Abstract

Gojek Indonesia is a technology company, not a transportation company that provides transportation services. The service features available on the go-jek application are go-food, which is a delivery service provided by go-jek companies to buy and deliver food orders to their users. The large number of consumers who use this application always cancel orders unilaterally which results in default in an agreement. This study discusses the settlement of defaults on the use of the gojek application in the form of unilateral cancellation of orders for gofood drivers in the Payakumbuh City area. This research raises two problems, namely What is the process for the birth of an agreement between gojek drivers and go-jek application users in food ordering activities, What is the settlement of compensation for defaults on gojek application users in the form of unilateral cancellation of orders against go-jek drivers? Food. This study uses the Juridical Empirical method. The data sources used are Primary Data through interview studies and document studies and Secondary Data through primary legal materials, secondary legal materials and tertiary legal materials. The results of the study show how the process of the birth of an agreement between go-jek drivers and go-jek application users in food ordering activities and settlement of compensation for defaults on go-jek application users in the form of unilateral cancellation of orders against go-food drivers. The implementation that occurs for consumers purchasing food and drinks through the online ordering application, as mentioned, does not always go well. There are also actions that can harm other parties in their implementation, especially when ordering food and drinks using an online application, in other words, consumers do not come directly to the places where the food and beverage sellers are concerned. Default means negligence, negligence, default, not fulfilling its obligations in the agreement. Based on the Consumer Protection Act, there are rights and obligations held by business actors.

Abstract

Based on Article 1 paragraph (1) of the UUHT, Mortgage Rights on land and objects related to land are security rights that are imposed on land rights as referred to in Law Number 5 of 1960 concerning Basic Regulations on Agrarian Principles, along with or without other objects that are an integral part of the land, for the repayment of certain debts, which give priority to certain creditors against other creditors. Mortgage rights begin with a debt and credit agreement entered into by the debtor and his creditor. This is followed by the making of a deed of granting mortgage rights (APHT) made by a Land Deed Official (PPAT). Before 2020, APHT registration was carried out by PPAT at the Land Office directly or manually. This is different after 2020, APHT registration is carried out online or electronically, with the enactment of Regulation of the Minister of Agrarian and Spatial Planning / Head of the National Land Agency Number 5 of 2020 concerning Electronically Integrated Mortgage Services. In its implementation after the enactment of the aforementioned regulation, there are several problems in the Implementation of Electronic Registration of Deeds of Granting Mortgage in Agam Regency. With problems: 1) How is the implementation of electronically integrated Mortgage Rights registration in Agam Regency? 2) How are the obstacles and constraints to electronically integrated registration of mortgage rights in Agam Regency? This research uses an empirical juridical approach and the nature of the research is descriptive. The implementation of Electronic Registration of Deeds of Mortgage in Agam Regency has been running well and in accordance with applicable regulations and has fulfilled the principles of electronic registration of mortgage rights, namely fast, precise and easy. Meanwhile, there are still obstacles both at the land office, PPAT and banks. One of them is that there are still many land data that have not been validated and the lack of human resources at the land office. Meanwhile, in PPAT and banking, there are still errors in typing APHT and its application.

Abstract

Tanah bekas verponding merupakan peninggalan sistem hukum pertanahan kolonial Belanda yang hingga kini masih ditemukan di berbagai daerah, termasuk Kota Payakumbuh. Setelah berlakunya Undang-Undang Pokok Agraria Tahun 1960, seluruh hak atas tanah yang bersumber dari hukum Barat wajib dikonversi ke dalam sistem hukum agraria nasional guna menjamin kepastian dan perlindungan hukum. Namun dalam praktiknya, masih terdapat tanah bekas verponding yang belum terdaftar sehingga menimbulkan ketidakpastian hukum, potensi tumpang tindih kepemilikan, serta risiko sengketa di kemudian hari. Penelitian ini bertujuan untuk menganalisis perbedaan pendaftaran tanah bekas verponding dengan tanah non-verponding serta mengidentifikasi kendala yang dihadapi Kantor Pertanahan Kota Payakumbuh dalam pelaksanaannya. Metode penelitian yang digunakan adalah yuridis empiris dengan pendekatan deskriptif kualitatif. Data diperoleh melalui studi kepustakaan terhadap peraturan perundang-undangan dan literatur terkait, serta wawancara langsung dengan pejabat Kantor Pertanahan Kota Payakumbuh. Hasil penelitian menunjukkan bahwa pendaftaran tanah bekas verponding memiliki kompleksitas lebih tinggi karena memerlukan penelusuran dokumen historis, proses konversi hak, penelitian riwayat penguasaan, serta verifikasi ketat terhadap data fisik dan yuridis. Sementara itu, pendaftaran tanah non-verponding lebih menitikberatkan pada pembuktian penguasaan adat, keterangan saksi, dan administrasi pertanahan yang berlaku saat ini. Kendala utama meliputi rendahnya pemahaman masyarakat, hilangnya dokumen lama, ketidakjelasan batas tanah, serta keterbatasan sumber daya dan dukungan administratif. Disimpulkan bahwa optimalisasi sosialisasi, digitalisasi arsip, serta peningkatan kualitas pelayanan pertanahan sangat diperlukan guna mewujudkan kepastian hukum yang efektif dan berkelanjutan.
