Abstract

Legal uncertainty in inheritance distribution in Indonesia stems from the simultaneous application of three inheritance law systems without a clear hierarchy. This study aims to analyze the legal position of widows and widowers as first-class heirs from the perspective of filial justice and to formulate an ideal model of family protection norms following the death of a spouse. The method employed is normative juridical research utilizing statutory, conceptual, and comparative approaches. The findings indicate that filial justice has not been applied consistently across the three legal systems, as reflected in the inconsistency of Supreme Court jurisprudence. This study proposes a proportional-contributive reconstruction model integrating contributive proportionality, minimum protection for the surviving spouse, and guaranteed filial justice, positioning both values as mutually reinforcing pillars within a coherent inheritance law framework.

Abstract

This research aims to analyze the legal problems in the execution of inheritance regarding share ownership in family companies in Indonesia. The research method used is normative legal research with statutory and conceptual approaches. The results indicate that the main challenge in executing share inheritance lies in the conflict between inheritance laws (Civil Code or Islamic Law) and the provisions of the company's Articles of Association, as well as the Law on Limited Liability Companies. The scope of the research focuses on procedural obstacles when heirs enter the shareholder structure, which often trigger internal conflicts and threaten business continuity (going concern). The conclusion of this study emphasizes the need for regulatory synchronization and the drafting of buy-back clauses or restrictions on the transfer of share rights within the Articles of Association to ensure legal certainty for heirs and corporate stability. The effectiveness of the execution heavily depends on mediation among heirs and compliance with the principles of information disclosure within the company.

Abstract

The implementation of Western Civil Inheritance Law based on the Burgerlijk Wetboek (BW) in Indonesia is often carried out through family deliberation. Although BW normatively regulates inheritance distribution, heirs generally prioritize mutual agreement to maintain family harmony. This study aims to analyze the application of BW inheritance law in the practice of family deliberation in inheritance distribution in Indonesia. The results show that family deliberation is more commonly chosen because it is considered capable of creating a fair and peaceful settlement while preventing disputes among heirs without disregarding applicable legal provisions.

Abstract

. Inheritance disputes often trigger family conflicts, particularly when one heir unilaterally sells inherited property without the consent of other heirs. This study aims to analyze the regulation of inheritance law in the Indonesian Civil Code (KUHPerdata) regarding such actions and to examine its function in resolving disputes among heirs. The research uses a normative legal method with a statutory approach. The results indicate that under KUHPerdata, an undistributed estate is considered jointly owned by all heirs and therefore cannot be transferred or sold unilaterally. Such actions may be classified as unlawful acts and have the potential to cause disputes. Thus, inheritance law in KUHPerdata plays an important role in providing legal certainty and serves as a mechanism for resolving conflicts to protect the rights of all heirs.

Abstract

Environmental pollution in agglomeration areas creates challenges in environmental law enforcement because the source of pollution is often difficult to identify specifically (unidentified polluter). Conventional liability mechanisms that require proof of an individual causal relationship make it difficult for victims to obtain legal protection, even though environmental and public health damages are clearly evident. The Market Shared Liability (MSL) doctrine is considered relevant because it allows liability to be imposed proportionally based on the market share or contribution level of each corporation to the pollution. The implementation of this doctrine is important to overcome evidentiary deadlocks in collective pollution cases within agglomeration areas and to ensure the protection of the public’s right to a good and healthy environment. Therefore, explicit regulation regarding Market Shared Liability in Indonesia’s environmental procedural law is necessary. Pencemaran lingkungan di wilayah aglomerasi menimbulkan kesulitan dalam penegakan hukum karena sumber pencemar sering kali tidak dapat diidentifikasi secara spesifik (unidentified polluter). Mekanisme pertanggungjawaban konvensional yang mensyaratkan pembuktian hubungan kausal secara individual menyebabkan korban kesulitan memperoleh perlindungan hukum, meskipun kerugian lingkungan dan kesehatan masyarakat nyata terjadi. Doktrin Market Shared Liability (MSL) menjadi relevan diterapkan karena memungkinkan pembebanan tanggung jawab secara proporsional berdasarkan pangsa pasar atau tingkat kontribusi masing-masing korporasi terhadap pencemaran. Penerapan doktrin ini penting untuk mengatasi kebuntuan pembuktian dalam kasus pencemaran kolektif di wilayah aglomerasi serta menjamin perlindungan hak masyarakat atas lingkungan hidup yang baik dan sehat. Oleh karena itu, diperlukan pengaturan eksplisit mengenai Market Shared Liability dalam hukum acara lingkungan di Indonesia.

