Jurnal IUS established December 2012, is an institution that focuses on journal development for post graduate students and all law activists in general and specialised topics. Journal IUS publishes three times a year and articles are based on research with specific themes.
Jurnal IUS was founded by a group of young lecturers who had a passion to spread their ideas, thoughts and expertise concerning law. Jurnal IUS focuses on publishing research about law reviews from law students, lecturers and other activists on various topics. As an academic centre, we organize regular discussions around various selected topics twice a month.

Pada tahun 2020 lalu, Rumah Mode Christian Dior Couture, S.A. yang berkedudukan di Paris, Perancis, mengajukan permohonan kepada Kementerian Luar Negeri Republik Indonesia untuk menggunakan kain tenun Endek Bali dalam acara Paris Fashion Week untuk koleksi musim semi/panas (spring/summer) pada tahun 2021. Artikel ini bertujuan untuk memahami dan menganalisis konsep dan penerapan pelindungan dan pemajuan pengetahuan tradisional dan ekspresi budaya tradisional Indonesia dalam studi kasus penggunaan tenun Endek Bali oleh Christian Dior serta menganalisis pelajaran, baik kelebihan maupun kekurangan, yang dapat dipetik dari studi kasus tersebut. Artikel ini menunjukkan bahwa konsep pelindungan dan pemajuan pengetahuan tradisional dan ekspresi budaya tradisional Indonesia dalam studi kasus tenun Endek Bali oleh Christian Dior menggunakan konsep pelindungan hak kekayaan intelektual komunal dalam Undang-Undang Hak Cipta dan konsep pemajuan kebudayaan dalam Undang-Undang Pemajuan Kebudayaan. Adapun penerapan pelindungan tenun Endek Bali tersebut dilaksanakan dengan melakukan pendaftaran kekayaan intelektual komunal tenun Endek Bali sebagai ekspresi budaya tradisional dan pemajuan kebudayaan berdasarkan prinsip-prinsip dalam Undang-Undang Pemajuan Kebudayaan. Beberapa pelajaran dapat dipetik, yaitu kelebihan, bahwa adanya dukungan dari semua pihak, dan koordinasi serta sinergi yang relatif baik antara Pemerintah Pusat dan Pemerintah Daerah dalam setiap kronologis dan proses penggunaan tenun Endek Bali oleh Christian Dior serta penggunaan tenun Endek Bali yang dituangkan di dalam Memorandum Saling Pengertian antara Pemerintah Daerah Provinsi Bali dengan Christian Dior telah memberikan dampak secara positif terhadap perekonomian pada perajinnya

Pasal 78 Ayat (1) Undang-Undang Nomor 6 Tahun 2014 Tentang Desa mengatur bahwa Pembangunan Desa bertujuan meningkatkan kesejahteraan masyarakat Desa dan kualitas hidup manusia serta penanggulangan kemiskinan melalui pemenuhan kebutuhan dasar, pembangunan sarana dan prasarana Desa, pengembangan potensi ekonomi lokal, serta pemanfaatan sumber daya alam dan lingkungan secara berkelanjutan. Dalam rangka melaksanakan pembangunan Desa, Desa dapat mendirikan Badan Usaha Milik Desa. Pasca keberlakuan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja yang telah menegaskan kedudukan BUM Desa sebagai badan hukum. Penulis selanjutnya melihat adanya isu hukum yaitu apakah Interpretasi Bentuk Badan Usaha Milik Desa Pada Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja peraturan pelaksanaannya, serta implikasi yuridis pengaturan tersebut. Berdasarkan isu hukum tersebut di atas, maka penelitian ini bersifat “normatif” (dogmatik), dengan menggunakan pendekatan yakni : statute approach (pendekatan perundang-undangan). Hasil pembahasan pada penelitian ini adalah bahwa Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja dan peraturan pelaksananya yaitu Peraturan Pemerintah Nomor 11 Tahun 2021 Tentang Badan Usaha Milik Desa telah menegaskan kedudukan BUM Desa sebagai badan hukum, tetapi mengenai apa bentuk badan hukumnya hal ini belum diatur secara jelas dan tegas. Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja justru memuat norma yang membuka ruang multi tafsir mengenai bentuk badan usaha dari BUM Desa dan mengaburkan status BUM Desa sebagai badan hukum publik.

