Abstract

The concept of kafa'ah or equivalence in marriage is one of the fundamental principles in Islamic family law that aims to maintain harmony and social balance. The Qur'an does not mention the term kafa'ah explicitly, but the principle of equivalence is emphasized through QS. an-Nūr: 26, QS. an-Nisā': 25, and QS. al-Ḥujurāt: 13, which emphasizes that ideal equivalence in marriage focuses on the balance of faith, morals, and piety, not social or economic status. The understanding of kafa'ah in the contemporary context has undergone a reinterpretation, shifting from a focus on socio-structural status to an emphasis on ethical-religious aspects, relevant within the framework of maqāṣid al-syarī‘ah to realize welfare and justice. This study uses the thematic interpretation method to analyze the concept of kafa'ah in the Qur'an and its implications in contemporary Islamic family law. The research results show that kafa'ah should be understood as the equivalence of religious values, visions, and responsibilities, not simply equality of social or economic status.

Abstract

Human well-being, peace, and tranquility can be achieved and begin with a harmonious household. A safe home, characterized by mutual love and respect, will produce good individuals who will not disturb the atmosphere or pose a danger to society. Implementing the concept of a harmonious family requires a strong commitment from each family member. This involves a willingness to support, respect, and understand one another. This paper uses qualitative research, which examines social phenomena from the perspective of participants. In traditional husband-wife relationships, there is a division of duties and roles between husband and wife. The husband is responsible for earning a living, while the wife is responsible for managing the household and raising children. Male leadership over women is not a form of discrimination against women, but rather a form of Islamic respect for women's status as wives who must be protected.

Abstract

This study examines the Qur’anic perspective on the protection of children and women within Islamic family law through a thematic interpretation approach (tafsīr mawdhū‘ī). Focusing on QS. an-Nisā’ [4]: 2–10 in relation to QS. al-Isrā’ [17]: 31 and QS. al-An‘ām [6]: 151, the research analyzes the linguistic meanings of legal verses (āyāt aḥkām) and their normative implications. The findings show that the Qur’an establishes firm legal and moral obligations to safeguard the rights of vulnerable groups, particularly orphans and women, through principles of justice, compassion, and responsibility. These verses emphasize the protection of life, property, dignity, and fair treatment in family relations, while strongly condemning exploitation and oppression. The study further demonstrates that Islamic family law is not merely a rigid normative system, but a framework oriented toward social justice and human dignity, reflecting the universal principle of raḥmatan lil ‘ālamīn. Through thematic interpretation, the Qur’anic message emerges as coherent and integrative, offering a relevant ethical foundation for the development of contemporary Islamic family law that prioritizes protection, balance of rights and obligations, and social harmony.

Abstract

Metode tafsir tahlili merupakan salah satu pendekatan klasik dalam penafsiran Al-Qur’an yang menekankan analisis ayat secara runtut berdasarkan urutan mushaf dengan memperhatikan aspek kebahasaan, konteks historis, asbāb al-nuzūl, munāsabah, serta implikasi hukum dan sosial yang terkandung di dalamnya. Artikel ini bertujuan untuk mengkaji secara komprehensif konsep tafsir tahlili, karakteristik, kelebihan dan kekurangannya, serta penerapannya dalam ayat-ayat hukum keluarga Islam. Penelitian ini menggunakan metode kualitatif dengan pendekatan kepustakaan (library research) dan analisis deskriptif-analitis terhadap ayat-ayat Al-Qur’an yang berkaitan dengan pernikahan, relasi suami-istri, dan penyelesaian konflik rumah tangga, khususnya Surah Ar-Rum ayat 21 dan Surah An-Nisa ayat 34–35. Hasil penelitian menunjukkan bahwa tafsir tahlili mampu mengungkap prinsip-prinsip dasar hukum keluarga Islam yang bersifat fleksibel dan kontekstual, seperti tujuan sakinah dalam pernikahan, konsep kepemimpinan keluarga yang berbasis tanggung jawab, serta mekanisme mediasi dalam penyelesaian konflik. Temuan ini menegaskan bahwa ayat-ayat hukum keluarga dalam Al-Qur’an membuka ruang ijtihad untuk pembaruan hukum keluarga Islam yang responsif terhadap dinamika sosial kontemporer tanpa meninggalkan nilai-nilai fundamental syariat Islam.

