Abstract

The aim of this research is to discuss defaults in rental agreements for flats for low-income communities in the city of Gorontalo in light of law number 20 of 2011 concerning flats. By reviewing the issues regarding the form of implementation of the rental agreement and the legal consequences of non-performance in the agreement, this research can benefit from this. The method used in this research is an empirical legal research method. The results of this research suggest that it is necessary to provide legal education to flat tenants by implementing the contents of the rental agreement as well as the responsibility of the government as the manager of the flat, then carrying out good coordination between the relevant and authorized parties in resolving a case/case.

Abstract

This research explain how to implement civil cases settlement before and after the implementation from of E-Court system in electronic and conventional court. on this case it explains that civil cases settlement in a modern manner is described according to Supreme Court Regulation Number 7 of 2022 while conventionally described according to HIR / RBG. Before the advent of system E-Court, the testing method was conducted conventionally. The optimization of these two forms of civil case settlement is then examined according to Law Number 48 of 2009 concerning Judicial Power where the judiciary is administered out with the principles of simple, fast and low cost. This research is a normative legal research with Statute Approach and Conceptual Approach methods. The research concluded: first, the existence of court dualism is still needed for justice seekers who still need conventional lawyers. Second. The implementation of Civil Case Settlement with the presence of E-Court as an effort to realize the principles of simple, fast and low cost in reality has not been optimal, however, E-Court has not fully resolved the cases received by the Supreme Court and the lower courts. That is, most cases are still conducted conventionally.

Abstract

This research examines how local regulations regulate the functions of the Village Consultative Body (BPD) and whether these rules have been implemented properly. The research method used is empirical-sociological juridical with a statutory and conceptual approach. This research not only focuses on the applicable legal rules, but also looks at how the law is implemented and affects social life through field data collection. The results showed that BPD has a legislative function in discussing and agreeing on village regulations with the Sangadi (village head), accommodating and channeling community aspirations, and overseeing the performance of the Sangadi. The results showed that implementing the BPD function in Motabang Village was not optimal. The BPD tends to carry out its duties as a formality, especially in discussing village regulations and supervising the performance of the Sangadi. The inhibiting factors include the BPD members' low understanding of regulations, lack of community participation, and conflicts of personal interest. To improve the effectiveness of BPD performance, it is necessary to increase the capacity of members through training, increase community participation, and strengthen independence in carrying out supervisory functions.

Abstract

This research aims to analyze the impact of Covid-19 in triggering spousal conflict that leads to divorce. This research uses a normative-empirical legal research method (applied law research) which is basically a combination of normative legal approaches with the addition of various empirical elements. The results obtained from this research are that there are several impacts of Covid-19 which are factors in the occurrence of divorce between couples based on data from the Gorontalo City Statistics Agency, not a few divorce rates during the Covid-19 period, one of the biggest factors is economic factors that affect everyone in this world.

Abstract

The purpose of this research is the Cooperation Agreement between the Goods Delivery Service Company and the Courier in the Cash on Delivery System. This research uses empirical research method. The research location is Ninja Xpress Gorontalo City. The data obtained are primary and secondary data. Data collection techniques used by the author are observation, interviews and literature. The research results obtained Every agreement must be carried out in good faith, as found in Article 1338 Paragraph (3) of the Civil Code regarding the principle of good faith, which reads “Agreements must be carried out in good faith”. This article determines that agreements are made in good faith by those who make them. The most important thing in the implementation of an agreement is to determine when the agreement begins, considering that from that moment the rights and obligations of the parties to the agreement arise. In general, an agreement occurs after an agreement between the parties, since there is an agreement, then from that moment an obligation has arisen. In addition, the contents of the agreement between Ninja Xpress and couriers consist of the scope of the agreement, validity period & termination of the agreement, agreement of the parties, work compensation, dispute resolution, tiering system, COD scheme, awards or awards for the best rider/driver and sanctions for violation of procedures. The form of agreement between the courier and Ninja Express is a partnership agreement which can be in the form of a digital agreement or print out agreement.

Abstract

Gender transition (transgender) is a current phenomena on a worldwide and national scale. The subject of transgender in Indonesia has numerous issues, one of which is the status of transgender in Indonesian law, particularly inheritance law, which is found in both the Civil Code and the Compilation of Islamic Law. The issue is that there is a legal vacuum surrounding transgender arrangements in inheritance distribution. According to the study's findings, the legal situation of transgender persons has not been explicitly defined, and there is a legal vacuum, resulting in an ambiguous distribution of inheritance for transgender people. In Islamic law, transgender inheritance is reverted to its original gender and does not take bodily changes into account. Meanwhile, under the Civil Code, inheritance is distributed based on the method of gaining inheritance.

