Abstract

The advancement of information technology has facilitated the widespread use of giveaways on social media platforms, which have increasingly been exploited by unscrupulous actors as a form of fraudulent activity. This study examines the legal protection afforded to victims of giveaway-related fraud on social media. Such schemes are commonly perpetrated by impersonating public figures or official accounts to obtain money or personal data from unsuspecting users. From a legal standpoint, these actions constitute the criminal offense of fraud as stipulated in Article 378 of the Indonesian Criminal Code (KUHP) and a violation of Article 28(1) of the Electronic Information and Transactions Law (UU ITE), which prohibits the dissemination of false or misleading information that results in consumer losses in electronic transactions. The findings underscore the necessity of a comprehensive legal approach that extends beyond the punishment of offenders to include preventive strategies, such as strengthening digital platform governance, enhancing public digital literacy, and fostering close coordination among regulatory authorities, including the Financial Services Authority (OJK), Bank Indonesia, and electronic system operators, to support early detection and effective victim recovery.

Abstract

Freedom of expression is a constitutional right that occupies a crucial position in the structure of Indonesia's democratic rule of law, as it is guaranteed in Article 28E paragraph (2), Article 28E paragraph (3), and Article 28F of the 1945 Constitution of the Republic of Indonesia. In practice, this guarantee often clashes with restrictive policies through the Electronic Information and Transactions Law, particularly in provisions on insults, defamation, and hate speech in the digital space that have the potential to lead to multiple interpretations and criminalization of criticism. This article aims to analyze the position of freedom of expression as a constitutional right, the constitutional limits of its restrictions, and the development of the Constitutional Court's interpretation in testing the ITE Law, particularly through Decision Number 50/PUU-VI/2008 and Decision Number 105/PUU-XXII/2024. The research uses normative legal methods with statutory, conceptual, and case approaches. The results of the study indicate that the direction of the Constitutional Court's interpretation has evolved from a more permissive approach to the criminalization of expression to a more restrictive, proportional, and protective interpretation of citizens' constitutional rights in the digital space.

Abstract

Abstract: This paper aims to analyze the implementation of the principle of the best interests of the child in the legal protection of children in cyberspace under the 1989 Convention on the Rights of the Child. This principle constitutes a fundamental principle of international law, emphasizing that every action concerning children, whether undertaken by the state, public bodies, or other institutions, must prioritize the best interests of the child. This study employs a normative legal approach by examining international legal instruments, particularly the 1989 Convention on the Rights of the Child, as well as national laws and regulations concerning the protection of children in cyberspace. The study focuses on two main issues: first, the regulation of the principle of the best interests of the child under the 1989 Convention on the Rights of the Child as the legal basis for protecting children in cyberspace; and second, the implementation of this principle in Indonesia’s national policies and legal framework. The findings indicate that the 1989 Convention on the Rights of the Child provides a comprehensive legal framework for the fulfillment of children’s rights, including protection against the risks of digital exploitation. Therefore, it is necessary to strengthen national legal regulations and consistently integrate the principle of the best interests of the child into all legal frameworks concerning child protection in cyberspace in order to ensure harmonization with international standards and to effectively address the increasingly complex and evolving threats in the digital environment.