Abstract

Article 66 of Law Number 32 of 2009 concerning Environmental Protection and Management provides legal protection for environmental defenders from criminal prosecution and civil lawsuits. However, its implementation still faces challenges in law enforcement practices. This study discusses the effectiveness of Article 66 of the Environmental Protection and Management Law in the case of the arrest of two environmental activists in Semarang in November 2025. The research uses a normative legal method with statutory and case approaches. The results show that legal protection for environmental defenders has not been fully effective because law enforcement officials tend to focus on criminal allegations without considering the context of environmental advocacy. Therefore, a more consistent implementation of the Anti-SLAPP principle is needed to ensure effective legal protection for environmental defenders.

Abstract

River pollution from industrial waste poses a serious threat to ecosystem sustainability and community welfare in the industrialisation era. This study aims to analyse the implementation of environmental law enforcement  in the Citeureup River pollution case involving PT Harapan Mulya in Bogor Regency, as well as to assess its effectiveness and impact on surrounding communities. The research employs a normative juridical method with a qualitative and conceptual approach, focusing on secondary data such as laws, regulations, and scientific literature. The findings show that law enforcement has been carried out gradually through administrative measures by the Bogor Regency Environment Office, including site sealing and closure of waste channels  (grouting) as forms of government  coercion (bestuursdwang). There is also potential for criminal sanctions under Law Number 32 of 2009 through the principle of strict liability. The pollution has significantly degraded water quality, damaged aquatic ecosystems, and caused health problems and economic decline for residents relying  on the river. The study concludes that although regulations are systematic, effective enforcement requires stronger supervision , better coordination, and greater compliance from business actors to ensure environmental protection and intergenerational justice

Abstract

Environmental pollution caused by industrial waste is a serious problem with the potential to trigger ecological disasters, particularly in large industrial zones such as the Indonesia Morowali Industrial Park (IMIP). This study aims to analyze legal regulations regarding environmental pollution, examine the liability of polluters, and evaluate the effectiveness of environmental law enforcement in Indonesia using a normative legal approach. The results of the study indicate that Indonesia has a fairly comprehensive legal framework, particularly through the Law on Environmental Protection and Management. However, implementation and enforcement still face challenges, such as weak oversight. The legal liability of polluters covers administrative, civil, and criminal aspects, but has not been optimally enforced. Therefore, strengthened oversight, consistent law enforcement, and synergy among stakeholders are required.

Abstract

Illegal logging practices in Katingan Regency, Central Kalimantan, remain a grim portrait of systemic environmental crime. These illegal activities not only destroy the ecosystem's carrying capacity and trigger a local climate crisis, but also undermine the country's economic stability and threaten the living spaces of indigenous communities. Using normative juridical methods and in-depth literature review, this study seeks to map the complexity of the causal factors and evaluate the extent to which legal enforcement has been enforced in the region. Illegal logging in Katingan is driven by the conflict between high global market demand and the economic hardships of communities surrounding forest areas. This situation is exacerbated by minimal oversight in remote areas, limited personnel, and the shadow of corruption in forestry licensing mechanisms. Constitutionally, Indonesia has legal safeguards in place through Law No. 41 of 1999 and Law No. 18 of 2013. However, the reality on the ground shows that law enforcement is often hampered by geographical barriers and an inefficient bureaucratic structure. As a solution, a policy reorientation is needed that does not only rely on criminal sanctions, but also prioritizes improved governance, synergy between agencies, and concrete community empowerment programs to ensure the sustainability of forests in the future.

Abstract

The fire at PT Biotek Saranatama's pesticide storage facility in South Tangerang in February 2026 resulted in significant environmental consequences. The fire caused approximately 20 tons of poisoning, with waste carried by the air and polluting rivers. This study aims to examine the environmental consequences and examine the application of relevant criminal sanctions. The approach used is normative juridical, through regulatory review and case investigation. The study results indicate that this incident caused widespread air pollution, the death of airborne biota, and potential public health problems. A legal review indicates that this case is punishable as an environmental crime under Law No. 32 of 2009. This is due to the element of negligence that caused environmental damage due to pollution. Legal enforcement for corporations is necessary to ensure that sanctions are educational and raise awareness of compliance with hazardous materials management standards..
