Abstract

This article aims to find the concept of welfare and Islamic economic justice contained in the Qur'an Surah At-Taubah: 34 and An-Nisa: 58, a type of library research study with the thematic interpretation method (maudhu'i) which focuses on the concept of welfare and Islamic economic justice contained in the Qur'an Surah At-Taubah: 34 and An-Nisa. The data collection technique uses document studies, the book of Tafsir Jami' Al Bayan Fii Tafsiril Qur'an. The analysis of verse interpretation data is relevant to the concept of welfare and Islamic economic justice. The basic principles of the Islamic economic system emphasize justice, trust, and social responsibility. Surah At-Taubah: 34 emphasizes the importance of spending wealth for the benefit of society, not just hoarding wealth without being distributed for social good. Meanwhile, Surah An-Nisa: 58 reminds of the importance of trust and justice in establishing laws and managing the economy.

Abstract

This study aims to explore generosity from the perspective of the Qur'an as an inspiration for the development of philanthropic start-ups. By integrating Islamic philanthropic values, this study seeks to demonstrate the relevance of the teachings of the Qur'an in creating a business model that not only prioritizes financial profit, but also social welfare. The method used is qualitative descriptive research with literature analysis. Data were collected from secondary sources, including books and academic articles, as well as related publications that explore the verses of the Qur'an on generosity. The findings of the study indicate that the principles contained in verses such as Surah Al-Imran 3:92 and Surah Al-Baqarah 2:261-262 underline the importance of goodwill, social responsibility, and wealth sharing to create a positive impact. Philanthropic start-ups, inspired by these teachings, can distribute profits to those in need and make social contributions an integral part of their business model. Thus, this study concludes that the implementation of the values ​​of generosity in the Qur'an can contribute significantly to the creation of better social and economic justice in Indonesia..

Abstract

This article discusses the interpretation approach, namely tafsir bi al matsur, tafsir bi al ra'yi, tafsir bi isyari. With the aim of knowing the explanation and differences of various approaches to the science of interpretation, namely tafsir bi al matsur, tafsir bi al ra'yi, tafsir bi isyari. This article uses qualitative research based on literature (library research) with a qualitative descriptive approach and descriptive analysis techniques. The results of this study show the differences in interpretation methods between tafsir bi al matsur, namely the method of interpreting verses using other verses or the hadith of the Prophet Muhammad, tafsir bi al ra'yi, namely interpretation taken based on ijtihad and the thoughts of the mufassir after knowing Arabic and its methods, legal arguments are addressed in the interpretation, while tafsir bi al isyari is an interpretation carried out based on existing or obscure signs and can be understood and known by people who have knowledge in their fields and have a high level of piety. Interpretation through interpretation of the verses of the Qur'an must be in accordance with or in line with the literal or apparent meaning of the verses of the Qur'an which are interpreted from various angles.

Abstract

Constitutional Court Decision No. 68/PUU-XII/2014 is an important milestone in the legal debate regarding the validity of interfaith marriages in Indonesia. Although the decision does not change the normative provisions in Article 2 paragraph (1) of Law No. 1/1974 on Marriage, the implications for the position of children from interfaith marriages are very real. Children born from such relationships often face administrative obstacles, uncertainty of legal status, and potential discrimination in obtaining their basic rights as citizens. This study aims to analyze the juridical implications of the Constitutional Court's decision on the legal protection of children from interfaith marriages, and to encourage the formulation of affirmative policies that guarantee the protection of children's rights as a whole. The research method used is normative juridical with the approach of legislation and analysis of court decisions. The results of the study show that derivative regulations and concrete steps are needed from the state to ensure recognition of the legal status of children, in line with the constitutional principles of child protection and respect for human rights.

Abstract

This study aims to examine the meaning of zakat in the Qur'an through Paul Ricoeur's hermeneutic approach with a focus on symbolism, text, and the process of refiguration. Through Ricoeur's hermeneutic theory, this study explores how zakat can be understood more deeply as a symbol of purification, social solidarity, and economic justice, and how the Qur'anic texts about zakat can be reinterpreted according to contemporary challenges and needs. This study uses a qualitative method with data collection techniques in the form of literature studies. The main data sources for this study are the verses of the Qur'an related to zakat, classical and contemporary interpretations, and literature on Paul Ricoeur's hermeneutics. The data were analyzed using Ricœur's hermeneutic approach which emphasizes understanding symbolism and the process of refiguring texts. The results of the study show that Paul Ricoeur's hermeneutic approach provides a new framework for understanding zakat. Zakat is understood not only as a financial obligation, but also as a symbol that reflects the values ​​of social justice and purification of the soul. Ricœur's theory of textual autonomy allows for a rereading of the zakat verses in a modern context, where challenges such as economic inequality and global poverty are increasingly pressing. The process of reinterpretation allows zakat to remain relevant and serve as an instrument of economic empowerment and wealth distribution in modern society.

Abstract

The inequality of divorce procedures in KHI and Law No. 1 of 1974 prompted the issuance of SEMA No. 3 of 2023 as a refinement of the formulation of SEMA No. 1 of 2022. This SEMA provides strict guidelines on the minimum separation requirement of six months to grant a divorce, except for the element of domestic violence. Using a qualitative approach with normative legal interpretation, this research examines the legal construction and legal considerations of judges in resolving divorce cases. First, SEMA Number 3 Year 2023 has proven to be an effective tool in realising a legal system that is reliable, fair, and able to provide substantive legal protection to litigants in religious courts. Second, although SEMA No. 3 of 2023 regulates a minimum separation of six months, judges can still grant divorce in cases with a shorter separation time if there is evidence of verbal domestic violence.

Abstract

This study addresses the challenges faced by customers in the debt transfer (take over) process in Islamic banking, particularly the need for a practical application of the concept of maslahah (welfare) in aligning financial transactions with Sharia principles. Islamic banking, as a trusted institution, provides ethical financing solutions based on justice and welfare, and the debt transfer product serves as a means for customers to move their debts from conventional banks to Islamic banks, ensuring adherence to Sharia values. The objective of this study is to identify the specific mechanisms of the debt transfer contract, evaluate its impact on customer welfare, and examine the practical implementation of the maslahah concept in this product. This research employs a qualitative approach, including interviews with bank representatives and analysis of relevant Sharia banking documents, to gain insights into the process and outcomes of debt transfer contracts. The study finds that the debt transfer contract not only serves as a financial tool but also reflects Islamic banks' commitment to customer welfare by providing an alternative free from interest-based practices. This research contributes to the literature by introducing innovative approaches in debt transfer contracts and reinforcing the role of maslahah in Islamic banking, offering practical solutions for promoting economic welfare and justice. The study also focuses on Bank Syariah Indonesia as a case study, contributing to the broader understanding of the development of Islamic banking in Indonesia. The findings highlight the importance of applying maslahah as a principle of economic welfare and justice within Islamic finance.