Tujuan Penelitian ini adalah untuk mengetahui konsep hukum peralihan hak atas tanah berdasarkan hukum positif di Indonesia. Untuk mencapai tujuan ini, penelitian ini menggunakan metode penelitian hukum normatif. Adapun hasil penelitian ini mengungkapkan bahwa terdapat tiga jenis hukum yang terkait dengan peralihan hak atas tanah di Indonesia. Pertama: KUHPerdata, ketentuan ini memiliki karakteristik perjanjian bersifat konsensual dan peralihan hak milik hanya dianggap terjadi jika perjanjian tersebut diikuti dengan levering atau penyerahan. Kedua: Hukum Adat, ketentuan ini memiliki karakteristik tidak hanya bersifat konsensual dalam perjanjiannya, akan tetapi juga bersifat konkrit sehingga persetujuan saja tidak cukup sebagai dasar peralihan hak atas tanah. Ketiga: UUPA melalui PP Nomor 24 Tahun 1997, ketentuan ini menganggap bahwa peralihan hak atas tanah dianggap terjadi ketika dilakukan pendaftaran peralihan hak atas tanah sesuai dengan prosedur yang telah ditetapkan. Peralihan hak atas tanah berdasarkan Hukum Adat memiliki kedudukan yang sah berdasarkan hukum positif Indonesia, namun jika tidak menghiraukan ketentuan dalam KUHPerdata maupun PP Nomor 24 Tahun 1997 maka kedudukannya pembuktiannya memiliki kedudukan hanya sebagai bukan akta autentik.

Melalui Instruksi Presiden Nomor 1 Tahun 2022 tentang Optimalisasi Pelaksanaan Program Jaminan Kesehatan Nasional, Pemerintah menginstruksikan kepada 30 (tiga puluh) Kementerian/Lembaga untuk menindaklanjuti agar kepesertaan BPJS menjadi syarat wajib dalam pelayanan publik. Instruksi tersebut merupakan peraturan kebijaksanaan yang berisi diskresi dalam menafsirkan UU SJN dan UU BPJS. Tujuan dari penelitian adalah untuk mengetahui diskresi memiliki Batasan dan untuk mengetahui instruksi presiden tersebut memenuhi syarat diskresi. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konsep yang ditunjang oleh bahan hukum primer dan bahan hukum sekunder. Berdasarkan hasil penelitian bahwa diskresi dibatasi AAUPB dan asas legalitas, serta Inpres Nomor 1 Tahun 2022 tidak memenuhi syarat diskresi karena bertentangan dengan ketentuan dalam UU No. 25 Tahun 2009 tentang Pelayanan Publik.

This paper aims to determine the role of coping strategies and legal protection on Indonesian migrant workers. By focus on coping strategies and legal protection on migrant workers. Since they are indirectly correlated and cannot be parted from Indonesian Migrant Workers. That being the case, this paper examines these two issues by conducting a literature review and portraying them descriptively. Where it is related to the condition of Indonesian Migrant Workers and the difficulties, they face in the migration process. Coping strategies, in this case, act as PMI's efforts to overcome problems or challenges in the individual and social spheres. On the other hand, legal protection plays a role as an effort by the government to protect and be responsible for the rights of its citizens. Both coping strategies and legal protections have a substantial contribution to PMI's welfare condition. In consequence, the protection of PMI does not just rely on the government, but all parties include the private sector (businesses or sponsors) and PMI themselves.

