Abstract

The rapid progress in the field of information technology has contributed greatly to the development of the world of information and electronic transactions. The security of consumer personal data that enters e-commerce data should be a guarantee given by the company to its consumers. This study aims to find out the legal protection for data/information security of e-commerce application users during a pandemic. This study uses normative legal research with analytical descriptive methods to explain, describe, and correlate legal regulations and theories with the problems that occur. Data analysis was carried out qualitatively. The results of the study indicate that the electronic system operator must ensure the availability of service level agreements, the availability of information security agreements for the information technology services used; and security of information and means of internal communication held. Then, the operator of the electronic system must ensure that each component and the integration of the entire electronic system operates properly. Especially in the era of the covid-19 pandemic, it is appropriate that the regulation of personal data protection can be immediately upgraded to the level of the law.Keywords: Protection; Security; Personal Data;E-Commerce.

Abstract

Rule lower against the rules of higher then lower regulation it can test the material (judicial review) to be canceled entirely or partially canceled. Position regulations set by the People's Consultative Assembly (MPR) House of Representatives (DPR), the Regional Representatives Council (DPD), the Supreme Court (MA), the Constitutional Court (MK), the Supreme Audit Agency (BPK), Commission Judicial (KY) , Bank Indonesia (BI), the Minister, the Agency, Organization, or commissions, in the Indonesian legal system recognized by Act No. 12 of 2011 either were born because of higher regulatory mandate and within the scope and authority of the minister. Thus, no doubt that the regulations set by state institutions, have binding force that must be obeyed by the parties set forth therein. While the Regulations issued policy also recognized as an Freies Ermessen in the execution of its duties and functions.

Abstract

There are many crimes against humanity cases that occurred in the world. One of them is happened in Myanmar, which is Rohingya ethnic conflict. Rohingya ethnic conflict is an issue based on discrimination to Rohingya ethnic because there are some differences at ethnic and religion. Ethnic Rohingya is not recognized by Myanmar and not granted a status of citizenship Based on Myanmar Citizenship Law (Burma Citizenship Law 1982). This research was conducted to find out how the legal forms to Rohingya citizens based on international law. This methodology is a normative legal research that uses statutes, case, fact approaches. The research found that the role of UNHCR in handling Rohingya cases has been mandated by the United Nations and in accordance with UNHCR Statute. UNHCR plays an important role in addressing the issue of Rohingya case, at leas as initiator, facilitator, conciliator, and determination. Such roles were taken to resolve the conflict that face by Rohingya ethnic, like provide protection, safety, and facilitate every Rohingyas refugees needs. In addition to the role of UNHCR, some countries such as Indonesia, Thailand and Canada also provided some arrangement in addressing the issue of Rohingya.

Abstract

This study aims to determine the authority to collect fees is the authority of local governments to increase regional income. Therefore the mechanism for calculating the tera/recalibration must be carried out as well as possible and have a clear scientific basis. In determining the standardization of measurement and weighing is carried out through a scientific standard known as legal metrology. This research is normative juridical by taking a statutory approach and a conceptual approach. The sources of legal materials that the author uses are primary and secondary legal materials by collecting data through library research and data analysis techniques using content analysis and analytical descriptive. Based on the provisions of Article 1 letter b Law Number 2 of 1981 concerning legal metrology, what is meant by legal metrology is a measurement system that regulates and manages units of measure, measurement methods and measuring instrument standards, which involve technical requirements and regulations based on the Law aims to protect the public interest in terms of the correctness of measurement. Legal basis for determining legal metrology standards: First, Law Number 2 of 1981 concerning Legal Metrology; Second, Government Regulation Number 2 of 1985 concerning Compulsory and Exemption for Calibration and/or Re-calibration and Requirements for Measuring, Measuring, Weighing Instruments and their Equipment; Third, Regulation of the Minister of Trade Number 115 of 2018 concerning Legal Metrology Units; Fourth, Regulation of the Minister of Trade Number 52 of 2019 concerning Legal Metrology Size Standards. The legal metrological calibration/recalibration system can be applied in traditional markets so that market traders are required to pay a levy to obtain calibration/recalibration services related to their scales

