Abstract

Non-Fungible Tokens (NFTs) serve as a digital platform that aids creators of digital works, particularly E-Books, in marketing or introducing their creative outputs. This platform offers easy access and high-security systems to safeguard the copyright of E-Book creators. This study aims to analyze and provide insights into the copyright protection of E-Book works in the form of NFTs, under the perspective of Copyright Law. Additionally, the study seeks to determine whether NFT transactions can serve as a solution for Intellectual Property protection in Indonesia. The research employs a normative legal research method, utilizing literature review and descriptive techniques. The findings reveal that NFTs can indeed offer a solution for intellectual property protection in Indonesia. By transforming works into NFTs, their copyright is protected through ownership tokens that are automatically integrated into the blockchain (digital ledger).

Abstract

The large number of people who do not have proof of land ownership is an obstacle in obtaining credit from banks. However, responding to this, the bank allows the bank to be able to accept credit submitted to it. However, it becomes a problem when the auction winner wants to transfer the rights to the land, it cannot be done because the land has not been certified, which results in the auction winner not being able to pay the BPHTB. The research method used is normative legal research. Legal regulations regarding auctions for land that have not been certified are contained in Article 41 Paragraph 4 of the PP on land registration, Articles 76 and 108 of the Regulation of the Minister of Land Registration, Article 34 of PMK Implementation of auctions. Meanwhile, the conflict that occurred was Article 83 of the PMK for the Implementation of the Auction, which required the auction winner to pay BPHTB, while Article 2 of the BPHTB Law states that land that has not been certified does not include land rights. The solution provided by the author is: the head of the land office and the head of the KPKNL provide concessions for BPHTB payments and change the laws and regulations related to allowing uncertified land to be auctioned.

Abstract

The right to vote as a fundamental human right in a democratic country like Indonesia, in fact cannot always be guaranteed to be implemented and its benefits can be realized. The problem of election integrity in Indonesia, which has not improved, has encouraged Indonesia to continue to update its democratic party implementation system, including considering various existing alternatives. Revoking and limiting expatriates' right to vote is a practice that has actually been carried out by other countries, to improve the integrity of elections. This research aims to analyze the possibility of revoking and/or limiting the right to vote from expatriates as an effort to increase election integrity, with a constitutional lens. This analysis is supported by normative legal research methods, with a statutory approach and a comparative approach. The research results found that although revoking the right to vote from expatriates is an unconstitutional option and has not been implemented, the government can implement limiting the right to vote from expatriates to cover the normative gap that exists regarding citizenship, while increasing the accuracy of election list data, by implementing several policies that have been implemented by other countries

Abstract

The movement of people across countries has both positive and negative impacts on society. Globalization has changed the way humans move massively and quickly. Indonesia, as a country with a strategic geographical position between two continents and two oceans, plays a role as a center of human crossing. Indonesia's vast sea area is an important potential to be developed, and President Joko Widodo initiated the World Maritime Axis policy to drive the economy in the sea area. Government agencies in the sea area are part of the ecosystem that supports policies in the sea area. Policies related to law enforcement in the sea area continue to develop along with the expansion of activities at the border. Immigration has a strategic role because it regulates traffic at the state border, maintains state sovereignty, and supports the implementation of sea area policies. This research aims to evaluate the strategic role of immigration by applying a progressive legal theory approach and using normative legal research methods. Progressive law returns the law to its substantial purpose, so that legal changes should not eliminate the substance. This research aims to answer the challenges of the times by adapting the law in accordance with the purpose of the law. In the context of international law of the sea (UNCLOS 1982), this research looks at the strategic role of immigration in law enforcement in the sea area, including the territorial sea zone and additional sea zone. The cooperation of law enforcement agencies in the maritime area is key to maintaining state sovereignty and security at the border. This research contributes to the understanding of the strategic role of immigration in supporting Indonesia's territorial sea policy.

