Abstract

Children's use of technology has a significant impact on their physical, cognitive, social and emotional development. One of the technologies that children often use is social media. While social media can provide benefits, there are also negative impacts such as bullying and harassment. Therefore, supervision from parents, educators, and authorities is essential. Technology is not all good or all bad; what matters is how its use is managed to suit children's needs and development, while considering its positive and negative impacts. This research aims to find out and analyze various countermeasures that can be taken against children who experience sexual harassment on social media in accordance with the provisions in the Child Protection Law, as well as identify forms of legal protection provided to child victims of sexual harassment in cyberspace based on applicable regulations. This analysis includes measures for prevention, handling, and recovery of victims, as well as legal implementation to ensure that children's rights are optimally protected in the midst of rampant cases of harassment in the digital realm. Data collected from primary legal materials and secondary legal materials are then analyzed qualitatively. Countermeasures against child sexual abuse on social media according to Law number 35 of 2014 and Law number 12 of 2022 involve integrated preventive and enforcement actions.

Abstract

ABSTRAK Kasus kekerasan seksual terhadap anak menunjukkan peningkatan signifikan dari tahun ke tahun, sebagaimana tercatat dalam data Sistem Informasi Online Perlindungan Perempuan dan Anak (Simfoni PPA). Peningkatan ini dipengaruhi oleh meningkatnya kesadaran masyarakat, keberanian melapor, serta kemudahan akses pelaporan. Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap anak sebagai korban tindak pidana kekerasan seksual berdasarkan Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual (UU TPKS). Dengan metode yuridis normatif dan pendekatan deskriptif-analitis, penelitian ini mengevaluasi prinsip-prinsip perlindungan hukum seperti non-diskriminasi, kepentingan terbaik anak, hak pemulihan, dan hak restitusi. Hasil analisis menunjukkan bahwa meskipun UU TPKS memberikan kerangka hukum yang komprehensif, implementasinya masih menghadapi tantangan, termasuk keterbatasan pemahaman aparat hukum dan kurangnya fasilitas pendukung korban. Harapan kedepan pemerintah dapat meningkatkan kapasitas aparat hukum, penyediaan layanan pemulihan terpadu, dan sosialisasi hak-hak korban untuk memastikan efektivitas perlindungan hukum bagi anak korban kekerasan seksual. Kata Kunci: perlindungan hukum, tindak pidana kekerasan seksual, restitusi ABSTRACT Cases of sexual violence against children have shown a significant increase year-on-year, as recorded in the Online Information System for Women and Child Protection (Simfoni PPA). This increase is influenced by growing public awareness, courage to report, and easier access to reporting. This study aims to analyze the legal protection of children as victims of sexual crimes based on Law Number 12 of 2022 concerning Sexual Violence Crimes (UU TPKS). Using a normative juridical method and a descriptive-analytical approach, this study evaluates the principles of legal protection such as non-discrimination, the best interests of the child, the right to recovery, and the right to restitution. The results of the analysis show that although the UU TPKS provides a comprehensive legal framework, its implementation still faces challenges, including limited understanding by law enforcement officers and a lack of supporting facilities for victims. It is hoped that in the future the government can improve the capacity of law enforcement officers, the provision of integrated recovery services, and the socialization of victims' rights to ensure the effectiveness of legal protection for child victims of sexual violence. Abstract

The Constitutional Court issued Decision Number 144/PUU-XXI/2023. The decision contains an extension of the time limit for non-use trademarks from 3 years to 5 years and adds the provision of force majeure to the provision of valid reasons. This policy certainly has an impact on non-use trademark holders to maintain their brands and third parties have to wait longer. This research aims to analyze how the implications of non-use trademark policy changes on the elimination of registered trademarks based on the perspective of justice and the principle of national treatment. The research method used is normative juridical. The results of the study concluded that based on the perspective of justice, the implications of changes in the non-use trademark deadline policy on the elimination of registered trademarks in Indonesia have a major impact in providing justice for trademark owners, especially micro, small and medium enterprises (MSMEs). Based on the principle of national treatment, the implications of this policy change strengthen the fairness of trademark law in Indonesia by providing equal protection for domestic and foreign trademark owners, while maintaining the rights of domestic and foreign third parties. And maintaining compliance with international commitments contained in TRIPs.

