Abstract

State-owned enterprises (BUMN) certainly play a very important role as actors in economic activities based on economic democracy in accordance with the Pancasila economy, whose activities must pay attention to the balance between the interests of business actors and the public interest. However, granting monopoly rights to BUMN has been further regulated, so that in the future it can create fair business competition in market competition in Indonesia. The exclusion of monopoly rights is only one sentence in article 51, so that it still creates legal ambiguity for the implementation of monopolistic practices granted to BUMN. The contribution of this research aims to encourage further regulation regarding monopoly by BUMN. In addition, it is also used as academic library material so that it can be used as a reference and material for other academic studies. This research uses a normative juridical study with a statutory approach and a conceptual approach. Thus, this research results in a study of BUMN monopoly rights from the perspective of business competition in Indonesia.

Abstract

Corruption is still a major problem in Indonesia. Various efforts to eradicate corruption have been carried out, but in fact still less effective. This can be seen from several points of view. Firstly, the substance of the punishment stipulated in Corruption Laws has not given a deterrent effect to the perpetrators. Secondly, weaknesses in the legal structure of the functioning of authorized institutions. And thirdly, the culture of applying punishment is only juridical and does not emphasize the value of society (Shame Culture and Guilt Culture). Therefore, the author offers a solution to the problem, namely the Concept of Social Work as an Alternative criminal principle of Social Defence perspective in the Efforts to Enforce Corruption In Indonesia. This concept is the application of social work punishment into the principal criminal reviewed from the theory of Social Defence by integrating perpetrators into the community as an effort to instill the value of Shame Culture and Guilt Culture. The application of social work punishment into the principal criminal is reviewed from the theory of Social Defence and instills the value of Shame Culture and Guilt Culture by means of punishment cumulatively given with basic criminal punishment. This concept involves prosecutors, supervisory judges, and prisons in the implementation of social work. The research method used is juridical normative with statutory approach, conceptual approach, and comparison approach.

Abstract

Agrarian conflicts weakened the Administrative Judiciary and General Judiciary sectors in their settlement. The number of agrarian cases according to the Consortium for Agrarian Renewal for the period 2010-2019 amounted to 3,358 cases. The plantation, property, and infrastructure sectors become the largest agrarian conflicts in the last 5 years. Normative juridical research methods, statutory approaches and case studies, primary and secondary legal materials with analysis, and technical descriptive analysis. So the author analyzes the Urgency of the Establishment of Agrarian Courts. The results of the study assessed that judicial power is free without outside intervention. The type of court chamber has not been able to solve problems in the land sector properly. An Agrarian Court is needed in an effort to resolve land problems and reduce blur in the authority to file cases.

Abstract

Persaingan usaha tidak selamanya membawa dampak yang baik. Jumlah pengusaha di Indonesia yang mengalami kenaikan setiap tahunnya mencapai 3,10% dari total penduduk di Indonesia. Melihat persaingan usaha di Indonesia semakin ketat, maka seorang pengusaha menggunakan cara kolaborasi yaitu kemitraan. Kemitraan ini dilakukan antar perusahaan satu dengan yang lain. Namun, hal ini dapat memicu persaingan usaha tidak sehat diantara keduanya karena adanya kepentingan masing-masing. Mengenai persaingan usaha tidak sehat diatur tersendiri dalam Undang-Undang Nomor 5 tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat. Penelitian ini terfokus pada dua permasalahan yaitu terkait dengan tolak ukur persaingan usaha tidak sehat dan penegakkan hukum atas tindakan kemitraan dalam persaingan usaha tidak sehat. Didapati bahwa merujuk pada Undang-Undang Nomor 5 Tahun 1999 terdapat indikator persaingan usaha dapat dikatakan tidak sehat yaitu tidak jujur, melawan hukum dan menghambat persaingan usaha yang sehat. Sedangkan kategori dari persaingan usaha tidak sehat yaitu tidak adanya kerjasama dalam bidang usaha, komposisi dari perusahaan tidak seuai peraturan perundang-undangan terkait dan terdapat perusahaan yang lebih dominan. Sedangkan dalam penegakkan hukum atas persoalan kemitraan dapat dilakukan oleh KPPU dengan dibantu oleh pengaduan dari masyarakat mengenai monopoli sebuah perusahaan. Tertuang dalam alur penanganan kemitraan yaitu pengaduan, penyelidikan, sidang majelis, pengawasan dan putusan.

