Abstract

From the Welfare State perspective, the state is also referred to as a social services state or an agency of services. The form of social services from the state in the context of realizing general welfare is that the government in building international cooperation must always consider national interests through community participation. This study aims to evaluate the practice of forming international agreements concerning people's participation, and analyzing how the RIA method can increase people's involvement in the formation of international agreements. Writing this article applies normative legal research methods, with statutory, conceptual, and comparative approaches. The research results show that the involvement of the House of Representatives as a form of people's participation in the formation of international agreements can be said to be quite minimal. In contrast to some countries such as Germany, the House of Representatives or parliament must be provided with information regarding the negotiation process that is being carried out by the Government. Likewise in the United States, Parliament can participate in the negotiation process on international agreements for certain fields. Even though Article 2 of the Law on International Agreements mentions a mechanism for consultation by the government regarding international agreements that concern the public interest. However, there is no further explanation of whether the Consultation mechanism is voluntary or an obligation for the executive. Therefore, one of the methods that can be applied to increase public participation, especially through the involvement of the House of Representatives is to apply the RIA method.

Abstract

One the things in the Law Number 11 year of 2020 about Job Creation that cause problem is the deletion of an article concerning Environmental Permit Obligations. Environmental Permit Obligation is not strictly regulated in the Law of Job Creation. However, a petitioner must get a ruling about Environmental Eligibility to be permitted in running a business. Environmental Permission’s Nomenclature and Substance in Law of Environmental Protection and Management is changed into Environmental Agreement in the Law of Job Creation. The purpose of writing this article is to analyze environmental disputes in the Law of Job Creation, analyze environmental issue connected to Human Right, and also suggest improvement concerning environmental provision after the constitutional court’s decision number 91/PUU-XVIII/2020. The result of the research indicate that in order for a legal product that is born to be functional in the order of life of the nation and state, the legal product must accommodate what is the soul of the nation, which must be in accordance with and in harmony with the values contained in the Constitution. In addition, the right to the environment is one of the human rights regulated by the constitution, so that the revision of the Job Creation Law after the Constitutional Court’s decision related to the environment must prioritize human rights and sustainable development, especially by accommodating related environmental permit obligations in the form of Environmental Impact Assessment. Abstrak: Salah satu hal di dalam Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja (UU Cipta Kerja) yang memunculkan persoalan adalah dihapusnya pasal mengenai kewajiban izin lingkungan. Dalam UU Cipta Kerja, izin lingkungan tidak diatur secara tegas. Namun, untuk mendapatkan izin berusaha, pemohon harus mendapatkan keputusan mengenai kelayakan lingkungan. Izin Lingkungan dalam UU PPLH diubah nomenklatur dan substansinya menjadi persetujuan lingkungan dalam UU Cipta Kerja. Tujuan dari penulisan artikel ini adalah untuk mengkaji permasalahan lingkungan hidup dalam UU Cipta Kerja, mengkaji isu lingkungan hidup dalam kaitannya dengan hak asasi manusia, serta memberikan saran perbaikan mengenai ketentuan lingkungan hidup pasca Putusan MK Nomor 91/PUU-XVIII/2020. Hasil penelitian menunjukkan bahwa agar suatu produk hukum yang dilahirkan menjadi fungsional dalam tatanan kehidupan berbangsa dan bernegara, maka produk hukum tersebut harus mengakomodir apa yang menjadi jiwa bangsa, yakni harus sesuai dan selaras dengan nilai-nilai yang terkandung dalam Konstitusi. Selain itu , hak atas lingkungan hidup adalah salah satu hak asasi yang diatur oleh Konstitusi, sehingga revisi UU Cipta Kerja pasca putusan MK terkait lingkungan hidup harus mengedepankan hak asasi manusia dan pembangunan yang berkelanjutan, khususnya dengan mengakomodir terkait kewajiban izin lingkungan berupa Amdal.

