Abstract

The aim of this study is to understand the politics of procurement of government goods / services through self-management based on Presidential Regulation Number 16 Year 2018 concerning Procurement of Government’s Goods/Services by focusing on Type III Self-Management as collaboration between the Government and social organizations.The results of the study show that the existence and dynamics of the development of social organizations and changes in the government system gave rise to a new paradigm for the organization of social organizations in the life of the community, nation and state especially in the procurement of goods/services. Law and politics play a role as social subsystems which are in the position where the degree of determination is balanced, so even though the law is a product of political decisions, but once the law is in force, political activity must obedient to the rule of law. Collaboration between the Government and Social Organizations generate the regulation of Type III Self-Management in Presidential Regulation Number 16 Year 2018 concerning Procurement of Government’s Goods/Services, in which the Perpres became a legal platform (providing legal certainty) for the Government to provide and give space to the public (in this case is the social organization) to be actively involved and participate in national development to realize national goals and ideals. Keywords      : Procurement of Government’s Goods/Services; Type III Self-Management, Social Organizations. Abstrak Tujuan dari penulisan ini adalah untuk memahami politik hukum pengadaan barang/jasa pemerintah melalui swakelola berdasarkan Peraturan Presiden RI Nomor 16 Tahun 2018 tentang Pengadaan Barang/Jasa Pemerintah, dengan lebih terfokus pada Swakelola Tipe III sebagai kolaborasi antara Pemerintah dengan organisasi kemasyarakatan. Hasil studi  menunjukkan bahwa eksistensi dan dinamika perkembangan organisasi kemasyarakatan dan perubahan sistem pemerintahan memunculkan sebuah paradigma baru bagi pengaturan organisasi kemasyarakatan dalam kehidupan bermasyarakat, berbangsa, dan bernegara khususnya dalam pengadaan barang/jasa. Hukum dan politik berperan sebagai subsistem kemasyarakatan yang berada pada posisi di mana derajat determinasinya seimbang sehingga meskipun hukum merupakan produk keputusan politik tetapi begitu hukum telah berlaku maka kegiatan politik harus tunduk terhadap aturan hukum. Kolaborasi antara Pemerintah dengan Organisasi Kemasyarakatan memunculkan adanya pengaturan mengenai Swakelola Tipe III dalam Peraturan Presiden RI Nomor 16 Tahun 2018 tentang Pengadaan Barang/Jasa Pemerintah di mana Perpres tersebut menjadi sebuah landasan hukum (memberikan kepastian hukum) bagi Pemerintah dalam menyediakan dan memberikan ruang kepada masyarakat (dalam hal ini adalah organisasi kemasyarakatan) untuk terlibat aktif dan berpartisipasi dalam pembangunan nasional untuk mewujudkan tujuan dan cita-cita nasional. Kata Kunci    : Pengadaan Barang/Jasa Pemerintah; Swakelola Tipe III; Organisasi Kemasyarakatan.

