Abstract

The aim of the study is to understanding and explore the meaning of the constitutional rights of Indonesian citizens to a decent living from a spatial planning perspective by evaluating policies and the implications of evolution interpretations of sustainable principles. Normative legal research methods are used with several approaches such as legislation, concepts, analytical, philosophy, and cases. The results of the study show that Article 27 paragraph (2) of the 1945 Constitution of the Republic of Indonesia concerning the right to a decent living has an important position in development and spatial planning in Indonesia as grundnorm. The evolutionary interpretation according to Dewa Gede Atmadja emphasizes the importance of involving various aspects of sustainability principles in development. To overcome the problem of spatial patterns, controlling the use of spatial patterns can be carried out through the establishment of district/city zoning regulations which are regulated in the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 11 of 2021, as well as Based on Law No. 32 of 2009 concerning Environmental Protection and Management and Article 14 A of the Spatial Planning Law. The preparation of Regional Spatial Planning (RTRW) must be based on identifying the physical condition of the area and taking into account the Strategic Environmental Study (KLHS) to prevent environmental damage. Keywords: Evolutionary Interpretation, Principles of Sustainability, Decent Livelihoods, Spatial Planning Penulisan artikel ini bertujuan untuk mengkaji dan mengeksplorasi dari adanya kekaburan norma terhadap asas berkelanjutan pada hukum tata ruang dalam memengaruhi hak konstitusional warga negara Indonesia untuk memperoleh penghidupan yang layak, dengan fokus pada evaluasi kebijakan dan implikasi interpretasi evolutif terhadap asas berkelanjutan dalam memaknai hak tersebut. Studi ini menggunakan metode penelitian hukum normatif, didukung dengan pendekatan perundang-undangan, pendekatan konsep, pendekatan analisis, pendekatan filsafat, dan pendekatan kasus. Adapun hasil kajian terhadap penelitian ini bahwa dengan mempertimbangkan konsep grundnorm dalam teori hukum, dapat disimpulkan bahwa ketentuan Pasal 27 ayat (2) UUD NRI 1945 mengenai hak penghidupan yang layak memiliki kedudukan yang sangat penting dan mengikat dalam konteks pembangunan dan penataan ruang di Indonesia. Pasal ini merupakan salah satu bentuk dari grundnorm atau norma dasar negara yang memberikan landasan bagi semua aturan hukum lainnya di Indonesia. Berdasarkan teori Interpretasi Evolutif menurut Dewa Gede Atmadja bahwa pemaknaan terhadap ketentuan perundang-undangan tidak boleh terbatas pada satu norma saja, mengingat kompleksitas asas keberlanjutan dalam pembangunan di Indonesia. Untuk mengatasi masalah penyimpangan penataan ruang, pengendalian pemanfaatan ruang dapat dilakukan dengan melibatkan stakeholder terkait dan melalui penetapan peraturan zonasi kabupaten/kota yang diatur dalam Peraturan Menteri Agraria dan Tata Ruang/ Kepala Badan Pertanahan Nasional Republik Indonesia Nomor 11 Tahun 2021 Tahun 2011, serta Berdasarkan Undang-Undang No. 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup dan Pasal 14 A UU Tata Ruang. Penyusunan Rencana Tata Ruang Wilayah (RTRW) haruslah berdasarkan pada identifikasi kondisi fisik wilayah dan memperhitungkan Kajian Lingkungan Hidup Strategis (KLHS) untuk mencegah kerusakan lingkungan Kata kunci: Interpretasi Evolutif, Asas Keberlanjutan, Penghidupan Yang Layak, Tata Ruang

Abstract

Artificial Intelligence (AI) is one of the leading technologies that has begun to attract attention in the financial sector across various regions worldwide, including Southeast Asia. One potential application of AI is its ability to automatically detect specific data or situations within an electronic system, which can be utilized to identify money laundering activities. However, this cutting-edge technology may also result in certain unintended legal implications. The purpose of this study is to explore the potential and legal challenges in utilizing AI for the detection and prevention of money laundering. This research employs a normative legal research method to examine the legal implications of AI utilization in efforts to prevent and combat money laundering. The analysis reveals that significant normative issues persist regarding the legal certainty of AI applications in general, which poses complex challenges when coupled with specific legal implications, such as consumer protection and the safeguarding of privacy and data rights. This study proposes a legal development model that emphasizes balancing the efforts to prevent and combat money laundering with the rights of financial service users to maintain the integrity of the financial system.

Abstract

Law No. 1 of 1974 represents the unification of national laws in the field of marriage, deriving from Islamic law, civil law, and customary law. As society has progressed in the era of modernization and digitalization, this law has presented numerous legal issues, underscoring the need for legal reform to address legal voids and conflicts. Over its 50-year history, at least seven judicial reviews have been initiated, challenging provisions that conflict with the 1945 Constitution of the Republic of Indonesia (UUD NRI 1945), particularly those that are inconsistent with principles of justice and human rights for all citizens. This study utilizes normative (doctrinal) legal research methods, incorporating three approaches: statutory, comparative law, and analytical methods. The analysis highlights the necessity of reconstructing Law No. 1 of 1974 on Marriage to ensure it aligns with principles of justice and human rights, focusing especially on Article 2(1) (regarding interfaith marriages), Article 7 (marriageable age), Article 43(1) (status of children born outside of lawful marriage), Article 57 (mixed marriages), and provisions related to child rights post-divorce.

