Abstract

This research aims to carry out an in-depth analysis of the judge's basic considerations and legal consequences in rejecting an unacceptable divorce claim (niet ontvankelijk verklaard) in court, seen from the perspective of Civil Procedure Law. This study explores various legal aspects that form the basis of a judge's consideration in rejecting a divorce lawsuit and the legal implications for the parties involved. The research method used involves legal text analysis, case studies, and a comparative legal approach to understand the legal framework that supports the judge's decision to reject an unacceptable divorce lawsuit. The results of this research provide in-depth insight into the legal process involving judge deliberations in this context and its impact on both parties

Abstract

The legitimate of a marriage is clearly stated in the Marriage Law No.1 1974 in article 2, it is declared valid if it is carried out according to the laws of each religion and belief and must be recorded according to the applicable laws and regulations, but then there are other rules contained in the Administration Law No.23 2006 Article 35 states that marriages that occur because of differences in religion are still recorded in the civil registry. This research uses normative (doctrinal) methods. Meanwhile, there are problems related to the legal status arising from interfaith marriages which are registered based on court decisions, so that it becomes a legal issue, but currently the Supreme Court has issued a circular stating that judges in adjudicating such matters will not do so. grant the application for marriage registration submitted at a later day.

Abstract

Interfaith marriage are still a hot topic of discussion among Indonesian society, to overcome this problem the Supreme Court (MA) issued SEMA Number 2 of 2023 which contains a prohibition on the Courts not to approve applications for registration of interfaith marriages. This research aims to determine the Human Rights perspective on SEMA Number 2 of 2023, by applying normative juridical methods, and library research as a technique in collecting data. The results of this study show that SEMA Number 2 of 2023 has drawn pros and cons, from a human rights perspective, the prohibition in SEMA Number 2 of 2023 is considered discriminatory and not in line with human rights principles, which ignores the freedom to practice religion and guarantee the protection of marriage rights without religious restrictions as stated in Article 3 paragraph (3) of Law Number 39 of 1999 concerning Human Rights, Article 28 E paragraph (1) and Article 29 paragraph (2) of the 1945 Constitution, Article 16 paragraph (1) of the Universal Declaration of Human Rights (UDHR), Article 2 paragraph (1) and Article 23 paragraph (2) of the International Covenant on Civil and Political Rights.

Abstract

This research examines the legal construction of default in commercial guarantee relationships, focusing on the analysis of District Court Decision No. 127/Pdt.G/2022/PN Jkt.Pst. The background arises from the growing complexity of modern business contracts that position guarantors as equivalent to primary debtors, thereby shifting the legal function of guarantees. This research seeks to examine the legal aspects basis of guarantor liability in cases of debtor default and to assess the judicial interpretation trends regarding contractual obligations. The research applies a normative-juridical approach by reviewing primary legal materials, including primary sources like statutes and judicial rulings, along with secondary materials such as legal literature and journals scholarly. The findings indicate that the court adopted a progressive interpretation of the pacta sunt servanda and good faith principles as the basis for imposing liability on guarantors. The decision reflects a paradigm shift from a formalistic to a contextual and proportional approach that prioritizes substantive justice over mere textual certainty. The study concludes that the standardization of commercial guarantee contracts and consistent jurisprudence are essential to ensure balance between creditor protection and guarantor fairness in commercial transactions.

Abstract

Penelitian ini bertujuan untuk menganalisis kedudukan dan fungsi ketentuan legitime poertie dalam Kitab Undang-Undang Hukum Perdata (KUHPerdata) sebagai mekanisme perlindungan hak ahli waris, serta menjelaskan bagaimana ketentuan tersebut membatasi kebebasan testator dalam menentukan pembagian harta waris. Kajian ini menggunakan metode penelitian yuridis normatif melalui pendekatan perundang-undangan, pendekatan konseptual, serta studi literatur terhadap doktrin, jurnal ilmiah, dan regulasi yang relevan. Hasil penelitian menunjukkan bahwa legitime poertie merupakan bagian mutlak yang wajib diberikan kepada ahli waris tertentu, terutama ahli waris dalam garis lurus, sebagai bentuk perlindungan hukum terhadap hak mereka yang tidak dapat dihapuskan oleh pewaris. Keberadaan legitime poertie berfungsi menjaga keadilan distributif, kepastian hukum, dan stabilitas keluarga dalam pembagian harta peninggalan. Selain itu, penelitian ini menemukan bahwa kebebasan pewaris dalam membuat hibah maupun wasiat dibatasi oleh ketentuan legitime poertie, sehingga setiap tindakan pewaris yang berpotensi mengurangi bagian mutlak ahli waris dapat dibatalkan atau dikurangi melalui mekanisme inkorting. Hal ini menunjukkan bahwa hukum waris perdata Indonesia mengakui kebebasan individual pewaris, namun tetap memberikan perlindungan kuat bagi ahli waris inti guna menghindari ketidakadilan dan potensi konflik keluarga. Dengan demikian, legitime poertie berperan sebagai instrumen penting dalam menyeimbangkan kebebasan testator dengan perlindungan hak ahli waris dalam sistem hukum waris perdata.