Abstract

Child trafficking cases are one of the fastest-growing crimes in the world. Lack of education and limited information make them vulnerable to being trapped in human trafficking. In the Indonesian legal framework, human trafficking is regulated in Law Number 21 of 2007 concerning the Eradication of Human Trafficking and Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection which regulates the right to restitution. However, there are still weaknesses in law enforcement, namely for any criminal offense that restitution can be submitted, so law enforcement does not necessarily facilitate victims in applying for the right to restitution. The research method used in this study is a normative juridical research method. This approach involves problem analysis using primary reference materials which include statutory regulations as the main source (primary legal materials), as well as various secondary sources of legal materials, such as legal literature, legal books, scientific publications, and scientific articles. discusses the regulation and implementation of criminal sanctions against child traffickers and their rights to restitution to find appropriate and accurate answers. Based on the research results, law enforcement efforts regarding the crime of child trafficking and the right to restitution can be carried out in three stages, namely: during the crime, during the trial of the perpetrator of human trafficking, and after the verdict.

Abstract

Artikel ini menjelaskan tentang pertanggungjawaban notaris dalam menghadapi indikasi pemalsuan pada peralihan kepemilikan aset dari perspektif hukum positif di Indonesia. Metode penelitian yang digunakan adalah penelitian hukum yuridis normatif. Kasus pemalsuan surat pengalihan aset Bantuan Likuiditas Bank Indonesia (BLBI) di Bogor digunakan sebagai ilustrasi dalam konteks pembahasan. Dalam analisisnya, artikel ini menekankan pentingnya notaris untuk dapat mengidentifikasi indikasi pemalsuan, tindakan pencegahan, dan pelaporan terhadap indikasi tersebut. Notaris memiliki peran penting dalam memastikan keabsahan transaksi hukum dan harus bertindak dengan itikad baik. Selain itu, artikel ini juga membahas konsekuensi hukum yang mungkin dihadapi oleh notaris jika mereka gagal menjalankan kewajiban mereka dalam menghadapi pemalsuan, termasuk sanksi administratif, tindakan hukum pidana, dan tuntutan perdata. Keseluruhan, artikel ini menggarisbawahi pentingnya menjaga kepercayaan masyarakat terhadap sistem hukum dan peran notaris dalam menjaga integritas transaksi hukum.

Abstract

Protection of personal data is a human right that must be given legal protection. However, Indonesia does not yet have special rules governing the protection of personal data and the Personal Data Protection Supervisory Agency. As for when compared to Germany, which has special rules regarding the protection of personal data in full to the Institution that oversees the implementation of the rules for protecting Personal Data. The research method used by the author is a legal comparison method with the type of research being normative research. The author uses secondary data to analyze the results of the data, namely, primary materials, secondary materials, and tertiary materials. The analytical method used by the author is a qualitative method. Similarities and differences in personal data protection between Indonesia-Germany and the legal contributions of personal data protection that he can adopt or apply in Indonesia such as special arrangements for personal data protection, data classification, one of which is the deletion of personal data, and the establishment of a Personal Data Protection Supervisory Agency and the rules that govern it

