Abstract

Social status, cultural pressures, and economic stratification often drive the high value of marriage dowries. This study analyzes the social and cultural influences on dowry practices in Indonesia, India, Bangladesh, and Pakistan. It formulates a reconstruction of the determination of dowry grounded in the principles of fairness and justice. This study is normative-empirical, using a qualitative approach with a multilayered comparative approach, both in social, cultural, and legal aspects of dowry determination, which is then analyzed using the IRAC (Issue, Rule, Argument, and Conclusion) method. The results of the study show that although dowry in Islamic law functions as a theological right of the wife and financial protection, in practice, dowry is often influenced by socio-economic and cultural factors, making it a symbol of social status, a burdensome cultural pressure, and even a source of dowry-based violence. This study also identifies significant challenges in law enforcement regarding dowry, despite regulations governing it. Therefore, it is necessary to reconstruct the determination of dowry by prioritizing the principles of fairness, distributive justice, and integration between legal regulations and human values to prevent harmful dowry practices. This will create a legal system that is responsive to social dynamics, protects women's rights, and ensures justice for both parties in marriage, free from irrational social and cultural pressures.

Abstract

This study aims to analyse the representation of mut'ah marriage practices in the film Bidaah and assess its compatibility with the principles of Islamic family law. This phenomenon is motivated by the emergence of religious practice deviations and the manipulation of religious arguments by charismatic figures depicted in visual media. The focus of this study is how the film constructs the practice of mut'ah marriage and how Islamic family law views this representation. This research method is qualitative with a media text analysis type of research. The data collection technique uses content analysis of the film Bidaah as the primary data source, supported by a literature study as secondary data for its legal basis. The analysis was conducted descriptively and analytically with reference to classical Islamic literature, the Compilation of Islamic Law, and the principles of maqāṣid al-syarī‘ah. The results of the study show that the practice of mut'ah marriage in the film Bidaah is represented as a temporary and deviant ‘inner marriage’. The practice is carried out without the involvement of a guardian, without valid witnesses, and without official registration, with the dowry being only a recitation of Al-Fatihah. From the perspective of Islamic family law, this practice is considered invalid because it does not fulfil the pillars and requirements of marriage and contradicts the sacred purpose of marriage to form a permanent family. This study concludes that the film serves as a social critique of the abuse of authority or power by religious leaders or heads of religion, which can harm the rights of women and children when such marriages occur.

Abstract

This research aims to explore literature that examines the tradition of wedding dowries in Southeast Asia. The method used in this research is a Systematic Literature Review (SLR). Data sampling used Harzing's Publish or Perish and Watase UAKE applications starting from 2013-2023. The selected articles have passed several specified criteria, resulting in a total of 46 articles. The results of this research show that the country that discusses the topic of marriage dowry significantly in Southeast Asia is Indonesia, with a percentage of 70%, followed by Malaysia at 17%, Thailand at 7%, Vietnam at 4%, and the Philippines at 2%. In terms of research themes around wedding dowries, the topic of wedding dowry traditions is the highest topic category in research in Southeast Asia, with a total of 28 studies and a percentage of 60.87%. Likewise, the contextual approach, with a percentage of 21.74% and Fiqh Theory and Islamic Family Law, with a percentage of 10.87%, are the highest categories of research approaches and analytical theories in research on marriage dowries in Southeast Asia.

Abstract

This thesis aims to find out the basis of the Panel of Judges' considerations in the Decision of the Bekasi Religious Court Number 2560/Pdt.G/2022/PA.Bks in the Divorce Lawsuit for the accumulation of hadlonah and child support, and to find out the basis of Islamic Law in this decision.This research aims to analyze the impact of parental divorce on children's rights based on an Islamic legal perspective using the Maqashid Syariah approach, with a case study of Decision Number 2560/Pdt.G/2022/PA.Bks. Maqashid Syariah are principles in Islamic law that aim to protect five basic human interests: religion, soul, reason, lineage and property. In this context, research focuses on how the protection of children's rights, including rights to custody, education, living and psychological well-being, is considered and applied in divorce decisions. The research method used is a qualitative approach with juridical-normative analysis of Decision Number 2560/Pdt.G/2022/PA.Bks. Data was obtained through studying court decision documents and literature related to Islamic law and Maqashid Syariah. The analysis was carried out by examining how Maqashid Syariah principles were applied in the decision to ensure the protection and welfare of children.The research results show that in this decision, the court decided that child care was under the responsibility of the mother, while the father was obliged to provide maintenance. This decision is based on Maqashid Syariah principles which emphasize the importance of protecting the lives and welfare of children. Apart from that, this decision also takes into account the psychological aspects of the child to reduce the negative impact of divorce