Haryono No. 169 Malang e-mail: relysandi20@student.ub.ac.id Abstrak Potensi lahan gambut wilayah Indonesia sebagai luas lahan gambut terluas se Asia Tenggara. Badan Restorasi Gambut dan Mangrove (BRGM) lembaga nonstruktural. Daerah yang menjadi wilayah binaan BRGM ialah Jambi. Desa Bhakti Idaman dengan kekayaan lokal pinang dan kelapa menjadi penopang hidup masyarakat. BUMDesa Bhakti Idaman juga turut memberikan kesejahteraan terhadap perekonomian masyarakat. Namun, BUMDesa tersebut dirasa belum optimal disamping adanya kehadriran BRGM. Tujuan penelitian ini untuk mengetahui seberapa efektif pembentukan BUMDesa dan upaya yang seharusnya dilakukan dalam pembentukan BUMDesa. Metode yang digunakan yaitu penelitian yuridis empiris dengan pendekatan sosialogi hukum. Efektivitas BUMDesa diukur dari teori soerjono soekanto yaitu faktor hukum belum memiliki peraturan desa khusus tentang BUMDes, faktor penegakan, Kepala Desa belum menegakkan peraturan terkait BUMDes secara terperinci, Faktor sarana prasarana, BUMDes Bhakti Idaman belum memiliki kantor operasional secara permanen, faktor budaya mengolah secara mentah tanpa bantuan alat, faktor masyarakat terbiasa menjual hasil-hasilnya kepada datuk. Rumusan kedua terkait dengan hambatan yang terjadi antara BRGM dengan pemerintah desa yang mana BRGM lebih berfokus pada lingkungan lahan gambut, sedangkan pemerintah desa sedang mengembangkan BUMDesa untuk kesejahteraan masyarakat. Hambatan lain pada kondisi akses jalan yang sulit, jenis usaha yang belum dipilih yang cocok bagi BUMDes dan persoalan market penjualan. Pada rumusan masalah kedua untuk pembentukan BUMDesa dapat mengacu pada Undang-Undang Nomor 6 Tahun 2014 tentang Desa, Peraturan Pemerintah Nomor 11 Tahun 2021. Kata Kunci: Badan Usaha Milik Desa, Efektivitas, Badan Restorasi Gambut dan Mangrove Abstract Peatlands in Indonesia are the largest in Southeast Asia. Mangrove and Peat Restoration Agency (henceforth referred to as BRGM) is a non-structural body, covering Jambi. Bhakti Idaman village is home to betel nut and coconut plantations serving as the source of the livelihood of the locals. Village-Owned Enterprises of Bhakti Idaman village also contribute to the economic well-being in the area, but they do not operate optimally notwithstanding the presence of BRGM. This research aims to find out to what extent the effectiveness of the establishment of the enterprises has been and what measures should be taken to establish the enterprises. This research employed an empirical-juridical method and a socio-legal approach. The effectiveness of the enterprises is to be seen from the theoretical perspective of Soerjono Soekanto, implying that the legal factor does not have any specific regulation governing the enterprises in the village. The issues also comprise enforcement that the village head has not specifically performed regarding the enterprises, in addition to other factors such as infrastructure and facilities, the absence of permanent offices for Village-Owned Enterprises in Bhakti Idaman, the cultural factor that may need natural cultivation without tool assistance, and social factors where the locals sell the products to Datuk. The second research problem is linked to the impeding factors between BRGM and the village government. In this issue, the BRGM focuses more on peatlands, while the concern of the government lies in the well-being of the locals. Other problems in this context also include difficult road access, unselected businesses that suit the enterprises, and marketing and sale issues. The establishment of the enterprises could refer to Law Number 6 of 2014 concerning Village and the Government Regulation Number 11 of 2021. Abstract

