Abstract

Kebutuhan manusia akan informasi merupakan kebutuhan manusia yang lebih mudah untuk dipenuhi. Informasi yang deras dapat mempengaruhi kehidupan dunia yang dimana mulai dari berita ya atau dengan kata lain berita yang sudah ketinggalan zaman hingga informasi terbaru pun menjadi sangat mudah diakses sesuai dengan perkembangan zaman. Perkembangan inilah yang dapat menjadi kreasi dan inovasi menusia. Penelitian ini lebih memfokuskan kepada penggambaran fenomena sosial yang berhubungan dengan objek penelitian, sehingga spesifikasi penelitian ini bersifat deskriptif analisis, Data-data primer yang diperoleh pada penelitian dikumpulkan, kemudian diolah dan diklasifikasikan kedalam bagian-bagian tertentu, untuk seterusnya. Prinsip-prinsip kode etik wartawan yang berindekasi pencemaran nama baik yang dilakukan pers media massa cetak berita yang mengandung unsur pencemaran nama baik di koran merupakan suatu tindak pidana, karena telah memenuhi unsur-unsur untuk dapat dikatakan sebagai tindak pidana. Batas-batas suatu pemberitaaan dalam media massa cetak dapat pencemaran nama baik ditinjau dari perspektif yuridis pencemaran nama baik sumber daya manusia, bahwa kebijakan Kode Etik Jurnalistik belum efektif, karena masih terdapat pelanggaran kode etik yang memiliki unsur kesengajaan dan tidak kesengajaan. Pertanggungjawaban pidana bagi pers apabila melakukan perbuatan pencemaran nama baik kebijakan kode etik jurnalistik secara umum belum maksimal. Hasil analisis penulis menilai bahwa Kode Etik Jurnalistik masih relevan untuk mengatur para wartawan yang bekerja di dunia pers. Pasal-Pasal yang dituangkan dalam Kode Etik Jurnalistik berkaitaan dengan etika para wartawan dalam menjalankan profesinya. Namun penulis menilai kinerja Dewan Pers belum maksimal.

Abstract

Land disputes are a complex problem that frequently occurs in Indonesia, including in Serdang Bedagai Regency. Land, as a strategic resource, is often the object of disputes due to unclear ownership, inheritance that is not properly resolved, land purchases that do not comply with legal procedures, and conflicts between communities and the government or companies in land acquisition. The problem faced by the people of Serdang Bedagai Regency is the lack of understanding of the mechanism for resolving land disputes through inter-party agreements as a more effective and efficient alternative to out-of-court settlement. Many land dispute cases drag on and end in social conflict due to the community's lack of understanding of the procedures and benefits of dispute resolution through agreements. To address this problem, socialization activities were conducted through counseling for the people of Pematang Kuala Village using presentations, group discussions, and interactive question and answer methods. The material presented included types of land disputes, settlement mechanisms through inter-party agreements, and their implementation and challenges. This activity was attended by residents experiencing land disputes, traditional leaders, village officials, and related stakeholders. This program is expected to increase public understanding about peaceful land dispute resolution, reduce the level of land conflict, and increase social harmony in Serdang Bedagai Regency.

Abstract

Pancasila, as the foundation of the state, plays a vital role in shaping the character of the nation. However, the practice of its values among students has begun to fade due to the challenges of globalization, technological advances, and the influence of foreign ideologies. The problem faced by students at the UPMI in Medan is that their understanding of Pancasila is limited to memorization without appreciation and practice in their daily lives. The phenomena of intolerance, individualistic attitudes, and a decline in social awareness indicate that the internalization of Pancasila values has not been successful. To overcome these problems, activities to promote the Pancasila Virtue Movement were carried out in coordination with the UPMI rectorate and student organizations. The implementation methods included interactive lectures, group discussions, inspirational video screenings, and question and answer sessions. The material covered Pancasila as the foundation of the state and the Pancasila Virtue Movement, the implementation of Pancasila values in student life, and strategies for becoming agents of change. The results of the activity showed an increase in students' understanding of the practice of Pancasila values and the formation of a community of Pancasila-minded students who are committed to carrying out real acts of virtue. This program is expected to strengthen the character of students and make them pioneers of the Pancasila Virtue Movement on campus and in the community.

Abstract

The growth of digital transactions and the creative economy in Indonesia brings tremendous opportunities as well as significant legal risks. In reality, many people do not yet understand their rights as consumers and do not know what to do when they suffer losses. This situation serves as the background for the organization of the Seminar by the Faculty of Law of Universitas Pembinaan Masyarakat Indonesia (UPMI) Medan as part of its community service program. The seminar, themed Consumer Protection in Digital Transactions and the Creative Economy, was designed to provide practical understanding to the community, particularly students, regarding consumer protection regulations, legally guaranteed rights, challenges in the creative economy sector, and complaint channels available when their rights are violated. The methods employed included interactive lectures, panel discussions, and direct question-and-answer sessions with speakers competent in consumer law and the digital economy. Pre- and post-activity evaluations showed a significant increase in participants' understanding of Law No. 8 of 1999 on Consumer Protection, the Electronic Information and Transactions Law (ITE Law), the complaint mechanism through BPSK, and preventive measures in digital transactions. This activity is expected to be part of ongoing efforts to promote legal literacy in the digital era.

Abstract

The aim of this research is only to focus on discussing the authority of pre-trial institutions regarding the termination of investigations carried out by the Police regarding criminal acts of document forgery and procedures for whether or not the termination of an investigation (SP3) is valid based on evidence as well as pre-trial applications containing obscuur libel based on decision Number 43/Pid. Pra/2023/PN Mdn. The research method used is normative legal research, which refers to library materials or secondary data. The collection of materials used is literature study based on books, journal articles and field studies by taking court decision data, then the data is analyzed qualitatively. The results of this research found that the pre-trial authority to terminate investigations carried out by the Police regarding criminal acts of forgery of documents, namely pre-trial in accordance with the provisions of Article 1 point 10 of the Criminal Procedure Code and Article 77 of the Criminal Procedure Code and based on the decision of the Constitutional Court of the Republic of Indonesia Number 21/PUU-XII/2014 has been given three new pretrial object authority, namely the determination of suspects, search and confiscation. The procedure for whether to stop an investigation (SP3) is valid or not if it refers to the provisions of Article 109 paragraph (2) of the Criminal Procedure Code, namely stopping the investigation because there is not enough evidence or the incident turns out not to be a criminal act or the investigation is stopped by law. Meanwhile, the pretrial petition containing obscuur libel in decision Number 43/Pid.Pra/2023/PN Mdn, based on the judge's considerations in the posita and petitum of the applicant's pretrial petition, has conflicted with one another, so that the judge's obscuur libel petition contains formal defects.
