Abstract

The release of Minister of Trade Regulation Number 11 of 2022 then invited a lot of controversy and protests, one of which was the emergence of lawsuits from several palm oil companies including PT. Wilmar Nabati Indonesia is famous for producing Sania and Fortune cooking oils which are sold both in supermarkets and markets in Indonesia. The purpose of issuing this regulation is to overcome the phenomenon of scarce oil, because with it the price of oil will become expensive but in terms of quantity it will appear because the price is high due to the HET not being regulated in Minister of Trade Regulation Number 11 of 2022. This research was analyzed using data method techniques. descriptive qualitative with library research data collection techniques on secondary data which is then carried out by reducing and interpreting the data. The aim of this research is to review juridically the lawsuit regarding Minister of Trade Regulation Number 11 of 2022 from the perspective of the elements of state administration decisions. This Minister of Trade Regulation is appropriate to be brought to the Jakarta PTUN (State Administrative Court) by PT. Wilmar Nabati Indonesia as the plaintiff with the Minister of Trade Zulkifli Hasan as the defendant. The Minister of Trade Regulation is not worth challenging because the KTUN has given rise to legal consequences. This is based on Article 53 Paragraph (2) of Law Number 9 of 2004 concerning PTUN which states that the law can be traced through the absence of legal losses. Direct and real losses can be traced if the KTUN in question has a relationship with a person or civil legal entity.

Abstract

Food security is where food is sustainably available, accessible, safe to consume, and affordable. In 2023, the province will hold the B2SA Local Food Festival, which the government and community hope will create a healthy generation. This research has two objectives: a). to describe and analyze the implementation of the Program for Increasing Diversification and Food Security Towards Diverse, Nutritious, Balanced and Safe Food (B2SA) through the 2023 East Kalimantan Local Food Festival. b). To describe and analyze the inhibiting and supporting factors for implementing the Program for Increasing Diversification and Food Security Towards Diverse, Nutritious, Balanced, and Safe Food (B2SA) through the 2023 East Kalimantan Local Food Festival. This research uses descriptive qualitative methods. The research location was the Food Crops and Horticulture Service of East Kalimantan Province. This research shows that the Local Food Festival (B2SA) in East Kalimantan Province is a good step in overcoming dependence on rice and wheat. The importance of consuming diverse foods can be increased through education and promotion of B2SA, including using the East Kalimantan Local Food Festival (B2SA). 2023 as a platform to disseminate relevant information. The implementation of the 2023 Provincial B2SA Local Food Festival by the East Kalimantan Province Food, Food Security and Horticulture Service has paid attention to dependent variables, which include essential stages in the policy implementation process to improve the nutritional quality and food security of the community as a whole, and in changing patterns. Food consumption has become more diverse, nutritious, balanced, and safe (B2SA).

Abstract

Untuk mewujudkan tata kelola pemerintahan daerah yang baik, pemerintah telah membuat kebijakan yaitu dengan dikeluarkannya UU No. 20/2008 yang mengatur tentang UMKM, disusul dengan PP No. 07/2021 tentang fasilitasi, perlindungan, dan pemberdayaan koperasi dan UMKM. Namun, kenyataan menunjukkan Pemerintah Kota Samarinda belum menindaklanjuti kebijakan-kebijakan tersebut ke dalam peraturan daerah dan peraturan lain yang lebih rendah. Tujuan dari penelitian ini adalah untuk menganalisis instrumen kebijakan yang digunakan oleh pemerintah Kota Samarinda, partisipasi dan upaya pemangku kepentingan dalam membangun infrastruktur dan meningkatkan sumber daya manusia pelaku UMKM untuk mendukung implementasi kebijakan pengembangan UMKM dalam konteks tata kelola pemerintahan daerah yang baik. Jenis penelitian ini menggunakan metode kualitatif dan pengumpulan data dilakukan dengan observasi, wawancara mendalam dan dokumentasi melalui teknik analisis data dengan menggunakan model interaktif oleh Miles, Huberman, dan Saldana. Hasil penelitian menunjukkan dalam implementasi kebijakan pengembangan UMKM, Pemerintah Kota Samarinda telah berpedoman pada instrumen kebijakan. Adanya partisipasi dan upaya stakeholder dalam implementasi kebijakan pengembangan UMKM di Kota Samarinda juga diterapkan untuk menciptakan Infrastruktur UMKM dan memajukan sumber daya manusia pelaku usaha dalam mendorong implementasi kebijakan pengembangan UMKM di Kota Samarinda.