Abstract

This study examines the extent to which Islamic legal norms regard polygamy as a permissible marital practice, and how feminist legal perspectives assess such practice within the framework of gender equality and the protection of women’s rights. The research is directed by two principal legal questions: (1) What is the comparative analysis of polygamy under the Marriage Law when viewed from the standpoint of Islamic Law and Feminist Legal Theory? and (2) How is the concept of justice for women subjected to polygamous marriages assessed under Islamic Law and Feminist perspectives? This study employs a normative legal research design using a qualitative  descriptive analysis. Data were obtained through a literature-based method involving statutory materials, authoritative legal texts, scholarly works, and relevant academic articles. An analytical approach was adopted to interpret the meaning and scope of terms contained in legislative provisions, while data collection was conducted through comprehensive doctrinal and literature review to assemble all relevant legal information. The findings of this research demonstrate both differences and points of convergence between Islamic Law and Feminist perspectives regarding the legal and ethical status of polygamy. Under Islamic Law, polygamy is deemed permissible subject to strict substantive and procedural conditions, including the husband’s ability to uphold justice among his wives, both materially and emotionally. In practice, however, the failure to fulfil the principle of justice often results in discrimination and harm toward women. Conversely, from a Feminist perspective, polygamy is viewed as an inherently inequitable institution that reinforces patriarchal structures and places women in subordinate positions, socially, economically, and emotionally. Therefore, in order to achieve justice from both legal and gender-equality standpoints, a reinterpretation and reassessment of existing marital regulations is necessary to ensure greater responsiveness to gender justice and stronger protection of women’s rights.

Abstract

This study examines criminal liability for the use of dark patterns in the registration process on digital platforms and applications, which often mislead users into providing consent for the processing of their personal data. Dark patterns are interface design strategies intentionally crafted to influence user behavior through visual and psychological manipulation, resulting in consent that is no longer freely given. The purpose of this research is to analyze the basis of criminal liability for the implementation of dark patterns under Indonesia’s national legal framework, particularly the Personal Data Protection Law (PDP Law), the Electronic Information and Transactions Law (ITE Law), and the 2023 Criminal Code (KUHP), as well as to identify obstacles to law enforcement against such practices in Indonesia. This study employs a normative legal research method using statutory, conceptual, and case approaches. The findings indicate that dark patterns may fulfill the elements of a criminal offense due to the presence of intentionality, deception, and unlawful economic gain, thereby allowing liability to be imposed on both individuals and corporations. Nevertheless, significant barriers to effective enforcement remain, including the absence of an independent data protection authority, the lack of clear legal standards regarding manipulative interface design, and low levels of digital literacy among the public. This research underscores the urgency of strengthening regulatory frameworks and institutional capacity to ensure the protection of privacy rights and legal certainty within Indonesia’s digital ecosystem. Abstract

The development of digital technology has led to an increase in the processing of personal data in various community activities, but this has not been matched by adequate legal awareness regarding personal data protection. This condition has the potential to cause data leaks and misuse that are detrimental to the community. This community service activity aims to strengthen legal awareness and increase public understanding of personal data protection through the dissemination of Law Number 27 of 2022 concerning Personal Data Protection. The methods used include public education through legal counseling, material presentations, and interactive discussions with partner groups. The results of the activity show an increase in public awareness of the importance of personal data protection and a better understanding of the rights of personal data subjects and the legal measures that can be taken in the event of data leaks or misuse. This activity is important as a preventive measure in building a culture of legal awareness among the public in the digital age.
