Abstract

Marital Rape is a form of sexual violence against a wife or husband that occurs in a marital relationship. In general, sexual violence has been regulated in the construction of Indonesian criminal law, specifically (lex specialist) as outlined in Law Number 8 of 2004 concerning the Elimination of Domestic Violence (UU-PKDRT). However, it is necessary to develop subject qualifications in these regulations to emphasize the elements of marital rape so that the evidence obtained is more objective. This research aims to analyze the validity and proof of marital rape as a criminal offense of domestic violence. As normative research, this research uses a legal approach (statute approach) and a conceptual approach (on conceptual approach), using primary and secondary types of legal materials, and techniques for collecting legal materials using literature study using qualtatꬵ with analysis descriptive, based on the method A conclusion was found that, marital rape (rape within marriage) can be used as a type of criminal act of domestic violence if the evidence presented has been acknowledged, but the lack of evidence makes the proof process less objective.

Abstract

The development of technology and communication, more and more companies in Indonesia are starting to adopt remote working. There is no clear regulation of remote working in the Manpower Law Number 13 of 2003 or the Job Creation Law Number 11 of 2020. This research will discuss the regulation and legal protection for remote workers or remote working related to working hours, as well as welfare facilities based on labor law in Indonesia. Researchers use normative legal research as well as a statue approach and conceptual approach. The application of remote working systems can currently be based on the rules of labor law in Indonesia regarding working time, which has been determined in Government Regulation No. 35 of 2021 and Government Regulation No. 36 of 2021. However, The Employment Law has yet to further regulate the implementation and existence of remote working, which has not been fully defined under Indonesian Employment Law.

Abstract

The development of the digital economy has created both opportunities and challenges in protecting children's rights, particularly when children become the main subjects of monetized digital content. This phenomenon has grown rapidly in countries such as Indonesia and France, although their normative responses differ significantly. This study aims to analyze and compare the legal frameworks in Indonesia and France regarding the involvement of child labor in monetized digital content. Using a normative and comparative legal approach, and drawing on functionalism, legal transplant, and legal convergence theories, this research finds that Indonesia still faces normative ambiguity in this area, while France has developed a more specific regulatory framework through Loi n° 2020-1266 and Loi n° 2023-566. The study recommends the formulation of specific regulation in Indonesia that addresses the challenges of the digital economy in relation to child protection, by referring to international best practices. These findings are expected to contribute to national legal reform in the context of labor law and child rights in the digital space.

Abstract

There are provinces in Indonesia considered “archipelagic” and “non-archipelagic.” One criterion is to determine whether a province has an ocean wider than the land, with the so-called matter of geography. The issue raised here is a condition where an archipelagic custom exists in a non-archipelagic province. Such a gap between geographical concern and customary characteristics brings at least two consequences. First, a non-archipelagic province has been set out in the international customary law of the sea, including the 1982 UNCLOS on Traditional Fisheries Rights and the law on the Management of Coastal Islands and Small Islands. Second is the problem of recognizing a unique coastal-oceanic socio-culture in that province. This study was motivated to bridge the two, i.e., the legal and socio-cultural case of the Bajo Tribe in Gorontalo Province. Bajo is a tribe with an archipelagic socio-cultural tradition, while Gorontalo is categorized as a non-archipelagic province. So far, there is no clear legal framework on how the national and international laws captured the existing tradition, custom, and wisdom, as shown in Bajo’s. In this regard, a normative legal method was used by collecting and analyzing how national and international instruments answered the call from the Bajo Community. This study found that, at the core, the main issue was the gap of recognition between geography and socio-cultural perspectives in policy-making. This study also found that the Bajo has experienced a limbo due to the no clear policy on how the existence of their community is accommodated. Finally, this research suggested that an archipelagic tradition such as Bajo’s should be recognized in the non-archipelagic province’s policy to construct a bridge connecting geography and socio-cultural tradition.

