Abstract

Spatial planning policy in Indonesia is not effectively implemented due to land conversions and other problems. This occurs since the spatial planning policy is sectoral especially since the enactment of regional autonomy. This research accordingly tries to explain how the management of spatial policy in Indonesia compared to the Netherlands. The method used was juridical normative. The results of the research showed that in its implementation of spatial policy in Indonesia, regional governments have the authority to make their own policy. Nevertheless, the spatial policy in the Netherlands is based on efforts to improve and secure accessible space with the first priority on users. Therefore, although the spatial policy is based on the community participation, the control remains on the Central Government’s hand. In conclusion, it takes comprehensive measures and social participation to formulate spatial policy. Keywords: comparative law, policy, spatial planning

Abstract

The purpose of this research was to know the application of material criminal law to narcotics abuses criminal case based on Verdict of Kuningan District Court Number 176 / Pid.Sus / 2016 / PN.KNG and legal consideration used by judge in imposing criminal sanction on narcotics abuse case based on The Verdict of Kuningan District Court Number 176 / Pid.Sus / 2016 / PN.KNG. This research was conducted in Kuningan District, Kuningan District Court using normative juridical approach as well as primary and secondary data. Data was processed and analyzed qualitatively and then presented descriptively. From the research conducted, the authors get the result that was: the application of the material criminal law to the criminal case of narcotics abuse based on the Verdict of Kuningan District Court Number 176 / Pid.Sus / 2016 / PN.KNG has been precise with the fulfillment of the elements of Article 127 Paragraph (1) Sub-paragraph a of Law Number 35 Year 2009 on Narcotics has been proven by declaring the defendant legally and convincingly guilty of committing criminal acts of Narcotics misuse; The legal considerations used by the judge in imposing criminal sanctions on cases of narcotics abuse based on the Verdict of the District Court of Kuningan Number 176 / Pid.Sus / 2016 / PN.KNG have been appropriate based on normative by looking at legitimate evidence instruments.Keywords: Verdict of District Court, Abuse, and Narcotics. AbstrakTujuan penelitian ini adalah untuk mengetahui penerapan hukum pidana materiil terhadap perkara tindak pidana penyalahgunaan narkotika berdasarkan Putusan Pengadilan Negeri Kuningan Nomor 176/Pid.Sus/2016/PN.KNG serta pertimbangan hukum yang digunakan hakim dalam menjatuhkan sanksi pidana terhadap perkara tindak pidana penyalahgunaan narkotika berdasarkan Putusan Pengadilan Negeri Kuningan Nomor 176/Pid.Sus/2016/PN.KNG. Penelitian ini dilaksanakan di Kabupaten Kuningan yakni Pengadilan Negeri Kuningan dengan menggunakan pendekatan yuridis normatif serta data primer dan sekunder. Data diolah dan dianalisa secara kualitatif dan selanjutnya disajikan secara deskriptif. Dari penelitian yang dilakukan, penulis mendapatkan hasil yaitu: penerapan hukum pidana materiil terhadap perkara tindak pidana penyalahgunaan narkotika berdasarkan Putusan Pengadilan Negeri Kuningan Nomor 176/Pid.Sus/2016/PN.KNG telah tepat dengan terpenuhinya unsur-unsur Pasal 127 Ayat (1) huruf a Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika telah terbukti dengan dinyatakannya terdakwa secara sah dan meyakinkan bersalah melakukan tindak pidana penyalahgunaan Narkotika; pertimbangan hukum yang digunakan hakim dalam menjatuhkan sanksi pidana terhadap perkara tindak pidana penyalahgunaan narkotika berdasarkan Putusan Pengadilan Negeri Kuningan Nomor 176/Pid.Sus/2016/PN.KNG telah sesuai berdasarkan pertimbangan yuridis normatif dengan melihat alat-alat bukti yang sah.Kata Kunci: Putusan Pengadilan Negeri, Penyalahgunaan, dan Narkotika.