Abstract

Tafsir bil ma’tsur is one of the Qur’anic exegesis methods that emphasizes transmitted reports derived from the Qur’an itself, the Sunnah of the Prophet Muhammad (peace be upon him), the statements of the Companions, and the interpretations of the Successors (tabi‘in). This method is regarded as the most authoritative form of interpretation due to its close connection to the original sources of revelation and the early generations of Islam. This article aims to examine the concept of tafsir bil ma’tsur, its sources, characteristics, as well as its strengths and limitations within the tradition of Qur’anic exegesis. This study employs a qualitative approach through library research by analyzing classical and contemporary scholarly works on Ulumul Qur’an and tafsir. The findings indicate that tafsir bil ma’tsur plays a crucial role in preserving the authenticity of Qur’anic interpretation through a verified transmission system. Nevertheless, this method also encounters challenges, including the mixture of authentic and weak narrations and the infiltration of Isra’iliyyat. Therefore, a critical and rigorous verification process is essential to ensure that tafsir bil ma’tsur remains methodologically sound and academically reliable.

Abstract

This study aims to analyze how digital piety among santri in Islamic boarding schools (pesantren) in Bandung Regency shapes the ecology of Islamic authority and influences diverse forms of religious moderation in everyday practice. This study is important because the digitalization of da‘wah has expanded santri’s religious references while simultaneously carrying the potential to generate polarization when not accompanied by adequate literacy and guidance. The research employs a qualitative approach with a case study design. Data were collected through in-depth interviews with santri, observation of religious activities within the pesantren environment, and examination of relevant digital artifacts, such as religious content accessed and shared by participants. The data were analyzed using thematic analysis to identify patterns of religious practice, authority references, and emerging mechanisms of negotiation. The findings indicate that digital piety emerges as a structured religious routine through the consumption of short religious lectures, practices of saving and sharing content emphasizing ethical and moral values, and the curation of content perceived as “safe” and non-confrontational. Within a plural ecology of Islamic authority, kiai and pesantren teachers remain the final sources of religious legitimacy, while digital religious authorities function primarily as initial triggers of knowledge that are negotiated through account selection, interaction restraint, and cross-checking with pesantren authorities. As a result, religious moderation among santri appears more strongly as a lived social practice operating contextually between pesantren spaces and digital environments. The implications of this study highlight the importance of strengthening digital religious literacy, establishing accessible verification mechanisms, and developing pesantren-based content curation to reinforce religious moderation in the era of social media. The originality of this research lies in its articulation of the micro-level mechanism of “authority negotiation” as a bridge between digital piety and religious moderation, thereby offering both conceptual and empirical contributions to the fields of digital religion, Islamic authority, and religious moderation within pesantren contexts.

Abstract

Understanding of the Qur’an can be achieved through mastery of the various disciplines encompassed within ʿulūm al-Qur’ān, one of which is the branch of knowledge that discusses the muhkam and mutashabih verses. This study aims to elaborate more deeply on the characteristics of muhkam and mutashabih verses by referring to the twentieth principle in al-Qawā‘id al-Ḥisān fī Tafsīr al-Qur’ān by  Abdurrahman al-Sa‘dī.  Using a  qualitative-descriptive approach based  on library research, the twentieth principle in al-Qawā‘id al-Ḥisān maps verses into three categories: entirely muhkam, entirely mutashabih, and verses that contain elements of both muhkam and mutashabih to a certain degree. The results of the study indicate that muhkam verses possess several main characteristics: their meanings are clear and their intent can be understood; they do not require interpretation (ta’wil); they can stand independently without reliance on other verses; their wording is not repetitive; and they contain legal provisions such as commands, promises, and threats. As for mutashabih verses, their characteristics are as follows: some of their meanings cannot be fully comprehended by human beings and their ultimate knowledge rests only with Allah SWT, such as the occurrence of the Day of Judgment; others can be understood through interpretation and in-depth study; they require ta’wil; they cannot stand independently without reference to other verses; their wording tends to be repetitive; and they often contain narratives and parables

