Abstract

The role of law students in the implementation of legal aid is divided into two, namely the implementation of legal aid litigation and non-litigation legal aid. The role of students in the provision of legal aid services, urgent existence, considering many people who are not capable of, marginalized and legally blind in Indonesia is difficult to get access to justice, especially a dense population and spread across a wide area so it is not proportional to the number Advocates are available and include high student awareness of the legal issues faced by the community/communities are not able to. Students have contributed significantly in their communities by providing legal aid services, running the advocacy work and organizing in their communities in order to encourage growth is growing awareness of the laws of society and realize access to justice (acces to justice) for everyone, especially people not being able to obtain a guarantee in the fulfillment of their rights as citizens, especially equality before the law (equality before the law) as mandated by the constitution in Article 28D paragraph (1) and Article 28H paragraph (2) of the constitution of 1945 .Keywords: Student, Legal Aid, Role

Abstract

The development of the digital era has increased the number of crimes in cyberspace, one of which is doxing. Doxing is the dissemination of information regarding the personal data of a person or group, which is carried out online without the consent of the party concerned. This act is regulated in Article 26 of Law Number 19 of 2016 concerning Electronic Information and Transactions. Legal protection against the crime of doxing is divided into two, namely preventive and repressive. Preventive is where legal protection is provided to prevent doxing by limiting activities on social media, while repressive is in the form of legal protection in the form of criminal sanctions that have been regulated and the rules that have been established in Indonesia. This research is a legal analysis with a conceptual approach. The main objective of this research was to analyze the legal protection against victims of doxing crime in Indonesia. According to this research Legal protection efforts for victims of doxing crime are divided into 2 (two): Preventive legal protection and Repressive Legal is provided by the government by creating cyber police.

Abstract

The inclusion of a specific minimum crime in the Law on the Eradication of Criminal Acts of Corruption is intended to prevent a very striking disparity of sentencing, both for the same case in the context of deelneming, as well as for different cases but the types of offenses involved. the ratio decidendi of the judge's decision that imposes a criminal under a special minimum in corruption cases. Judges who impose criminal penalties under the special minimum criminal threat on decisions on corruption cases, the authors of the analysis assume that the degree of guilt of the accused is not directly proportional to its dangerous act and will be very disproportionate between the act and the punishment that will be given to the defendant of a criminal act of corruption, so that in the name of "Justice" the judge carries out contra legem or legal breakthroughs against the provisions of the special minimum criminal threat in the Law on the Eradication of Criminal Acts of Corruption. The independence of judges and the conviction of judges in imposing criminal penalties under a special minimum penalty in cases of criminal acts of corruption are reflected in legal reasoning in the judge's decision.

Abstract

Illegal, Unregulated, and Unreported (IUU) Fishing cases often occur in Indonesia. This is due to the lack of supervision by the Indonesian government towards foreign vessels conducting fishing activities in Indonesia’s territorial waters, and exclusive economic zone (EEZ).  IUU fishing has caused huge losses to the country. One of the perpetrators engaged in this illegal act was the Thai Silver Sea 2 ship. The ship entered Indonesian territorial waters specifically in Sabang waters, by flying the Indonesian flag to trick the Indonesian government patrolling around the area. However, gradually the Indonesian government became aware of the existence of foreign vessels which had been suspected by Indonesia for a long time because it often turned off VMS so that its existence could not be detected by the Indonesian government. This study delves deeper into whether the actions conducted by Silver Sea 2 Vessels violate Indonesian regulations and UNCLOS 1982. Additionally, it examines the compatibility of the Indonesian government’s legal enforcement of IUU Fishing with UNCLOS 1982. The results indicate that the actions of SS2 ships violated Indonesian legislation and UNCLOS 1982. Furthermore, the handling of this case by the Sabang District Court was deemed appropriate.

Abstract

Commercial sexual exploitation of children (ESKA) is a fundamental violation of children's rights. The offense is in the form of sexual violence by an adult with remuneration to a child, a third person, or other persons. ESKA treats children treated as commercial sexual objects. The problem in this study is what are the factors that affect the crime of Commercial Sexual Exploitation of Children (ESKA) in the coastal area of Bandar Lampung? This study uses normative legal methods. The results obtained are the factors that influence the crime of Commercial Sexual Exploitation of Children (ESKA) in the coastal area of Bandar Lampung, which can be seen by the poor people so that people make this activity a job to meet their living needs. The suggestion in this study is that there must be good coordination between law enforcement officers and the government to prevent the occurrence of criminal acts of Commercial Sexual Exploitation of children from recurring, such as providing decent work and conducting educational activities to the public about criminal acts of Commercial Sexual Exploitation of children. The community must also be able to be open and cooperate with all relevant parties to prevent the re-occurrence of criminal acts of Commercial Sexual Exploitation of children.