Abstract

 Work agreements give birth to work relationships which are the relationship between employers and workers based on work agreements, which have elements of work, wages, and orders. The emergence of a pilot contract case that reaches a dozen years is something that needs to be considered under the labor law. The purpose of this study was to determine and analyze the legal aspects of work agreements for pilots on Wings Air airlines, legal protection of pilots on Wings Air airlines and legal solutions that can be taken in cases of violations of work agreements against pilots on Wings Air airlines according to Law No. 13 of 2003 concerning employment. The method used is to use a critical paradigm which is to see phenomena that arise due to work agreements that are not in accordance with the Manpower Act. The results showed that the legal aspect of the work agreement for pilots on the wings air airline was that the Lion Air Group contract clause was in conflict with Labor Law No. 13 of 2003. Legal Protection of Pilots on Wings Air Airlines was that the employment contract that was valid for the dozen years were not in accordance with the law because the pilot's work did not comply with the provisions of the work agreement for a certain time so that the contract was null and void then changed to an indefinite time work agreement, and the status of the pilot became a permanent employee. Legal Settlement that Can Be Taken In Case of Violation of Work Agreement Against Pilots on Wings Air Airlines, among others, can be reached through Bipartite, Mediation, Conciliation, Arbitration, and Industrial Relations Court.

Abstract

AbstractThe author conducted this research with the background of how the status of children out of wedlock according to the Law of 1974 on Marriage. The purpose of writing this thesis to know an examine how the status outside of marriage according to Law Number 1 Year 1974 about Marriage and to know how the legal effect on the status of children outside marriage after the decision of the Constitutional Court Number 46/PUU-VIII/2010. The method used in this research is with the normative juridical approach, in normative law research, then investigated initially secondary data. The result of this study is the regulation of marital status of children outside of marriage regulated in Article 43 paragraph (1) of Law Number 1974 about concerning marriage. The conclusion of the writing of this thesi is the Chief Justice Mahfud MD declared that children born outside the relationship of marriage or uitside the official relationship still have a relationship with his father. In the Constitutional Court’s declaration, the child who is married outside the marriage has a civil relationship with his mother and his mhoter’s family and with his father as p[roved by science and technology and or other evidence according to the law has blood relation, including civil relationships with his father’s family.Keyword: Marriage, Child Status AbstrakPenulis melakukan penelitian ini dengan latar belakang yaitu bagaimana status anak di luar nikah menurut Undang-Undang Tahun 1974 tentang Perkawinan. Tujuan penulisan skripsi ini untuk mengetahui dan mengkaji bagaimana status diluar nikah menurut Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan dan untuk mengetahui bagaimana akibat hukum terhadap status anak diluar nikah setelah putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010. Metode yang digunakan dalam penelitian ini adalah dengan pendekatan yuridis normatif, dalam penelitian hukum normatif maka yang diteliti pada awalnya data sekunder, lokasi penelitian di kabupaten kuningan. Hasil penelitian ini adalah pengaturan status anak diluar nikah diatur dalam Pasal 43 ayat (1) Undang-Undang Nomor 1974 tentang perkawinan. Kesimpulan dari penulisan skripsi ini adalah Ketua Majelis Hakim Mahfud MD menyatakan bahwa anak lahir diluar hubungan pernikahan atau diluar hubungan resmi tetap memiliki hubungan dengan ayahnya. Dalam Putusan MK disebutkan anak yang dilahitkan diluar perkawinan mempunyai hubungan perdata dengan ibunya dan keluarga ibunya serta dengan laki-laki sebagai ayahnya yang dapat dibuktikan berdasarkan ilmu pengetahuan dan teknologi dan atau alat bukti lain menurut hukum mempunyai hubungan darah, termasuk hubungan perdata dengan keluarga ayahnya.Kata kunci :  Perkawinan, Status Anak