Abstract

This study is expected to have significant implications for policymakers and stakeholders in Indonesia and other developing countries seeking to reform their labor laws. The study can validate the development of new policies and programs to protect the rights of the workers, promote decent work, and provide greater access to social protection. The discussion on comparing labor regulations before and after implementing the Job Creation Law (The Law Number 6 Year 2023) in Indonesia covers several key aspects, including wage arrangements, outsourcing, social protection, and fixed-term employment agreements (PKWT). The Job Creation Law reflects the trend to provide more flexibility to employers, allowing them to customize working conditions according to business needs. While a push exists to improve the investment climate and create jobs, these changes raise serious questions about workers’ rights and welfare, particularly concerning about social protection and job security. This comparison indicates significant changes in Indonesia’s labor regulations, providing a clearer picture of workers’ challenges and opportunities. Labor law reform in Indonesia has impacted workers’ perception and responses. While some perceive it as a positive step that strengthens legal protection against unfair termination of employment, many workers still experience inequalities in access to health insurance, pensions, and workplace accident insurance. The government and stakeholders should work to improve workers’ access to social security and strengthen law enforcement and oversight to minimize potential implementation failures that could harm the rights of the workers.

Abstract

This study analyzes the implementation of good governance principles in managing the Regional Revenue and Expenditure Budget (APBD) of Sumenep Regency in 2023. The research is based on Sumenep’s condition as an archipelagic region with fiscal limitations and geographical challenges that affect financial management effectiveness. The study underscores the need to balance fiscal decentralization with the principles of transparency, accountability, public participation, effectiveness, efficiency, and the rule of law. Using an empirical approach and a descriptive-analytical design, it combines interview data from the Regional House of Representatives (DPRD) and community figures with analyses of the Budget Realization Report, audit results from the Audit Board of Indonesia (BPK), and relevant regulations. Results show that transparency improved through the PPID portal but remains limited by publication timeliness and data format; accountability is still administrative due to dominant routine spending (83.9%) over capital expenditure (16.1%); public participation is mainly formal through Musrenbang; fiscal effectiveness is low because of high logistics costs and stagnant HDI (68.61); while the rule of law emphasizes procedural compliance without strong enforcement and anti-corruption control. The study’s novelty lies in its comprehensive empirical mapping of the five good governance principles in archipelagic regional financial management.   Penelitian ini bertujuan menganalisis penerapan prinsip good governance dalam pengelolaan APBD Kabupaten Sumenep Tahun 2023. Latar belakang penelitian ini berangkat dari kondisi Kabupaten Sumenep sebagai wilayah kepulauan dengan keterbatasan fiskal dan tantangan geografis yang berdampak pada efektivitas tata kelola keuangan daerah. Urgensi penelitian terletak pada perlunya memastikan desentralisasi fiskal berjalan seimbang dengan prinsip transparansi, akuntabilitas, partisipasi publik, efektivitas dan efisiensi, sertasupremasi hukum. Menggunakan pendekatan empiris dan rancangan deskriptif-analitis, penelitian ini mengombinasikan data wawancara dengan DPRD dan tokoh masyarakat serta analisis terhadap Laporan Realisasi APBD, hasil audit BPK, dan regulasi terkait. Hasil menunjukkan bahwa transparansi meningkat melalui portal PPID, namun masih terkendala ketepatan publikasi dan format data; akuntabilitas belum substantif karena dominasi belanja rutin 83,9 persen dibanding belanja modal 16,1 persen; partisipasi publik bersifat formal melalui Musrenbang; efektivitas fiskal rendah karena biaya logistik tinggi dan IPM stagnan 68,61; sedangkan supremasi hukum masih menekankan kepatuhan prosedural tanpa penguatan penegakan dan kontrol antikorupsi. Kebaruan penelitian ini terletak pada pemetaan empiris komprehensif terhadap lima prinsip good governance dalam konteks keuangan daerah kepulauan.