Abstract

Reformasi birokrasi nasional Indonesia dimulai sejak tahun 2010 dengan tujuan menciptakan tata pemerintahan yang bersih dan efektif. Peraturan Pemerintah Nomor 60 Tahun 2008 tentang Sistem Pengendalian Intern Pemerintah (SPIP) diterapkan untuk memastikan efektivitas dan keandalan pelaporan keuangan serta ketaatan terhadap peraturan. Namun, masih terdapat kelemahan dalam efektivitas SPIP di daerah, termasuk peran APIP sebagai fasilitator SPIP. Penelitian ini bertujuan untuk menilai sejauh mana proses SPIP dalam pengawasan penyelenggaraan pemerintah daerah di Kalimantan Timur, khususnya melalui Audit Berbasis Risiko (ARB).Penelitian ini menggunakan metode deskriptif analitis dengan wawancara, studi literatur, dan analisis data primer dan sekunder untuk mengevaluasi pengendalian internal dan implementasi ARB di APIP Kalimantan Timur. Ditemukan bahwa APIP di Kalimantan Timur telah menerapkan beberapa aspek SPIP, namun masih terdapat kekurangan dalam pemantauan dan evaluasi, serta kebutuhan peningkatan sumber daya manusia dan infrastruktur. Penelitian ini menyimpulkan bahwa meskipun telah ada upaya dalam menerapkan SPIP, masih diperlukan perbaikan dan peningkatan dalam aspek pemantauan, evaluasi, dan sumber daya untuk mencapai efektivitas SPIP yang optimal di Kalimantan Timur.

Abstract

This study provides an in-depth understanding of the jurisdictional dispute involving Fadel Muhammad and the DPD RI regarding the decision of the State Administrative Court (PTUN) of Jakarta. The results show that PTUN plays a crucial role in ensuring government accountability and protecting individual rights, but the decision in this case also highlighted tensions between the executive, legislative, and judicial powers. While PTUN has the authority to adjudicate administrative disputes, decisions related to political matters, such as the dismissal of Fadel Muhammad, present complexities that need to be carefully managed to avoid destabilizing the constitutional order. One of the main challenges is the enforcement of PTUN’s decisions, which remains susceptible to non-compliance by the government, potentially leading to legal uncertainty and undermining the effectiveness of the legal system in Indonesia. Therefore, further reforms are needed to strengthen the administrative law system and the judiciary to ensure that PTUN decisions are implemented effectively and fairly, thus maintaining the stability of democracy and the constitutional order in Indonesia.

Abstract

Tujuan peneitian ini adalah menganalisis Implementasi Kebijakan Disiplin Pegawai Penelitian ini menggunakan pendekatan penelitian kualitatif dengan menggunakan terknik pengumpulan data wawancara, observasi dan dokumentasi. Penelitian ini menggunakan Teori Ripley dan Franklin dengan 3 (tiga) perspektif implementasi. Hasil penelitian menunjukkan bahwa Implementasi kebijakan disiplin Pegawai Negeri Sipil pada Dinas Pemuda dan Olahraga Provinsi Kalimantan Timur menunjukkan belum berjalan dengan maksimal.