Abstract

The purpose of writing this scientific article is as a material to deepen insight related to the perspective of criminal law and health law regarding the act of abortion and how the form of liability of the perpetrator who performs the act of abortion based on juridical perspective. Abortion is an act of miscarriage of the unwanted / unwanted pregnancy that is done intentionally and is an event that occurs as a result of a human action with his efforts so that a pregnancy can be aborted. When reviewing abortion in terms of the Criminal Code, there is no room for such actions. However, when looking at the Health Law (Law No. 36 of 2009 generally prohibits abortion, but there are special provisions that become exceptions so that abortion can be done. In this case there is a misalignment between the two regulations.

Abstract

This research endeavors to analyze the safeguarding of the traditional cultural expression of the “perang ketupat” as a communal intellectual property in Tempilang District, West Bangka, as well as to explore the perception of the Air Lintang community in Tempilang District towards efforts to protect the “perang ketupat” tradition as communal intellectual property. This study employs a socio-legal approach through combining qualitative analysis and a simple quantitative survey. Qualitative analysis is carried out to understand the social context, cultural values, and community perspectives in managing communal intellectual rights. The quantitative survey involved 110 respondents from 11 neighborhood units in Air Lintang village to measure community perceptions about legal protection of the “perang ketupat” tradition. The results show that although the Tempilang community consistently preserves the “perang ketupat” tradition, their grasp of intellectual property rights and the corresponding legal safeguards remains underdeveloped. Most respondents acknowledge the significance of safeguarding traditional cultural expressions using legal instruments, However, most respondents have an incomplete understanding the implications of registering the “perang ketupat” as communal intellectual property. This research encourages strengthening community legal awareness through legal literacy programs involving collaboration between the government, local governments, and universities.

Abstract

This study analyzes the regulation and enforcement of cryptocurrency-related money laundering in Indonesia compared to the United States. Through normative legal research method and a comparative approach, regulations in both countries are evaluated. In the United States, government agencies such as FinCEN, IRS, and SEC play roles in law enforcement, while Indonesia relies on BAPPEBTI. Although the United States has more comprehensive laws, Indonesia has also taken steps to address this issue, including through the "Travel Rule." However, the main challenge is the anonymity of cryptocurrency, which makes investigations difficult. To address this, more detailed regulations are needed, along with international cooperation to prevent money laundering through cryptocurrency.

Abstract

A decent living is a standard requirement for an employee or single worker to live physically well within a month. To fulfill this, the government has established regulations so that the wages earned by workers can meet their basic living needs. This study discusses the wage system in Indonesia, as well as the Wage System for Workers at PT Wedanata Industri Nusantara in Badung, Bali. The methodology used is an empirical juridical research methodology, approaching facts occurring in the field related to the legal issues examined. The aim of this research is to understand the implementation of wage regulations in conversion companies. It can be concluded that Indonesia has regulations governing wages and wage systems.

Abstract

This research discusses the Visum et Repartum policy as one of the use of medicolegal aspects to foreign tourists as victims of sexual violence in Indonesia. In several cases, victims are often embarrassed, insecure and even hesitant to report the perpetrator to the authorities due to the lack of evidence to support the victim of sexual violence. One solution that can be taken for victims of sexual violence is by carrying out Visum et Repartum. The problem arises regarding the settlement through the post-mortem, there has been a vacuum in the norms governing the guidelines for implementing the post-mortem. The results show that various regulations in the existing law do not regulate in detail and firmly the guidelines for implementing Visum et Repartum for victims of sexual assault in Indonesia, in order to support those who have been harmed by it often have difficulty reporting it to the authorities and proving it in KUHAP. In this research, the Visum et Repartum arrangements for foreign tourists who are victims of sexual violence in Indonesia are regulated by several laws and regulations in Indonesia, one of which is regulated by the Tourism Law and the Sexual Violence Crime Law. The form of legal regulation regarding the appropriate implementation of Visum et Repartum for foreign tourists who will be covered by the new law as victims of sexual assault (Ius Constituendum) can be in the form of regulations or policies that specific regulate law enforcement guidelines for the implementation of Visum et Repertum in Indonesia. In practice, currently there are no regulations governing the implementation of Visum et Repartum for foreign tourist victims properly and correctly in accordance with Indonesian regulations.

Abstract

The general purpose of writing in this scientific journal is to find out the legal basis for marriage for Hindus in Bali and specifically to find out the legality of virtual Hindu marriages from the perspective of National Law in Indonesia. The writing method used is descriptive normative legal research using a statutory approach and a case approach. The first research result is the Legal Basis for Hindu Marriage in Bali, which refers to Article 28 paragraph (1) of the 1945 Constitution, Article 1 & Article 2 of Law Number 1 of 1974 concerning Marriage, Law Number 16 of 2019 concerning Amendments Based on Law Number 1 of 1974 concerning Marriage, Rigveda X. 85.23 & Rigveda VI.15.19. The second research result, namely the Legality of Virtual Hindu Marriages in the Perspective of Law Number 1 of 1974 concerning Marriage, is that national norms do not regulate virtual marriages so it can be said to be an empty norm. Viewed from custom, tradition and religion, there are no rules regarding virtual marriage because it can be seen that the conditions that must be met to make a Hindu marriage in Bali valid are one of the witnesses in the mabyakala (wiwaha) ceremony which involves 3 witnesses or Tri Upasaksi, namely the witness god, human witnesses, and bhuta witnesses.