Abstract

Child guardianship (ḥaḍānah) in Islamic family law represents a critical mechanism for child protection during family dissolution, yet existing scholarship remains predominantly normative and fragmented, lacking longitudinal socio-legal analysis of judicial reasoning that integrates child protection and gender justice within Islamic legal frameworks. This study aims to analyze the transformation of child guardianship adjudication in Indonesian Religious Courts (Pengadilan Agama) during 2020–2025, focusing on judicial reasoning patterns, child welfare orientations, and the positioning of women's rights. Employing a normative-empirical (socio-legal) approach, this study analyzed 120 guardianship decisions retrieved from the Supreme Court Verdict Directory through qualitative content analysis and systematic coding, integrating three analytical frameworks: the best interest of the child, maqāṣid al-sharī'ah, and gender justice theory. The findings reveal a significant shift from textualist-normative reasoning toward discretionary, welfare-oriented adjudication, with judges increasingly prioritizing emotional stability, caregiving continuity, and socioeconomic conditions. A pronounced maternal preference pattern was identified, reflecting caregiving realities while simultaneously indicating latent gender bias. Women's rights were found to be implicitly integrated yet structurally subordinated within the best interest framework rather than recognized as autonomous legal principles. The COVID-19 pandemic additionally functioned as a structural catalyst accelerating guardianship litigation. This study contributes a longitudinal socio-legal framework that bridges maqāṣid al-sharī'ah with contemporary human rights discourse, while critically exposing the risks of unchecked judicial subjectivity. These findings underscore the urgent need for verdict standardization, explicit gender justice integration, and systematic reform of Islamic family law in Indonesia.

Abstract

Penelitian ini menganalisis implementasi mediasi dalam penyelesaian sengketa perceraian talak pada perkara Nomor 1542/Pdt.G/2024/PA.Bks di Pengadilan Agama Kota Bekasi, serta mengevaluasi keberhasilan dan keterbatasan mediasi dalam mencapai kesepakatan yang adil dan sesuai dengan prinsip Maqashid Syariah. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan kasus, yang bertujuan untuk mendalami penerapan mediasi dalam konteks perceraian talak secara spesifik. Teknik pengumpulan data yang digunakan adalah studi dokumen dan wawancara. Studi dokumen dilakukan dengan menganalisis dokumen perkara, termasuk putusan pengadilan dan berkas mediasi terkait dalam perkara Nomor 1542/Pdt.G/2024/PA.Bks, untuk memahami secara mendalam proses hukum dan mediasi yang diterapkan dalam penyelesaian sengketa. Hasil penelitian menunjukkan bahwa meskipun mediasi berhasil mencapai kesepakatan sementara antara kedua belah pihak, beberapa aspek penting, seperti besaran nafkah, mut’ah, dan hak asuh anak, masih perlu diperbaiki untuk memastikan keadilan yang lebih menyeluruh. Mediasi dalam perkara ini sejalan dengan prinsip Maqashid Syariah, khususnya dalam hal perlindungan hak-hak dasar seperti agama, jiwa, keturunan, dan harta. Namun, masih ada ruang untuk memperbaiki perlindungan hak-hak individu, khususnya bagi isteri dan anak-anak, agar lebih adil dan memadai. Oleh karena itu, meskipun mediasi telah memberikan solusi sementara yang damai, perlu ada penyesuaian dalam beberapa aspek untuk menciptakan keadilan yang lebih menyeluruh bagi semua pihak yang terlibat.
