Abstract

Program kemandirian masyarakat Program Studi Ilmu Hukum Fakultas Hukum Universitas Komputer Indonesia dilaksanakan melalui kegiatan edukasi dan advokasi di Desa Cilame dengan tema edukasi dan advokasi mitigasi penanggulangan kejahatan terhadap kemanusiaan di Desa Cilame yang mana tujuannya adalah sebagai upaya pencegahan terjadinya kejahatan terhadap kemanusiaan yang berkembang di masyarakat seperti kasus bullying, perundungan dan lain sebagainya yang dipandang juga sebagai kejahatan terhadap kemanusiaan. Metode yang digunakan adalah dengan memaparkan materi dengan metode ceramah kemudian dilakukan diskusi melalui tanya jawab. Dalam kegiatan PKM ini dilibatkan mahasiswa agar memperoleh pengalaman di luar kampus dan juga dosen yang berkegiatan di luar kampus yang hasilnya dapat dimanfaatkan oleh masyarakat. Edukasi yang disampaikan merupakan upaya preventif dengan memberikan pengetahuan dan pemahaman hukum serta pendirian Lembaga Konsultasi dan Bantuan Hukum (LKBH) sebagai infrastruktur yang berada di desa yang dipandang mudah diakses oleh masyarakat, mengingat bahwa desa merupakan barisan terdepan yang berhadapan langsung dengan masyarakat. Melalui kegiatan ini dimana Fakultas Hukum UNIKOM telah melaksanakan kegiatan PKM di Desa Cilame sebanyak 3 kali dengan tema yang berbeda, harapannya Desa Cilame merupakan pilot projek desa yang memiliki kesadaran hukum yang tinggi yang dapat menjadi role model bagi desa lainnya. Adapun hasil dari kegiatan pengabdian kepada masyarakat ini adalah masyarakat Desa Cilame mengetahui dan memahami kedudukannya sebagai subjek hukum dan memahami upaya pencegahan kejahatan tidak luput dari peran serta aktif dari masyarakat yang oleh karenanya peningkatan pemahaman hukum merupakan suatu keniscayaan bagi masyarakat Desa Cilame. Kata kunci: Edukasi, mitigasi, kejahatan, kemanusiaan, Desa Cilame. ABSTRACT The community self-reliance program, the Law Study Program, Faculty of Law, Indonesian Computer University, is carried out through educational and advocacy activities in Cilame Village with the theme of education and advocacy for mitigating crimes against humanity in Cilame Village, where the aim is to prevent crimes against humanity from developing in society, such as cases of bullying, harassment and so on which are also seen as crimes against humanity. In this PKM activity students are involved in order to gain experience outside the campus and also lecturers who have activities outside the campus whose results can be utilized by the community. The education delivered is a preventive effort by providing legal knowledge and understanding as well as the establishment of a Consultation and Legal Aid Institute (LKBH) as an infrastructure whose existence in the village is seen to be easily accessible by the community, bearing in mind that the village is the front line dealing directly with the community. Through this activity where UNIKOM's law faculty has carried out PKM activities in Cilame Village 3 times with different themes, it is hoped that Cilame Village will become a Village pilot project that has high legal awareness that can be a role model for other villages. The results of this community service activity are that the people of Cilame Village know and understand their position as legal subjects and understand that crime prevention efforts do not escape the active participation of the community, which is why increasing understanding of the law is a necessity for the people of Cilame Village. Abstract

This study aims to find the impact of the implementation of the Independent Campus, Freedom to Learn programme on academic policies in higher education, especifically the Faculty of Law, Indonesian Computer University so that this programme can be implemented more optimally in the future. The study conducted by the author is descriptive analytical with a normative juridical approach. The resulting data is analyzed in a qualitative juridical manner so that the hierarchy of laws and regulations can be considered and can guarantee legal certainty. Based on the results of the study, it can be seen that the Independent Campus, Freedom to Learn programme organized by the Unikom Faculty of Law has met the expectations of both the institution and its partners, although there are still shortcomings in its implementation practice, including internal policy alignment. The increasing competence of students participating in the Independent Campus, Freedom to Learn programme is a factor that needs to be followed up by the program, as well as the need to expand collaboration with various parties/partners to provide wider opportunities for students. The Independent Campus, Freedom to Learn programme at the Faculty of Law, Unikom, still has obstacles, namely related to the addition of new partners, curriculum adjustments and adjustments to the Academic Information System that accommodates the Independent Campus, Freedom to Learn programme. This research is a media for searching for problems, analyzes and solutions needed in the implementation of the Independent Campus, Freedom to Learn programme at the UNIKOM Faculty of Law, so that appropriate solutions can be found for these problems, especially related to internal policies within the UNIKOM Faculty of Law relating to with the implementation of the Independent Campus, Freedom to Learn programme.