Abstract

Notary Supervisory Council, which is a body that has the authority and obligation to supervise and develop notaries. Article 66 paragraph (1) of Law Number 2 of 2014 concerning amendments to law number 30 of 2004 concerning the position of a notary determines: For the purposes of the judicial process, investigators, public prosecutors, take a photocopy of the minutes of the deed and/or the attached documents. in the minutes of the deed or the notary protocol, as well as the summons of the notary to be present at the examination related to the deed he made, or the notary protocol, with the approval of the MPD. The Constitutional Court in its decision Number 49/PUU-X/2012, stated that the phrase “with the approval of the Regional Supervisory Council” in Article 66, is contrary to the 1945 Constitution and has no legal force. The juridical issues are: What are the powers of the MPD after the Constitutional Court's decision no. 49/PUU-X/2012 ? and What is the mechanism for notary inspection by MPD? With this type of normative legal research, the problem is answered, that the duties and authorities of the MPD after the Constitutional Court Decision. No. 49/PUU-X/2012 only to conduct periodic inspections and/or if deemed necessary, as well as conduct a notary check if there are complaints from the public. The duties and authorities of a notary as referred to in Article 66 of Law Number 2 of 2014 concerning amendments to Law number 30 of 2004 concerning the position of a notary, are carried out by the Notary Honorary Council. Regarding the mechanism of a Notary examination, it must be carried out in accordance with Law Number 30 of 2004, Law Number 2 of 2014, Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number M.02.PR.08.10 of 2004 concerning Procedures for Appointing Members, Dismissing Members, Organizational Structure, Work Procedures, and Procedures for Notary Examination; and Decree of the Minister of Law and Human Rights of the Republic of Indonesia No. M.39-PW.07.10 of 2004 concerning Guidelines for the Implementation of the Duties of the Notary Supervisory Council.

Abstract

The era of regional autonomy has made regions strive to utilize their potential for the sake of community’s welfare. Yet, the limited job opportunities cause the job seekers to work abroad which results in various legal cases, including human trafficking. The purpose of this research is to analyze the regulations on human trafficking, the factors causing human trafficking, and the role of regional government in preventing human trafficking. The research method used was non-doctrinal. The results showed that human trafficking has been regulated in various regulations, but in practice, the regulations are not well implemented because of various factors, including economic, social, and cultural factors. Moreover, the policy of Kuningan District Regional Government in the efforts to prevent human trafficking is limited to the forming of Integrated Service Center for Empowering Women and Children (P2TP2A) which in its implementation has not run optimally due to limited funds and participation from the community. Era otonomi daerah menjadikan daerah berupaya untuk memanfaatkan potensi yang dimilikinya dalam rangka mensejahterakan masyarakat. Akan tetapi keterbatasan lapangan kerja menyebabkan  tingginya  para pencari kerja untuk bekerja di luar negeri, sehingga menimbulkan berbagai kasus hukum, diantaranya perdagangan manusia. Rumusan masalah: bagaimana pengaturan tentang perdagangan manusia,  faktor-faktor apa yang menjadi penyebab terjadinya perdagangan manusia, serta bagaimana peran pemerintah daerah dalam mencegah terjadinya Perdagangan manusia. Metode penelitian yang digunakan bersifat non doktrinal dengan pendekatan yuridis empiris. Pengaturan perdagangan manusia telah diatur dalam berbagai perundang-undangan namun dalam pelaksanaannya tidak berjalan dengan optimal karena ada faktor yang mempengaruhi.  Faktor-faktor tersebut antara lain faktor ekonomi, faktor sosial dan faktor budaya. Kebijakan Pemerintah Daerah Kabupaten Kuningan dalam upaya mencegah perdagangan manusia baru sebatas membentuk  Pusat Pelayanan Terpadu Pemberdayaan Perempuan dan Anak (P2TP2A). yang dalam pelaksanaannya belum berjalan optimal karena