Abstract

Permasalahan pidana mengenal adanya suatu ketimpangan dalam pemberian hukuman pidana yang disebut dengan disparitas. Disparitas pidana merupakan suatu pelaksanaan pidana yang berbeda atau tidak sama bagi pelaku tindak pidana yang melakukan tindak pidana yang sejenis atau serupa. Disparitas pidana akan menjadi permasalahan di kemudian hari apabila dikaitkan dengan pendidikan administrasi. Dimana pelaku akan melakukan perbandingan mengenai tindak pidana yang dapat ditanggung oleh orang lain. Akan terjadi suatu kejadian ketidakadilan mengenai perbedaan pidana yang akan berimplikasi pada stigma negatif oleh narapidana dan masyarakat yang akan memperkuat ketidakadilan peradilan dalam menentukan penjatuhan putusan pidana. Dalam hal ini terdapat banyak aspek yang menyebabkan terjadinya disparitas pidana. Akan terjadi suatu peristiwa ketidakadilan mengenai perbedaan pidana yang akan berimplikasi pada stigma negatif oleh narapidana dan masyarakat yang akan memperkuat ketidakadilan peradilan dalam menentukan penjatuhan putusan pidana. Abstract

In the face of cultural erosion, particularly the dwindling proficiency in deciphering Lampung characters, this research pioneers an innovative approach to cultural preservation. The Lampung character recognition model was developed using TensorFlow, a robust computer vision and machine learning framework. Convolutional Neural Networks (CNN) are integrated to enhance the image processing capabilities. The research employs the Design Science Research methodology, emphasizing problem identification, solution objectives, design and development, demonstration, evaluation, and communication. The dataset, comprising 3900 instances, is meticulously collected and features diverse Lampung script writing. Through preprocessing and classification, the model undergoes training with an 80:10:10 split for training, validation, and test data. The architecture includes CNN layers with ReLu activation functions, and transfer learning is employed using the MobileNet V2 network model. Demonstrating commendable performance, the model achieves an accuracy spectrum of 0.652 to 0.998. The research not only underscores the viability of the TensorFlow model but also establishes a foundation for future explorations in preserving Lampung cultural heritage. This intersection of advanced machine learning and cultural preservation signifies a promising synergy, ensuring the enduring legacy of Lampung characters amid societal and technological transformations.

Abstract

Penangkapan ikan dengan alat tangkap terlarang merupakan salah satu bentuk illegal fishing. Bentuk praktik illegal fishing yang biasa terjadi seperti penangkapan ikan dengan menggunakan bahan seperti bom, bius, serta pukat harimau yang dilakukan oleh masyarakat untuk memperoleh ikan sebanyak-banyaknya dengan cara instan sehingga hal ini membuat para nelayan tidak mengindahkan aturan demi kepentingannya sendiri. Lemahnya sikap reaktif aparat yang berkewajiban mengawasi laut Indonesia adalah salah satu faktor penyebab maraknya kasus illegal fishing yang banyak terjadi di perairan Indonesia saat ini, padahal Indonesia memiliki banyak peraturan perundang-undangan yang mengatur tentang perikanan dan kelautan, sekitar belasan peraturan yang mengatur perikanan dan kelautan tersebut. Salah satu upaya pengawasan dari pihak pemerintah adalah dengan adanya Vessel Monitoring System (VMS) yaitu sebuah sistem monitoring kapal ikan dengan alat transmitor yang berfungsi untuk mengawasi proses penangkapan ikan yang dilakukan di perairan Indonesia. Namun sistem tersbut tidak begitu efektif sehingga pemerintah  perlu  melibatkan  masyarakat  dalam  melakukan pengawasan, mengingat jumlah SDM Pengawas sumber daya kelautan dan perikanan (PKSDP) jumlahnya sangat terbatas jika dibandingkan dengan jumlah wilayah perairan Indonesia. Keterlibatan masyarakat sebagai pengawas dalam tindak pidana perikanan (illegal fishing) merupakan amanat dari Undang-Undang No. 31 tahun 2004 yang sebagaimana telah diubah dengan Undang-Undang No. 45 Tahun 2009 tentang Perikanan Pasal 67 mengharuskan untuk melibatkan masyarakat dalam pengawasan SKDP. Oleh karena itu, hasil yang diharapkan setelah pelaksanaan kegiatan ini yaitu Masyarakat Adat Kratoen Lamban Gedung Marga Way Napal Kecamatan Krui Selatan Kabupaten Pesisir Barat agar mempunyai kesadaran hukum khususnya akan upaya pencegahan dan dampak dari tindak pidana illegal fishing, serta menyadari dan memahami pentingnya menjaga kelestarian sumberdaya ikan dan ekosistemnya, dan nelayan Desa Kiluan Negeri berperan aktif dalam pencegahan praktik illegal fishing.
