Abstract

Discussion results conclude that impact online gambling usually impact on social, economic, psychological and other aspects enforcement law. Even  in tracking related cash flows with online gambling that is necessary researched. This approach allows police For browse cash flow​ online gambling so that No only ensnare perpetrator field, but also uncovers the bookies and networks that play a role as controller as well as recipient profit main. With focus on tracking transaction finance, enforcement law become more oriented towards termination cash flow and weakening structure crime in a way comprehensive.

Abstract

The regulation of the crime of abortion in the National Criminal Code (KUHP) is part of a formulative policy of criminal law that aims to balance the protection of the right to fetal life, the interests of women's reproductive health, and moral and social values living in Indonesian society. This study aims to analyze the formulative policy of regulating the crime of abortion in the National Criminal Code and its implications for the penal system in Indonesia. The research method used is normative legal research with a statutory approach, a conceptual approach, and a comparative approach. The results of the study show that the National Criminal Code reformulates the abortion offense with a more systematic and progressive regulation, especially through the recognition of certain exceptions based on medical and emergency reasons, in line with the principles of health protection and human rights. However, the policy still maintains the criminal character as the ultimate remedium through proportionate criminal threats. The implications of this regulation on the penal system can be seen in the shift in orientation from a purely repressive approach to a more humanistic and just approach, by providing space for consideration of the perpetrator's subjective condition and the purpose of correctional punishment. Therefore, this formulative policy is expected to be able to create a balance between legal certainty, justice, and usefulness in criminal law enforcement in Indonesia.

Abstract

Perjanjian leasing barang modal merupakan salah satu bentuk pembiayaan yang banyak digunakan dalam kegiatan usaha, terutama untuk memperoleh barang modal tanpa harus melakukan pembelian secara langsung. Dalam praktiknya, tidak jarang debitur melakukan wanprestasi berupa keterlambatan pembayaran, tidak dipenuhinya kewajiban sesuai perjanjian, atau penggunaan barang leasing yang bertentangan dengan ketentuan kontrak. Permasalahan ini menimbulkan konsekuensi yuridis terkait tanggung jawab hukum debitur terhadap kreditur. Penelitian ini bertujuan untuk menganalisis bentuk-bentuk wanprestasi dalam perjanjian leasing barang modal serta mengkaji tanggung jawab hukum debitur akibat wanprestasi tersebut. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual, melalui kajian terhadap Kitab Undang-Undang Hukum Perdata, peraturan di bidang pembiayaan, serta doktrin dan putusan pengadilan yang relevan. Hasil penelitian menunjukkan bahwa debitur yang melakukan wanprestasi dalam perjanjian leasing bertanggung jawab secara hukum untuk memenuhi prestasi, membayar ganti rugi, bunga, dan biaya, serta berpotensi dikenakan sanksi berupa pemutusan perjanjian dan penarikan objek leasing oleh kreditur sesuai dengan ketentuan hukum yang berlaku. Oleh karena itu, pemahaman yang komprehensif mengenai tanggung jawab hukum debitur dalam perjanjian leasing menjadi penting guna memberikan kepastian dan perlindungan hukum bagi para pihak.

Abstract

An agreement is a legal relationship between two or more parties who agree to carry out an action. An agreement begins with a statement of commitment from the parties. One of the principles that must be respected when drafting an agreement is freedom of contract, which means giving the parties the opportunity to reach an agreement. However, freedom of contract raises legal challenges, especially because it protects the interests of the parties. Therefore, legal review of freedom of contract in venture capital investment agreements has an important role in ensuring that freedom of contract and adequate legal protection are balanced to avoid disputes that may arise.The type of research used is normative, employing qualitative analysis techniques, which are then described and analyzed using descriptive methods. The approach used in this study is a statutory approach, namely by understanding and reviewing regulations related to this research.The results of the research and discussion in this study are that the principle of freedom of contract in venture capital investment agreements is implemented through the freedom of the parties in determining the form of the agreement content, capital participation, profit sharing and the mechanism for terminating the agreement. Legal protection for the parties is also realized through the principle of good faith and the principle of balance from the formation stage of the agreement to its termination. Freedom of contract in venture capital investment agreements is also limited by applicable legal provisions including, among others, the requirements for the validity of the agreement as regulated by the Civil Code and special regulations in the field of venture capital.