Abstract

This study aims to determine the regulation of converting agricultural land into housing and the suitability of its implementations. This study employed a juridical empirical approach which is a research done by looking at and paying attention to applicable legal norms associated with existing facts from the problems encountered. In this case,  the local government policies on converting agricultural land into housing. The findings revealed the perpetrators of the land conversion process that occur in Kuningan Regency are the landowners. Some of the causes are: social, economic, population density, and the lack of socialization of Law Number 41 of 2009. Efforts made by local government officials and related agency officials to realize sustainable food land protection are still limited to carrying out their main duties and functions. The guideline in controlling the use of space, licensing and controlling mechanisms for the implementation of development, stated in the Regional Regulation of Kuningan Regency Number 26 of 2011 on regional Spatial Planning and Regulation of the Head of the National Land Agency Number 2 of 2011 concerning guidelines for technical land considerations in controlling location permits and determining locations and permits for changes in land use. The study concluded that converting the function of agricultural land to non-agriculture in Kuningan Regency is carried out by the landowner. In addition, efforts made by local government officials and related agency officials to realize sustainable food land protection are still limited to carrying out their main duties and functions. Accordingly, it is necessary to socialize Law Number 41 of 2009 on Protection of Sustainable Food Agricultural Land and Regional Regulation of Kuningan Regency Number 26 of 2011 concerning Regional Spatial Planning continuously to the community level. Furthermore, local governments need to coordinate with the village officials to monitor the use of agricultural land and the development of housing areas. This can be done by providing socialization to village officials.

Abstract

The process of transferring bengkok land ownership rights through land swap agreements is frequently done, but due to lack of understanding of the legislations, the transfer of land rights often experiences various problems. This study aims to find out the mechanism of transferring bengkok land ownership rights through land swap agreements based on the legislations as well as the process of certifying bengkok land into proprietary land. This descriptive-analytic study applied an empirical juridical approach. The results showed that the mechanism of transferring bengkok land ownership rights through land swap agreements in Kuningan District is regulated in Kuningan District Regulation No. 44 of 2017 concerning Management of Village Assets. Meanwhile, the process of certifying bengkok land into proprietary land is regulated in Article 17 of Government Regulation No. 27 of 2014 concerning Management of State/Regional Property. In conclusion, the process of transferring land ownership rights, especially state-owned land, shall to be done in a written form and is based on the applicable legislation. Peralihan Hak Milik Tanah Bengkok Melalui Perjanjian Tukar Guling Proses peralihan hak milik tanah bengkok melalui perjanjian tukar guling sering dilakukan namun karena ketidak pahaman terhadap peraturan perundang-undangan, peralihan hak milik atas tanah tersebut mengalami berbagai permasalahan. Tujuan penelitian adalah untuk mengetahui mekanisme peralihan tanah bengkok melalui perjanjian tukar guling menurut perundang-undangan dan proses pensertifikatan tanah bengkok menjadi tanah hak milik. Jenis penelitian deskriptif-analistis dengan pendekatan yuridis empiris. Hasil penelitian mengemukakan bahwa Mekanisme peralihan tanah bengkok melalui perjanjian tukar guling di Kabupaten Kuningan diatur dalam Peraturan Bupati Kuningan Nomor 44 Tahun 2017 tentang Pengelolaan Aset Desa dan Proses pensertifikatan tanah bengkok menjadi tanah hak milik diatur dalam Pasal 17 Peraturan Pemerintah Nomor 27 Tahun 2014 adalah pengalihan kepemilikan barang negara/daerah. Kesimpulannya Dalam proses perjanjian tukar menukar tanah terutama tanah milik negara perlunya dilakukan secara tertulis dan sesuai dengan peraturan perundangan yang berlaku.

Abstract

Guarantee legal certainty and economic stability is very important to keep the movement of the economy of a country. The formulation of the problem formulated a point of issue is how the environmental law enforcement in Indonesia on a case study of forest fires in Indonesia and How to influence environmental law enforcement to economic growth in Indonesia. The purpose of this study was to determine the environmental law enforcement in Indonesia on a case study of forest fires in Indonesia and How to influence environmental law enforcement to economic growth in Indonesia. This research could be useful in a practical and theoretical. The method used by the researchers are using a normative juridical approach. The results of the study Enforcement of Environmental Law in relation to the Criminal Law which is related substance of Law in Article 69 paragraph (1) letter H Law No. 32 of 2009 on the Protection and Environmental Management includes about a ban on land clearing by burning and action against the perpetrators for enforce the law and environmental law enforcement to economic growth in Indonesia affected by three (3) aspects, namely Products of law, justice system and political risks are always changing. Conclusions of law enforcement carried out by the legislation in force and the factors that influence economic growth is necessary to be noticed is the commitment of the highest officials responsible to the reciprocation of a country. Recommendation law enforcement must be carried out according the legislation without seeing the background of the company or individual that legal certainty to invest guaranteed and the reformulation of Article 69 paragraph (1) letter H Law No. 32 of 2009 on the Protection and Environmental Management.

