Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana pengaturan terkait laporan korban tindak pidana yang tidak dilanjutkan ke tahap penuntutan karena tidak cukup alat bukti dan bagaimana penerapan prinsip due process of law untuk pelapor dalam proses penyidikan dan penuntutan tindak pidana. Dalam penelitian ini menggunakan jenis penelitian hukum normatif dengan pendekatan Undang-Undang (Statute Approach) dan pendekatan konseptual (Conceptual Approach). Perbedaan pandangan antara Jaksa dan Penyidik dalam menentukan cukupnya alat bukti kerap kali menjadi masalah hingga terbitnya Surat Perintah Penghentian Penyidikan (SP3). Pengaturan mengenai penghentian perkara akibat kurangnya alat bukti diatur dalam Pasal 77, 109, 110, 138, 140, dan 183 KUHAP. Penerapan prinsip due process of law bagi pelapor dalam penyidikan dan penuntutan menjamin hak atas informasi, perlindungan hukum, dan keterlibatan dalam proses hukum. Hak tersebut rata-rata saat ini tidak diakomodir dalam KUHAP. KUHAP saat ini lebih mencerminkan crime control model daripada due process model. Kepentingan Pelapor bergantung pada bagaimana Aparat Penegak Hukum menangani laporan sesuai prosedur. Praperadilan dapat menguji keabsahan SP3, dan jika dinyatakan tidak sah, penyidikan harus dilanjutkan. Namun, putusan ini hanya mengikat Penyidik meskipun penghentian penyidikan juga melibatkan Jaksa melalui forum koordinasi dan konsultasi. Agar sistem lebih seimbang, putusan praperadilan seharusnya mengikat Jaksa sehingga perkara dapat berlanjut ke penuntutan demi kepastian hukum. KUHAP saat ini tidak mengakomodir mekanisme yang jelas untuk memutuskan perbedaan pendapat antara Penyidik dan Jaksa terkait cukupnya alat bukti, yang sering berujung pada penghentian perkara.

Abstract

At the end of 2023, a group of refugees that came to the Aceh region committed several acts of misconduct that shocked Indonesia. Such acts included throwing away rice that was given to them by the Acehnese residents, who did so as an act of kindness. However, the refugees disappointed the Acehnese residents with their response. Due to this, the Acehnese residents insist on expelling the refugees from their area, but the local government needed clarification in order to determine their position. On one hand, it is important to take note of the concerns of the Indonesian people, however, there is also a need to protect international refugees. Based on this understanding, this article will discuss what actions the Indonesian government can take in response to the phenomenon between the Acehnese residents and Rohingya refugees. Moreover, what solutions can the Indonesian government provide in order to balance the interests of local communities and international responsibilities, in the context of the expulsion of Rohingya refugees in Aceh? This article concludes that policymakers and stakeholders must collaborate to develop comprehensive solutions that address the needs of the local community and the refugees, fostering a more sustainable and empathetic response to refugee challenges in the future. This study emphasizes the importance of forging a synergy between local and global perspectives in order to acknowledge the interdependence of community interests and international responsibilities in pursuing effective refugee management.
