Abstract

This research aims to study the prevention law of gambling in Aceh. Which has applied since 2003 M. The problem appears from this study is miss understanding of some  Achiness society. Some of them accept that the gambling law is applied according to the purpose of Islam on the prohibit gambling. On another perception some of the community in Aceh do not accept it. they argue that the law of prevention gambling in Aceh is just from government not from Syari’. The explanation of appropriation between the purpose of government on applying this law and the purpose of maqashid al- syariah on prevention gambling. And discuss the reason of miss understanding society. So, this research will analyse the problems deal from this law, the solution, and finding out the wisdom of forbid gambling, and the relation prevention gambling law and the maqashid al – syariah on keep the wealth, because the command of preserve wealth is one of the purpose of syariah that Muslim should watch over it.thus, The researcher adopted the inductive methodology and the analytical approach to reach the solution on it. The most important result finding in this study is firm relation between the prevention gambling law in Aceh and maqashid al- syariah. Gambling is prohibited by many evidences and propositions from al-qur’an and hadits. In addition There are many kind of gambling renowned, the punishment for violate the gambling law is ta’ziriah. This forbidden relate to the command on keeping the wealth. Since that is one of the purpose of shariah. If the prevention of gambling law is approved and applied so that the purpose of shariah is reached as well. Futhermore, the law must be holdout on all Muslims to avoid gambling .

Abstract

Halal certification is a guarantee of safety for Muslims to be able to consume a product as evidenced by the inclusion of the halal logo on the product packaging. To realize the "halal awareness" program in Indonesia, public awareness of halal-certified products is very influential in the success of the program's obligations. While in the field there are still many Muslim consumers who do not understand, and still do not prioritize halal certification in every product purchase. Further research is needed related to study the importance of halal certified products in Samarinda City, beacuse there are still many products do not have halal certificate yet. This research is a field research, a type of empirical normative research with a sociological juridical approach by studying and analyzing data obtained in the field with the study of Maqasid Al-Syariah. This research will examine and analyze the importance of halal certification on products circulating in the Samarinda City market, in the light of Maqasid al-Shari'ah.The results of this study indicate that halal certification is very important to be applied in Samarinda City. Meanwhile, if seen from the perspective of maqasid al-shari'ah with the existence of halal certification can realize mashlahah, namely goodness in the lives of Muslim consumers. Because with guaranteed food consumed, maqasid al-shari'ah al-dharuriyah al-khamsah, namely guarding religion, guarding souls, guarding intellect, guarding offspring, and protecting property will be fulfilled. The importance level of halal certification if viewed from the perspective of maqasid al-shari'ah, it can be concluded that halal certification in Samarinda is at the level of hajjiyah, which is needed, which without halal certification does not cause inaccuracies, but can be potentially difficult if there is no halal certification in Samarinda City. Therefore, the need for halal certification in Samarinda City is important because of the needs of Muslim consumers towards it.

Abstract

The article aims to analyze the role of modern interpretations of Sharia on women's emancipation in Tunisia. Even though Tunisia is a Muslim country influenced by the Maliki school of thought, its social, cultural, and political conditions are conducive to women's emancipation efforts. This condition was created partly by the government's efforts to adopt Sharia's modern interpretation in Tunisia. Efforts to modernize Islamic law through state law have been going on for a long time and are consistent. Islamic legal modernism is evidenced by the Constitution, which guarantees women's equal rights, manifested in state law and policies. A case in point is family law in Tunisia that prohibits the practice of polygyny, gives equal share of the inheritance, and punishes perpetrators of domestic and sexual violence against women. Modern interpretations of Sharia have resulted in Islamic law that is more gender-friendly and maximizes women's potential in Tunisia's public sector. As a result, women's political participation in Tunisia is very high: they occupy many Parliament seats and high government bureaucracy positions. The condition of equality of women in Tunisia is far different from that of its compatriots in the middle east and north African countries, which are still influenced by conservative Islamic law interpretations.Keywords: Islamic legal modernism, women's Emancipation, polygyny prohibition, sexual harassment