Abstract

Abstracts The research aims to find out about developing community participation in the protection and management of the environment for sustainable national development. The research method used in this study is empirical legal research that uses a conceptual approach. The results of the study show that First, the protection and management of the environment in its area is a shared responsibility, between the government (state), the private sector and the community. One of the roles of the community in environmental activities is the supervision room. Community participation in the framework of protecting the right to a good and healthy environment is accommodated in various environmental instruments, as stipulated in the PPLH Law. Secondly, empirically the involvement of the community so far in managing the new environment is solely looking at the community as the information provider (public information) or merely limited to counseling so that activities related to the environment run unimpeded. In the future, optimizing the role of the community in protecting and managing environmental activities needs to be further enhanced by opening up a wider space of participation. Keywords: Community Participation, Environment. Sustainable Development Abstrak Penelitian bertujuan untuk mengetahui mengembangkan partisipasi masyarakat dalam perlindungan dan pengelolaan lingkungan hidup untuk pembangunan nasional berkelanjutan. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum empiris yang menggunakan pendekatan konseptual (conceptual approach). Hasil penelitian menunjukan bahwa Pertama, Perlindungan dan pengelolaan lingkungan hidup pada dasanya merupakan tanggung jawab bersama, antara pemerintah (negara), swasta dan masyarakat. Salah satu peran masyarakat dalam aktivitas lingkungan hidup adalah ruang pengawasan. Partisipasi masyarakat dalam kerangka untuk melindungi hak atas lingkungan yang baik dan sehat, diwadahi dalam berbagai instrumen lingkungan hidup, sebagaimana diatur dalam UU PPLH. Kedua, Secara empiris pelibatan masyarakat selama ini di dalam pengelolaan lingkungan hidup baru semata-mata hanya  memandang masyarakat sebagai penyampai informasi (public information) atau hanya sebatas penyuluhan sehingga suatu kegiatan yang berkaitan dengan lingkungan hidup berjalan tanpa hambatan. Kedepan, harus dilakukan optimalisasi peran serta masyarakat dalam aktivitas perlindungan dan pengelolaan lingkungan hidup perlu lebih ditingkatkan dengan membuka lebih luas ruang partisipasi. Kata Kunci: Partisipasi Masyarakat, Lingkungan Hidup. Abstract

Initially, Employment and social protection was based on National Social Security System Law and it is applied for public, includingState Civil Apparatus. According to the law, all employment social security should be implemented by Social Security Administration of Employment. Legal problems then emerged as a result of the stipulation of occupational accident insurance rules for State Civil Apparatus that were managed by PT Taspen as mandated by Government Regulation No. 70/2015. This research aimed to describe and analyze the legal construction of Occupational Accident Security and Death Security regulations for State Civil Apparatus. This research uses doctrinal legal research as part of qualitative research with conceptual and statue approach. The analysis was carried out descriptively by processing primary legal materials, secondary legal materials, and tertiary legal materials. The results of the research showed that legal problems were in the form of disharmony and regulatory inefficiency in the Occupational Accident Security and Death Security policies. A clash occurred between the State Civil Apparatus Law, the Social Security Administration Law and Government Regulation No. 70/2015. The problems occurred were related to the authority of PT Taspen as the organizer of Occupational Accident Security and Death Security for State Civil Apparatus as well as violations of the National Social Security System principles in the management of Occupational Accident Security and Death Security for ASN based on Government Regulation No. 70/2015.

Abstract

Indonesia officially stipulates Corona Virus Disease 2019 (Covid-19) as a health emergency with the issuance of Presidential Decree No. 11 of 2020. The employment sector is affected by the Covid-19 pandemic. The government issued PMK (Minister of Manpower Regulation) No. 14 of 2020 as an effort to realize the national economic recovery program and improve worker welfare. This law writing aims to analyze the urgency and implementation of the policy of providing salary/wage subsidies for workers affected by Covid-19 and to find out the existence (prospectus) of the policy in the future.This research is a doctrinal law research with a conceptual approach and statute approach. The researchers conducted an analysis of secondary data, both in the form of primary legal materials, secondary legal materials, and tertiary legal materials. The analysis was carried out in a descriptive-qualitative. The results of the research showed that the salary/wage subsidy policy was implemented with the applicable terms and conditions as stipulated in PMK No. 14 of 2020. In the implementation, the policy was aligned with the participation of workers in the BPJS Employment. This policy is a fairly appropriate solution related to the economic recovery of the community during a pandemic. Itcan be a model for similar policy making in facing pandemic in the future

