Abstract

This study examines the implications of constitutional flexibility on governance using a comparative law method with a normative-historical approach. The focus is on comparing rigid and flexible constitutions in Civil Law and Common Law systems, along with case studies of amendments to Indonesia’s 1945 Constitution and constitutional reforms in the United Kingdom. Findings indicate that rigid constitutions provide political stability and legal certainty but adapt slowly to socio-political changes, whereas flexible constitutions allow rapid adaptation, though they may pose potential legal instability if not properly controlled. The study highlights the importance of balancing stability and flexibility through selective reforms, checks and balances, and public participation. These findings offer recommendations for lawmakers and policymakers to adjust amendment mechanisms to maintain equilibrium between stability and adaptability

Abstract

Suntik mati atau euthanasia masih menjadi perbincangan hangat bagi para ahli hukum dan juga para medis. Dalam hal ini, euthanasia menimbulkan banyak pro kontra antara pakar ilmu. Sehingga dirasa perlu adanya kajian yuridis terkait bagaimana hukum positif Indonesia mengatur euthanasia itu sendiri. Meskipun belum memiliki aturan yuridis secara rinci, namun berdasarkan Pasal 338, 345, 340, serta 462 KUHP euthanasia memberikan implikasi hukum yang serius sehingga dapat dijerat dengan Pasal Pembunuhan, sebagaimana dimaksud. Artikel ini bertujuan untuk memberikan pandangan hukum terkait dengan euthanasia, kedudukan dokter yang melakukan tindakan tersebut, serta legalitas euthanasia di Indonesia dan Negara lain. Melalui metode penelitian yuridis normatif dengan menggali beberapa kajian pustaka, penulis berusaha menggali lebih jauh terkait bagaimana tinjauan hukum positif mengenai euthanasia. Namun, berdasarkan implikasi hukum yang muncul dari Pasal 340 KUHP, maka euthanasia dinyatakan dilarang di Indonesia meskipun beberapa Negara seperti Australia, Belgia, Belanda, Kolombia, Inggris telah melegalkan nya

Abstract

Penelitian ini bertujuan untuk mengkaji dan menelaah kewenangan Mahkamah Konstitusi sebagai lembaga superbody dalam sistem ketatanegaraan Indonesia. Menganalisis bagaimana Mahkamah Konstitusi menjalankan kewenangannya dan apa yang menjadi batasan konstitusional kewenangan Mahkamah Konstitusi sebagai lembaga superbody. Penelitian ini menggunakan metode yuridis normatif dengan fokus penelitiannya yang berhubungan dengan wewenang Mahkamah Konstitusi sedangkan teknik pengumpulan data menggunakan studi kepustakaan (library research). Hasil penelitian menyimpulkan bahwa Mahkamah Konstitusi melalui kewenangannya seolah tampil sebagai lembaga negara yang superbody dengan harapan menghindari kekuasaan yang terlampau luas, tetapi dalam realitanya belum tercapai maksimal karena kekuasaan Mahkamah Konstitusi yang luas dan cenderung melampaui batas, berimplikasi pada putusan yang cenderung ultra petita. Begitu pula dengan mandat yang diberikan oleh Undang-undang kepada Mahkamah Konstitusi sebagai penafsir tunggal konstitusi, namun bukan berarti tafsirannya bisa dilakukan dengan tanpa batasan. Mahkamah Konstitusi dalam menjalankan tugas dan tanggungjawab sebagai lembaga negara harus berpedoman pada aturan hukum yang ada, sebagai upaya agar tidak menjadikan Mahkamah Konstitusi sebagai lembaga yang superbody.

Abstract

The Election Organizer Honorary Council as an institution formed to handle violations of the code of ethics of election organizers applies the principles of maintaining justice, independence, impartiality, and transparency in enforcing the rules or ethical norms that apply to all election organizers, as stipulated in Law Number 7 of 2017. The method used in this study uses a normative legal approach. The results of the study, First, the legal framework for handling violations of the code of ethics of election organizers in Indonesia is a mandate of Law Number 7 of 2017, in Article 1 number 24 which states that the Election Organizer Honorary Council is an institution tasked with handling violations of the code of ethics of Election Organizers. Second, The urgency of law enforcement for violations of the code of ethics of election organizers as an effort to present the integrity of election organizers is the main capital in realizing democratic elections, the presence of the Election Organizer Honorary Council as an institution that is given the authority to handle violations of the code of ethics of election organizers is important in order to realize election organizers with integrity. Third, the Election Organizer Honorary Council in the process of handling alleged violations of the code of ethics of election organizers can be carried out including by carrying out prevention, action, and innovation in various forms of activities carried out in the process of law enforcement against alleged violations of the code of ethics of election organizers.

Abstract

The purpose of this article is to describe the fulfillment of social work rights, analyzing the extent to which the government provides social security for social workers. This study uses a qualitative method with a normative juridical approach. The analysis in this study contributes to the fulfillment of social workers' rights in terms of social security and provides recommendations regarding social security regulations as a fulfillment of social workers' rights. The results show that three aspects must be considered in the rights of social workers to social security in Indonesia, namely (1) Fulfillment of Social Workers' Rights, (2) Anticipation of regulations against the risks of social workers, and (3) Social security for social workers in Indonesia. From these three aspects, there are several efforts made by the government in regulation that has issued Law Number 14 of 2019 concerning Social Workers, but the law only regulates the Rights and Obligations of Social Workers in Indonesia. The findings may also impact the lives of social workers, including improved financial well-being, job security, and professional satisfaction. Previous studies have not discussed the aspect of social security as a fulfillment of social workers' rights, so this research contributes to this void by paying attention to the analysis of the fulfillment of social workers' rights in terms of social security aspects.

Abstract

This research explores the national legal formation policies that support the development of Micro, Small, and Medium Enterprises (MSMEs) in Indonesia, emphasizing their role as critical drivers of economic growth. Using a normative juridical method, the study evaluates recent regulatory reforms, such as the introduction of the Business Identification Number (NIB) and incentives for MSME partnerships. These initiatives simplify business formalization and enhance MSME competitiveness. The study applies Inclusive Growth Theory and Economic Analysis of Law (EAL) to propose policy directions that ensure equitable access to resources, digital transformation, and efficient regulatory environments. Recommendations highlight the need for adaptive and collaborative legal frameworks to strengthen MSMEs as pillars of inclusive and sustainable economic growth.

Abstract

The phenomenon of low legal awareness among the public highlights the importance of examining the role of religious values in shaping legal compliance, particularly within Islamic boarding schools. This study aims to determine the effect of understanding religious values on obedience to state law among students of Pondok Pesantren Al-Musyahadah “Rumah Cerdas Indonesia.” The research employed a quantitative approach using simple linear regression analysis. Data were collected from 120 respondents through a Likert-scale questionnaire and analyzed using validity, reliability, and classical assumption tests. The findings indicate that understanding religious values has a positive and significant effect on obedience to state law, meaning that the better the understanding of religious values, the higher the level of legal compliance.