Abstract

Penelitian ini bertujuan untuk menganalisis perlindungan hukum atas hak kepemilikan tanah di Indonesia, dengan fokus pada pengadaan tanah untuk pembangunan Waduk Bulango Ulu di Kabupaten Bone Bolango. Metode yang digunakan adalah pendekatan kualitatif dengan analisis deskriptif, yang melibatkan pengumpulan data melalui studi dokumen dan wawancara dengan pemangku kepentingan terkait, termasuk masyarakat, pemerintah, dan ahli hukum. Hasil penelitian menunjukkan bahwa meskipun Undang-Undang Pokok Agraria (UUPA) memberikan kerangka hukum untuk perlindungan hak atas tanah, implementasinya sering kali tidak transparan dan menimbulkan konflik antara pemilik tanah dan pemerintah. Isu-isu seperti penilaian ganti rugi yang tidak adil dan kurangnya partisipasi masyarakat dalam proses pengambilan keputusan menjadi sorotan utama. Penelitian ini merekomendasikan perlunya kebijakan yang lebih adil dan transparan dalam pengadaan tanah, serta peningkatan partisipasi masyarakat untuk memastikan keadilan sosial dan perlindungan hak-hak pemilik tanah

Abstract

Penelitian ini bertujuan untuk menganalisis kedudukan dan hak waris anak di luar nikah menurut hukum adat Tionghoa serta relevansinya dengan perkembangan hukum nasional di Indonesia. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan kualitatif, didukung data sekunder berupa peraturan perundang-undangan, putusan pengadilan, dan literatur hukum terkait. Hasil penelitian menunjukkan bahwa dalam hukum adat Tionghoa, anak di luar nikah umumnya tidak diakui sebagai ahli waris kecuali terdapat pengakuan resmi dari ayah biologis, sehingga hak warisnya sangat terbatas. Sementara itu, KUHPerdata dan Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 memberikan peluang lebih luas bagi anak luar kawin untuk memperoleh hak waris dari ayah biologis, asalkan diakui secara hukum atau dapat dibuktikan secara ilmiah. Namun, implementasi di masyarakat masih menghadapi hambatan berupa kuatnya tradisi dan minimnya pemahaman hukum. Penelitian ini merekomendasikan perlunya edukasi hukum dan peran aktif negara serta tokoh masyarakat untuk memastikan perlindungan hak waris anak di luar nikah secara adil dan tanpa diskriminasi.

Abstract

This study aims to determine the factors that lead to criminal offenses committed by children in the city of Gorontalo and how the response to the occurrence of criminal offenses committed by children in the city of Gorontalo. Data were collected through interviews, questionnaires. Analysis of the data used is data analysis that seeks to provide a clear and concrete description of the object that are discussed qualitatively and then the data is presented in descriptive technique that uses a frequency distribution test with the formula P = F / N x 100%. The results showed that the root causes of criminal offenses committed by children in the city of Gorontalo is the environmental factor family and social environment, socio-economic condition factor, factor the low level of education, liquor as psychological factors, and factors that are less religious knowledge. Efforts to control criminal offenses committed by children in the city of Gorontalo there are three forms: preventive countermeasures (prevention), attempts repressive and rehabilitation efforts

Abstract

This study aims to determine the extent of legal protection by the Women and Children Service Unit (PPA) of the Gorontalo City Resort Police Criminal Investigation Unit against women as victims of domestic violence and to find out what factors are obstacles to the efforts of the PPA Unit of the Criminal Investigation Unit Gorontalo Resort Police in tackling violence against women victims of Domestic Violence. Data collected through interviews and library research. Analysis of the data used is the data obtained will be analysed descriptively qualitatively describing the data obtained from field research (primary data), tested the truth then linked and analysed qualitatively with data obtained from library research (secondary). The results showed a form of legal protection by the PPA Unit of the Gorontalo Police Resort Criminal Investigation Unit against women as victims of domestic violence, namely preventive efforts by holding legal counselling in collaboration with the local government and further optimizing the performance of the Gorontalo City Resort Police Especially the PPA unit, repressive efforts that are in accordance with the rules of the Domestic Violence Protection Act. What factors hinder the efforts of the PPA Unit of the Gorontalo District Police Resort Criminal Investigation Unit in tackling violence against women victims of Domestic Violence, among others: Legal factors themselves, Law Enforcement Officers Factors, Factors or Facilities That Support Law Enforcement, Factors Society and Culture.
