Abstract

The Indonesian political system is officially based on Pancasila as the state ideology, while some community groups advocate an Islamic political system as an alternative. This study aims to: analyze the conceptual and implementation differences between the Pancasila and Islamic political systems in Indonesia; evaluate the impact of these differences on national and state life; and examine the relevance of both systems in the context of Indonesia's diverse society. The research method uses a qualitative approach through literature review of primary (the 1945 Constitution, MUI fatwas, sharia regulations) and secondary (30 journals published between 2010 and 2023) documents, as well as policy analysis of five cases of Islamic political implementation at the local level. The results reveal three main findings: First, the Pancasila political system is inclusive-pluralistic with a positivist legal source and a deliberative democratic structure, while the Islamic political system is based on sharia with the concept of hakimiyyah (God's sovereignty) and the caliphate model. Second, implementation in the field shows that Pancasila is more effective in maintaining social cohesion (a tolerance index of 72.3% according to SETARA 2022), while the application of Islamic politics tends to lead to polarization (conflicts increased by 40% in regions with sharia regulations). Third, despite fundamental differences, the synthesis of Islamic values within the Pancasila framework has proven to be able to create balance, as seen in the national education system that accommodates madrasahs. This study concludes that Pancasila remains the primary foundation of Indonesia's political system due to its ability to integrate diversity, but strengthening dialogue between Islamic and national values is needed to minimize ideological tensions.

Abstract

Police detainees are individuals suspected of committing criminal acts who are held in police detention centers. During their detention period, suspects are placed in the Bengkulu Regional Police Detention Center (Rutan Polda Bengkulu), under the responsibility of investigators and detention officers to ensure proper legal procedures. This study aims to analyze whether the management and care of narcotics offenders in the Bengkulu Police Detention Center are in accordance with existing legal provisions, and to identify the factors that hinder such management and care. The research used four techniques: (1) Population and Sample Determination, which included all police officers of the Directorate of Detention and Evidence (Dit Tahti) at the Bengkulu Regional Police and all narcotics detainees; (2) Data Collection using primary and secondary data; (3) Data Processing through coding and editing; and (4) Data Analysis using a qualitative descriptive method with a normative-empirical approach. The findings show: (1) Management and care of narcotics detainees at the Bengkulu Police Detention Center are in accordance with applicable laws and regulations, including: Perkap No. 4 of 2005, Perkap No. 4 of 2015, Law No. 12 of 1995, Law No. 39 of 1999, Law No. 35 of 2009, Law No. 5 of 1997, Law No. 2 of 2002, and Presidential Regulation No. 58 of 1999. (2) Factors hindering effective detainee management and care include: the classification of narcotics detainees as special detainees, ineffective service procedures, overcrowded cells, lack of officer knowledge on detainee care, limited medical personnel, short detention periods, and minimal involvement from related government agencies.

Abstract

Legal maxims possess a unique place in jurisprudence, and jurists of all schools recognize it as a basis for forming sharia opinions, particularly if they are based on the holy Quran and prophetic traditions. Ibn Nujaym al-Hanafi was a prominent jurist from the Hanafi school who paid special attention to legal maxims (qawâ`id  al-fiqhiyyah) and compiled them in his books al-Ashbah wa al-Nazhâ’ir and al-Fawâ’id al-Zainiyyah, etc. He also wrote commentaries on various subjects in his other books. He became one of the most distinguished jurists in this discipline and the Hanafi school. The purpose of this article was to examine the accuracy of Ibn Nujaym's perspectives on the Islamic legal maxim, the explanation of the most significant five maxims, and how they can be applied to some juridical issues. This study employed a qualitative method and a content analysis approach. The data was obtained through a search of books, journals, and other sources of information. The collected data were analyzed qualitatively and deliberated. The findings of study show that Ibn Nujaym al-Hanafi's masterpiece al-Ashbah wa al-Nazhâ’ir became the leading work on legal maxims and was acknowledged as authoritative by Hanafi jurists. Qawâ`id al-fiqhiyyah memiliki kedudukan yang istimewa dalam eksistensi hukum Islam, dan para ulama dari berbagai mazhab fikih pun mengakui keistimewaan tersebut, sebab ia dapat digunakan untuk menghasilkan fatwa (pandangan hukum syariah), terutama jika ia dibentuk berdasarkan Alquran dan Hadis. Ibn Nujaym al-Hanafi adalah seorang ahli hukum terkemuka dari kalangan mazhab Hanafi yang telah mencurahkan perhatian dan pemikirannya terhadap eksistensi qawâ`id  al-fiqhiyyah. Pemikiran beliau tentang tema ini tertuang dalam buku beliau yang berjudul al-Ashbah wa al-Nazhâ’ir, al-Fawa’id al-Zainiyyah, dan lain-lain. Bahkan, buku al-Ashbah wa al-Nazhâ’ir, menjadi salah satu rujukan terkemuka dalam kajian tema qawâ`id al-fiqhiyyah, mewakili pandangan ulama mazhab Hanafi. Tujuan artikel ini adalah untuk mengkaji pemikiran Ibnu Nujaym tentang qawâ`id al-fiqhiyyah, dan penjelasan tentang lima macam qawa’id al-fiqhiyyah yang utama, serta bagaimana qawâ`id al-fiqhiyyah dapat digunakan untuk menjawab beberapa permasalahan fikih. Penelitian ini menggunakan metode kualitatif dengan pendekatan analisis konten. Data diperoleh melalui pencarian buku, jurnal, dan sumber informasi lainnya. Data yang terkumpul dianalisis secara kualitatif dan ditampilkan secara menyeluruh. Penelitian ini mendapatkan bahwa karya agung Ibnu Nujaym, yaitu al-Ashbah wa al-Nazhâ’ir, menjadi karya terkemuka yang membahas tentang qawâ`id al-fiqhiyyah dan telah diakui sebagai pandangan ilmiah yang terpercaya dalam mazhab Hanafi. Dan qawâ`id al-fiqhiyyah dapat digunakan untuk menjawab beberapa permasalahan fikih (qadhiyah fiqih).