Abstract

The diplomatic conflict between Saudi Arabia and Canada in 2018 drew significant attention in international law, as it emerged from Canada’s public criticism delivered through social media of the arrest of human rights activists in Saudi Arabia, which the Saudi government perceived as interference in its domestic affairs. This study aims to analyze the dynamics of bilateral relations between Saudi Arabia and Canada with regard to the application of the principle of non-intervention and the protection of human rights within the framework of international law. This research employs an empirical juridical approach, using data collection techniques including interviews, observation, and literature study on international legal instruments and contemporary sources such as official government statements, social media posts, and international news coverage from 2018 to 2023. An interview was conducted with a Saudi national as a social witness to public responses surrounding the rhetorical escalation between the two states. The findings indicate that Canada’s public call for the release of human rights activists does not, in itself, constitute prohibited intervention under international law, although the use of imperative language created a perception of coercion from the Saudi perspective. The tension between state sovereignty and the universality of human rights is shown to be contextual and shaped by broader geopolitical dynamics. The restoration of diplomatic relations in 2023 demonstrates that peaceful settlement, bilateral dialogue, and multilateral diplomacy remain the most effective mechanisms for navigating normative conflicts between non-intervention and human rights protection Abstrak Konflik diplomatik antara Arab Saudi dan Kanada pada tahun 2018 menjadi perhatian dalam hukum internasional karena memunculkan ketegangan yang bermula dari kritik terbuka Pemerintah Kanada terhadap penahanan aktivis HAM di Arab Saudi melalui media sosial, yang kemudian dianggap sebagai bentuk intervensi dalam urusan domestik oleh Pemerintah Saudi. Penelitian ini bertujuan untuk menganalisis dinamika hubungan bilateral antara Arab Saudi dan Kanada terhadap pelaksanaan prinsip non-intervensi dan perlindungan hak asasi manusia dalam konteks hukum internasional. Penelitian ini menggunakan pendekatan yuridis empiris, dengan teknik pengumpulan data berupa wawancara, observasi, serta studi kepustakaan terhadap instrumen hukum internasional dan sumber-sumber aktual seperti pernyataan resmi pemerintah, unggahan media sosial, serta pemberitaan internasional terkait periode 2018–2023. Wawancara dilakukan dengan seorang warga negara Arab Saudi sebagai saksi sosial atas respons publik terhadap eskalasi retorika kedua negara. Hasil penelitian menunjukkan bahwa seruan publik Kanada mengenai pembebasan aktivis HAM tidak serta-merta memenuhi unsur intervensi yang dilarang dalam hukum internasional, meskipun diksi yang bersifat imperatif menimbulkan persepsi koersif bagi Arab Saudi. Ketegangan kedua prinsip kedaulatan dan universalitas HAM, menunjukkan bahwa batas keduanya bersifat kontekstual dan dipengaruhi dinamika politik global. Pemulihan hubungan diplomatik pada tahun 2023 membuktikan bahwa penyelesaian secara damai, dialog bilateral, dan diplomasi multilateral tetap menjadi mekanisme paling efektif dalam menavigasi konflik normatif antara non-intervensi dan penegakan HAM.

Abstract

Background (General): Governance at the village level plays a vital role in realizing democratic principles and sustainable local development, particularly within the framework of decentralization in Indonesia. Background (Specific): Desa Rogojampi in Banyuwangi faces challenges in implementing village regulations (Perdes) due to limited institutional capacity, low community participation, and suboptimal oversight mechanisms. Knowledge Gap: Although the legal framework strongly supports village autonomy, empirical evidence on how regulatory formulation aligns with good governance principles at the village level remains insufficient. Aims: This study aims to analyze perceptions of villagers, local officials, and the Village Consultative Body (BPD) regarding the formulation of Perdes as an instrument to strengthen good governance. Results: A survey of 40 respondents revealed adequate public understanding of Perdes (72%), but participation in drafting remains low (58%). Village officials’ regulatory capacity is modest (60%), while BPD oversight is weak (55%). Conversely, expectations for improvement are high (85%), particularly for broader public involvement and academic support. Novelty: The study integrates community-based legal education with governance principles to highlight the intersection of law, participation, and accountability in village administration. Implications: Strengthening technical capacity, expanding inclusive participation, and enhancing oversight mechanisms are crucial strategies for optimizing village regulation to achieve transparent, accountable, and responsive governance.Highlight : Community understanding of the function of village regulations is fairly good, but participation remains low. The capacity of village officials in regulation drafting needs strengthening. The supervisory mechanism of the Village Consultative Body (BPD) is not yet optimal and requires improvement.