Abstract

Legal protection of workers is intended to guarantee the basic rights of workers and ensure equal opportunities and treatment without discrimination on any basis to realize the welfare of workers. The research method uses normative juridical, with a legislative approach and data collection techniques using primary data and secondary and tertiary data. The result of the research is that the application of wages to workers in Decision Number 349/Pdt. Sus-PHI/2021/PN Mdn is to reject because it cannot present evidence, namely a note from the Labor Inspector regarding wage shortages and evidence must be by the request. After all, it is used to strengthen the judge's belief. The form of legal protection for the implementation of the minimum wage in Decision Number 349/Pdt. Sus-PHI/2021/PN Mdn is contained in Article 1 number 30 of the Manpower Law which regulates wages made based on a work agreement where the form of agreement in this decision is an Indefinite Time Work Agreement which was made orally at the beginning of the employment period and ratified through a decision from the panel of judges.

Abstract

The large number of cases of suspected election crimes at every stage of the elections in Indonesia are not balanced with a fair law enforcement design and legal certainty. The establishment of the Integrated General Election Law Enforcement Center (Sentra Gakkumdu Pemilu) apparently did not have a significant impact in effectively prosecuting perpetrators of election crimes. This research aims to examine the design of law enforcement for election crimes and analyze the application of the concept of restorative justice as an approach to law enforcement for election crimes. The results of the research, firstly, are that the complexity of the law enforcement mechanism for election crimes causes the number of reports of election crimes submitted by the public to election supervisors to be meaningless. Second, that the current law enforcement design for election crimes still prioritizes punishment, even though law enforcement prioritizes the principle of ultimum remedium in its implementation. The absence of legal loopholes in prioritizing the concept of restorative justice in enforcing election criminal law is an obstacle for the Gakkumdu Center in enforcing election criminal law. The large number of cases of suspected election crimes that occur while the resolution time is relatively short makes it difficult for law enforcement to promote election crimes to promote justice and legal certainty. So there is a need to design technical regulations in implementing restorative justice in handling election crimes in the future.

Abstract

Public services are services provided by the government as state administrators to the community, Electronic KTP is a population document containing a security / control system from both the administrative and information technology side based on the national population database. The type of research used is normative juridical and the nature of the research used is descriptive analytical. The data collection technique used 2 (two) methods, namely library research and field research. Data analysis was carried out qualitatively. The results of research in 2011 the population of Medan Baru Subdistrict is estimated to have reached 57,962 people, the management of KTP is recorded and documented in a special agenda book of Electronic KTP, it is absolutely necessary to have valid population data and already have a NIK and photo recording, signature, fingerprint, and population iris, the results of the discussion of Law Number 24 of 2013 in Article 1 number 21 concerning the population administration information system, the government provides data verification services, photo recording, signatures, fingerprints and iris of the population at the Electronic KTP service place, lack of blanks from central government, lack of clear information for the public and limited Electronic KTP security tools, in conclusion, Electronic KTP contains a security code and electronic records as a means of verification and validation of a person's identity data.

Abstract

This research aims to determine the position of death penalty law based on a human rights perspectiveafter the enactment of the new Criminal Code (KUHP). This research uses normative juridical methods,with qualitative analysis. The results of the research show that the old Criminal Code put the death penaltyas the main punishment, whereas in the new Criminal Code there is a shift in the position of the deathpenalty. After the enactment of the new Criminal Code, the death penalty was not immediately abolished,the death penalty still existed but alternative punishment was provided as a substitute for the deathpenalty. If we look at developing countries, the death penalty has begun to be abandoned because it isconsidered to violate human rights, in fact Indonesia is also aware of that, we can see in Article 28 A andArticle 28 Paragraph (2) of the Constitution of the Republic of Indonesia that the death penalty is it isagainst Human Rights.