Abstract

Perkembangan teknologi informasi tidak saja memberikan manfaat tetapi juga tidak luput dari dampak negatif yang menyertainya. Dalam terjadinya tindak pidana teknologi tidak memilah siapa korbannya, tidak hanya masyarakat pada umumnya tetapi dapat juga terjadi kepada aparatur pemerintahan. Dimana pada akhirnya korban mengalami kerugian. Hal tersebut terjadi dengan berbagai macam modus, berangkat dari permasalahan tersebut, maka tujuan pengabdian ini adalah untuk memberikan pemahaman terkait jenis-jenis tindak pidana teknologi informasi (cyber crime) serta bagaimana kebijakan penegakan hukum dalam upaya penanggulangan tindak pidana cyber crime. Metode yang digunakan dalam pengabdian masyarakat ini adalah memberdayakan masyarakat melalui peningkatan pengetahuan melalui edukasi. Hasil dari kegiatan adalah meningkatnya pengetahuan dan sikap hati-hati bagi masyarakat Desa Cilame Kabupaten Bandung Barat. Berdasarkan hal tersebut maka penulis berpandangan bahwa perlunya suatu lembaga bantuan hukum yang ditempatkan di setiap Kantor Kepala Desa dalam membantu menyelesaikan masalah hukum terjadinya tindak pidana teknologi informasi (cyber crime) di Desa Cilame Kabupaten Bandung Barat

Abstract

Perkawinan ialah ikatan lahir bathin anatara seorang pria dengan seorang wanita sebagai suami isteri dengan tujuan membentuk keluarga (rumah tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. meskipun kasus KDRT tidak pernah terjadi baik melalui laporan maupun pengaduan, namun upaya sosialisasi sebagai upaya pencegahan dan peningkatan pemahaman masyarakat terhadap hukum penting dilakukan. Mengingat bahwa kejahatan merupakan gejala social, factor-faktor penyebab serta termasuk dalam delik aduan, maka kegiatan pengabdian kepada masyarakat ini dilaksanakan dalam rangka meningkatkan pengetahuan dan sikap antisifatif bagi masyarakat Desa Cilame Kabupaten Bandung Barat. Pengabdian kepada masyarakat dilakukan melalui penyuluhan hukum serta konsultasi hukum secara offline. Dimana pertanyaan umumnya yang ditanyakan terkait tuang lingkup rumah tangga, upaya pencegahan yang harus dilakukan serta langkah-langkah apabila mengetahui terjadinya KDRT. Setelah mendapatkan penyuluhan hukum kepada masyarakat Desa Cilame Kecamatan Ngamprah Kabupaten Bandung Barat, terjadi peningkatan pengetahuan tentang Undang-Undang Penghapusan Kekerasan Dalam Rumah Tangga.

Abstract

This research investigates the dynamics of adaptive learning programs in fostering continuous skill development among employees within the organizational context of PT Usaha Jaya. Through a quantitative research design and Structural Equation Modeling with Partial Least Squares (PLS) analysis, the study examines the direct and indirect effects of adaptive learning programs and workplace environment on employee engagement and subsequent skill development. The findings reveal significant direct effects of adaptive learning programs on both employee engagement and continuous skill development, underscoring the efficacy of personalized learning initiatives in enhancing employee commitment and skill acquisition. Moreover, the indirect effect analysis demonstrates a significant pathway from adaptive learning programs to continuous skill development through employee engagement, emphasizing the mediating role of employee engagement. However, the influence of workplace environment on continuous skill development through employee engagement was found to be nonsignificant, suggesting that other factors may play a more prominent role in shaping the relationship between employee engagement and skill development. These results provide valuable insights for organizations seeking to optimize workforce development strategies and drive organizational success in dynamic business environments.

Abstract

This article examines the role of the Deputy Attorney General for Military Criminal Affairs (JAMPIDMIl) in handling cases of connexity in corruption offences (tipikor) in Indonesia. With the increase in tipikor cases involving military members and civilians, Jampidmil faces the challenge of coordinating prosecutions between two jurisdictions. This article analyses Jampidmil's organisational structure, relevant legislation, and legal implications through a normative juridical approach. The research found that collaboration between Jampidmil and other law enforcement agencies is essential to improve the effectiveness of handling such cases. In addition, it is recommended that Jampidmil strengthen training for its members and conduct socialisation on the regulations governing connectivity, to ensure a transparent and accountable legal process.