Constitutional Court will be able to provide protection for constitutional rights which will produce institutions that are able to provide answers to reforms. The presence of the Constitutional Court third amendment to the 1945 Constitution of the Republic of Indonesia, which became the basis of Article 24C. The legitimacy of the Constitutional Court in a limited way is formulated, namely: to begin, to investigate legislation that violates the constitution, to adjudicate disputes over the power of state institutions vested with constitutional authority, and to adjudicate the dissolution of political parties and settlement, the four general election disputes. In the modern state administration discourse, it currently requires the Constitutional Court to expand the scope of its authority in relation to Constitutional Complaints or commonly referred to as Constitutional Complaints. The necessity of one of these powers can be seen in the number of state institutions that violate the constitutional rights of citizens through the actions of these institutions. However, the channel for this complaint still does not exist, only that currently exists in providing protection for the right of Constitutional Complaints to be protected through judicial review of the basic constitution as regulated in the constitution.

The purpose of this study is to analyze the projected status of the Special Capital Region (DKI) Jakarta after the on-going move of Indonesia’s Capital City from Jakarta to Nusantara, and to analyze the legality status of the government’s decision regarding the move within Indonesia’s constitutional system. Through normative legal method, this study demonstrates that the status of DKI Jakarta as the capital city will change after the capital city move based on several articles in Law Number 3 of 2022 on Capital City; hence, the function and role of the capital city of the Republic of Indonesia will be transferred from DKI Jakarta to the National Capital City (IKN) after the president releases a presidential decree on the matter. Prior to the move, all positions, functions and roles of the capital city will remain in DKI Jakarta. Once the presidential decree related to the transfer of the capital city is released, the Law Number 29 of 2007 on the Provincial Government of Jakarta as the capital city of Indonesia will no longer be valid. However, Jakara’s function as an autonomous region will still apply. There are several steps that need to be done; firstly, compiling academic manuscript in drafting the academic text of Law Number 3 of 2022 on Capital City; secondly, conducting more discussions regarding Law Number 3 of 2022 on Capital City and the status of Law Number 29 of 2007 regarding the Provincial Government of Jakarta as the Capital City of Indonesia; thirdly, providing opportunity for public participation in the preparation and discussion in the making of Law Number 3 of 2022 on Capital City.

The realization of Indonesia’s vision to become the Global Maritime Fulcrum depends on eradicating illegal fishing, reducing overfishing, and rehabilitating damaged marine and coastal environments. However, there are still frequent violations, and exploration in Indonesian waters has not been maximized, so the desire to realize Indonesia as the Global Maritime Fulcrum will be difficult to achieve. This study intends to examine how to strengthen the maritime security legal system to realize Indonesia as the Global Maritime Fulcrum. The research approach used is normative juridical. The author uses a qualitative approach to secondary legal data. The data is in the form of interviews related to the efforts made by stakeholders towards strengthening the maritime security system and realizing the vision of the Global Maritime Fulcrum. This study indicates that to realize Indonesia as the Global Maritime Fulcrum is to strengthen its maritime security system. There are three indicators based on legal system theory, namely optimal maritime security institutions, especially Indonesia Coast Guard, strengthening legal products related to eradicating illegal fishing, improving maritime security infrastructure, and creating new branding to continue to remind the public that Indonesia is a maritime state.

This study aims to explore the concept and urgency of mediator’s good faith in mediating civil law. It is a normative juridical study (doctrinal) with secondary data from primary and secondary legal materials, using bibliography technique. Those materials are analyzed with a qualitative descriptive method. Further, good faith is put as the highest principle in agreement, including mediation and expecting to be implemented by all dispute parties and mediators as well. A mediator’s good faith should be carried out with earnest effort and intention formerly, instead of pushed by constitution to mandatory mediating dispute parties. This study has shown that good faith visibly implements if the mediator actively conducts the functions and responsibilities with confidentiality, volunteer, empowerment, neutrality, and exclusive solutions as the principles.

This article explains the policies and strategies currently used in Thailand for responding to terrorism. This study uses in-depth interviews with technicians and policy analysis experts in the area of cyber-attack, including more than 30 people in 15 governmental agencies. Specifically, the study begins by exploring the definition of cyberterrorism. Moreover, the study uses document research in both Thai and English and concludes that Thailand’s governmental agencies understand the concept of cyberterrorism and have already established policies and strategies for responding to it in the future.
