Abstract

This study analyzes the fatwa of the Indonesian Ulema Council in imposing three divorces at once and the factors that influence the fatwa of the Indonesian Ulema Council so that it imposes three simultaneous divorces. This research is qualitative, with a descriptive analysis method supported by normative law or literature study. Data collection, namely the fatwa of the Indonesian Ulema Council Three Divorces at Once, and books, journals, articles, and so on. The study's results explained that the decision of the fatwa of the Indonesian Ulema Council stated that divorces that occurred with three divorces at the same time resulted in one divorce law. In this decision, the Indonesian Ulema Council considered the opinion of the majority of scholars and Law no. 1 Marriage and the Compilation of Islamic Law as stated in article 115 KHI "Divorce can only be carried out before the trial of the Religious Court after the Religious Court has tried and failed to reconcile"

Abstract

The problems that exixt in the Kutajaya village government are that optimal administration has not been implemented, this can be seen in the incomplete population administration in kutajaya village and the issuance of decrees to community empowerment institutions and youth organizations. The method of implementation in the activity program is public education, a socialization seminar, in which the author collaborates with university education academics as resource persons to be able to provide material related to increasing the capacity of the village apparatus. With this socialization seminar, village officials can bring the knowledge provided by professional speakers in their fields. The results provided from the program are able to provide understanding to village officials regarding administration and community empowerment. It can be concluded that increasing the capacity of the village apparatus is very important for strengthening human resources in the village government. With efforts to increase the capacity of village government officials, it can bring human resources of village apparatus to optimize performance and be able to see the potential that exists in rural communities in kutajaya village. So it is very important for village officials to be able to improve their skills. Thus increasing the village government apparatus is an important part for the village government to be carried out by the village head as an effort to improve the skills pf the village apparatus.

Abstract

This study aims to determine the effectiveness of Pusaka Sakinah activities to foster family resilience in suppressing divorce by the KUA of Tambun Selatan District. This study uses a qualitative research method, with the type of research used being socio-legal research, a legal science research approach that uses the help of social sciences. Data analysis techniques were carried out through several predetermined stages, namely identification and classification, and then interpreted by explaining descriptively. The study results explained that the concept of Sakinah heritage activities, the hallmark of the program implemented by the KUA of Tambun Selatan District, is fairly effective. The material presented in these activities is the formation of each individual male or female character in establishing household relationships. So that every husband and wife pair have the provision of understanding and experience in building a household, the problems that occur can be resolved properly. The Sakinah Family Service Center, or in the future referred to by the acronym "Pusaka Sakinah," is an activity for the community that functions to facilitate and provide continuous consultation and guidance to create a sakinah family.

Abstract

One of the public health problems is smoking behavior that occurs in various circles of society in Indonesia, including among students or high school students, therefore it is necessary to conduct counseling to provide awareness of the dangers of smoking to health. The purpose of this community service activity is so that students understand efforts to anticipate the catastrophe of smoking on health, also able to disseminate it to the family environment, learning environment and community. The stages of the community service method are carried out with Preparation, Implementation and Evaluation activities. Furthermore, the acquisition of service activities is conveyed descriptively and narratively. The results of the service activities showed that the measurement results before the counseling activities of the participants gave an understanding value of 80.88% from 130 participants. There are 15 question points, the most wrong answer responses to questions related to the catastrophe of smoking, smoking behavior in daily association and activities that are beneficial to support physical health. After the presentation of the material, measurements were made with the same questionnaire before counseling with the aim of knowing the transformation of students' knowledge after getting advice and counseling. The measurement results gave a value of 95.50% from 130 participants. There was an increase in knowledge by 14.62%. It is recommended that the school conduct further guidance in the field of public health on an ongoing basis so that students can be trained to become facilitators or health agents both at school and in their place of residence and also increase the role of school health efforts (UKS) in following up on various health problems that can be handled including smoking at school and according to an Islamic perspective, Smoking law is widespread in today's society, namely makruh. This then motivates smokers to justify their actions assuming acceptance of religion is that in Islam cigarette consumption does not occur including something illegal. As most of you probably know Indonesians follow Islam, which also means the majority of smokers are Muslims. In addition, it was later announced that smoking laws were haram (Purnawan et al. 2022).

