PERSPEKTIF is a peer-reviewed journal that publishes scientific articles in the field of law. The published articles are the results of original scientific research and review of legal interactions. PERSPEKTIF is published by the Institute for Research and Community Services (LPPM) of University of Wijaya Kusuma Surabaya. PERSPEKTIF accepts any manuscripts or articles in the field of law or legal studies from both national and international academicians and researchers. The articles published in PERSPEKTIF is published three times a year (in January, May, and September). Submitted article should follow the writing guidelines.

Government in performing national development really needs capital investment whether capital investment inside the country or capital investment in outside the country, especially in industrial sector. Difficulties in performing the development are caused by lack of capital, ability in technology, knowledge, experiences and skills, and it ’s nature is multi-dimensionality, therefore there is a need of a big capital. The efforts of central government and City government in attracting investment have been performed such as the lessen of bureaucracy paths, the given of guarantee to political and security stability, and law certainty besides the giving of incentive forms to the investors, therefore, they will be believe and have faith that capital investment in industrial sector will give much advantages to investors.

Hubungan hukum antara Dokter atau Bidan dan Akseptor KB dalam pelayanan pelaksanaan Program KB adalah hubungan kepercayaan, dimana akseptor KB mempercayakan pelayanan KB baik perawatan maupun pengobatannya kepada dokter atau bidan yang diberi kewenangan dalam pelaksanaan program KB. Hubungan hukum yang terjadi melahirkan hak dan kewajiban yang berlaku secara timbal balik. Bagi Dokter dan bidan yang melakukan kesalahan atau kelalaian sehingga menimbulkan kerugian maka akseptor KB berhak atas ganti rugi.

Desa merupakan bagian tak terpisahkan dari Negara Kesatuan Republik Indonesia. Eksistensi pemerintahan desa ini diakui dan dihormati secara konstitusional dalam Pasal 18B ayat (2) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Desa mempunyai otonomi dengan karakteristik tersendiri. Melalui otonomi ini desa dapat mengatur dan mengurus urusan pemerintahan desanya. Pada dasarnya otonomi desa dapat menjadi penggerak atau poros dalam pembangunan ekonomi nasional. Potensi desa yang begitu besar dapat dimanfaatkan dalam meningkatkan ekonomi nasional. Menjadi suatu permasalahan tentang bagaimana integrasi antara hukum modern negara dengan hukum yang hidup di desa, dalam kaitannya dengan pembangunan ekonomi nasional, dan bagaimana cara mengoptimalkan pembangunan ekonomi nasional melalui otonomi desa, serta Melakukan integrasi hukum ini perlu dilakukan melalui proses pembentukan hukum modern negara (peraturan perundang-undangan). Mendasarkan pada tiga pijakan penting dalam penyusunannya. Selain itu perlu juga untuk merefleksi kembali pemahaman tentang Pancasila. Optimalisasi pembangunan ekonomi berdasarkan otonomi desa, dilakukan melalui pemberdayaan dan pembenahan masyarakat, serta melakukan penataan pembentukan dan pelaksanaan Badan Usaha Milik Desa.Village is Republic of Indonesia integral part. The existence of the village administration is constitutionally recognized and respected in Article 18B (2) of the Republic Indonesia Constitution 1945. The village has autonomy with its own characteristics. Through this autonomy village will be able to regulate and administer the village government. Basically village autonomy can play an important role in the development of national economic. The potential of village can be used in improving the national economy. There came the problems about how is the integration between modern legal state law with village law related to the national economic development, and how to optimize the national economic development through village autonomy. This kind of law integration needs to be done through the process of establishing a modern state of law (legislation). Based on three important step in their preparation. It is also necessary to reflect the understanding of Pancasila. Optimization of economic development based on the village autonomy, can be conducted through the empowerment and improvement of society, and the arrangement of the formation and implementation of village-owned enterprises.

Public servant have an abligation to transparent on public policy related to citizen interest. This value is one of the important point in the Democratic Government and Good Governance principles. To apply the principle of transparent and public accountability if is need General principle law of administration (government). The "Batu" case is "maladministration of public servant". The problem is the period and requirement of the promotion is contradictive with regulation. But for all of the problem the Mayor of Kota Batu and Chief of Regional Administration of Public Servant Regional II East Java should be responsible.

Dinamika ketatanegaraan harus diwujudkan dalam ketentuan formal yang harus dipatuhi oleh lembaga-lembaga negara sebagai alat perlengkapan negara. Memorandum adalah tata cara yang ditetapkan sebagai bentuk pengawasan DPR terhadap kinerja Presiden dalam melaksanakan GBHN. DPR akan meminta kepada MPR untuk mengadakan Sidang Istimewa, bila Presiden tidak memperhatikan Memorandum DPR tersebut. Realitas yang terjadi di balik fenomena Memorandum dan Sidang Istimewa adalah saratnya nuansa kepentingan politik berbagai pihak yang terlibat, adanya polemik interpretasi hukum yang sebenarnya telah disadari adanya legitimasi formal atas permasalahan tersebut. Hal ini ditambah dengan belum membudayanya ketertundukan pada supremasi hukum di kalangan politisi yang duduk dalam Majelis dan Parlemen.

Foundation is a corporation that has particular aim in social, religiousness and humanism sector. Its corporate status is obtained after Ministry of Justice and Human Rights approved its Founding Document. The achievement of its aim and business activity is set based on the Statutes mentioned in the Founding Document which referring to the Foundation Regulation. While it has no members, foundation has components such as Advisors and Foundation Board in which, based on the transparency principles and public accountability, a control mechanism should be held, i.e.: 1. Internal control, by the foundations component named Controller; 2. Annual reports; 3. Audit by Public Accountant; 4. Enquete Right by Attorney General or other concerned parties; and 5. Attorney General authority. As a component in the organization, the foundation board responsible for losses caused by ultra vires action and has a possibility of collective responsibility among the member of the board, or along with the advisor in case of a mistake or a carelessness that leads into a bankruptcy.