Abstract

The rapid growth of influencer marketing has revolutionized the way brands connect with their target audiences. However, this novel marketing strategy has also brought forth new legal challenges, particularly in consumer trust and intellectual property rights (IPRs). This study aims to bridge the gap in the current understanding of the interplay between consumer trust and IPR risks in the context of influencer marketing. Through a normative legal research method with a statutory approach, this study seeks to comprehensively examine the wider implications of influencer marketing. The research aims to contribute to developing a more robust legal framework that can effectively address the unique challenges posed by influencer marketing while fostering consumer trust and protecting intellectual property rights. The findings reveal inadequacies in the existing Indonesian legal frameworks, particularly the Consumer Protection Law, Copyright Law, and Trademark and GI Law, in addressing the unique challenges of influencer marketing. The study proposes targeted amendments to these laws, including mandatory disclosure requirements, clear guidelines on fair use and trademark usage, and stronger enforcement mechanisms to mitigate consumer trust and IPR risks. Pertumbuhan pesat pemasaran melalui influencer telah merevolusi cara mengenalkan merek berhubungan dengan audiens target mereka. Namun, strategi pemasaran baru ini juga memunculkan tantangan hukum baru, terutama di bidang kepercayaan konsumen dan hak kekayaan intelektual (HKI). Penelitian ini bertujuan untuk menjembatani kesenjangan dalam pemahaman saat ini mengenai keterkaitan antara kepercayaan konsumen dan risiko HKI dalam konteks pemasaran influencer. Melalui metode penelitian hukum normatif dengan pendekatan perundang-undangan, penelitian ini berupaya memberikan pemeriksaan menyeluruh terhadap implikasi luas pemasaran influencer. Penelitian ini bertujuan untuk berkontribusi pada pengembangan kerangka hukum yang lebih kuat yang dapat secara efektif menangani tantangan unik yang ditimbulkan oleh pemasaran influencer sambil mendorong kepercayaan konsumen dan melindungi hak kekayaan intelektual. Temuan mengungkapkan ketidakcukupan dalam kerangka hukum Indonesia yang ada, terutama Undang-Undang Perlindungan Konsumen, Undang-Undang Hak Cipta, dan Undang-Undang Merek dan Indikasi Geografis, dalam menangani tantangan unik pemasaran influencer. Penelitian ini mengusulkan amandemen khusus terhadap undang-undang ini, termasuk persyaratan pengungkapan wajib, pedoman yang jelas tentang penggunaan wajar dan penggunaan merek dagang, serta mekanisme penegakan yang lebih kuat, untuk mengurangi risiko kepercayaan konsumen dan HKI.

Abstract

In terms of conducting business interactions through a PT, it is not uncommon for investors from Indonesia and Singapore to experience disharmony in practice, such as negligence by the board of directors that results in harm to the company. Therefore, it is important to have an effective legal mechanism to challenge such negligence so there is an urgency to identify and understand the differences between the legal framework in Indonesia and Singapore in dealing with directors' negligence is important for stakeholders to adopt best practices and improve corporate governance. The results show that derivative rights in Singapore provide a more effective and efficient tool for shareholders to challenge directors' negligence, with clearer legal procedures and stronger legal protections compared to Indonesia. The study concludes that the adoption of best practices from Singapore can improve corporate accountability and governance in Indonesia.

Abstract

Media massa dan wartawan merupakan dua sumber daya yang saling berhubungan. Perusahaan media massa tidak profesional berdampak negatif terhadap kehidupan pers. Media massa dan wartawan bagaikan dua mata pisau sehingga bisa dijadikan alat untuk kepentingan tertentu, bahkan melanggar hukum. Media massa dan wartawan yang tidak mengedepankan kode etik jurnalistik mencoreng profesi jurnalis, dan cenderung melanggar hukum sehingga muncul stigma negatif di tengah masyarakat terhadap profesi wartawan. Adapun rumusan masalah dalam penelitian ini adalah bagaimana problematika pendirian perusahaan pers serta urgensi verifikasi media massa dan uji kompetensi wartawan, yang dihubungkan dengan prinsip kemerdekaan pers dan Undang-Undang Pers. Penelitian disajikan menggunakan metode yuridis empiris dengan pendekatan penelitian bersifat kualitatif. Berdasarkan hasil penelitian, terdapat celah hukum pada peraturan terkait pendirian media massa. Bahkan UU Nomor 40 Tahun 1999 tentang Pers sendiri membuka ruang kepada siapa saja untuk mendirikan perusahaan pers, namun tidak mewajibkan untuk meningkatkan kapasitas. UU Pers juga tidak mengatur syarat pendidikan bagi wartawan, melainkan hal tersebut diserahkan kepada perusahaan pers. Regulasi pers terkait verifikasi media massa dan uji kompetensi wartawan hanya berlaku bagi yang mendaftar di Dewan Pers. Kondisi tersebut menyebabkan pertumbuhan media massa, khususnya media siber tidak terkendali, bahkan aktivitas wartawan yang tidak profesional cenderung melanggar prinsip-prinsip kemerdekaan pers.