Abstract

This study discusses the meaning of rada’ah in QS. al-Baqarah [2]: 233 and its implications for divorce law. This verse affirms the mother's right to breastfeed her child for two full years for those who wish to complete the breastfeeding period, while emphasizing the father's obligation to provide for the mother and child in a ma'ruf manner. Using qualitative-descriptive methods with library research, this article applies ijmali and tahlili interpretations to understand the global and detailed meaning of the verse, and examines its impact on the rights, obligations, and protection of children after divorce. The results of the study indicate that the meaning of rada’ah encompasses biological, legal, social, and emotional dimensions. Through ijmali interpretation, this verse is understood globally as the principle of balance between parental rights and obligations, while tahlili interpretation emphasizes legal details related to maintenance, breastfeeding, weaning, mahram rights, and child protection. Implications for divorce law include the father's obligation to provide for a nursing mother, the mother's primary right to care for the child during the breastfeeding period, and the principle of deliberation in weaning children before two years of age. This research confirms that the concept of rada’ah serves as a normative foundation for maintaining justice, the welfare of children, and the continuity of parental relationships even after divorce, in line with Islamic law and Indonesian national law. The contribution of this research lies in the integration of ijmali and tahlili interpretations with contemporary family law studies, thus positioning rada’ah as the basis for child protection and post-divorce arrangements for support and care.

Abstract

Penelitian ini bertujuan untuk membahas pola asuh generasi Z berdasarkan penafsiran QS. an-Nisa’ [24]: 30–31. Hal ini dilatarbelakangi oleh tantangan pola asuh yang dimanjakan dengan teknologi yang terus berkembang sehingga melemahnya peran keluarga sebagai pranata pendidik pertama. Pola asuh generasi Z memiliki ciri khas unik dari generasi sebelumnya yang dapat memanfaatkan perkembangan teknologi, namun memiliki tantangan baru yang dituntut untuk siap siaga dalam menjaga, mengawasi dan memberikan pola asuh anak dengan baik. Metode yang digunakan kualitatif-deskriptif dengan jenis penelitian kepustakaan (library research). Dengan metode tersebut, hasil kajian menunjukkan bahwa dari tafsir klasik maupun kontemporer, QS. an-Nisa’ [24]: 30–31 mengandung pesan kuat tentang pentingnya menanamkan kesadaran moral, disiplin, dan tanggung jawab sejak dini. Dalam tinjauan tafsir maudhu’i, ayat tersebut menekankan prinsip yang sangat relevan dalam konteks pola asuh di era modern, yakni mengedepankan pentingnya pandangan dan akhlak, terutama memberikan pedoman penting bagi orang tua generasi Z dalam mendidik anak-anaknya. Hasil kajian ini menunjukkan bahwa orang tua generasi Z di era modern perlu membimbing cara pandang, karakter, dan perilaku anak baik di dunia nyata maupun di ruang digital, karena pengawasan yang bijak, komunikasi yang terbuka, serta keteladanan orang tua merupakan unsur utama dalam pola pengasuhan anak pada era modern.

Abstract

This study aims to analyze the application of Principle Twenty-One (The Qur’an in its guidance corresponds to time and circumstances in its rulings that are based on custom and tradition), Principle Eighteen (Releasing and restricting guidance and misguidance), and Principle Twenty-Six (Qur’anic verses that contain limitations (qayd/exceptions/qualifications) cannot have their legal rulings applied unless those conditions or limitations are fulfilled, except in certain verses that are indeed exempted by other evidence) from the work Qawāʿid al-Ḥisān fī Tafsīr al-Qur’ān in the verses of Islamic family law. The discussion focuses on their relevance to Indonesian positive law. Using a qualitative-normative method with comparative analysis between classical fiqh and national regulations, this study shows that several family law verses, such as QS. al-Baqarah [2]: 229 and 231, contain a muthlaq–muqayyad structure that opens space for legal change in accordance with developments in time, place, and social conditions. Principle Twenty-One affirms that Qur’anic guidance in social matters refers back to ‘urf, so that the practices of khulu’, ṭalāq, and the prohibition of ḍirār undergo significant adjustment in the present time. Principle Eighteen indicates that verses which appear absolute are often explained by other verses through the mention of legal causes related to human behavior. Principle Twenty-Six affirms that a legal ruling does not apply without the fulfillment of its binding element, except where there is evidence that exempts it. In the Indonesian context, this dynamic is reflected in the transformation of the concept of khulu’ into a divorce lawsuit, the regulation of ṭalāq through court registration, and the criminalization of psychological violence and family neglect as stipulated in the UUPKDRT. This study concludes that the application of these three principles of interpretation affirms the flexibility of Islamic family law and its compatibility with national legal reform.
