Abstract

Merariq sebagai tradisi perkawinan adat di masyarakat suku Sasak ternyata menyimpan potensi konflik yang tidak jarang berakhir dengan sengketa, karena diawali dengan peristiwa memaling atau mencuri atas dasar persetujuan si gadis dari kekuasaan orangtuanya, sebagai wujud sikap ksatria sekaligus bentuk keseriusan si laki-laki untuk menikahi si gadis. Namun di tengah kelemahannya ternyata sistem merariq telah menyediakan sarana alternatif penyelesaian berupa pelaksanaan negosiasi antara perwakilan pihak calon mempelai laki-laki dengan keluarga calon mempelai perempuan yang diistilahkan dengan selabar untuk menyepakati pembayaran ajikrame dan pisuke guna menuju perdamaian para pihak.Merariq is a customary law of marriage in Sasak society, this Merariq turned out to potentially create conflict that is commonly ended up with a dispute. The reason is because it begins with the events of rob (steal) on the consent of the girl approval from the power of her parents. The rob (steal) be done as a form of chivalry of the man’s seriousness marrying the girl. But amid that weakness, Merariq has provided an alternative dispute settlement by the process of negotiation between the representatives of the prospective groom to the bride family, which are termed selabar to agree on payment ajikrame and pisuke towards peaceful relationship between the parties.

Abstract

The significance of contract is to secure a fair transaction of rights and obligations of the party to the contract, by which it creates a safely properly and beneficially contractual relation. Under no circumstances is the contract made to harm one or both of the parties. Despite fair formation, due to breach of contract or force majeure the contract is not performed as supposed to be. The stipulation of force majeur clause, in some cases, are not accomodative to the business activity because the dispute settlement is usually put in the court. Therefore, there is a new way to apply hardship doctrine which in the perspective of business is seen more flexible and accomodative to solve the dispute. The hardship characteristic, as mention above, is appropriate to the business character which needs both dynamic activity and the business continuity among parties. The implementation of hardship doctrine is a "win-win solution" model which benefits both parties.

Abstract

The concept of promotion participation agreement should apply the system in the 3rd book of Civil Law (KUHP Perdata). The parties involved have reached and agreement with element of agreement. Therefore, the legal rule in the promotion participation agreement has almost entirely stated in this agreement. As a matter of fact, there still a possibility for the parties that chose not follow the rule, to make the agreement of their own.

Abstract

Corruption case in Indonesia has been growing rapidly, therefore it needs big efforts to eradicate and prevent corruption, such as establishment of Corruption Eradication Commission (KPK) and the enactment of Law No. 31 Year 1999 as amended by Law No. 20 Year 2001 (Anti-Corruption Law). Corruption itself, as regulated in Article 2 and 3 Anti-Corruption Law, consists of some main elementswhose subject is anyone.The illegal act must exist which aims to enrich themselves and should create loss of state finance or economy. The efficiency of Anti-Corruption Law can be seen by how every article can be fully and properly fulfilled. Only authorized legal entities can determine state finance loss as one of corruption elements. Then, the problems emerge from the legal entity which actually has authority to determine state finance loss, yet if the fulfillment element of state finance loss is not discovered, it means that the corruption suspected cannot be charged. Supreme Audit Board (BPK/SAB) and Finance & Development Supervisory Board (BPKP/FDSB) are legal entities which have authority to conduct audit investigation. This study, by using normative-empirical research method, will discuss whether both or only one of those state agencies have authority to determine state finance loss.

Abstract

Crime is reaction given by State to someone which have proven to make a mistake to conduct doing an injustice. As an instrument, crime dropped pursuant to and considerations of purpose selected so that will bring benefit for punished by self and for society. Therefore construction of crime person have to be given in execution of crime in institute of community. But the effort do not always in line with crime direction. Appearance of Inmate Subculture in convict community and also given by negative stigma is society is reality in life of diffraction convict become trigger of prisonisasi for convict. Side ejects execution crime in institute of community require to get special attention for convict repeal of freedom short-range. So that crime which isn’t it effective correct reach the target of expected crime, not on the contrary.

Aktivitas bisnis di Indonesia terkait erat dengan kebijaksanaan politis pemerintah, termasuk juga penanggulangan kejahatan bisnis Deviance Behavior merupakan fenomena yang melekat dalam praktek bisnis, dimana terjadi pelanggaran atau kejahatan yang tidak bertentangan dengan peraturan perundang-undangan tetapi juga bertentangan dengan moral dan etika masyarakat strategi penanggulangan terhadap kejahatan bisnis dapat dilakukan dengan cara-cara pemberdayaan komisi pengawas persaingan usaha serta badan penyelesaian sengketa konsumen, konsisten pada penegakan hukum, memotivasi persaingan bisnis untuk mencapai daya saing yang baik, pemberian informasi bisnis pada masyarakat.

Abstract

Pejabat umum di Indonesia yang bertugas untuk menjamin kepastian hukum bagi masyarakat yang melakukan perbuatan hukum mulai dari jual beli, sewa menyewa, waris, hibah, wasiat dan perbuatan perbuatan keperdataan lainnya. Dalam hal ini notaris sebagai pejabat umum yang diberikan wewenang oleh undang-undang, melalui diundangkannya Undang-Undang No. 30 Tahun 2004 tentang Peraturan Jabatan Notaris. Meskipun dalam UUJN telah jelas mengatur mengenai wewenang jabatan Notaris, namun dalam jabatan pejabat umum notaris bukanlah satu-satunya jabatan yang disandang pejabat umum untuk membuat alat bukti otentik (akta). Dalam pembuatan akta di bidang pertanahan dikerjakan oleh Pejabat Pembuat Akta Tanah, sedangkan untuk membuat Akta risalah lelang dibuat oleh Pejabat Lelang kelas II yang semuanya itu mempunyai dasar aturan dan pertanggung jawaban yang berbeda padahal sebenarnya wewenang tersebut telah ada pada jabatan notaris dan wewenang tersebut telah diatur secara jelas pada Pasal 15 UUJN. Jurnal ini akan menggunakan metode penelitian normatif, akan banyak menggunakan pendekatan konseptual, dan menggunakan pendekatan histori yang mana akan membahas sejarah dari masing-masing jabatan pejabat umum. Dalam menganalisa isu hukum akan menggunakan beberapa teori seperti teori wewenang. Pada akhir jurnal ini dapat kita temukan alasan mengapa jabatan pejabat umum harus dipisah, dan tidak disandang hanya dengan jabatan notaris.General public officials in Indonesia who are committed to ensuring legal certainty for people who commit legal acts ranging from sale, lease, heirs, grants, wills and other civil actions. In this case the Notary as a general officer authorized by law, through the enactment of Law No. 30 of 2004 on Notary Public Regulation. Although UUJN has clearly regulated the authority of a Notary position, but in the office of a notary public office it is not the only office held by a public official to create an authentic proof (deed) tool. In the making of deed in the field of land is done by the Land Authorities Act, whereas to make the Auction Brochure Act made by the Class Auction Officer all of which have different rules and responsibilities whereas the actual authority has already existed notary and the authority is regulated clearly in Article 15 of the UUJN. This journal will use normative research methods, will use a lot of conceptual approaches, and use historical approaches which will explain the history of each public official. In analyzing legal issues will use several theories such as the theory of authority. At the end of this journal we can find the reason why the position of public officials should be separated, and not only served by notary office.
