Abstract

Lampung customary inheritance system generally applies a pure patrilineal system, where sons become heirs from the father's side, while daughters have no position as heirs. However, along with the times, there have been changes in the implementation of inheritance in urban Lampung customary society, especially in Bandar Lampung City. The dynamics of this change are influenced by various factors, one of which is the increasingly common occurrence of mixed marriages. Therefore, this study aims to examine the dynamics of changes in the inheritance system by considering the various factors that influence it. This research uses a qualitative approach with a type of empirical juridical research that is analytically descriptive. Data were obtained through interviews as primary data and document analysis as secondary data. Data processing is done through the stages of data reduction, data presentation, and conclusion drawing. The results showed that the dynamics of change in the patrilineal inheritance system in Lampung customary society in Bandar Lampung City reflected a paradigm shift that occurred gradually in response to the influence of external and internal factors, such as the environment, educational development, religious influence, and others. Although the patrilineal inheritance system is still influential, these changes lead to a fairer and more equitable distribution of inheritance, while still maintaining existing religious and customary principles, as well as respecting the philosophy of life of the Lampung people.

Abstract

Inheritance system The Semende traditional community generally applies a female majorat kinship system, namely the eldest daughter (wait tubang) who becomes the heir. However, along with the times, there has been a paradigm shift that has occurred in a small portion of the Semende contract community, especially those in overseas lands, who no longer apply the traditional Twai Tubang inheritance system as is the case in the city of Bandar Lampung. This research aims to examine the meaning of the shift and the factors that caused the shift in the paradigm of the Semende indigenous community towards the matrilineal inheritance system. This type of research is carried out using sociological law or empirical juridical research, which is descriptive analytical in nature which describes and explains the kinship structure of the Semende indigenous community in the city of Bandar Lampung which is taken from primary data by conducting interviews and secondary data by processing data from primary legal materials and even secondary law. and tertiary legal materials. From the results of the research, it can be understood that the transformative meaning/paradigm shift of the Semende indigenous community towards the matrilineal inheritance system means that inheritance rights were previously controlled by the eldest daughter but have now undergone changes, especially assets obtained from marriage, or assets obtained from overseas land. which is known as waiting for tubang hijrah, while inheritance assets in the form of agricultural land, high inheritance land, inherited rice fields, gadang houses, will be owned and controlled by Mamak, the head of the heir. One of the reasons for the shift in the paradigm of the Semende Indigenous Community is that the Semende Indigenous Community is a dynamic society, and has a life principle of behaving with high morals, self-knowledge and a big heart. Apart from that, the shift in understanding of the Tubang inheritance system is caused by several factors, such as residential environmental factors, religious/religious factors, educational environmental factors, economic factors, mixed marriage factors, educational level factors and parental love factors for children who do not differentiate between men and women.Keywords: Semende Indigenous People; matrilineal; transformative/shifting; wait for the tube

Abstract

This article examines maṣlahah mulgah as an alternative method of establishing progressive law, in resolving contemporary legal cases in Indonesia. The problem is that maṣlahah mulgah has so far been underestimated in the ushul fiqh method. The research approach used is qualitative, with a literature study on the application of maslahah mulgah, rules or norms in Islamic law. Meanwhile, the analysis techniques used are qualitative content analysis and holistic interpretation. The results of the discussion show that Maṣlahah mulgah can be applied to contemporary legal problems that continue to occur in various aspects by considering the dimensions of the spirit of shari'ah, maqaṣid al-syari'ah, maṣlahah al-'ammah, and tagayyur al-azminah da al-amkinah, especially on legal problems that fima la naṣṣa fih, and sukut al-Syari 'an syar'iyyah al-'amal ma'a qiyam al-ma'na al-muqtaḍa lah. Abstract