Abstract

In studying the Qur'an, two things absolutely must be considered, namely al-tsubut (source truth) and al-dalalah (meaning content). In the case of al-subutal-Qur'an, there is no difference of opinion among Muslims regarding the truth of the source (qath'itsubut) originating from Allah because it reaches the mutawatir of Muslims to ensure. All the verses of the Qur'an that Allah sent down through Jibril to the Prophet Muhammad. which are compiled in the Mushaf and read by Muslims around the world, which are agreed upon by Muslims, are no different and have changed since the beginning of their descent until now and in the future. Meanwhile, from a dalalah or editorial point of view, the contents of the Qur'anic verses related to law can be divided into qath'i and zanni verses. An in-depth study of al-Qur'an poetry shows that the existence of qathi'i and zanni poems is a characteristic of the al-Qur'an in explaining law (ahkam). This journal will discuss the Qath'i and zanni debates from the perspective of the Quran. The method used in the study of this paper is a literature review. Taking the main reference from the Quran, as well as the interpretation of the scholars. Hopefully this study will be useful to add to the body of knowledge, especially in the field of Quranic studies.

Abstract

Artikel ini mendeskripsikan proses Pendampingan Pengajuan Isbat Nikah Masyarakat Untuk Mendapatkan Kepastian Hukum di Kecamatan Sangatta Selatan Kabupaten Kutai Timur serta mendeskripsikan faktor pendukung dan penghambat yang dihadapi Kerukunan Keluarga Kampung Hijau (K3H) dalam pendampingan proses pengajuan Isbat Nikah masyarakat untuk mendapatkan kepastian hukum di Kecamatan Sangatta Selatan Kabupaten Kutai Timur. Metode penelitian yang digunakan dalam penelitian berikut yaitu kualitatif dengan jenis penelitian Field Research dengan menggunakan pendekatan sosiologis-yuridis. Hasil dari penelitian ini yaitu Peranan Kerukunan Keluarga Kampung Hijau Dalam Membantu Masyarakat Untuk Mendapatkan Kepastian Hukum  di Kecamatan Sangatta Selatan ialah  ada beberapa proses dalam pendampingan pengajuan isbat nikah masyarakat, ada prosedur pelaksanaan, waktu pelaksanaan, biaya serta sarana dan prasarana yang mana pada hasil penelitian bahwa K3H telah berperan penting dalam membantu masyarakat nikah sirri dalam mendaptkan kepastian hukum, dan untuk faktor penghambatnya ialah kondisi insfratukturnya yang kurang baik serta kesadaran hukum masyarakat yang juga masih kurang, untuk faktor pendukungnya banyak pihak yang mendukung dari mulai Kepala Desa, Pemerintahan, masyarakat serta perusahaan, dukungan diberikan baik secara materil maupun immaterial.

Abstract

Sudan is a power that enforces Islamic Law as a statutory principle of unity. Sudan also a country consisting of various ethnicities and religions. Likewise, Indonesia consists of various tribes, cultures and nations and their religious diversity. Sudan and Indonesia are countries that have renewed Islamic law In the field of marriage, both Sudan and Indonesia have their own legal stipulations in this field. In this study, the author will describe the differences between Sudanese marriage law and Indonesian marriage law.

Abstract

Despite the transparent and legal-compliant implementation of the Halal certification system in Indonesia and Malaysia, there are obstacles in practice, such as quality control and supervision for Halal-certified products. Therefore, it is necessary to implement a comprehensive Halal certification system founded on Maqasid al-Sharīʿah. This study employs normative-doctrinal legal research to provide recommendations for resolving issues associated with implementing the Halal certification system in Indonesia and Malaysia. It reveals that both Indonesia and Malaysia have institutions tasked with administering the Halal certification system; in Indonesia, it is administered by Badan Penyelenggara Jaminan Produk Halal (Halal Product Guarantee Organizing Agency or BPJPH), and in Malaysia, Jabatan Kemajuan Islam Malaysia (Department of Islamic Development Malaysia or JAKIM). Quality control and supervision are obstacles to implementing Halal certification in Indonesia and Malaysia, particularly self-declaration. Due to the misuse of Halal labels and the incorporation of non-submitted materials and products, rigorous oversight is necessary for the products that acquired Halal certificates using this scheme. Business actors lack knowledge and comprehension of the Halal guarantee system, which prompts them to implement the objectives of Halal certification. Adopting Maqasid al-Sharīʿah is necessary to put in place a Halal certification system that prioritizes business actors' awareness of the goals of Halal certification, which include the preservation of religion, life, the mind, ancestry, and property. Moreover, this preservation aligns with the goal of Halal certification's contribution to spiritual and worship strength.