Abstract

General background: The regulation of property assets in Indonesian marriage law operates within a dual framework involving the Civil Code and the Marriage Law, each establishing different principles on ownership and control. Specific background: These differences create practical ambiguity in marriages concluded without a prenuptial agreement, particularly when determining the status of separate and marital property upon dissolution. Knowledge gap: Despite substantial jurisprudence, limited scholarly analysis examines how both legal regimes interact in real disputes, especially in cases where property acquired before marriage becomes contested inheritance. Aims: This study analyzes the status and distribution of property assets in marriages without a prenuptial agreement by comparing the Civil Code and the Marriage Law, using Supreme Court Decision No. 2981 K/Pdt/2024 as a case reference. Results: The findings show that during marriage, property classification follows the Marriage Law, but upon dissolution—especially by death—the distribution of assets reverts to the parties’ respective legal system, resulting in the Civil Code governing inheritance for those subject to civil law. Novelty: This research clarifies the normative intersection between marital property and inheritance law in the absence of prenuptial agreements. Implications: The study highlights the need for harmonization between the Marriage Law and the Civil Code to ensure legal certainty and prevent interpretive inconsistencies in future marital property disputes. Abstract

Early marriage in Indonesia, particularly in Indramayu Regency, is a pressing social issue that requires addressing. Although Law Number 1 of 1974 and its revision through Law Number 16 of 2019 set the minimum age for marriage at 19, the practice of underage marriage remains widespread. Data shows that in 2023, there were 425 cases of early marriage in Indramayu, with the main factors being premarital pregnancy and parental pressure. The consequences of early marriage are devastating, both in terms of health, education, and socioeconomics, potentially exacerbating the cycle of poverty. Therefore, efforts to address early marriage through community outreach and education are crucial. The implementation method for this community service includes several stages, starting from preparation, proposal development, activity planning, to implementation of outreach and final report preparation. The outreach activities are designed to raise legal awareness in the community, including education regarding the marriage age requirements stipulated in the law and preventive measures that can be taken early on. The implementation of socialization and education activities to reduce the number of early marriages in Indramayu has created an understanding of the negative impacts of underage marriage, as well as legal awareness for the people of Indramayu Regency, and educated the importance of cooperation between society, religion, and the government in jointly making Indonesia a success without underage marriage. Perkawinan dini di Indonesia, khususnya di Kabupaten Indramayu, menjadi isu sosial yang mendesak untuk ditangani. Meskipun Undang-Undang Nomor 1 Tahun 1974 dan revisinya melalui Undang-Undang Nomor 16 Tahun 2019 menetapkan batas usia minimal menikah pada 19 tahun, praktik perkawinan di bawah umur masih marak terjadi. Data menunjukkan bahwa pada tahun 2023, terdapat 425 kasus perkawinan dini di Indramayu, dengan faktor utama seperti kehamilan di luar nikah dan desakan orang tua. Konsekuensi dari perkawinan dini sangat merugikan, baik dari segi kesehatan, pendidikan, maupun sosial ekonomi, yang berpotensi memperburuk siklus kemiskinan. Oleh karena itu, upaya penanggulangan perkawinan dini melalui sosialisasi dan edukasi kepada masyarakat menjadi sangat penting. Metode pelaksanaan pengabdian kepada masyarakat ini meliputi beberapa tahap, mulai dari persiapan, penyusunan proposal, pembuatan rencana kegiatan, hingga pelaksanaan sosialisasi dan penyusunan laporan akhir. Kegiatan sosialisasi dirancang untuk meningkatkan kesadaran hukum bagi masyarakat, didalamnya memuat edukasi mengenai syarat usia menikah dalam Undang-Undang, dan pencegahan-pencegahan yang dapat dilakukan sejak dini. Terlaksananya kegiatan sosialisasi dan edukasi dalam menekan angka perkawinan dini di Indramayu telah mewujudkan pemahaman akan dampak negatif dari perkawinan anak dibawah umur, serta kesadaran hukum bagi masyarakat Kabupaten Indramayu, dan mengedukasi pentingnya kerja sama akan masyarakat, agama, dan pemerintah dalam bersama menyukseskan Indonesia tanpa perkawinan anak dibawah umur.