Abstract

Hubungan antara wajib pajak dengan fiskus kadangkala diwarnai adanya sengketa pajak. Keluarnya undang-undang Pengadilan Pajak menimbulkan anggapan bahwa semua sengketa pajak, satu-satunya pengadilan yang mempunyai kompetensi menyelesaian sengketa adalah Pengadilan Pajak. Faktanya banyak sengketa di bidang perpajakan yang diajukan ke pengadilan lain selain Pengadilan Pajak salah satunya PTUN. Tulisan ini mengkaji batasan kewenangan mengadili Pengadilan Pajak dengan PTUN. Batasan kewenangan antara Pengadilan Pajak dan PTUN atas Surat Ketetapan Pajak dapat disimpulkan: jika terkait dengan jumlah rugi yang ditimbulkan atas SKP dan kesalahan prosedur terkait dengan hal-hal yang dapat diajukan gugatan sebagaimana yang diatur UU KUP, maka kewenangan pengujiannya ada pada Pengadilan Pajak, sementara jika gugatan yang masuk terkait dengan keabsahan kewenangan, dugaan penyalahgunaan wewenang dan perbuatan melanggar hukum maka PTUN yang memiliki kewenangan menguji.

Abstract

Abstract Consequences of the stipulation of Permenlhk No. 20 of 2018 is the shift in the classification of some animals that were not protected before to become protected. Beleidsregel is a logical consequence of the usage of discretion in the government administration in a welfare state. The realization of public welfare as the main goal of a welfare state can be accomplished by recognizing discretion. Beleidsregel is needed if there is any urgent problem that requires immediate solution, including the efforts of animals conservation that intersect the interest of citizens who exploit protected animals that are unprotected before. Beleidsregel issued by agencies within the Ministry of Environment and Forestry, namely the Circular Letter of the General Director of Natural Resources and Ecosystem Conservation and the Announcements of the Central Java Natural Resources Conservation Agency, has provided legal certainty regarding the transition required in the classification change of unprotected animals into protected animals. The Circular Letter has instructed the Natural Resources Conservation Agencies to collect data and tag the protected animals, while the Announcements has provided informations regarding provisions of protected animals data collection during the COVID-19 pandemic to reduce the transmission of COVID-19. Abstrak Konsekuensi penetapan Permenlhk No. 20/2018 adalah beralihnya penggolongan beberapa satwa yang semula tidak dilindungi menjadi dilindungi. Beleidsregel adalah konsekuensi logis penggunaan asas diskresi dalam penyelenggaraan pemerintahan di negara kesejahteraan. Perwujudan kesejahteraan umum yang menjadi tujuan utama negara kesejahteraan dapat terakomodir dengan adanya pengakuan asas diskresi. Beleidsregel dibutuhkan apabila terjadi persoalan yang mendesak di masyarakat dan membutuhkan penyelesaian yang segera, termasuk dalam upaya pelestarian satwa yang bersinggungan dengan kepentingan warga negara pemanfaat satwa yang semula tidak dilindungi menjadi dilindungi. Beleidsregel yang dikeluarkan oleh instansi yang berada di lingkup Kementerian Lingkungan Hidup dan Kehutanan, yaitu SE Dirjen Konservasi Sumber Daya Alam dan Ekosistemnya serta Pengumuman Balai Konservasi Sumber Daya Alam Jawa Tengah, telah memberikan kepastian hukum dengan perihal peralihan yang dibutuhkan dalam perubahan penggolongan satwa menjadi satwa yang dilindungi. SE telah menginstruksikan kepada Balai/Balai Besar Konservasi Sumber Daya Alam untuk melakukan pendataan dan penandaan satwa, sedangkan Pengumuman telah memberikan informasi perihal ketentuan pendataan satwa di masa pandemi COVID-19 untuk mengurangi penyebaran COVID-19.

Abstract

Research on the Legal Position of Child Care Agreement made by a notary aims to find out how the role of the notary in making child custody agreements, as well as to find out the legal position of the child custody agreement made by the notary. This research is a study with a normative juridical approach, namely examining the principles of law, legal rules, and legal systematic by examining library materials to obtain secondary data.The results showed that the notary as a public official who had the authority to make a deed. Agreement on parenting rights agreed by both parties (husband and wife) ratified by the notary is a notary deed that has legal force and is an authentic deed. In the case of husband and wife, divorce before court hearing, The notary deed is very instrumental, especially for judges, namely accelerating judges in leading the trial process and making it easier to make decisions. The position of the child due to divorce, among others, is both the father or mother still obliged to maintain and educate his children solely based on the interests of the child, the judge has the authority to give a decision, the father must be responsible for all the education costs needed by the child, However, if in reality the father can not be sufficient or fulfill these obligations, then the judge can decide that the mother joins him and the court can order that the interests of Sianak are guaranteed after their parents are divorced, because it is placed under the responsibility of his parents, where They are still required to maintain and educate the child until the child is an adult. If in its implementation there is one party to define the contents of the agreement contained in the notary deed, other parties who are disadvantaged can make a lawsuit to the District Court.