Sistem kewarisan adat Lampung pada umumnya menerapkan sistem kekerabatan patrilineal murni menjadikan anak laki-laki sebagai waris dari pihak bapak, sedangkan anak perempuan tidak dapat berkedudukan sebagai ahli waris. Namun, seiring dengan perkembangan zaman terjadi pergeseran dan perkembangan yang ada terdapat perubahan kedudukan laki-laki dan perempuan dalam lingkup keluarga maupun masyarakat adat Lampung. Penelitian ini bertujuan mengkaji makna pergeseran dan faktor terjadinya pergeseran paradiqma masyarakat adat Lampung terhadap sistem kewarisan patrilineal. Jenis penelitian yang dilakukan menggunakan hukum sosiologis atau penelitian Yuridis Empiris, yang bersifat deskriptif analitis yang menggambarkan serta menjelaskan struktur kekerabatan masyarakat adat Lampung di Bandar Lampung yang diambil dari data primer dengan melakukan wawancara dan data sekunder dengan mengolah data dari bahan hukum primer bahkan hukum sekunder dan bahan hukum tersier. Hasil penelitian dapat dipahami bahwa makna pergeseran paradigma masyarakat adat Lampung terhadap sistem waris patrilinieal artinya hak waris yang sebelumnya dikuasi oleh anak laki-laki tertua namun saat ini telah mengalami perubahan-perubahan salah satunya memberikan bagian harta warisan kepada anak perempuan atau ahli waris lainnya. Hal ini disebabkan Masyarakat Lampung merupakan masyarakat yang dinamis, dalam arti cenderung untuk selalu berubah serta menjunjung tinggi falsafah hidup masyarakat Lampung dan faktor terjadinya pergeseran tersebut disebabkan, lingkungan tempat tinggal atau pergaulan, faktor Agama, faktor ekonomi, faktor perkawinan campuran, faktor tingkat Pendidikan.

Abstract

This study examines the validity of contracts in the Indonesian Standard Quick Response Code System (QRIS) from the perspective of Islamic economic law, as a response to the epistemological challenges of digital transformation to classical contract theory. The digitalisation of economic transactions has introduced new complexities in the application of the pillars and conditions of contracts as understood within the framework of conventional fiqh muamalah, thus requiring a conceptual reinterpretation of the ijab-qabul mechanism, the concept of majlis al-'aqd, and the validity of non-verbal contract forms. The emergence of QRIS as a national payment standard developed by Bank Indonesia is not only a technological innovation in supporting financial inclusion and economic digitalisation, but also raises fundamental questions about the validity of multi-party contract structures in the digital payment ecosystem in accordance with sharia principles. This study uses a descriptive qualitative method with a field research approach that integrates inductive thematic analysis, document review based on the fiqh muamalah framework, and structured participatory observation. Data were obtained through in-depth interviews with business actors who use QRIS, Muslim consumers, and muamalah academics, and were reinforced with literature related to Islamic economic law and Bank Indonesia regulations.  The results of the study indicate that the main contract formed in QRIS transactions is a sale and purchase contract (ba'i), while additional contracts include wakalah between business actors and service providers, as well as ijarah in the context of payment processing services. From a Shariah perspective, QRIS is in accordance with the principles of an-taradhi (mutual agreement), al-'adalah (fairness), and la dharar wa la dhirar (no harm), particularly due to its cost transparency and consumer protection. The scientific contribution of this research lies in the development of a framework for analysing digital contracts based on maqasid Shariah, which combines classical contract theory with the reality of contemporary electronic transactions, resulting in the conceptualisation of “virtual assemblies” and “digital consent” as a form of evolution of the pillars of contracts in the context of financial technology. These findings enrich the treasury of fiqh al-nawazil (contemporary fiqh issues) by providing sharia justification for digital economic practices that were previously in the grey zone of Islamic law, while also providing normative guidance for the future development of sharia fintech products. Therefore, the use of QRIS can be declared valid according to Islamic economic law and has the potential to become a model for digital payment instruments that are in accordance with the principles of Islamic muamalah.