Abstract

The issues of climate change and environmental degradation demand a transformation in development towards a more sustainable direction. One strategy adopted is the development of renewable energy and the implementation of green financing schemes, particularly at the regional level. This study aims to analyze the role of renewable energy and green financing in supporting environmental sustainability in East Kalimantan through the implementation of the Green Province Program. This research uses a qualitative descriptive approach based on literature review, with secondary data collected from various scientific sources and policy documents. The results show that although there was a decline in the Environmental Quality Index (IKLH) between 2020 and 2022, an improvement trend began to appear in 2023 and 2024 along with the increased implementation of programs such as communal solar power plants (PLTS), green microcredit, and the distribution of FCPF funds worth USD 20.9 million. The findings also highlight the importance of synergy between stakeholders and the need to scale up the revitalization of new and renewable energy infrastructure. With more thorough planning and adequate resource allocation, the Green Province Program has the potential to become a model for regionally-based low-carbon development and support the achievement of Sustainable Development Goals (SDGs) 7 and 13.

Abstract

This research examines the application of the smart mobility concept as a transition strategy towards low-carbon transportation in East Kalimantan, focusing on the cities of Samarinda and Balikpapan. This research aims to analyze the role of transportation digitalization in improving public service efficiency, reducing carbon emissions, and identifying barriers to implementation. The method used is an exploratory case study with a content analysis approach to secondary data. The results show that smart mobility in East Kalimantan is beginning to have a positive impact. E-parking services, the development of e-ticketing, and the use of navigation applications have proven effective in reducing congestion and fuel consumption. Furthermore, the adoption of electric vehicles (EVs) has shown a significant increase, marked by a 452% increase in electricity consumption and a 406% increase in SPKLU (Public EV Charging Station) transactions by 2024. The expansion of SPKLU and SPBKLU infrastructure has strengthened the electric vehicle ecosystem in this region. However, obstacles remain, such as a digital literacy gap among the community, particularly among the elderly, low-income groups, and residents in rural areas. This limits the optimal utilization of digital transportation services.

Abstract

Climate change and ecological pressures such as forest fires, land conversion, and natural resource degradation have a significant impact on the sustainability of the lives of protected forest buffer village communities in East Kalimantan. This research aims to assess the social-ecological readiness of the community in facing these pressures and design an adaptive and contextual community-based strategic model, with a case study of the Sungai Wain Protection Forest (HLSW). The method used was a mixed-methods approach consisting of three main techniques: (1) household survey of 200 respondents from two villages (RT 38 Karang Joang Village (Sungai Wain Village) and Lamaru Village) directly adjacent to the HLSW area, (2) focus group discussions (FGDs) and in-depth interviews with 30 key informants from village government, customary, NGOs, and forestry agencies, and (3) social ecological mapping using a participatory approach with the help of GIS technology. The results identified three clusters of community readiness, namely: “strong adaptive”, “transition moderation”, and “ecologically vulnerable”. Villages active in social forestry programs and involved in initiatives such as ProKlim and Green Growth Compact showed better economic and institutional readiness than villages dependent on traditional agriculture. This research has led to the development of community-based adaptation strategies that can be adopted by other forest buffer villages in Indonesia. This approach can increase the effectiveness of policy interventions within the framework of locally-based natural resource management and disaster risk reduction.

Abstract

This study aims to analyze collaboration between institutions in handling violations of the neutrality of State Civil Apparatus (ASN) in the 2024 Samarinda City Regional Head Election (Pilkada). Through a qualitative descriptive approach, this study highlights how the Election Supervisory Agency (Bawaslu), the Human Resources Development and Personnel Agency (BKPSDM), and the Samarinda City Inspectorate carry out synergy based on the principles of collaborative governance which include forums, transparency, goal management, compromise, communication, democracy and equality, as well as commitment and stamina. The results of the study show that collaboration between institutions has been running with a fairly good work structure and coordination, but still faces a number of challenges such as weak transparency between agencies, limited resources, minimal public participation, and potential conflicts of interest at the local level. These findings emphasize the importance of improving communication, improving regulations, and periodic evaluations to ensure that ASN neutrality is maintained and the democratic process runs professionally, transparently, and accountably.