Abstract

The purpose of this study is to analyze the arrangement and the application of House Ownership Credits known as KPR based on the prevailing laws and regulations. This study employed a juridical-empirical approach. The juridical approach was used to analyze various laws and regulations. Meanwhile, the empirical approach was used to analyze the law which was viewed as a patterned community behavior in people’s lives that continually interacts and relates to social aspects. Reffering to the state regulation of public housing number 6 of 2011, the findings revealed the procurement of housing and settlements was supported by housing and financial aid in the form of housing subsidies through credits/home ownership financing. In addition, it is also required to submit a collateral in each application of a mortgage agreement with the bank. This collateral provides an assurance to the bank that the credit granted to the customers returns according to mutually agreed terms and minimizes the possible risk involved and arise in any credit disbursement. Meanwhile, in terms of providing credits to prospective debtors, the bank must have a confidence in the debtors’ ability or capability to repay the loan. In conclusion, credit is a loan-borrowing agreement between the bank and the other party that requires the borrower to pay off his debt with the amount of interest, compensation or profit sharing within a certain period of time. Besides, in the implementation of legal aspects for credit applicants, a general home ownership credit applicant is an individual or human who is not a legal entity. Humans who are not legally incorporated are legal subjects. Thus, a credit analyst and an authorized officer who work in a credit unit must be able to fully understand the ins and outs of the credit applicant’s legal aspects.Tujuan penelitian yaitu menganalisis Pengaturan dan Pelaksanaan Perjanjian Kredit Pemilikan Rumah (KPR) Berdasarkan Peraturan Perundang-Undangan. Metode Penelitian yang digunakan dalam penelitian ini adalah Pendekatan Yuridis Empiris. Pendekatan Yuridis digunakan untuk menganalisis berbagai peraturan perundang-undangan. Sedangkan pendekatan empiris digunakan untuk menganalisis hukum yang dilihat sebagai perilaku masyarakat yang berpola dalam kehidupan masyarakat yang selalu berinteraksi dan berhubungan dalam aspek kemasyarakat. Hasil penelitian yaitu peraturan menteri negara perumahan rakyat nomor 6 tahun 2011 tentang perumahan rakyat menyebutkan bahwa pengadaan perumahan dan pemukiman dengan dukungan bantuan pembiayaan perumahan dalam bentuk subsidi perumahan melalui kredit/pembiayaan pemilikan rumah. Setiap pelaksanaan perjanjian kredit pemilikan rumah pada bank, disyaratkan untuk menyerahkan jaminan. Fungsi jaminan ini adalah untuk memberikan keyakinan kepada bank bahwa kredit yang diberikan kepada nasabah dapat diterima kembali sesuai dengan syarat-syarat yang telah disepakati bersama, dan itu juga untuk meminimalisir resiko yang terkandung dan senantiasa dimungkinan dapat timbul dalam setiap pelepasan kredit.Berkaitan dengan pemberian kredit kepada calon debitur, maka pihak bank harus mempunyai keyakinan atas kemampuan atau kesanggupan pengembalian pinjaman kredit oleh debitur. Simpulan bahwa kredit adalah persetujuan atau kesepakatan pinjam-meminjam antara bank dan pihak lain yang mewajibkan peminjam untuk melunasi utangnya setelah jangka waktu tertentu dengan jumlah bunga, imbalan atau pembagian hasil keuntungan. Pelaksanaannya aspek hukum bagi pemohon-pemohon kredit. Pada umumnya pemohon kredit pemilikan rumah adalah perorangan atau manusia dan tidak berbadan hukum. Manusia yang tidak berbadan hukum adalah subyek hukum. Seorang analisis kredit dan pejabat yang bertugas di unit kerja perkreditan harus mampu memahami seluk beluk aspek-aspek hukum pemohon kredit