Abstract

The article addresses the various challenges that waqf (Islamic endowment) law faces in Indonesia. It specifically investigates how the application of Qawā'id Fiqhiyyah (principles of Islamic jurisprudence) can enhance waqf law considering obstacles such as public ignorance about waqf, inadequate legal frameworks, and the necessity for effective management strategies to improve the productivity of waqf assets. The aim of this research is to analyze how Qawā'id Fiqhiyyah can provide foundational support to enhance Waqf law, proposing viable solutions to existing issues. The novelty of this research lies in its integrative approach, which combines traditional Islamic legal principles with the contemporary challenges of waqf management. By focusing on Qawā'id Fiqhiyyah, the study proposes a framework that not only addresses legal and administrative issues but also highlights the cultural and social dimensions of waqf in Indonesia, an area that has not been extensively explored in existing literature. . The results of the research suggest that the application of Qawā'id Fiqhiyyah can provide practical solutions to the identified challenges in waqf law. The study outlines several strategies, including enhancing public education about waqf, improving legal frameworks, and fostering collaboration among various stakeholders such as government bodies, religious organizations, and the community. These strategies aim to create a more effective and sustainable waqf system in Indonesia, ultimately leading to increased productivity and a greater social impact of waqf assets

Abstract

Abuse of office leading to criminal acts of corruption is one of the greatest threats to governance and public welfare in Indonesia and other Muslim countries. From the perspective of Islamic constitutional law —which is a branch of fiqh siyasah (especially siyasah dusturiyah)—public office is understood not merely as administrative power, but as a mandate that must be carried out with the principles of justice (al-‘adl), responsibility (al-mas’uliyyah), and orientation towards the public interest (maslahah ‘ammah). Any form of abuse of power and authority in public office is seen as a betrayal of the trust given by Allah SWT and society. This article aims to analyse the relationship between abuse of office leading to corruption and violations of the principles of Islamic constitutional law, particularly within the framework of fiqh siyasah. This study uses a qualitative-normative approach with a literature review method of classical Islamic sources such as the works of Al-Mawardi and Ibn Taymiyyah, as well as contemporary literature discussing governance reform based on Islamic values. The data was analysed using a descriptive-analytical approach by comparing the concept of official responsibility in Islamic law and the provisions of positive Indonesian law, particularly Law No. 31 of 1999 and Law No. 20 of 2001 on the Eradication of Corruption. The results of the study show that abuse of office not only violates positive legal norms but also contradicts Islamic moral and spiritual principles that emphasise integrity, trustworthiness, and social justice. Fiqh siyasah offers a paradigm of governance oriented towards the welfare of the people with moral and institutional oversight through the concepts of hisbah and shura. Therefore, strengthening internal and external control mechanisms and internalising the values of fiqh siyasah into the national legal system are very important as efforts to prevent systemic corruption. Thus, the integration of Islamic constitutional law values and Indonesian positive law is expected to build clean, fair, and God-based governance.