The integration of blockchain technology in stamp duty administration requires a clear legal framework to ensure effective implementation. This study evaluates the benefits and challenges of using blockchain in stamp duty imposition and provides regulatory framework recommendations. Using a normative legal approach and analysis of relevant legislation, the research shows that blockchain can significantly enhance efficiency, transparency, and security in the stamp duty process. The immutable nature of blockchain records ensures data integrity and reduces the risk of fraud. Moreover, smart contracts can automate and streamline the transaction process, minimizing human error. However, the adoption of blockchain faces challenges such as high initial costs and the need for regulatory adjustments. In conclusion, the adoption of blockchain in stamp duty administration necessitates comprehensive regulations to ensure the legality and validity of recorded transactions, providing a robust and reliable tax system for the digital age.

Abstract

Ministerial Regulation PPPA No. 6 of 2023 concerning Gender Equality Parameters in Legislation and other Legal Instruments, which is normatively expected to eliminate existing gender inequality in the state, is not necessarily effective when implemented at the local agrarian community level. The inherent masculinity of patriarchal culture in coffee plantations still makes women coffee farmers have unequal access and control with male coffee farmers. This research examines the effectiveness of Permen PPPA No. 6 of 2023 in the context of local agrarian communities, namely, women coffee farmers in Tirtoyudo Village, Malang Regency. This research uses a juridical-sociological approach with Lawrence Friedman's theory of legal effectiveness. The results of this study show that the implementation of Permen PPPA No. 6 of 2023 is not maximally effective due to the patriarchal culture that is strongly embedded in the community. The lack of gender awareness in the coffee farming community is a major obstacle in the realization of gender equality as regulated in Permen PPPA No. 6 of 2023. Formal recognition alone does not automatically result in equality to the substantive level. So from this research, there is still a gap between legal norms and social reality.

Abstract

Pancasila, as the foundation of the Indonesian state, upholds social justice for the people with the aim of equality in all areas, especially public income. However, recent research has found that the income gap between the Indonesian Legislative Institution and the Indonesian public is significantly different from that in Malaysia. This can certainly affect the welfare of the people of those countries. Therefore, the author analyzes and examines in more depth the income gap between the Legislative Institution and the public in Indonesia and Malaysia related to public welfare. This study uses a normative legal research type with a statutory and comparative approach, data sources are primary legal materials and secondary legal materials from books, journals, and legal dictionaries. The income gap between the legislative institution and the public in Indonesia reaches 10x-14x, while in Malaysia it is 4x-5x. This gap creates social injustice and hinders public welfare. Therefore, the values ​​of social justice in Pancasila do not function well in practice. It is necessary to strengthen Pancasila from an early age in shaping the character of the Indonesian people.Civic Awareness and Social Justice.

Abstract

Not only limited to individual decisions, it turns out that there are several things that can make female victims of domestic violence reluctant to report the violence they experienced. This study aims to analyze the causes why women victims of domestic violence are reluctant to report their cases. This literature study research found that cultural, gender, and social structure factors are one of the causes of women victims of domestic violence who are reluctant to report gender-based violence problems in the domestic sphere. In addition,  problems of legal culture and institutional capacity that are not yet gender-sensitive, such as limited training of apparatus, lack of integrated assistance services, and the risk of secondary victimization during the legal process strengthen the vulnerable position of victims of domestic violence, making women victims of domestic violence make the decision not to report the domestic violence they experience.

Abstract

The film is part of the intellectual property rights attached to the creator. Nowadays, it is commonly agreed that violation of intellectual property rights portrays in film piracy for personal gain is inevitable, with illegal streaming services. This study aimed to examine film protection, conduct a study of film institutions, and find concepts to protect films in Indonesia. The study used a juridical method with the statute and conceptual approaches. In so doing, it used secondary data processed using library research techniques. The study showed that illegal movie streaming rampant in Indonesia practiced illegal streaming movies. It violated the intellectual property rights inherent in the creator, resulting in enormous losses for the creators. There are further problems in the laws and regulations, and the government must accommodate preventive actions. This study suggested three components: correctional, supervision, and copyright protection against illegal movie streaming in Indonesia; and these components were to maximize the role of stakeholders.