Abstract

Rights to Citizenship must be protected because it is the basis to be able to access the other rights. Rights to citizenship of migrant workers in Nunukan District is potentially expired and lost if they do not renew their passports. The same case may occur with illegal migrant workers who stay for 5 years abroad. This article aims to analyze the potential of stateless person in Nunukan District, the effort made by the government to handle the issue, and the ideal construction of legal protection for stateless person. This study applied socio legal approach using primary and secondary data which were collected through interview, observation, and in depth interview. Those data then were analyzed qualitatively. Based on the analysis, it is concluded that: (1) the potential of being stateless person in Nunukan District occurred in migrant workers whose passports were expired for more than 5 years, irregular migrant workers who stayed abroad for more than five years, the descendants or children of migrant workers who were born and were raised in Malaysia; (2) the government prevents the occurrence of stateless person: (a) integrated management of handling migrant workers; (b) sweeping in order to prevent irregular migrant workers; (c) simplifying the issuance of Letter of Arrival of Indonesian Citizen (SKDWNI) and Letter of Overseas Arrival (SKDLN); (3)ideal construction of the protection of right to citizenship  for migrant workers is the extension of the scope of migrant workers protection agreement, and the placement of Citizenship and Civil Record Agency officers in order to make the paperwork handling of citizenship document easier.

Abstract

Perubahan Pasal 18 UUDNRI 1945 membawa konsekuensi perubahan paradigma penyelenggaraan otonomi daerah di Indonesia. Secara tersirat amanat UUDNRI 1945 Indonesia menganut otonomi asimetris. Dalam perjalanan ketatanegaraan, Undang-Undang Nomor 23 Tahun 2014 sebagai dasar hukum penyelenggaraan otonomi dinilai masih belum memenuhi nafas otonomi dalam UUDNRI 1945. Persoalan lain yang muncul terkait belum terakomodasinya undang-undang payung sebagai dasar hukum utama di bawah UUDNRI 1945 terkait kebijakan otonomi asimetris. Pembaharuan hukum otonomi daerah melalui pembentukan undang-undang payung otonomi daerah merupakan hal yang penting dilakukan untuk menjamin kesejahteraan sosial. Konstruksi ideal undang-undang payung otonomi daerah, bahwa pengaturannya bersifat umum (lex generalis); menganut prinsip-prinsip yang sejalan dengan Pasal 18 UUDNRI 1945; titik berat otonomi sebaiknya bersifat dinamis dan konstruktif; serta pembentukan Badan Otonomi Daerah yang bertugas untuk membantu Presiden di bidang penyelenggaraan pemerintahan daerah.

Abstract

Indonesia continues to increase economic growth by conducting the acceleration of the development of national strategic projects. The role of the appraisal profession in the National Strategic Project is needed in the denying the value of changes in loss. This study aims to analyze and provide the understanding of the role of the appraisal profession in the acceleration of national strategic projects. This research uses normative gurrent methods. The results of the study show that the role of the appraisal profession is needed in the planning stage to the stage of implementation of land procurement. The implications of the Nasoral Strategic Project should be realized that requires the readiness of the appraisal profession so that the procurement of land is increasingly reduced. The MAPPI Association can play a role in providing legal protection for each of its members in the form of cooperation of Memorandum of Understanding with the law enforcement official so that the appraiser may increase its participation in order to support national strategic projects. MAPPI can also initiate the formation of regulations related to the operation of the operations (KSO) between KJPP to improve the role of the appraisal in minimizing the ground procurement of the land as well as equity to the assessment of the assessment to all its members in Indonesia.