Abstract

The use of criminal law in crime prevention efforts tends to only function as a treatment step for symptoms that appear, not as a tool that is able to eliminate the root causes of crime itself. Criminal law focuses on imposing sanctions on perpetrators as a form of retribution and special prevention, but often does not touch on the underlying factors that drive a person to commit a crime, such as economic conditions, social environment, and education. One of the most frequent forms of crime in society is theft, which reflects the existence of structural problems that have not been fully resolved This research uses a descriptive method of analysis. Where the analysis is carried out in accordance with the provisions of the rule of law with a conceptual approach, which refers to the provisions of the law and other legal disciplines. The type of approach in this research is carried out through normative juridical means. By doing legal interpretation associated with legislation, it also examines and tests secondary data, namely primary legal material in the form of the Criminal Code Article 362 concerning Theft, secondary legal material in the form of doctrine or expert opinion, and tertiary legal material in the form of papers, articles and others, The conclusion of this research is that theft is a criminal offense in the Criminal Code which is classified based on the method, place and conditions of its implementation. Article 362 of the Criminal Code defines theft as the act of taking property belonging to another person unlawfully for possession. In addition, there are other types of theft, such as theft with aggravation (Article 363), theft with violence (Article 365), petty theft (Article 364), and theft in the family (Article 367), each with different sanctions. Abstract

Perubahan konsep Dominus Litis dalam Rancangan Kitab Undang-Undang Hukum Acara Pidana (RKUHAP) membawa implikasi besar terhadap sistem peradilan pidana di Indonesia, khususnya dalam hubungan antara penyidik dan penuntut umum. Dalam KUHAP yang berlaku saat ini, penyidik memiliki kewenangan independen dalam proses penyidikan, termasuk dalam menentukan arah penyidikan, mengumpulkan alat bukti, dan menghentikan penyidikan berdasarkan Pasal 109 KUHAP. Sementara itu, RKUHAP memperkuat peran jaksa sebagai pengendali proses penyidikan, sehingga terjadi pergeseran kewenangan yang berpotensi mengubah dinamika koordinasi antara penyidik dan penuntut umum. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan konseptual, serta mengandalkan data sekunder yang terdiri dari bahan hukum primer, sekunder, dan tersier. Teknik analisis dilakukan secara deskriptif-analitis untuk mengkaji perubahan regulasi serta implikasi penerapan konsep Dominus Litis dalam sistem peradilan pidana terpadu. Hasil penelitian menunjukkan bahwa meskipun pergeseran kewenangan ini bertujuan untuk meningkatkan efektivitas penegakan hukum, terdapat potensi ketimpangan dalam relasi kewenangan antara penyidik dan penuntut umum. Untuk memperdalam kajian ini, dilakukan diskusi publik dengan melibatkan mahasiswa dan masyarakat guna meningkatkan pemahaman kritis terhadap reformasi hukum acara pidana. Kesimpulannya, perubahan ini perlu diimbangi dengan mekanisme pengawasan yang jelas agar tetap menjamin prinsip keadilan. Rekomendasi yang diajukan adalah penguatan regulasi yang memastikan keseimbangan kewenangan serta peningkatan kapasitas akademik mahasiswa dalam memahami dinamika peradilan pidana di Indonesia.

Abstract

A notary is a public official authorised to draw up authentic deeds and process legal documents, such as letters of agreement, deeds of sale, and other important documents with legal force. Although signed by the parties, the documents drawn up by a notary are not treated as authentic documents and have only the force of private writing (Article 1869 of the Civil Code). The definition of an authentic deed is contained in Article 1868 of the Civil Code, which states that an authentic deed is a deed drawn up in a form prescribed by law, by or in the presence of public officials authorised to do so, in the place where the deed is drawn up. The Notaries Act requires notaries to read documents in the presence of the parties. Article 16(7) UUJN regulates the obligation of notaries to read documents in front of the parties. A deed not read in front of the parties may become private, lose its evidential force, and be considered null and void.

Abstract

This study aims to determine the enforcement of the Information Act and Electronic Transactions in tackling the black campaign with normative juridical research methods that start from the norms, principles and legislation that exist as positive legal norms. This study concludes that the implementation of the Information and Electronic Transaction Law in the case of black campaigns between the rights is in accordance with the Articles contained in the Electronic Information and Transaction Law (ITE) including Article 27 paragraph (3) in conjunction with Article 45 paragraph (3) of the Act Information and Electronic Transactions and Article 28 paragraph (2) juncto Article 45A paragraph (2) of the Electronic Information and Transaction Law. That according to this research the black campaign is interpreted as an attempt to fill certain positions, especially public positions in unhealthy ways, such as spreading hoaxes, sheep fighting, insults and slander. Black campaigns clearly violate the law and ethics in campaigning, besides the use of black campaigns in social media is felt to be very effective in bringing down political opponents so that in the elections the use of black campaigns violates the principle of fair play / justice.