Abstract

Abstrak: Penyalahgunaan narkotika di Indonesia banyak terjadi di kalangan remaja usia produktif, hal ini dikarenakan faktor lingkungan pergaulan di kalangan remaja. Undangundang No 35 tahun 2009 tentang Narkotika dibentuk untuk menekan angka penyalahgunaan narkotika dan peredaran gelap narkotika di Indonesia. Metode pelaksanaan terdiri dari dua tahap yaitu tahap persiapan serta tahap pelaksanaan sosialisasi. Keseluruhan rangkaian berjalan dengan baik dengan meningkatnya pemahaman masyarakat adalah guna mengetahui perlindungan hukum terhadap pecandu dan korban penyalahgunaan narkotika dan upaya mempertahankan diri agar tetap steril dari lingkungan narkoba terutama bagi masyarakan binaan di Panti Rehabilitasi Amelia Sumatera Utara. Lembaga rehabilitasi medis dan rehabilitasi sosial yang ditunjuk oleh pemerintah untuk mendapatkan pengobatan dan/atau perawatan melalui rehabilitasi medis, dan rehabilitasi sosial. Sifat wajib untuk rehabilitasi medis dan rehabilitasi sosial ini seharusnya menjadi landasan yang penting bagi hakim untuk mengambil tindakan dalam memutus perkara terhadap korban dan penyalahgunaan narkotika. Namun sifat wajib dari rehabilitasi ini Pasal 54 dengan pasal 127 UU Narkotika sangatlah berhubungan. Dapat dilihat dalam pasal 127 ayat (2) disebutkan bahwa hakim wajib memperhatikan ketentuan pasal 54, pasal 55, dan pasal 103 dalam menjatuhkan putusan. Namun meskipun bersifat wajib, dalam pelaksanaannya tetap bergantung pada penyidik dan penuntut umum. Efforts to Self-Sterilize Drug Users from the Drug Circle as a Form of Legal ProtectionAbstract: Abuse of narcotics in Indonesia occurs a lot among teenagers of productive age; this is due to environmental factors among adolescents. Law No. 35 of 2009 concerning narcotics was formed to reduce the number of narcotic abuses and illicit trafficking of narcotics in Indonesia. The implementation method consists of two stages, namely, the preparation stage and the implementation stage of socialization. The whole series went well with increasing public understanding about legal protection for people with addiction and victims of narcotics abuse and efforts to maintain themselves to remain sterile from the narcotics environment, especially for the people assisted at the Amelia Rehabilitation Center, North Sumatra. The government appoints medical rehabilitation and social rehabilitation institutions to receive treatment and care through medical rehabilitation and social rehabilitation. The mandatory nature of medical rehabilitation and social rehabilitation should be an essential basis for judges to take action in deciding cases against victims of narcotics abuse. However, the mandatory nature of this rehabilitation, Article 54 and Article 127 of the Narcotics Law, are closely related. It can be seen in Article 127 paragraph (2) that the judge must pay attention to the provisions of Article 54, Article 55, and Article 103 in making a decision. However, even though it is mandatory, its implementation still depends on investigators and public prosecutors.

Abstract

Penggunaan kecerdasan buatan dalam proses pembentukan perda di era revolusi industri 4.0 seolah mendapatkan pembenaran guna meminimalisir disharmoni antara peraturan daerah dengan berbagai peraturan perundang-undangan lainnya. Namun penggunaan Kecerdasan buatan tidak dapat serta merta menggantikan kewenangan organ pembentuk perda secara menyeluruh, tentunya hal ini masih menimbulkan perdebatan. Permasalahan yang diangkat dalam tulisan ini adalah Bagaimana implementasi penggunaan kecerdasan buatan dalam pembentukan Peraturan Daerah? Metode penelitian yang digunakan adalah yuridis normatif, dalam konteks penelitian ini juga akan dilihat apakah penggunaan kecerdasan buatan dalam proses pembentukan Perda memiliki pijakan secara teoritis yang diutarakan para ahli, maupun basis yuridis dalam berbagai peraturan perundang-undangan. Hasil penelitian menunjukkan bahwa penggunaan kecerdasan buatan dalam proses pembentukan perda tidak serta merta dapat menggantikan peran dan fungsi organ pembentuk perda. Penggunaan kecerdasan buatan dalam proses pembentukan perda diposisikan hanya sebatas alat bantu yang dapat memprediksi potensi disharmoni antara perda dan berbagai peraturan perundang-undangan lainnya. Untuk mengakomodir pengunaan AI dalam Proses pembentukan perda diperlukan perubahan terhadap UUP3, UU Pemda dan peraturan perundang-undangan turunannya yang berkaitan dengan pembentukan perda.