Abstract

The marriage desired by all prospective husbands and wives is a sakinah, mawaddah, warrahmah marriage, but in practice the road to marriage often experiences various obstacles and leads to divorce. Cases of divorce or divorce lawsuits continue to increase every year, a factor indicating this phenomenon is caused by various factors such as economic conditions, the environment, the presence of infidelity, the unpreparedness of a candidate to domestic violence. The solution for handling this case is by providing guidance on premarital education as an implementation of the readiness of the prospective husband and wife to get married. This activity is a form of student service to the community in the Real Work Lecture program with the Community Education method, namely using a socialization approach, mentoring or monitoring and providing webinars as exposure to premarital education and community consultation. The results of this activity are expected to be able to overcome problems that occur in the community and minimize the level of divorce to domestic violence in the community.

Abstract

Frequent disputes over the division of inheritance often lead to conflicts between households and relatives. This community service activity aims for a better understanding of the principles of inheritance law and creates an attitude of respect for family values to maintain good relationships within the family and respect the will of their parents or ancestors regarding inheritance. The service method applies community education in the form of socialisation. The results of the activity have an impact, namely, it can increase understanding and information about Islamic Inheritance Science to be applied in family life, can generate a sense of respect for family values to maintain good relationships in the family and respect the will of their parents or ancestors regarding inheritance and improve family communication.

Abstract

This research reviews LGBT issues which are increasingly being discussed because everything seems to be something normal. This is due to the increasing access to globalization, reaching 8,013 cases in Bogor district where LGBT marriages are taking place. Thus this study analyzes the problems related to LGBT marriage to hifdz nashl. This research also uses qualitative methods with literature review, is library research which is literature review research by collecting various sources from both primary and secondary sources and uses library research methodology in analyzing secondary legal materials in the form of reading, analyzing, and collecting data from library research The results of the research are related to Islamic views which include the Qur'an and hadith as well as the consensus of the scholars who say that marriage is an act that is unlawful because of the impact of the LGBT community. In this case, the problems of LGBT marriages can have a major impact on hifdz nashl, as well as discussing how marriage in Islam should be carried out by a man and a woman and perform consent qobul between the man and the marriage guardian with two witnesses. So, when a man marries a man or vice versa it will be equated with adultery which is unlawful.

Abstract

Dowry is an essential aspect of marriage. Scholars agree that while there is no fixed amount for a dowry, it must be beneficial and valuable, reflecting sincerity and affection. This study is normative research using descriptive-analytical data analysis. It explains that dowry in the form of shares is permissible in Islam as long as it does not harm anyone, is agreed upon by both parties and benefits the wife. The shares given must have clear contracts and be within the realm of Sharia-compliant business, even though they cannot be physically displayed, and there must be original proof of ownership of the shares. Legal protection regarding shares is based on the DSN MUI fatwa No. 40 of 2003 article 2, which states: Article 2 (a) The capital market and all its mechanisms, particularly concerning issuers, types of securities traded, and trading mechanisms, are considered compliant with Sharia principles if they fulfil Sharia principles. (b) All securities comply with Sharia principles if they have obtained a Sharia compliance statement.

Abstract

Public flogging is required by this jinayat law, which has existed since 2014. It is thought to be a severe and effective method of law enforcement. But there have also been a lot of complaints and criticisms of this jinayat law, particularly from the standpoint of human rights. The local community's justice, welfare, and peace are the main goals of Aceh's implementation of jinayat law. In the paper utilized for this study, the author employs normative juridical research, which is legal research done by looking through books and relevant statutes and regulations from libraries. This research employs a qualitative approach using a library research method by the study's characteristics. This research also employs a comparative methodology; specifically, the author compares Islamic law, human rights, and the Aceh Qanun Jinayat. As per the Aceh Qanun Jinayat and Islamic law, there is a whipping law for anyone who consumes alcohol. This is evident from the punishment meted out to the alcohol user, who is flogged 40 (forty) times as Uqubat Hudud. Acehnese people have lived under Islamic law for a long time, earning them the moniker "land of the porch of Makkah." When non-Muslim suspects of violating the qanun voluntarily turn themselves in for punishment, it is evident that Islamic Sharia's conceptions of justice align with the fundamental principles of legal justice and human rights. The courts denied every request for voluntary surrender made by non-Muslim defendants, although they did acknowledge the primary motivators behind their surrender.