Abstract

This writing discusses ta’abbudi and ta’aqquli in Islamic jurisprudence, aiming to provide comprehensive insight into both of these terms. Positioning oneself as a mukallaf (a responsible and accountable individual), on one hand, acknowledges that acts of worship (ta’abbudi) must be fully accepted, whether or not one comprehends their meanings, as they are divine commands. Similarly, on the other hand, a mukallaf is granted the authority and capability to employ reason in dealings with worldly matters (mu’amalah), enabling the development of laws in accordance with the changing times. In the context of Law Number 33 of 2014 on Halal Product Assurance, at-Ta’abbud and at-Ta’aqqul hold significant relevance. Article 10, paragraphs (1) and (2), regulate the requirements for halal products, encompassing raw materials, production processes, storage, as well as processing, handling, and packaging procedures. This indicates that at-Ta’abbud plays a crucial role in ensuring compliance with halal product requirements. Furthermore, Article 10, paragraph (3), emphasizes that halal products must be verified by accredited halal certification bodies. This underscores the importance of at-Ta’aqqul in analyzing and verifying the halal status of products.

Abstract

Penelitian ini berlatar belakang masalah para pedagang yang menggunakan Rajah dan Wafaq sebagai Azimat pelaris dagangan. Salah satunya pedagang yang ada di pasar Berkat di loa Janan Ilir. Para pedagang meyakini bahwa, Rajah tersbut dapat mempengaruhi dagangan mereka, agar laku keras. Akan tetapi para pedagang tersebut menyakini Rajah sebagai perantara. Dan tetap beranggapan atas izin Allah SWT dagangan mereka laku keras. Penelitian ini bersifat penelitian lapangan. Sumber data didapatkan dari hasil observasi para pedagang yang ada di Pasar Berkat. Dan Wawancara kepada para pedagang. Khusunya para pedagang pakaian. Karena mereka adalah salah satu pedagang yang mendominasi jenis barang yang dijual. Teknik analisis data yang digunakan peneliti adalah deskritif analisis. Dengan cara melalui peroses pengelolaan data. Setelah pengelolaan data lalu di analisis dengan tujuan menyederhanakan dan memudahkan data. Sehingga mudah untuk menarik kesimpulan. Hasil penelitian ini adalah para pedang yang menggunakan Rajah dan Wafaq memili alasan sebagai berikut, agar diperlancar rezekinya, agar ditambahkan rezekinya, membuat ramai pembeli, pembeli tidak kabur ke toko lain, merasa rezekinya kurang, untuk mendekatakan diri ke pada Allah.Kata Kunci : Wafaq Sebagai Azimat, Penjual, Hukum Islam

Abstract

Artikel ini akan membahas tentang upaya BKKBN Kaltim dalam menyikapi tingginya angka kelahiran total (TFR) Kalimantan Timur yang belum mencapai target 2,14 angka TFR. Tujuan penelitian mengetahui upaya yang dilakukan BKKBN Kalimantan Timur dalam amanat Undang-Undang No.59 Tahun 2009 tentang Perkembangan Kependudukan dan Pengembangan Keluarga, serta kendala yang dihadapi dan aspek maslahat terhadap upaya-upaya tersebut. Jenis penelitian yang digunakan deskriptif kualitatif dengan pendekatan normatif-empiris pengumpulan data observasi, wawancara dan dokumentasi, data dikelompokkan, disaring kemudian dikaitkan perspektif Maqashid Syariah agar ditarik kesimpulan. Hasil yang diperoleh dalam upaya Pengendalian Penduduk BKKBN Kaltim berupa Pengendalian Angka Kelahiran, Penurunan Angka kematian ibu dan anak, pengembangan kualitas penduduk, Penataan persebaran dan Pengarahan Mobilitas Penduduk, Peningkatan Ketahanan Kesejahteraan Keluarga serta Penyiapan Pengaturan Perkawinan dan Kehamilan. kendala berupa Pandemi Covid 19, Kebijakan dan Pendidikan kependudukan yang belum menyeluruh, Cakupan kualitas pelayanan KB Pasca Persalinan yang belum Optimal. Serta belum ada sistem peringatan dini pada Pemerintah Daerah untuk menangani masalah kependudukan. Upaya yang dilakukan sejalan dengan Maqashid Syariah untuk mencapai kemaslahatan diantaranya pengendalian angka kelahiran serta penurunan Angka Kematian Ibu dan Anak (Hifdz Nash) Pengembangan Kualitas Penduduk berupa Program pembinaan dan edukasi remaja (Hifdz Aql), pengarahan mobilitas penduduk (Hifdz Mal) Penyiapan Pengaturan Perkawinan serta Kehamilan (Hifdz Nasl).