Abstract

Latar belakang : Indonesia ialah negara dengan iklim tropis dan paparan sinar matahari yang melimpahdimana secara teori memiliki jumlah pengidap defisiensi vitamin D yang rendah, namun pada kenyataannyaprevalensi kasus defisiensi vitamin D masih tinggi. Hal ini disebabkan karena gaya hidup yang relatifmenghindar dari sinar matahari seperti menggunakan pakaian yang tertutup, kurangnya aktivitas di luarruangan dan obesitas. Sinar matahari menjadi sumber utama pembentukan vitamin D dan dipengaruhi olehkandungan lemak dalam tubuh. Penelitian ini ditujukan guna mengenali relasi durasi paparan sinar sertabody fat terhadap kadar vitamin D.Metode : Riset berikut diklasifikasikan sebagai riset observasi analitik dengan desain cross sectional.Responden riset yaitu 36 mahasiswi Fakultas Kedokteran Universitas Muhammadiyah dengan mengambilsampel menggunakan consecutive sampling. Analisis data mengaplikasikan uji korelasi Pearson ProductMoment (p-value<0,05).Hasil : Usia responden berkisar 21 – 24 tahun, durasi paparan sinar matahari berkisar 12 – 35 menit/hari,body fat  berkisar 11,4 – 48,9%, dan kadar vitamin D berkisar 8,1 – 25,6 ng/mL. Dari hasil uji korelasiPearson Product Moment ada relasi durasi paparan sinar matahari terhadap kadar vitamin D dengan nilainp-value 0,003 (p<0,05) namun, tidak terdapat relasi body fat dengan kadar vitamin D bernilai 0,491(p>0,05).Kesimpulan : Berdasarkan hasil penelitian didapati bahwa semakin lama durasi paparan sinar mataharimaka kian tinggi pula kadar vitamin D.Kata Kunci:  Sinar matahari, vitamin D, body fat.

Abstract

Corruption cases by regional heads nowadays do not only affect men but also women. This is evidenced by several cases that occurred in female regional heads. Normatively, regulations related to women's rights have been well accommodated, especially regarding their rights to run for regional heads. Therefore, the concept of feminism that is applied is no longer related to the struggle for women's rights, but to ensure the quality of women's leadership in accordance with the goals of feminism. The concept of the study carried out was raised by basing it on the concepts of lberal based, anti-essential model, and post-modern liberalism. These three concepts are studied based on the varieties of motives and accessibility of women's potential to commit corruption when they become regional heads. After that, this article discusses at a practical level the leadership of women in the regions involved in corruption. By basing on court decisions dealing with corruption of regional heads by women, this article analyzes the factors of accessibility, impulsive buying, women's powerlessness, and gender bias in sentencing. The results of this study show that in some cases, there are factors that indeed female regional heads commit corruption based on personal motives, but there are also those based on the context of powerlessness to regulatory factors that make women feel they are given “special” rights in the judicial process.

Abstract

Social security program reflects state's responsibilities to provide social and economic protection to citizens. However, social security in Indonesia has remained to become a central issue after Presidential Regulation Number 14 of 2021. This regulation outlines administrative sanctions on delaying or terminating social security for citizens that refuse vaccines. This study examined the issue from philosophical, juridical, and sociological perspectives on the administrative sanctions for delaying or terminating the social security related to the vaccine requirements. This study used a legal research method with statutory, conceptual, and case approaches. This study indicated that the regulation regarding the postponement or termination of social security provision contradicted Article 20(1) of Law Number 40 of 2004 on the National Social Security System. Also, it violated human rights about the right to social security based on the 1945 Constitution. Instead, to succeed in vaccination, it should adopt a socio-cultural approach by combining legal instruments with elements of local culture in the community for legitimating vaccination as its part of being accepted in the society. Abstract

Forced marriages are frequent in Indonesia for several reasons, including economics and culture. In reality, practically all South Asian countries have the same problem, with poverty and tribal animosity frequently being used to force certain adolescents to marry. The purpose of this study is to examine women’s rights in the context of family law in avoiding forced marriage, as well as to examine law enforcement against forced marriage from a family law viewpoint. This research uses normative legal methods with statutory, conceptual, case, and comparative approaches. The findings reveal that respect for and implementation of women’s rights have been included in various legal instruments, both at the international and state levels. The protection of women’s rights is critical for achieving substantive justice and avoiding forced marriage. However, the combination of social, cultural, and legal concerns continues to challenge law enforcement. As a result, a family consultancy institution in partnership with the judiciary is required, similar to Australia, which has a Family Court to address instances such as forced marriage. With consultants who understand family matters and are experts in their fields, the settlement of cases of forced marriage through non-litigation is expected to be more effective, where the results of the decision can be determined by the court, as is the practice in Australia.
