such unregistered marriages is unfairly burdened on children. Therefore, the risks and consequences of such marriages stand as a barrier to children’s rights. The legal vacuum which arise must be dealt with. Children born from unregistered marriages must still have a legal relationship with both parents, a relationship which cannot be subverted legally. Even when born from unregistered marriages, the non-marital child must still have civil relations with his biological mother and her kin as well as his biological father and his kin.

Abstract

This article examines the agrarian conflict which caused the misery of farming families, particularly women in developing a livelihood in the village. Agrarian conflicts, as a result of customary land conversion to state land (negaranisasi tanah adat), should be solvable through the agrarian reform policies which is supported by the political momentum of decentralization and the issuance of the Village Act which gives village more opportunities to regain control of land assets. However, the practice in East Lombok showed that local government tends to give land occupation permits to private investors rather than implement agrarian reform policy that gives more justice to develop a more independent and prosperous. rural economy.
