Abstract

Obyek transaksi antara produsen dengan konsumen, lazimnya menyangkut produk barang. Produsen sebagai pihak yang menghasilkan dan mengedarkan barang tidak dapat dilepaskan dari tanggung jawab produknya. Konsumen harus terjamin bahwa produk yang dibeli tidak mengandung cacat. Pertanggungjawaban produsen atas produk yang cacat, yaitu produk yang tidak dapat digunakan sesuai fungsinya, dapat berdasar, baik karena perjanjian maupun perbuatan melawan hukum.Fransantion object between producen and consumers usually relates to goods product. Producen as a party/side that produces and distribute. Goods must not be separated from the produc responsibility. Consumers Must be guarranteed that the purchased-goods should not be invalided. The producers accountability on invalided products is the product that can not be used according to its function is based on both an agreement and unlawful acts.

Abstract

Pemberlakuan Undang-Undang No. 21 Tahun 2011 tentang Otoritas Jasa Keuangan (UUOJK), membawa harapan dan kepastian hukum bagi perlindungan konsumen di sektor jasa keuangan di Indonesia. Namun demikian sebelum pemberlakuan UUOJK, telah terdapat pengaturan mengenai perlindungan konsumen, yakni dalam Undang-Undang No. 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK). Ruang lingkup pengaturan UUPK pada dasarnya juga mencakup perlindungan konsumen di sektor jasa keuangan yakni perbankan, lembaga pembiayaan dan asuransi. Metode penelitian merupakan metode yuridis normatif yakni penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder. Penelitian bersifat deskriptif analitis dengan menggunakan metode normatif. Berdasarkan hasil dan pembahasan diperoleh kesimpulan bahwa pengaturan perlindungan konsumen di sektor jasa keuangan dalam UUOJK pada dasarnya merupakan peraturan khusus yang mengatur mengenai perlindungan konsumen di sektor jasa keuangan. Namun karena adanya perbedaan definisi konsumen dalam UUPK dan UUOJK maka secara umum UUPK bukan merupakan lex generalis dari UUOJK. UUOJK dapat dipandang sebagai lex specialis dari UUPK sepanjang mengenai konsumen dalam pengertian konsumen menurut UUPK.Enforcement of the Act No. 21 Year 2011 on the Financial Services Authority (UUOJK) brings hope and legal certainty for consumer protection in the financial service sector in Indonesia. However, there has been a regulation on consumer protection, namely in Law No. 8 of 1999 on Consumer Protection (UUPK) before the enactment of UUOJK. The scope of UUPK regulation also basically includes consumer protection in the financial service sector which are banking, finance and insurance institutions. This study is a normative legal research which studies library materials or secondary data. The study is analytical descriptive that uses normative methods. Based on the results and discussion, it is concluded that regulation of consumer protection in the financial service sector written in UUOJK is basically special rules governing consumer protection in the financial service sector. However, UUPK is generally not a lex generalis of UUOJK due to different definition of consumer in UUPK and UUOJK. In the case of term consumer according to UUPK, UUOJK can be regarded as lex specialis of UUPK.

Abstract

Role of labour in filling national development very big its meaning. Attention to prosperity of labour shall be conducted seriously because related the mentioned sliver with effort improve national productivity. For the reason protection of law to labour have to be balanced with protection of law which have been specified to employer party. Difference of social status among activity energy labour with employer oftentimes problems menyulut that happened To employer party which is strong social status of often in specifying policy cause loss to labour. On the other side labour party is not easy to present to which its it, considering its much more compared to low social status of its employer Even what conducted by employer frequently get out of responsibility judicially The mentioned happened because rule which included in of No. 13 Year 2003 about conducive Ketenagakeejaan for that and still there are congeniality difference so that emerge other interpretation.

Di sisi lain, dalam menghadapi tantangan persaingan global, pemberdayaan konsumen merupakan salah satu cara yang efektif. Pemberdayaan konsumen dapat dilakukan melalui wacana hukum dan non hukum.

Abstract

The change of social pattern from traditional agrarian into modern industry has impact in woman transformation role. The previously woman role in the ‘back side’ or ‘under the man shadow’ begins to start into questions. Egalitarianism motto becomes familiar together with the extension of woman role. Anyhow, such change should be responded with a clear and specific policy. Accordingly, law as a tool of social engineering should be able to accommodate them, as well as gives the guarantee for the extension of woman role that has been once pushed in a corner by feudalism tradition.

Penataan hubungan antara Gubernur dengan Bupati/Walikota dalam pelaksanaan tata pemerintahan yang baik dan penataan kelembagaan yang dapat mensinergikan hubungan kewenangan pemerintahan yang efektif antara Pemerintah Provinsi dengan Pemerintah Kabupaten/Kota. Pola hubungan antara Gubernur dengan Bupati/Walikota dalam kaitannya dengan pelaksanaan tata pemerintahan yang baik dalam pelaksanaan peran Gubernur sebagai wakil pemerintah pusat, maka hubungan antara Gubernur dengan Bupati/Walikota bersifat bertingkat di mana Gubernur dapat melakukan peran pembinaan dan pengawasan terhadap penyelenggaraan pemerintahan daerah. Sebaliknya Bupati/Walikota harus senantiasa berkoordinasi dalam penyelenggaraan pemerintahan di daerah, termasuk dalam hubungan antar kabupaten/kota dengan provinsi.This Article are trying to find the relationship pattern between the governor and regent/majors, in the field of government management, also to find out managing form that may show a sinergical inter relationship between province and regency government. Based on the research, we found that the relation pattern between governor and regents related to the implementation of good governance in governor enforcement as the representative of the central government is that inter relation between governor and regents/majors are in the gradual level, which governors can do a form of mentoring and supervising. In other hands, regents should always perform coordination in region governance enforcement, including the relationship between regency and province government.
