Abstract

This research discusses the phenomena on Islamic Criminal Law enforcement by applying whipping in the perspective of justice and human rights. Analysis is based on empirical research result in Nangroe Aceh Darussalam using socio-legal approach. Research data includes regulation related to Islamic Law enforcement and dynamic thought of the actors involved in the enforcement of Islamic Law. The research result shows that the competency of sharia court is limited to some criminal conduct regulated in qanun. Competency is limited to the Islam citizen.Key words : Syaria’ court, criminal act, voluntary self submission

Abstract

The Constitutional Court adjudication, as the nature of a court decision, implies the rights that the justice seekers will appreciate. It is unfortunate, however, that the appeal procedures for those who dissatisfied with such adjudication has yet to be issued, and this may produce the disadvantages for the purpose of affording justice. For such reason, the amendment on Procedures of the Constitutional Court, particularly in the appeal procedures, is very much needed.Keyword: Adjudication, Verdict, Constitutional Court, Legal Consequence, Justice Seeker

Abstract

The research is aimed to figure out whether the International Law is a genuine law. This concerns with why the international community is willing to obey the international law though it lacks of formal institutions that are in charge of empowering the law. This is a normative legal research. The data used in this research are the secondary data along with the secondary law material that is in the form of research result. Through this research, it can be concluded that the nature of coordinative relationship among international community - not having a supranational institution that has an authority in making and forcing the validity of certain international regulation at once to the citizens of nations that are breaking the international law – will not decrease the existence and the essence of the international law as a legal norm. The most major factor emerging the acceptance and the obedience of the international community towards its regulation is the awareness and the needs of all people towards which regulation that can offer the law and order, justice, and law enforcement that can be done and of which can not be done in the practice of the international law. The internally emerged obedience will offer a better result that the one emerged by the punishment.

Abstract

The discussion about access to essential medicine issues nowadays cannot be separated from the TRIPS Agreement. The TRIPS Agreement is important because one of its provisions (Article 27) deals with the protection of pharmaceutical patent which has a great relevance to access to essential medicine issues, such as affordability of drugs. The TRIPS Agreement also regulates a series of policies called the TRIPS safeguards, such as parallel imports, bolar provision, compulsory license and government use that can minimize and manage the impact of pharmaceutical patent protection on access to essential medicines. Indonesia’s patent law includes the safeguards provided by the TRIPS Agreement, such as parallel importation, bolar provisions, compulsory licenses and government use. However, several areas need to be improved so that the safeguards can be effectively used to manage the impact of pharmaceutical patent protection on access to medicines.  Indonesia should seek a balance between pharmaceutical patent protection and use of policies and strategies that are essential for its public welfare.

Abstract

The research is aimed at finding out which institution, the Corruption Eradication Commission (KPK) or the Indonesian National Police (POLRI), actually has the authority to conduct investigations in the driving simulator case because both institutions stated that they had the authority. This research uses a normative approach supported by legal approach and case study. The type of data is secondary data. The data sources include primary legal materials, secondary legal materials, and tertiary legal materials. The research finding is that according to Law No.30 Year 2002 on Corruption Eradication Commission, Article 50, the Corruption Eradication Commission has the authority to conduct investigations. This authority is also strengthened by the statement of President Susilo Bambang Yudhoyono. To settle the dispute between KPK and POLRI, the President stated in his speech on 8 October 2012 that the driving simulator case involving Inspector General Djoko Susilo should be handled by KPK. Moreover, considering the Memorandum of Understanding among Corruption Eradication Commission, Indonesian National Police, and Attorney General, the authority should be given to KPK.

Abstract

Nowadays, the regulation on food and drugs is considered to be clear and sufficient. However, the duty to examine, supervise and to avoid the dangers which are possible to happen, is not yet been undertaken. In addition to this, thre is no relevant body establisehed for such puposes. Therefore, the wise step to avoid any negative impacts of food and drugs is by incepting a regulation to supervise importing, consuming and the sirculation of such products.Keywords: food production, drugs, consumers’ rights

Abstract

The protection for Intellectual Property Rights (HKI) with higher standards than the one mentioned in the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs), known as TRIPs-Plus, has become a crucial legal issue in bilateralism era nowadays. This research is aimed at analyzing the stipulations in TRIPs-Plus in the case of Patent which is mentioned in several Bilateral Free Trade Agreement (BFTAs), analyzing the existence of TRIPs-Plus in BFTA between Indonesia and its business partner countries, and analyzing whether Indonesia needs to revise its Constitution regarding Patent to fulfill such commitment. This was a normative legal research which used constitutional, conceptual, and comparative approaches. The findings show that most of BFTA which are already agreed by developed and developing countries with their business partner countries , in the case of Patent, contain the standards of TRIPs-Plus. Such stipulation is also found in Indonesian Japan Economic Partnership Agreement (IJEPA). However, the revision of Constitution about Patent should be based on not only bilateral commitment, but also national interests.

Abstract

Together with the occurrence of democracy in Indonesia through reformation in 1998, the practice on state administration is in dynamic way. One of the dynamics is the existence of the regional autonomy whose implementation triggered a wide interpretation among society. One of the pros and cons around regional autonomy is the existence of shariah regional regulation in some places in Indonesia; one of them is in Tasikmalaya regency. Those who agree on this regulation based themselves on regional autonomy. Meanwhile, the ones who against the regulation have argument on the basis that religion business is on the hand of a central authority which is not given as a part of the autonomy

Abstract

The law enforcement procedures that has been running these days are still strongly hold on the form of procedural justice that urges the regulation aspect and the application of law in formal way only. As the impact, the trial to commit a fair law become less qualified or in the other word, it cannot solve the core of the problem. This research talks about a problem relating with the question about how to find an ideal format of justice on giving judgment in a court. This study uses normative juridical approach. Meanwhile, the data for this research are taken from the secondary data by using the analysis method of qualitativedescriptive. The result of the research shows that on handling a law’s case, a judge should not only see from law’s perspective only that is related with the procedural justice, but also he should see the substantive justice. As the consequence, it would be very advantageous if the procedural and the substantive justice can be combined and accommodated in the right proportion. But in a case where those two forms of justice cannot be compromised, then it is suggested to make the substantive justice as the first priority.Key words : Decision, substantial justice, procedural justice

Abstract

A country has an absolute and exclusive sovereignty for its airspace. Sovereign country has right to manage flight routes and its airspace, regarding the fact that airspace is very strategic for its defense and security. Violations of Indonesia’s airspace sovereignty by either civilian aircraft or state aircraft often occur. The problem discussed is: how are the legal arrangement and law enforcement related to the violations of a country’s sovereign territory according to international law and Indonesia’s national law. The research method was normative legal research with statute approach, historical approach, conceptual approach, and comparative approach. The research finding was presented in the form of descriptive analysis. The result concludes that neither international nor national law is strict enough in determining the legal status parameter of an aircraft, whether it is civilian or state aircraft. Such thing can result in a serious conflict related to the regulations for such aircraft.
